Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Implementation of the Violence Against Women Reauthorization Act of 2013

Abstract

The Violence Against Women Reauthorization Act of 2013 (“VAWA”) protects qualified tenants, participants, applicants, and affiliated individuals in all HUD-covered housing programs, who are victims of domestic violence, dating violence, sexual assault, or stalking. On November 16, 2016, HUD published a final rule (VAWA Rule) at 81 FR 80724, implementing VAWA’s provisions in its housing programs. The VAWA Rule includes the following Appendices, which entail certain reporting and recordkeeping burdens: (A) Notice of Occupancy Rights Under the Violence Against Women Act; (B) Model Emergency Transfer Plan for Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking; (C) Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking, and Alternate Documentation; and (D) Emergency Transfer Request for Certain Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking. Under the VAWA Rule, PHAs, owners, and managers (collectively “Covered Housing Providers” or “CHPs”) Under the VAWA Rule, each CHP must make use of Appendix A and Appendix C, by providing copies of the Notice of Occupancy Rights and the Certification form. Each CHP presented with a claim for continued or initial tenancy or assistance, based on the victim’s status as a victim of domestic violence, dating violence, sexual assault, or stalking, may request that the victim document or provide written evidence to demonstrate that the violence occurred, and Certification form is one such way of documenting the violence. Each CHP must also establish an emergency transfer plan, although it need not be modeled on Appendix B. CHPs’ use of an Emergency Transfer Request form, like the model in Appendix D, is also discretionary. CHPs must track and report annually to HUD if they have any Emergency Transfer Requests and outcomes. Finally, under the VAWA Rule, CHPs may opt to provide a lease bifurcation to VAWA-covered individuals.

The FR 3033p is the first part of a two-stage survey series, which is a census survey designed to identify the universe of finance companies eligible for potential inclusion in the FR 3033s. It gathers limited information including total assets, areas of specialization, and information on the corporate structure of such companies. The second part of this information collection, the FR 3033s, collects balance sheet data on major categories of consumer and business credit receivables and major liabilities, along with income and expenses, and is used to gather information on the scope of a company’s operations and loan and lease servicing activities. The data collected from this voluntary survey will be used for two purposes: to benchmark the consumer and business finance series collected on the Board’s monthly Domestic Finance Company Report of Consolidated Assets and Liabilities (FR 2248; OMB No. 7100-0005) and to increase the Federal Reserve’s understanding of an important part of the financial system.

Abstract

The purpose of this request is to renew the currently OMB approved ICR and update the annual burden hour estimate. On December 16, 2015, FMCSA published a final rule entitled “Electronic Logging Devices and Hours of Service Supporting Documents,” (80 FR 78292) that established minimum performance and design standards for hours-of-service (HOS) ELDs; requirements for the mandatory use of these devices by drivers currently required to prepare HOS records of duty status (RODS); requirements concerning HOS supporting documents; and measures to address concerns about harassment resulting from the mandatory use of ELDs. To ensure consistency among ELD vendors and devices, detailed functional specifications were published as part of the December 2015 final rule. Each ELD vendor developing an ELD technology must register online at a secure FMCSA website where the ELD provider can securely certify that its ELD is compliant with the functional specifications. Each ELD vendor must certify that each ELD model and version has been sufficiently tested to meet the functional requirements in the rule under the conditions in which the ELD would be used. A motor carrier required to use an ELD must use only an ELD that is listed on FMCSA’s registered ELD list, accessible through the Agency’s Web site in accordance with 49 CFR 395.22. ELD providers are required to self-certify and register their devices with FMCSA online via an application Form MCSA-5893, “Electronic Logging Device (ELD) Vendor Registration and Certification.” Once completed, FMCSA will issue a unique identification number that the provider will embed in their device(s). The collection is mandatory reporting, where the ELD providers are expected report four times a year and will register an average of 2 devices. FMCSA maintains a list on their website of the current ELD vendors and devices that have been certified (by the vendors) to meet the technical specifications. The information is necessary for fleets and drivers to easily find a compliant ELD for their use in meeting the FMCSA regulation requiring the use of ELDs. Estimates of the number of respondents and responses has resulted in a program adjustment increase of an estimated annual 19 respondents, a decrease of 318 responses, and a decrease of 79 burden hours.

The National Healthcare Safety Network (NHSN) is a system designed to accumulate, exchange, and integrate relevant information and resources among private and public stakeholders to support local and national efforts to protect patients and promote healthcare safety. Specifically, the data is used to determine the magnitude of various healthcare-associated adverse events and trends in the rates of these events among patients and healthcare workers with similar risks. The data will be used to detect changes in the epidemiology of adverse events resulting from new and current medical therapies and changing risks. This is a change request that makes revisions to one form with no change to the burden. This change is not related to any E.O. or SPD-15.Emergency Justfication:Emergency Processing is requested to add three (3) additional pathogens of concern to the NHSN (OMB Control No. 0920-0666) data collection: Influenza A (H5), Marburg, and Oropouche. This requested update in disease surveillance will illustrate which patient populations are being affected by these pathogens and the potential need for additional healthcare infection prevention and control. Since this form is collecting data on hospitalized patients, the update will also help inform on the severity of illness a high consequence pathogen is causing as well as what region(s) of the country are affected. Data collection is vital to ensure that local and state authorities are supported to prepare for and respond to emerging outbreaks.

Abstract

Training informs miners of safety and health hazards inherent in the workplace and enables them to identify and avoid such hazards. Training becomes even more important in light of certain conditions that can exist when production demands increase, such as: an influx of new and less experienced miners and mine operators; longer work hours to meet production demands; and increased demand for contractors who may be less familiar with the dangers on mine property. In addition, with respect to miner health and safety training, Section 115(c) of the Mine Act, 30 U.S.C. 825(c) provides that, upon completion of each training each operator shall certify that the miner has received the specified training in each subject area of the approved health and safety training plan (this information requirement is covered in control number 1205-0009) ; paragraphs (d) and (e) address the Secretary of Labor's rulemaking authority with respect to miner training. MSHA's objective in these existing health and safety training requirements is to ensure that all miners receive the required training, which would result in a decrease in accidents, injuries, and fatalities. MSHA enforces training requirements at approximately 11,657 surface nonmetal mines and contractors.

[OPHDST] Generic Clearance for the Collection of Minimal Data Necessary for Case Data During an Emergency Response

Abstract

This information collection is designed to collect the MDN and response-specific data as needed, for confirmed, probable, and suspected cases of any disease or condition that is the subject of an emergency response at CDC. During an emergency response, CDC uses case data to inform actions that need to be taken at all levels of public health and by the public. State, tribal, local, and territorial (STLT) health departments and CDC need to exchange data on confirmed, probable, and suspected cases rapidly. Timely notification of cases from STLT to CDC is critical to provide situational awareness at the federal level to support decision making, particularly for public health threats. This Change Request is submitted to add new disease specific data elements (fields for outbreak status, CDC outbreak name, exposure dates, fields for 'other') for collection by CDC when individual GenICs are submitted under the 0920-1447 umbrella. Since each individual GenIC will differ, and will collect different data elements, there are no anticipated changes to the burden.

FEMA Form FF-600-FY-22-102 (formerly 127-0-1) is used to collect information provided voluntarily by the debtor to evaluate the debtor’s financial abilities to determine if they qualify for a payment plan and set repayment terms, or determine a compromise to write-off a debt in part or in full. Financial information obtained is essential to evaluate the debtor’s ability for the payment of the debt in part or in full. Debt may be a recoupment of an ineligible disaster assistance payment or improper payment to an employee.

Abstract

P.L. 114-95, section 302 (b) of the Rehabilitation Act of 1973, as amended by the Workforce Innovation and Opportunity Act (WIOA), the Rehabilitation Services Administration (RSA) provides Long-Term Training grants to academic institutions to support scholarship assistance to students. Students who receive scholarships under this program are required to work within the public rehabilitation program, such as with a state vocational rehabilitation agency, or an agency or organization that has a service arrangement with a state vocational rehabilitation agency. The student is expected to work two years in such settings for every year of full-time scholarship support. The program regulations at 34 CFR 386.33-386.35 and 386.40-386.43 detail the payback provisions and the RSA scholars' requirements to comply with them. Section 302 (b)(2)(C) of the Act requires tracking of scholars’ employment status and location of former scholars supported under the grants in order to ensure that students are meeting the payback requirement. Scholars must provide requested information necessary to meet the exit certification requirements. In addition to meeting the requirement that all scholars be tracked, the information collected will provide performance data relevant to the rehabilitation fields and degrees pursued by RSA scholars, as well as the funds owed and the rehabilitation work completed by them. In summary, RSA is requesting a revision of the currently approved collection by adding a section titled State Vocational Rehabilitation (VR) Agency: RSA Job Board Posting, where RSA envisions State VR agencies may initiate posting of an open position on the RSA Job Board on a rolling basis as positions become available. This addition to the current collection will be a helpful resource to students who receive RSA support, graduate, and seek qualifying employment to fulfill their required service obligation. This collection package adds the participation of State VR agencies to the existing approved ICR. Job leads will be submitted electronically through the online RSA Payback Information Management System (PIMS). There is minimal estimated burden required to report job information using the PIMS system.

Abstract

The Case Service Report (RSA-911) is used to collect individual level data on State Vocational Rehabilitation (VR) program participants on a quarterly basis. The data collected in this report are mandated by section 101(a)(10) and 607 of the Rehabilitation Act of 1973 (Act) and section 116(d) of the Workforce Innovation and Opportunity Act. In addition, the Rehabilitation Services Administration (RSA) uses data reported through this collection to support its other responsibilities under the Act. Section 14(a) of the Act calls for the evaluation of programs authorized under the Act, as well as an assessment of the programs’ effectiveness in relation to cost. Many of these evaluations use RSA-911 data. RSA also uses data captured through the RSA-911 during the conduct of both the annual review and periodic on-site monitoring of VR agencies required by section 107 of the Act to examine the effectiveness of program performance. Other important management activities, such as the provision of technical assistance, program planning, and budget preparation and development, are greatly enhanced through the use of RSA-911 data. In addition, RSA uses RSA-911 data in the exchange of data under a data sharing agreement with the Social Security Administration and the U.S. Department of Health and Human Services as required by section 131 of the Act. Finally, the RSA-911 is considered to be one of the most robust databases in describing the demographics of the disabled population in the country and as such is used widely in researchers’ disability-related analyses and reports. The current RSA-911 expires on 05/31/2024, which occurs during Program Year 2023 (07/01/2023-06/30/2024). Because RSA must collect the same performance data for the entirety of a Program Year, RSA must begin Program Year 2024 with approval of this proposed revision in place. Thus, RSA is proposing to extend with revisions the RSA-911 for three years. If this revision is approved, VR agencies will collect and report data under this collection for Program Years 2024 through 2026. (07/01/2024-06/30/2027).
