Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

RSA-509, Annual Protection and Advocacy of Individual Rights Program Performance Report

Key Information

Abstract

The Annual Protection and Advocacy of Individual Rights (PAIR) Program Performance Report (Form RSA-509) will be used to analyze and evaluate the PAIR Program administered by eligible protection and advocacy (P&A) systems in states and the P&A serving the American Indian Consortium. These systems provide services to eligible individuals with disabilities to protect their legal and human rights. RSA uses the form to meet specific data collection requirements of Section 509(k) of the Rehabilitation Act of 1973 (Rehabilitation Act), as amended by Title IV of the Workforce Innovation and Opportunity Act (WIOA), 29 U.S.C. 794e(k), and its implementing Federal regulations at 34 C.F.R. § 381.32. The data reported by PAIR grantees using the form include demographic information about the individuals served, information describing the types of issues addressed through individual and systemic advocacy, and information about the results of these activities. PAIR grantees must report annually using the form that is due on or before December 30 each year. The collection of information through Form RSA-509 is necessary for RSA to furnish the President and Congress with data on the provision of PAIR services, as required by sections 13(a) and 509(k) of the Rehabilitation Act. Data reported by PAIR grantees through the RSA-509 have also helped RSA to establish a sound basis for future funding requests. RSA also uses data from the form to evaluate the effectiveness of eligible systems within individual States and the PAIR serving the American Indian Consortium in meeting annual priorities and objectives, pursuant to section 13(b) of the Rehabilitation Act. Last, RSA has found the RSA-509 data useful in projecting trends in the provision of services from year to year. Several respondents are private not-for-profit organizations. RSA included the respondents and the national organization that represents them (National Disability Rights Network (NDRN)) in the initial development of this collection of information in an effort to ensure that the information requested could be provided with minimal burden to the respondents.

Railroad Locomotive Safety Standards and Event Recorders

Key Information

Abstract

The Locomotive Inspection Act requires railroads to inspect, repair, and maintain locomotives and event recorders so that they are safe, free from defects, and can be placed in service without peril to life. Crashworthy locomotive event recorders provide FRA with verifiable factual information about how trains are maintained and operated, and will be used by FRA and State inspectors for Part 229 rule enforcement. This collection of information is mandatory, and affects Class I, Class II, Class III, and passenger and commuter railroads operating on the general system of transportation in the United States. The required information is collected daily, quarterly, annually, and on occasion. Information collected includes both reporting and record keeping information, data about locomotives not complying with the requirements of this Part, data about remote control locomotives, accident reports, locomotive daily inspection and repair records, written reports about Multiple Unit (MU) locomotives, and readout information from locomotive event recorders. FRA uses the information collected to monitor and enforce the requirements of this Part, particularly to monitor the daily operations of trains and ensure that locomotives placed in service are safe to operate and undergo the required daily, periodic, and annual inspections. The information collected is also used by railroads and train crews to monitor train handling and improve safety on an ongoing basis.

Abstract

On April 4, 2024 the U.S. Court of Appeals of the Fifth Circuit granted a preliminary injunction against 34 § 685.400 et seq ("2023 Regulation") enjoining the rule and postponing the effective date of the regular pending final judgment in the case. The current Borrower Defense to Repayment application and related Request for Reconsideration are drafted to conform to the enjoined provisions of the 2023 Regulation. This request is to revise the currently approved information collection 1845-0163 to comply with the regulatory requirements of the borrower defense regulations that are still in effect, 34 C.F.R. § 685.206(e) ("2020 Regulation"), 34 C.F.R. § 685.222 ("2016 Regulation"), and 34 C.F.R. § 685.206(c) ("1995 Regulation") (together, the "current regulations"). These regulatory requirements are distinct from the 2023 Regulation's provisions. The revision is part of contingency planning in case the 2023 Regulation is permanently struck down. The Department of Education ("the Department") is attaching an updated Borrower Defense Application and application for Request for Reconsideration. The forms will be available in paper and electronic forms on studentaid.gov and will provide borrowers with an easily accessible and clear method to provide the information necessary for the Department to review and process claim applications. Also, under the current regulations, the Department will no longer require a group application nor group reconsideration application.

Periodically the Department of Labor (DOL or the Department) solicits applications for grants through issuing a “Funding Opportunity Announcement” (FOA). To ensure grants are awarded to the applicants best suited to perform the functions of the grant, applicants are generally required to submit a two-part application. The first part of DOL’s grant applications consists of submitting the Standard Form 424 (SF-424), “Application for Federal Assistance,” for which approval is obtained under Control Number 4040-0004. The second part of a grant application usually requires a technical proposal demonstrating the applicant’s capabilities in accordance with a statement of work and/or selection criteria. Crash Avoidance Warning System Human-Machine Interface Research

Key Information

Abstract

The National Highway Traffic Safety Administration (NHTSA) is seeking approval for this new information collection request (ICR) to conduct 6 new voluntary information collections as part of a one-time research program examining drivers’ interactions with crash avoidance technology with different human-machine interface (HMI) characteristics. Crash avoidance warning systems aid vehicle drivers in avoiding crashes by presenting alerts and warnings to inform drivers of situations in which the system has determined, via sensor information, that a crash is possible. These systems communicate the occurrence of such conditions to drivers via different sensory modalities, such as visual or auditory signals or vibration of the seat or steering wheel. The research will examine how the characteristics of the visual, auditory, and/or haptic (i.e., touch) signals presented by the system may affect the driver’s response to a crash-imminent situation. This research will help inform NHTSA’s rulemaking activities relating to crash avoidance technologies. The research will involve driver behavior observation while driving on a test track, public road, or in a simulated environment (i.e., driving simulator) as means of collecting needed data. Data collection may also involve stationary laboratory measurements relating to crash avoidance warning signal characteristics, such as stationary laboratory measurements of individuals’ visual angles when gazing at in-vehicle visual signals (e.g., instrument panel symbols) and displays. Experimental data collection will include measurements such as those relating to driving performance, vehicle control metrics, and eye glance behavior. Study participants are members of the general public and include licensed car and/or commercial truck drivers aged 25 to 65 who are healthy and able to drive without assistive devices. The full information collection request includes six information collections: Interest Response Form, Candidate Screening Questions, Appointment Scheduling, Informed Consent, Experimental Data Collection, and Post-Drive Questionnaire. Data collection will begin upon receipt of PRA clearance. Response to this information collection is voluntary and will be conducted in phases corresponding to the different crash avoidance warning system types to be examined (i.e., forward, lateral, and rear crash avoidance). This is a new information collection that is estimated at 239 annual burden hours and $7,200 annual opportunity costs.

This is a request for revision of the approved Information Collection 1820-0557 - Report of Children Receiving Early Intervention Services in Accordance With Part C; Report of Program Settings Where Early Intervention Services are Provided to Children With Disabilities and Their Families in Accordance to Part C; Report on Infants and Toddlers Exiting Part C Section 618 of the Individuals with Disabilities Education Act (IDEA), Public Law 108-446, directs the Secretary of Education to obtain data on: (1) the number and percentage of infants and toddlers with disabilities, by race, ethnicity, and gender, who are receiving early intervention services; (2) the number and percentage of infants and toddlers, by race and ethnicity, who are at risk of having substantial developmental delays (as described in Section 632), and who are receiving early intervention services under Part C; and (3) the number and percentage of children with disabilities, by race, ethnicity, and gender, who, from birth through age 2, stopped receiving early intervention services because of program completion or for other reasons. The specific legislative authority for these data collections may be found in Section 618(a)(1)(B), Section 618(a)(1)(C), Section 618(a)(2) and Section 618(a)(3). The purposes of such data are: (1) to assess the progress, impact, and effectiveness of State and local efforts to implement the legislation and (2) to provide Congress, the public, and Federal, State, and local educational agencies with relevant information. OSEP also uses these data for monitoring activities, planning purposes, congressional reporting, and disseminating data to individuals and groups. Abstract

Plan sponsors of terminating multiemployer pension plans give notices to PBGC about plan terminations and to plan participants about electing benefit options, and apply to PBGC for permission to pay lump sums greater than $1,750 or to pay nonvested plan benefits. PBGC uses information submitted to it to assess the likelihood of benefit reductions or suspensions and risks to PBGC and participants and to estimate the need for financial assistance to plans. Participants use information sent to them to make personal financial decisions. Plans terminated by mass withdrawal, plans terminated by plan amendment that are expected to become insolvent, and insolvent plans receiving financial assistance from PBGC are required to file actuarial valuations with PBGC.
