What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Board’s Regulation W - Transactions Between Member Banks and Their Affiliates (12 CFR Part 223), implements sections 23A and 23B of the Federal Reserve Act (FRA) by defining terms used in the statute, explaining the statute’s requirements, and exempting certain transactions from certain restrictions on transactions between member banks and their affiliates. The reporting and recordkeeping requirements of FR W are triggered by specific events. FR W filings are required from insured depository institutions and uninsured member banks (collectively, depository institutions) that seek to request certain exemptions from the requirements of sections 23A and 23B. The FR W is separate from the quarterly Holding Company Report of Insured Depository Institutions’ Section 23A Transactions with Affiliates (FR Y-8; OMB No. 7100-0126), which collects information on transactions between an insured depository institution and its affiliates that are subject to section 23A of the FRA.

Key Information

Abstract

SSA published regulations for the process we follow when we restrict individuals from receiving in-person services in our field offices and provide them, instead, with alternative services. We published these rules to create a safer environment for our personnel and members of the public who use our facilities, while ensuring we continue to serve the American people with as little disruption to our operations as possible. Under our regulations at 20 CFR 422.905, an individual for whom we restrict access to our facilities has the opportunity to appeal our decision within 60 days of the date of the restrictive access and alternative service notice. To appeal, restricted individuals must submit a written request stating why they believe SSA should rescind the restriction and allow them to conduct business with us on a face-to-face basis in one of our offices. There is no printed form for this request; rather, restricted individuals create their own written statement of appeal, and submit it to a sole decision-maker in the regional office of the region where the restriction originated. The individuals may also provide additional documentation to support their appeal. Under 20 CFR 422.906, if the individual does not appeal the decision within the 60 days; if we restricted the individual prior to the effective date of this regulation; or if the appeal results in a denial, the individual has another opportunity to request review of the restriction after a three-year period. To submit this request for review, restricted individuals may re-submit a written appeal of the decision. The same criteria apply as for the original appeal: (1) it must be in writing; (2) it must go to a sole decision-maker in the regional office of the region where the restriction originated for review; and (3) it may accompany supporting documentation. We make this periodic review available to all restricted individuals once every three years. Respondents for this collection are individuals appealing their restrictions from in-person services at SSA field offices.

Abstract

Title II recipients use Forms SSA-1099 and SSA-1042S, Social Security Benefit Statement, to determine if their Social Security benefits are taxable and the amount they need to report to the Internal Revenue Service. In cases where the original forms are unavailable (e.g., lost, stolen, mutilated), an individual may use SSA's Internet request form or automated telephone application to request a replacement SSA-1099 and SSA-1042S. SSA uses the information from the Internet and automated telephone requests to verify the identity of the requestor and to provide replacement copies of the forms. The Internet and automated telephone options educe requests to the National 800 Number Network (N8NN) and visits to local Social Security field offices. The respondents are applicants for, or claimants of, SSI payments. We are submitted a Non-Substantive Change Request to make changes to the system to allow callers to obtain any or all of the 5-tax year SSA-1099 or SSA-1042s prior to the current closed tax year they can already obtain for themselves or a deceased person.

Abstract

Section 3 of the Social Security Disability Applicants Access to Professional Representation Act (PRA) of 2010, Public Law (Pub.L.) 111-142, enacted on February 27, 2010 permanently extends the direct payment provision of Section 303 of the Social Security Protection Act (SSPA) of 2004, Pub.L. 108-203. The PRA permits the Social Security Administration (SSA) to extend direct payment of approved fees from claimants' past-due benefits to certain non-attorney representatives. The PRA, as did the SSPA, requires us to collect the information needed to determine if applicants have satisfied the prerequisites. Under the SSPA, we used the Social Security Administration Non-Attorney Representative Demonstration Project Application to collect applicants' prerequisite information. We are revising the application to comply with the PRA and the Revisions to Direct Fee Payment Rules (RIN 0960-AH21). To help us determine whether an applicant has fulfilled the statutory prerequisites and regulatory requirements of the PRA, we collect the following items from applicants: 1) A signed criminal background form, from all applicants, that allows us to conduct criminal background checks; 2) the examination document and score for applicants who take the examination, 3) professional or business liability insurance policies from applicants who pass the examination; 4) official college transcripts from applicants who pass the examination and possess a bachelor's degree or higher (high school transcripts, diplomas, or GED certificates and proof (e.g., Internal Revenue Service Form W-2(s) and wage and tax statement(s)) of relevant professional experience from applicants who pass the examination, but do not possess a bachelor's degree or higher) 5) email messages, from eligible non-attorneys, that certify the completion of a required continuing education course. We require applicants to submit their application forms directly to a contractor we hired to assist with the management of the prerequisites for direct payment. Every year, the contractor evaluates the applications, conducts verification investigations, and issues recommendations to us regarding applicants' eligibility to sit for the examination and eligibility to receive direct payment. The respondents are non-attorneys who want to receive direct payment of their fees for representational services before SSA. We are making non-substantive changes for clarity and to make signature field fillable.

Key Information

Abstract

The Health Information Technology for Economic and Clinical Health (HITECH) Act promotes the adoption and meaningful use of health information technology (IT), particularly in the context of working with government agencies. Similarly, section 3004 of the Public Health Service Act requires health care providers or health insurance issuers with government contracts to implement, acquire, or upgrade their health IT systems and products to meet adopted standards and implementation specifications. To support expansion of SSA's health IT initiative as defined under HITECH, SSA developed Form SSA-680, the Health IT Partner Program Assessment – Participating Facilities and Available Content Form. The SSA 680 allows healthcare providers to provide the information SSA needs to determine their ability to exchange health information with us electronically. We evaluate potential partners (i.e., healthcare providers and organizations) on (1) the accessibility of health information they possess, and (2) the content value of their electronic health records' systems for our disability adjudication processes. SSA reviews the completeness of organizations' SSA-680 responses as one part of our careful analysis of their readiness to enter into a health IT partnership with us. The respondents are healthcare entities, healthcare providers, and HIEs who wish to engage in a Health IT partnership with SSA.

The Social Security Act establishes travel expense reimbursement by Federal and state agencies for claimants travel incidental to medical examinations and to parties, their representatives, and all reasonably necessary witnesses for travel exceeding 75 miles to attend medical examinations, reconsideration interviews and proceedings before an administrative law judge. Reimbursement procedures require the claimant to provide 1) a list of expenses incurred, and 2) receipts of such expense. Responding to this collection is mandatory. The entities that must respond are commercial driver’s license (CDL) drivers and State driver licensing agencies (SDLAs). The CDL driver discloses convictions and disqualifications, as well as discloses employment history to the employer. The CDL driver reports by completing a CDL application form, as well as a knowledge and skills test. The SDLA records medical examiner’s certification and self- certification of CMV operations. The SDLA verifies medical certification status and there is an annual State certification of compliance. The State participates in annual program reviews and does recordkeeping for knowledge and skills tests. The State certifies the knowledge and skills test examiner, as well as monitors and audits the examiner. State officials use the information collected on the license application form that is posted to the CDLIS driver record, the information collected on the CLP application form that is posted to the CDLIS driver record and the conviction and disqualification data posted to the CDLIS driver record to prevent ineligible, not-qualified and/or disqualified CLP and CDL holders and applicants from operating CMVs on the nation's highways. State officials are also required to administer knowledge and skills tests to CDL driver applicants. During State CDL compliance reviews, FMCSA officials review this information to ensure that the provisions of the regulations are being carried out. Without these requirements, there would be no uniform control over driver licensing practices to prevent uncertified and/or disqualified drivers from being issued a CLP or CDL and to prevent unsafe drivers from spreading their convictions among several licenses in several States and remaining behind the wheel of a CMV. Failure to collect this information would render the regulations unenforceable. FMCSA reviews information submitted by the States and conducts reviews, audits, and investigations of each State as it deems necessary to make compliance determinations for all States and the District of Columbia. This information helps FMCSA ensure that drivers, motor carriers, and the States are complying with the notification and recordkeeping requirements for information related to testing, licensing, violations, convictions, and disqualifications. If this information were not available, the FMCSA would have no means of independently verifying State compliance.

Abstract

This is a request for renewal of an approved collection of information covering non-medical waivers and exemptions. The ICR estimates the burden an individual, motor carrier, State, or SDLA incurs to comply with the mandatory reporting tasks required for requesting waivers and exemptions in 49 CFR part 381. The FMCSRs require a motor carrier or individual seeking relief from one or more regulations to submit their request for a waiver or an exemption in writing. Section 4007 of TEA-21 requires that the terms and conditions for all waivers and exemptions likely achieve a level of safety equivalent to or greater than what would be achieved by complying with the safety regulations. To satisfy this statutory test, persons requesting waivers or applying for exemptions must present a credible alternative to the regulation and explain how that alternative would likely achieve an equivalent or greater level of safety. If the waiver or exemption request were less effective than the applicable regulation, it would be difficult to demonstrate compliance with the statutory test. If there is insufficient information or data for FMCSA to conclude that the waiver or exemption would satisfy the statutory test, the agency must not grant the waiver or exemption. FMCSA requires an individual, motor carrier, State, or SDLA to comply with certain terms and conditions if they are granted an exemption under § 381.330. FMCSA applies to waivers the same terms and conditions for reporting accidents as it does for exemptions. Each applicant covered by a waiver must notify FMCSA, via email at MCPSD@dot.gov, within 5 business days of any accident (as defined in 49 CFR 390.5), involving its drivers or CMVs operating under the terms of the waiver. Exemptions may be renewed upon request for subsequent 5-year periods. Exemption holders requesting a renewal must provide the same information as described in § 381.310. Each individual, motor carrier, State, or SDLA covered by an exemption must notify FMCSA via email at MCPSD@dot.gov within 5 business days of any accident (as defined in 49 CFR 390.5), involving the individual, motor carrier, or CMV operating under the terms of the exemption. IC-1 consists of three reporting and recordkeeping tasks an individual, motor carrier, State, or State Drivers Licensing Agency (SDLA) performs regarding the waiver application process required by § 381.210. Abstract

This is a request for Office of Management and Budget (OMB) renewal for an information collection request (ICR) to enable the Department of Transportation’s (DOT) Office of the Secretary (OST) to implement the Thriving Communities Initiative (TCI) and Build America Bureau programs which includes the Thriving Communities program (TCP), the Rural and Tribal Assistance Pilot Program, and the Asset Concession and Innovative Finance Assistance Program. The TCI was authorized in the Consolidated Appropriations Act, 2022 (H.R. 2471), enacted on March 15, 2022. The Thriving Communities Initiative is a key component in DOT’s Equity Action Plan that will provide direct, coordinated and place-based technical assistance and capacity building support that enables all communities, particularly those that are under-served and historically disadvantaged, to be able to access funding and programs established in the Infrastructure Investment and Jobs Act (IIJA also known as the Bipartisan Infrastructure Law).

Abstract

Section 2307 of Public Law 114-190, medical certification of small aircraft pilots, provides that, within 180 days of enactment of Public Law 114-190, the FAA Extension, Safety and Security Act of 2016, the Administrator of the FAA shall issue or revise regulations to ensure that an individual may operate as pilot in command of a covered aircraft if certain provisions stipulated in the Act are met. The Act was enacted July 15, 2016. The use of section 2307 by any eligible pilot is voluntary. Persons may elect to use these alternative pilot physical examination and education requirements or may elect to continue to operate using a third-class or higher medical certificate (information collection 2120-0034).The requirements of section 2307 were codified in 14 CFR parts 61, 91 and newly created part 68
