What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Certification of Airmen for the Operation of Light-Sport Aircraft

Key Information

Abstract

This information collection mandates that applicants who wish to obtain or maintain certification as sport pilots or light sports aircraft flight instructors; entities seeking to obtain or maintain light-sport aircraft airworthiness certification; and individuals wishing to become or remain Designated Pilot Examiners to report information to the FAA on occasion. Part 21 FAA designated inspectors confirm the appropriate manufacturer’s self-certification is presented with the aircraft, and inspects the aircraft to confirm that it is in a condition for safe operation. Those products that comply with the minimum requirement are issued the appropriate airworthiness certificate. The airworthiness certificate indicates to the purchaser of the aircraft that the product was designed and produced in compliance with the referenced industry developed consensus airworthiness standards. This will permit the purchaser of the aircraft to use the aircraft for purposes of flight instruction and rental for pilot proficiency training. This will lead to a higher skill level and resulting higher level of safety for the owners and operators of these aircraft. This information collection mandates that applicants who wish to obtain or maintain certification as sport pilots or light sports aircraft flight instructors report information to the FAA on occasion. The Airman certificate and/or Rating Application Form and the required records/logbooks/statements required by the federal regulations are submitted to Federal Aviation Administration (FAA) district offices or its representatives to determine qualifications of the applicant for issuance of a pilot or instructor certificate, rating, privilege, or authorization. Approximately 10,000 pilots and flight instructors have sought certification to date. Applicants for a new certificate for the student pilot, sport pilot, ground, and flight instructor with a sport pilot rating or new category or class privileges are required to submit FAA Form 8710-11, Sport Pilot Airman Certificate and/or Rating Application.

Abstract

The Federal Reserve Act and the Board’s Regulation H - Membership of State Banking Institutions in the Federal Reserve System (12 CFR Part 208) require a state member bank to seek prior approval of the Federal Reserve System before establishing or acquiring a domestic branch. Such requests for approval must be filed as applications at the appropriate Reserve Bank for the state member bank. Due to the limited information that a state member bank generally has to provide for branch proposals, there is no formal reporting form for a domestic branch application. A state member bank is required to notify the Federal Reserve by letter of its intent to establish one or more new branches and provide evidence that public notice of the proposed branch(es) has been published by the state member bank in the appropriate newspaper(s). The applicant may include with its letter a copy of the Conference of State Bank Supervisors Uniform Interstate Application/Notice (CSBS) form. The Federal Reserve uses the information provided by the applicant to fulfill its statutory obligation to review branch applications before acting on the proposals and to otherwise supervise state member banks.

Key Information

Abstract

This is a request to renew a currently approved information collection, OMB No. 2126-0004, “Driver Qualification Files.” This ICR estimates the burden commercial motor vehicle (CMV) drivers and motor carriers incur to comply with the mandatory reporting and recordkeeping tasks required for motor carriers to maintain driver qualification (DQ) files. FMCSA’s authority to require carriers to maintain DQ files is in 49 U.S.C. 504, 31133, 31136, and 31502; 49 CFR 391.51; and 49 CFR 1.87. A motor carrier is required to maintain specified information in a DQ file for each CMV driver it employs. The purpose of the information is to document the driver’s qualifications to operate a CMV. DQ files assist the motor carrier in assessing the safety risk of hiring an individual to drive a CMV. The DQ file documents that a driver: (1) is physically qualified to operate a CMV, (2) has the experience and training to safely operate the type of CMV he or she is assigned to drive, (3) has the appropriate driver’s license, (4) has not been disqualified from operating a CMV, and (5) has a history of avoiding high-risk behavior. The annual burden associated with this information collection consists of the Driver Hiring Process (IC-1), the Annual Review of Driver Qualifications (IC-2), the Limited Exemptions from Driver Qualification Documentation (IC-3), and the Driver Review and Rebuttal of Safety Performance History (IC-4). The DQ file assists Federal and State safety investigators in determining that motor carriers are weighing these factors in deciding who may drive CMVs on their behalf. Motor carriers collect and maintain part 391 information, and FMCSA does not require that information to be submitted to the Agency. A motor carrier must make the part 391 information available when an FMCSA or State investigator conducts an on-site review at the motor carrier’s place of business or terminal. The ICR is a renewal of a currently approved ICR. This renewal increases estimates of labor and non-wage costs and slightly decreases the estimated burden hours. These changes are caused by driver population growth and increased driver turnover rates.

Abstract

Section 709(c) of Title VII of the Civil Rights Act of 1964 (Title VII) requires employers to make and keep records relevant to the determination of whether unlawful employment practices have been or are being committed, to preserve such records, and to produce reports as the Commission prescribes by regulation or order. Pursuant to this statutory authority, the EEOC in 1966 issued a regulation requiring certain employers to file executed copies of the EEO–1 in conformity with the directions and instructions on the form, which called for reporting employee data by job category and by sex and race or ethnicity. Pursuant to Executive Order 11246, the Office of Federal Contract Compliance Programs (OFCCP), U.S. Department of Labor, in 1978 issued its regulation describing the EEO–1 as a report ‘‘promulgated jointly with the Equal Employment Opportunity Commission’’ and requiring certain contractors to submit ‘‘complete and accurate reports’’ annually. Under these authorities, private employers with 100 or more employees and federal contractors that have 50 or more employees and meet certain criteria are required to report annually the number of individuals they employ by job category and by sex and race or ethnicity.

The Federal Reserve Payments Study (FRPS) is supported by the following surveys: • Depository and Financial Institutions Payments Survey (FR 3066a), and • Networks, Processors, and Issuers Payments Surveys (FR 3066b). The FRPS collects information from organizations with a significant role in processing payments, including depository and financial institutions, general-purpose payment networks, third-party payment processors, issuers of private-label payment instruments, and providers of various alternative payment methods and systems, and helps to support the Federal Reserve System’s (Federal Reserve’s) role in the payments system. The FR 3066a and FR 3066b consist of a full set of surveys every three years and smaller versions of the surveys (fewer surveys, questions, or respondents) in each year between. The FRPS publishes aggregate estimates of noncash payment volumes, cash deposits and withdrawals, and related information derived from the surveys.

Abstract

The USGS Minerals Research Program is interested in understanding how mining and reprocessing of legacy mine waste has the potential to impact people and values in the Salmon River Basin of central Idaho. Metals present in the Salmon River Mountains have been identified as critical to the energy transition. The Basin is also a hotspot for recreational activities, notably subsistence hunting and fishing, Wild and Scenic Rivers, and Wilderness. Managing these resources thus requires finding an acceptable balance and while much is known about mineral locations and extraction techniques, no quantitative information is available about how the public uses the Basin, where they use it, or the benefits they derive from it. We intend to collect spatial and non-spatial information on users, uses, and associated values.

Settlement Agreements Between a Plan and a Party in Interest

Key Information

Abstract

This information collection request relates to two prohibited transaction class exemptions (PTEs) that the Department has granted, both of which involve settlement agreements. These two exemptions are described below. PTE 94-71 exempts from certain restrictions of ERISA and certain taxes imposed by the Code, a transaction or activity that is authorized, prior to the execution of the transaction or activity, by a settlement agreement, to which the Department is a party, resulting from an investigation of an employee benefit plan conducted by the Department. The following information collections are among the conditions for the exemption: (1) A party engaging in a settlement agreement arising out of a Department investigation must provide written notice to the affected participants and beneficiaries of the plan at least 30 days prior to entry into the settlement agreement. The notice must contain an objective description of the transaction or activity, the approximate date on which the transaction will occur, the address of the regional or district office of the Department that negotiated the settlement agreement, and a statement informing participants and beneficiaries of their right to forward their comments to such office. (2) A copy of the notice and a description of the method by which it will be distributed must be approved in advance by the regional or district office of the Department which negotiated the settlement. PTE 2003-39 exempts from certain restrictions of ERISA and certain taxes imposed by the Code, transactions arising out of the settlement of litigation that involve: the release by the plan or a plan fiduciary of legal claims against parties in interest in exchange for payment given by or on behalf of the party in interest to the plan; an extension of credit by a plan to a party interest in connection with a settlement; and the plan's acquisition, holding, and disposition of employer securities received in settlement of litigation. The relief is granted provided certain conditions are met, such as the requirement of an independent fiduciary who has no relationship to, or interest in, any parties in the litigation to authorize the settlement and the settlement terms of the agreement and any extension of credit are reasonable and no less favorable than comparable arm's length agreement. The other conditions include the following information collections: (1) The terms of the settlement must be specifically described in a written agreement or consent decree. (2) The fiduciary acting on behalf of the plan must acknowledge in writing that the person is a fiduciary with respect to the settlement of the litigation. (3) The plan fiduciary must maintain records of the transaction for six years and must disclose the records on request to the Department and other interested persons.

GEAR UP Application Packages for Partnership and State Grants (1894-0001)

Key Information

Abstract

The purpose of the Gaining Early Awareness and Readiness for Undergraduate Programs (GEAR UP) partnership and state applications is to allow partnerships and states to apply for funding under the GEAR UP program. GEAR UP, created in the Higher Education Act Amendments of 1998 (Title IV, Section 404A-404H), is a discretionary grant program which encourages applicants to provide support and maintain a commitment to eligible low-income students, including students with disabilities, to assist the students in obtaining a secondary school diploma and preparing for and succeeding in postsecondary education. GEAR UP provides grants to partnerships and states to provide services at high-poverty middle and high schools. GEAR UP grantees serve an entire cohort of students beginning no later than the seventh grade and follow them through graduation and, optionally, the first year of college. We are requesting a reinstatement without change of the previously approved GEAR UP applications (OMB number 1840-0821). This discretionary grant program falls under the streamlined grant process, 1894-0001, which waives the 60-day comment period.

Key Information

Abstract

The Leahy-Smith America Invents Act (AIA), Public Law 112–29 § 32 (2011) directs the USPTO to work with and support intellectual property law associations across the country in the establishment of pro bono programs designed to assist financially under-resourced independent inventors and small businesses (also referred to as “regional hubs”). To support this, the USPTO works with and supports various non-profit organizations to operate a series of autonomous regional hubs that endeavor to match low-income inventors with volunteer patent practitioners across the United States. The regional hubs comprise law schools, bar associations, innovation/entrepreneurial organizations, and arts-focused lawyer referral services that are strategically located to provide access to patent pro bono services across all fifty states, the District of Columbia, and Puerto Rico. To support the purposes described above, the Patent Pro Bono Survey collects information regarding the activity of the regional hubs. The USPTO works with the Pro Bono Advisory Council (PBAC) to determine what information is necessary to evaluate the effectiveness of each regional hub’s operations. The PBAC is a well-established group of patent practitioners and thought leaders in intellectual property who provide support and guidance to the regional hubs across the country. The data collected provides the USPTO with valuable information, including the number of inventor inquiries, referral sources, number of pro bono applicants successfully matched with patent practitioners, and types of patent filings. The USPTO, PBAC, and the regional hubs, are responsible for the quarterly collection of this data. The USPTO’s Patent Trial and Appeal Board (PTAB), collaborates with the PTAB Bar Association (PTAB Bar Assoc.), a non-profit organization focused on helping secure the just, speedy, and inexpensive resolution of every PTAB proceeding and serves the public by coordinating pro bono opportunities. The PTAB and the PTAB Bar Assoc. established a national clearinghouse that acts as a matchmaker to connect under-resourced inventors with volunteer patent practitioners across the United States for assistance in preparing and arguing ex parte appeals before the PTAB. The PTAB Bar Assoc.’s national clearinghouse provides nationwide access to legal representation for pro bono ex parte appeal services. The PTAB Pro Bono Program supports the purposes described above by facilitating the availability of pro bono services for proceedings before the PTAB, which the USPTO believes can help reduce the financial burden on under-resourced inventors seeking ex parte appeal assistance, especially those impacted by the pandemic.

Abstract

The North American Breeding Bird Survey (BBS) assists in fulfilling the Secretary of Interior's responsibilities under the Fish and Wildlife Conservation Act by collecting avian population data for numerous migratory nongame birds in the United States. The BBS is a long-term, large-scale avian monitoring program to track the status and trends of North American bird populations. Volunteers conduct avian point counts once per year during the breeding season (primarily June). Volunteers skilled in avian identification listen for 3 minutes at 50 stops along the route recording all birds seen or heard. Data are submitted electronically via the Internet or on hard copy. These data are used to estimate population trends and abundances at various geographic scales and assist with documenting species distribution.

Abstract

Section 10201(i) of the Affordable Care Act (ACA) added provisions under Section 1115 of the Social Security Act to require the Secretary to publish no later than 180 days after the enactment of this act, regulations that establish application requirements for demonstration projects. Under section 10201(i) of ACA the Secretary must establish a process for public notice and comment at the State level, and at the federal level after an application for a demonstration project is received by the Secretary. In addition, the Secretary must implement reporting requirements for States, establish a process for the periodic evaluation of demonstration projects and report annually to Congress on the implementation of previously approved demonstration projects. This collection would address the provisions required under Sections 10201(i) of the Affordable Care Act.

Since 2012, the United States Patent and Trademark Office (USPTO) has conducted the Patents for Humanity Program, a biennial award program to incentivize the distribution of patented technologies or products for the purpose of addressing humanitarian needs. The program is open to any U.S. patent owners, patent applicants, or patent licensees or licensors. The USPTO collects information from applicants that describe what actions they have taken with their technology to address the world’s most pressing humanitarian problems. There are numerous categories of awards including: medicine, nutrition, sanitation, household energy, and living standards. Sometimes the program includes additional categories specific for that year.

These interim final regulations set forth rules implementing revisions to the Public Health Service (PHS) Act section 2719 for internal claims and appeals and external review processes to implement Section 110 of the No Surprises Act (NSA), which protects participants, beneficiaries, and enrollees in group health plans and group and individual health insurance coverage from receiving surprise medical bills when they receive emergency services, non-emergency services from non-participating providers at participating facilities, and air ambulance services, under certain circumstances. Specifically Section 110 of the NSA amends section 2719 of the PHS Act to require the external review process to apply to participants, beneficiaries, and enrollees of such plans with respect to any adverse determination by a plan or issuer under section 2799A-1 or 2799A-2 of the PHS Act. These protections also extend to grandfathered plans.

Abstract

The Patient Protection and Affordable Care Act, Pub. L. 111-148, was signed into law on March 23, 2010, and the Health Care and Education Reconciliation Act of 2010, Pub. L. 111-152, was signed into law on March 30, 2010 (these are collectively known as the "Affordable Care Act"). The Affordable Care Act amends the Public Health Service Act (PHS Act) by adding section 2715 "Development and Utilization of Uniform Explanation of Coverage Documents and Standardized Definitions." Section 2715 directs the Secretary, in consultation with the National Association of Insurance Commissioners and a working group comprised of stakeholders, to develop standards for use by a group health plan and a health insurance issuer in compiling and providing to applicants, enrollees, and policyholders and certificate holders a summary of benefits and coverage (SBC) that accurately describes the benefits and coverage under the applicable plan or coverage. Section 2715 also directs the Secretary to provide for the development of standards for the defintions of terms used in health insuance. Finally, section 2715 requires 60-days advance notice of any material modification in any of the terms of the plan or coverage that is not reflected in the most recently provided SBC. To implement these disclosure requirements, the final rule would require a collection of information by health insurance issuers in the group and individual markets and third-party administrators.
