Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

The reporting and recordkeeping provisions in 30 CFR 50, Notification, Investigation, Reports and Records of Accidents, Injuries and Illnesses, Employment and Coal Production in Mines, are essential elements in MSHA’s statutory mandate to reduce work-related injuries and illnesses among the nation’s miners (30 U.S.C. 801). Part 50 applies to operators of coal, metal, and nonmetal mines. It requires operators to immediately notify MSHA of accidents, investigate accidents and restrict disturbance of accident-related areas. This part also requires operators to file reports with MSHA pertaining to accidents, occupational injuries, and occupational illnesses, as well as employment and coal production data, and requires operators to maintain copies of reports at mine offices. Section 103(d) of the Mine Act, 30 U.S.C. 813(d), mandates that each accident be investigated by the operator to determine the cause and means of preventing a recurrence. Section 103(h) of the Mine Act, 30 U.S.C. 813(h), requires operators to keep any records and make any reports that are reasonably necessary for MSHA to perform its duties under the Mine Act. Operators must keep records of such accidents and investigations and make them available to the Secretary or the Secretary’s authorized representative and the appropriate State agency. Section 103(j) of the Mine Act, 30 U.S.C. 813(j), requires operators to notify MSHA of the occurrence of an accident and to take appropriate measures to preserve any evidence that would assist in the investigation into the causes of the accident.

Abstract

On January 8, 2016, the Commission adopted a Report and Order, Second Report and Order, and Order on Reconsideration, FCC 16-1 (323/CORES Order and Reconsideration Order). The 323/CORES Order and Reconsideration Order adopted changes to the ownership reporting requirements that are intended to further improve the data collected on the form. The 323/CORES Order and Reconsideration Order adopts a Restricted Use FRN within CORES that individuals may use solely for the purpose of broadcast ownership report filings. In light of the Commission’s adoption of the Restricted Use FRN, the 323/CORES Order and Reconsideration Order eliminates the availability of the interim Special Use FRN for broadcast ownership reports, except in very limited circumstances. The 323/CORES Order and Reconsideration Order prescribes revisions to the reporting requirements for noncommercial broadcast stations that more closely conform to the reporting requirements for commercial broadcast stations. The 323/CORES Order and Reconsideration Order also makes a number of other improvements to the forms that are intended to reduce the filing burdens on broadcasters, streamline the filing process, and increase the quality and usability of the data submitted to the Commission. These changes include extending the biennial filing deadline for Form 323, reducing the number of filings required, improving the reporting of other broadcast and daily newspaper interests, and additional improvements.

OMB No. 1219-0144 and 1219-0078 (Expiring 2/29/2020) are being combined into 1219-0144 only. The 5000-3 Form, which currently belongs to both OMB No.’s, will then cover one OMB No. only after this combination occurs. The respondents for the paperwork provisions of this rule are underground mine operators. The records will be used by mine operators, supervisors, and employees, and State and Federal mine inspectors to provide assurance that each mine operator and mine rescue team is prepared for a mine emergency. The records show that the mine rescue team equipment has been examined and tested and is in good working order. The training records show that the mine rescue team members and the responsible persons at the mine are competent to respond to a mine emergency involving a fire, an explosion, or a gas or water inundation. The records greatly assist those who use them in making decisions that will ultimately affect the safety of all persons working underground. These information collection requirements help assure that properly trained mine rescue teams are readily available to save endangered miners in life-threatening situations. In addition, the training requirements in this information collection will help assure the safety of the mine rescue team itself.

Abstract

MSHA regulations at 30 CFR parts 6 through 36 contain application, testing and inspection procedures, and quality control procedures for the approval of mining equipment or explosives used in both underground and surface coal, metal, and nonmetal mines. Except for parts 6 and 7, MSHA conducts most of the testing and evaluation of products for a fee paid by the applicant; although some regulations require the manufacturer to pretest the product. Upon MSHA approval, the manufacturer must ensure that the product continues to conform to the specifications and design evaluated and approved by MSHA. Abstract

Pertains to certification of certain persons to perform specific exams and tests. Also contains procedures under which coal mine operators are required to maintain a list of certified and qualified persons, and to develop an approved training plan for hosting engineers or host men. 30 CFR 75.159 and 77.106 require coal mine operators to maintain a list of persons who are certified and those who are qualified to perform duties under Parts 75 and 77, such as conduct examinations for hazardous conditions, conduct tests for methane and oxygen deficiency, conduct tests of air flow, perform electrical work, repair energized surface high-voltage lines, and perform duties of hoisting engineer. The information collection is necessary to ensure that only persons who are properly trained and sufficiently experienced are permitted to perform these duties. Although MSHA does not specify a format for the recordkeeping, it normally consists of the names of the certified and qualified persons listed in two columns on a sheet of paper. One column is for certified persons and the other is for qualified persons.

MSHA is required to-issue regulations requiring operators to maintain accurate records of employee exposures to potentially toxic materials or harmful physical agents which are required to be monitored or measured under any applicable mandatory health or safety standard promulgated under this Act. Airborne radon and radon daughters exist in every uranium mine and in several other underground mining commodities. Radon is radioactive gas. It diffuses into the underground mine atmosphere through the rock and the ground water. Radon decays in a series of steps into other radioactive elements, which are solids, called radon daughters. Radon and radon daughters are invisible and odorless. Decay of radon and its daughters results in emissions of alpha energy.

Abstract

MSHA grantees are required by DOL regulations to submit project and final reports. Grantees are also required to submit final reports no later than 90 days after the end of the grant period. Technical Project Reports: A grantee submits a technical project report to MSHA no later than 30 days after quarterly deadlines. Technical project reports provide both quantitative and qualitative information and a narrative assessment of performance for the preceding three-month period. This includes the current grant progress against the overall grant goals. Between reporting dates, the grantee informs MSHA of significant developments or problems affecting the organization's ability to accomplish the work Final Reports: At the end of the grant period, each grantee provides a project summary of its technical project reports, an evaluation report, and a close-out financial report. These final reports are due no later than 90 days after the end of the 12-month performance period.

Abstract

Federal Mine Safety and Health Act of 1977 (Mine Act) Public Law 95-164, as amended, recognizes that education and training is an important element of Federal efforts to make the nation's mines safe. Section 115(a) of the Mine Act states that "each operator of a coal or other mine shall have a health and safety training program which shall be approved by the Secretary." 30 CFR 48.3 and 48.23 require training plans for underground and surface mines, respectively. Training plans are required to be submitted for approval to the MSHA District Manager for the area in which the mine is located. These standards are intended to ensure that miners will be effectively trained in matters affecting their health and safety, with the goal of reducing the occurrence of injury and illness in the nation's mines.

The Federal Trade Commission’s Energy Labeling Rule (Rule) contains testing, reporting, recordkeeping, and labeling requirements for manufacturers of major household products (refrigerators, refrigerator freezers, and freezers; dishwashers; clothes washers; water heaters; room air conditioners; furnaces; central air conditioners; heat pumps; pool heaters; fluorescent lamp ballasts; lamp products; plumbing fittings; plumbing fixtures; ceiling fans; consumer specialty lamps; and televisions). The Federal Trade Commission (FTC or Commission) issued a Notice of Proposed Rulemaking (NPRM) that would amend the Rule. The proposed amendments include new labeling requirements for air cleaners, clothes dryers, miscellaneous refrigerator products, and portable electric spas (collectively referred below as “new labeled products”) that constitute information collections under the PRA. The proposed amendments also contain requirements which reduce the manufacturers’ burden associated with labeling certain appliances and increase the burden for retailers by requiring them to ensure displayed products bear labels. Accordingly, the Commission is seeking OMB clearance specific to the Rule amendments.

The EPA promulgated the Air Emissions Reporting Requirements (AERR) (40 CFR part 51 subpart A) to coordinate emissions inventory reporting requirements with existing requirements of the Clean Air Act and 1990 Amendments. Under this reporting, 54 State and Territorial air quality agencies, including the District of Columbia, as well as an estimated 31 local and tribal air quality agencies submit emissions data (including mobile model inputs) every 3 years for all point, non-point, on-road mobile, and non-road mobile sources of volatile organic compounds, oxides of nitrogen, carbon monoxide, sulfur dioxide, particulate matter less than or equal to 10 micrometers in diameter, particulate matter less than or equal to 2.5 micrometers in diameter, ammonia, and lead. In addition, the air quality agencies must submit annually emission data for point sources emitting at greater than specified levels of those pollutants. The data supplied to the emission reporting requirement is needed so that the EPA can compile and make available a national inventory of air pollutant emissions. A comprehensive inventory updated at regular intervals is essential to allow the EPA to fulfill its mandate to monitor and plan for the attainment and maintenance of the national ambient air quality standards established for criteria pollutants. The EPA makes the inventory available to states for air quality planning and to the public at large. This information is collected under 23 U.S.C. 101; 42 U.S.C 7401-7671q, and the authority of the AERR. This information is mandatory and, as specified, cannot be treated as confidential by the EPA. The number and frequency of data collection and submittal is expected to remain the same for 20222024.Emergency Justfication:EPA is requesting that the previously approved collection be reinstated for a six-month period while OAR prepares and publishes the 60 and 30-day notices necessary to complete a renewal package.

Abstract

As part of the DoD-wide effort to promote resource utilization for those who experienced Unwanted Sexual Contact (USC; i.e., sexual assault and sexual harassment), the Department of Navy (DoN) Office of Force Resiliency (OFR) developed and recently updated the Prevention Plan of Action (aka Prevention Plan of Action 2.0, 2022-2024; PPoA 2.0). The PPoA 2.0 is a strategy framework leveraging public health science in military environments to prevent sexual assault in the military and improve response efforts. As part of this initiative, OFR commissioned this study (Agreement #NMR-24-11717) to investigate the factors influencing reporting and resource utilization among men who experienced USC during military service. This DoN OFR-commissioned investigation involves three study phases, and findings from each phase will be pieced together to provide a comprehensive understanding of resource utilization decision-making processes among men affected by USC and will inform the development of programmatic recommendations to improve resource utilization. Phase 1) A systematic literature review (no human subjects involvement), Phase 2) An archival data analysis of deidentified data with no human subjects involvement, and Phase 3) A narrative/semi-structured interview study of male Sailors who report experiencing USC and/or sexual harassment during military service to build upon limited research among men. Finally, findings will be used to develop recommendations to modify extant policy and practices around sexual assault reporting and service utilization by male Sailors (no human subjects involvement). This information collection request describes our data collection efforts for Phase 3, a primary interview data collection with men who have experienced USC and/or sexual harassment during military service.

Safety Management Systems for Part 121 Certificate Holders

Abstract

Information received from the current collection is used to determine part 121 certificate holder’s compliance with FAA’s SMS regulation, their implementation of the mandatory SMS components, and assess the burden to comply with the 14 CFR part 5. Information from this collection is also used to monitor post-implementation compliance with 14 CFR part 5 as an additional source of information to understand the compliance burden on part 121 air carriers. The proposed amendments to 14 CFR part 5 would require certain certificate holders authorized to conduct operations under parts 21, 121, 135, and § 91.147 to develop and implement an SMS for all of their aviation safety-related activities and would require amending ICR Reference Number 202107-2120-004 accordingly. The organization required to have an SMS would use the data it collects to identify hazards and mitigate risk. The safety policy, outputs of safety risk management and safety assurance processes, and training and communication records would be maintained by the organization and be used in its SMS. The hazard notification information would be shared with the person in the best position to address a discovered hazard or mitigate the related risk. The system description would be used by the organization to delineate its structure, processes, business arrangements, and interfaces that impact the organization’s management of aviation safety. The system description would also be used as a resource for the FAA because it provides foundational information regarding the organization’s operations covered by the SMS, as well as interfaces of those operations both internal and external to the organization. SMS information would also be used to determine compliance with the proposed rule, including mandatory SMS components. Information from this proposed collection will also determine ongoing compliance with proposed 14 CFR part 5, post-implementation.

Operators of gas and hazardous liquid pipelines must develop, implement, and submit a human factors management plans designed to reduce risk associated with human factors in each control room. This mandatory record keeping requirement supports the U.S. Department of Transportation’s “SAFETY STRATEGIC GOAL” which targets three main strategic initiatives: managing risk and integrity, sharing responsibility, and providing effective stewardship. This goal enhances public health and safety by working toward the elimination of transportation-related deaths and injuries. The information is used by PHMSA to determine compliance with federal pipeline safety regulations and is also used by Agency and State Officials to assist federal and state pipeline safety inspectors who audit this information when they conduct compliance inspections and to provide background for failure investigations.
