Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Community Services Block Grant (CSBG) Annual Report

Key Information

Abstract

The Community Services Block Grant (CSBG) Act (42 U.S.C. § 9901, et seq.) was established under the Community Opportunities, Accountability, and Training and Educational Services Act of 1998, Public Law 105-285. The Office of Community Services (OCS), Administration for Children and Families (ACF), U.S. Department of Health and Human Services (HHS) administers CSBG at the federal level. CSBG provides funds to states and other entities to support services and activities that alleviate the causes and conditions of poverty in communities. Section 678E of the CSBG Act requires states, including the District of Columbia and the Commonwealth of Puerto Rico, and U.S. territories, to annually prepare and submit a report on the measured performance of the state and the eligible entities in the state. Prior to the participation of the state in the performance measurement system, the state shall include in the report any information collected by the state relating to such performance. Each state shall also include in the report an accounting of the expenditure of funds received by the state through the CSBG program, including an accounting of funds spent on administrative costs by the state and the eligible entities, and funds spent by the eligible entities on the direct delivery of local services, and shall include information on the number of and characteristics of clients served under the subtitle in the state, based on data collected from the eligible entities. The state shall also include in the report a summary describing the training and technical assistance offered by the state. Section 3(b) of the Government Performance and Results (GPRA) Modernization Act of 2010 (GPRAMA) requires OCS, as an office under the U.S. Department of Health and Human Services, to collect performance information for the CSBG. In alignment with the Executive Orders, Initial Rescissions of Harmful Executive Orders and Actions, and Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government the Office of Community Services is requesting a change request to remove language related to diversity, equity, and inclusion (DEI) and update gender collected data to denote sex as a biological variable in current approved information collection requests to comply with the directives.

Abstract

This information collection request (ICR) is for a revision to the umbrella Generic for ACF Program Monitoring Activities. The current expiration date is November 30, 2023. The overall proposed purposes, uses, and scope of the umbrella remain unchanged. The only changes are to the burden estimates, as described in sections A12 and A15. The Generic for ACF Program Monitoring Activities allows Administration for Children and Families (ACF) program offices to collect standardized information from recipients that receive Federal funds to ensure oversight, evaluation, support purposes, and stewardship of Federal funds. The information is necessary to ensure compliance with Federal and programmatic requirements, monitor progress on recipient activities, and determine and respond to recipient needs such as Training and Technical Assistance (T/TA). ACF is primarily a grant-making agency that promotes the economic and social well-being of families, children, individuals and communities with partnerships, funding, guidance, T/TA. ACF program offices have evolving monitoring needs, dependent on both internal and external factors, such as but not limited to: current grantee activities, needs; uses of federal funds; changes to aspects of programs based on statutory authority, federal regulations or policy, and/or Congressional appropriations; availability of program office funds for site visits (v. desk monitoring); matters of importance related to national health and safety needs of the public, or other events that lead to program changes. There are times when standardized collections of information would be helpful for program offices as they monitor recipient activities and needs. This generic clearance allows program offices the flexibility to create tailored information collections based on current circumstances and to receive approval for these in a timely manner. This is important to allow for ACF’s: • monitoring of compliance with federal practice, guidelines and requirements, • quick understanding of and remediation to national, regional, and/or site-specific issues, • provision of support as needed, • accurate assessment of the efficiency and efficacy of recipient activities • documentation of promising practice, innovative services, and program strengths • flexible and responsive oversight of federal funds

[NIOSH] Reducing Fatigue Among Taxi/Rideshare Drivers

Key Information

Abstract

The goal of this study is to evaluate an online, interactive training on fatigue management tailored to taxi drivers and other for-hire rideshare drivers. The proposed study is a longitudinal, randomized design comparing two interventions and a control over 5 study periods. One group of 60 drivers will receive both interventions: fatigue training and daily feedback on estimated fatigue score. A second group of 60 drivers will receive only the fatigue training. A third group of 60 drivers will receive neither intervention. All participating drivers will take a self-administered questionnaire, wear a wrist actigraph to measure sleep quality, complete a sleep and activities diary, and take a sleep health and driving knowledge assessment. Drivers taking the training will be asked to complete an evaluation. Findings will be used to improve the training program for potential future dissemination. This change request updates documents to follow executive orders.

On March 17, 2023, we received OMB approval to conduct a descriptive case study for the Culture of Continuous Learning Project: Case Study (OMB #0970-0605). The purpose of this project is to document the factors that contribute to the feasibility of implementing the Breakthrough Series Collaborative (BSC) quality improvement methodology in Head Start and child care centers. The OMB-approved information collection includes: (1) implementation materials (e.g., worksheets); (2) key informant interviews; (3) focus groups with key staff, teachers, and parents; and (4) surveys with administrators, teachers, staff, and parents. The National Healthcare Safety Network (NHSN) is a system designed to accumulate, exchange, and integrate relevant information and resources among private and public stakeholders to support local and national efforts to protect patients and promote healthcare safety. Specifically, the data is used to determine the magnitude of various healthcare-associated adverse events and trends in the rates of these events among patients and healthcare workers with similar risks. The data will be used to detect changes in the epidemiology of adverse events resulting from new and current medical therapies and changing risks. This Change Request is submitted to adhere to recent EOs and includes another minor change.Emergency Justfication:Emergency Processing is requested to add three (3) additional pathogens of concern to the NHSN (OMB Control No. 0920-0666) data collection: Influenza A (H5), Marburg, and Oropouche. This requested update in disease surveillance will illustrate which patient populations are being affected by these pathogens and the potential need for additional healthcare infection prevention and control. Since this form is collecting data on hospitalized patients, the update will also help inform on the severity of illness a high consequence pathogen is causing as well as what region(s) of the country are affected. Data collection is vital to ensure that local and state authorities are supported to prepare for and respond to emerging outbreaks.

National Healthy Start Evaluation and Quality Assurance

Abstract

The goal of this ongoing monitoring and evaluation is to assess Healthy Start (HS) progress towards meeting its performance goals. Results from monitoring and evaluation efforts will provide actionable evidence to support the improvement, sustainability, replication, and dissemination of the program. The information collected will be used to obtain consistent information across all 100 grantees about HS, its participants, and its outcomes. Respondents include pregnant women and women of reproductive age that were served by HS and HS staff. This revision seeks to reduce the burden of data collection on grantees and program participants, as well as to focus the evaluation more clearly on progress towards meeting performance goals regarding program impact. In the process, this will ensure that collected data is meaningful for monitoring and evaluation, and that previously separate data systems can be streamlined, thus improving efficiency.

CMS Plan Benefit Package (PBP) and Formulary CY 2026 (CMS-R-262) - IRA

Key Information

Abstract

CMS has incorporated the following changes to address the Inflation Reduction Act (IRA). This includes new attestations and data entry fields to reflect Part D policy changes (i.e., new insulin and vaccine benefits and $0 cost sharing in the catastrophic phase) that are required by the IRA, specifically Sections 11101, 11201, 11401, and 11406. CMS is also modernizing the PBP software by migrating from its current client/server based platform to a new web-based module within HPMS. This initiative is critical, as the current platform technically antiquated. The new PBP module will enhance system security, improve the user interface, streamline the bid submission process, increase system performance, and provide greater flexibility to accommodate unique benefit designs. CMS requires that MA and PDP organizations submit a completed formulary and PBP as part of the annual bidding process. During this process, organizations prepare their proposed plan benefit packages for the upcoming contract year and submit them to CMS for review and approval.

Collective Investment Funds Conversion Transactions, Prohibited Transaction Class Exemption 1997-41

Key Information

Abstract

Prohibited Transaction Exemption (PTE) 97-41 permits an employee benefit plan to purchase shares of a registered open-end investment company (mutual fund) in exchange for plan assets transferred in-kind from a collective investment fund (CIF) maintained by a bank or plan adviser, even though the bank or plan adviser, or an affiliate thereof, is the investment adviser for the mutual fund and also serves as a fiduciary for the plan, provided that the purchase and transfer is in connection with a complete withdrawal of the plan's investment in the CIF and certain other conditions are met. Among other conditions, the exemption requires the bank or plan adviser to provide an independent fiduciary of the plan with advance written notice of the proposed transfer and full written disclosure of information concerning the mutual fund, including the current prospectus; disclosure of the fees to be charged to, or paid by the plan and funds to the bank or plan adviser, including the nature and extent of any differential between the rates of the fees; the reasons why the bank or plan adviser considers the in-kind transfers appropriate for the plan; and a statement of whether there are any limitations applicable to the bank or plan adviser with respect to which plan assets may be invested in shares of the mutual fund and, if so, the nature of such limitations; and the identity of securities that will have to be valued for the transfer. The independent fiduciary must give prior written approval of the transfer (and written approval of any electronic transmission of subsequent confirmations from the bank or plan adviser, if the independent fiduciary elects to receive such statements in that form); and the bank or adviser must send written (or electronic, if approved) confirmation of the transfer. Subsequent to a transfer, the bank or plan adviser must provide the independent fiduciary of the plan with updated prospectuses at least annually for mutual funds in which the plan remains invested; the bank or plan adviser must also provide, upon the independent fiduciary's request, a report or statement of all fees paid by the mutual fund to the bank or plan adviser, which may be in the form of the most recent financial report.

Energy Employees Occupational Illness Compensation Program Act Dose Reconstruction Interviews and Forms (EEOICPA)

Abstract

NIOSH is charged with developing reasonable estimates of the radiation doses incurred occupationally by U.S. nuclear weapons workers with cancer that are covered by the Energy Employees Occupational Illness Compensation Program Act of 2000. These radiation dose reconstructions are completed using methods promulgated by HHS under 42 CFR 82. An essential data source for completing the dose reconstructions is the information collected through structured telephone interviews conducted with claimants, who may be energy employees or surviving family members. In some cases, if necessary, co-workers of the employee are interviewed. These individuals may have unique knowledge of work conditions, radiation protection measures, and monitoring practices that are not available from other sources. At the completion of the dose reconstruction process, claimants review the estimated radiation dose, and signify that they have no more relevant information to offer by submitting a conclusion form (OCAS-1). This Extension requests OMB approval for an additional three years. There are no changes to the information collection instruments or burden on respondents.

[NCCDPHP] Message Testing for Tobacco Communication Activities

Key Information

Abstract

In 2012, CDC/OSH obtained OMB approval of a generic clearance to support the development of tobacco-related health messages (Message Testing for Tobacco Communication Activities (MTTCA), OMB No. 0920-0910). The MTTCA clearance has been used to obtain OMB approval for a variety of message testing activities. CDC is requesting OMB approval to extend the generic MTTCA clearance for three years. CDC will continue to use the MTTCA clearance to develop and test messages and materials for current and future phases of the ACA-funded media campaign, as well as OSH's ongoing programmatic initiatives including, but not limited to, the Media Campaign Resource Center, reports from the Office of the Surgeon General, and other communication efforts and materials. The MTTCA generic clearance may also be used to facilitate the development of tobacco-related health communications of interest for CDC collaborative efforts with other federal partners including, but not limited to, the Food and Drug Administration, the Substance Abuse and Mental Health Services Administration, the National Institutes of Health, and the National Cancer Institute. The MTTCA clearance is sufficient to test tobacco related messages developed by CDC. No modification is requested for information collection activities or methodology. Non-Subsantive Change Request is submitted to modify questions in previously approved GenIC for compliance with recently issued EOs. There is no change to burden hours.

Aleutian Islands Pollock Fishery Requirements

Key Information

Abstract

The National Marine Fisheries Service (NMFS), Alaska Regional Office, requests extension of this currently approved information collection. No changes were made to this collection other than updating the hourly wage rate to use the most current rate available and to improve consistency in the rates used for the same respondent types in NMFS Alaska Region information collections. This information collection is for the annual participant letter for the Aleutian Islands (AI) pollock fishery. The Aleut Corporation’s AI pollock fishery is set up so that harvesting pollock in the AI directed pollock fishery and processing pollock taken in the AI directed pollock fishery are authorized only for those harvesters and processors that are selected by The Aleut Corporation. The Aleut Corporation is required by Federal regulations to provide its selected harvesters and processors to NMFS for approval. The purpose of the annual AI pollock fishery letter participant letter is for NMFS to obtain the list of vessels and processors selected by The Aleut Corporation to harvest and process its annual AI pollock allocation. NMFS uses this information to manage the AI pollock fishery. Without this information, NMFS would not know the participants selected by The Aleut Corporation and harvest rates could not be determined, which may result in allocations being exceeded.

Child Care and Development Fund (CCDF) Plan Preprint for States and Territories for Federal Fiscal Year (FFY) 2022-2024 & 2025-2027

Abstract

The authorization to require a Lead Agency in the State or Territory administering a Child Care and Development Fund (CCDF) program to submit a plan using the Preprint form is contained in the Child Care and Development Block Grant Act of 1990 (CCDBG Act), 42 U.S.C 9858 as amended by the Child Care and Development Block Grant Act of 2014, Public Law 113-186. To be eligible to receive funds under this program, Section 658E of the CCDBG Act, 42 U.S.C. 9858c, a State or Territory shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary shall require by rule, including a CCDF Plan (OMB 0970-0114) that meets the requirements of Section 658E(c) of the CCDBG Act, 42 U.S.C. 9858c(c). OCC provides State/Territory Lead Agencies with the CCDF Preprint (ACF Form 118) as a useful tool to guide the development and submission of their Plans. The following ICR has been updated with non substantive changes in response to the Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government Executive Order (Defending Women EO) and recent Presidential Actions related to diversity, equity, and inclusion (DEI), such as those covered under the EO Initial Recissions of Harmful Executive Orders and Actions.

[NCEZID] Traveler-based Genomic Surveillance

Key Information

Abstract

The goal of the study is to amend one question on our list of potential additional questions to support data collection for a winter 2023/2024 pilot project. There is a continuous need to have no more than four of the additional questions added to the primary instrument at any given time, there is no additional burden to the participant. The responses to these questions will be collected using the same digital questionnaire as the primary instrument. The PRA-approved supporting statement A (SSA) and consent form both indicate the potential for testing for additional pathogens, and the data collected from this additional question is necessary for the interpretation of test results from the pathogens for which are now testing. This change request modifies the collection to adhere to current execute orders.

The Administration for Children and Families (ACF) at the U.S. Department of Health and Human Services (HHS) seeks approval of the Healthy Marriage and Responsible Fatherhood (HMRF) Final Report Templates. HMRF grant recipients carrying out local evaluations of their programs are required to submit a final evaluation report to ACF at the end of their grant. This request includes templates for grant recipients to use to document their evaluation’s analysis and findings. Abstract

Prohibited Transaction Exemption (PTE) 2002-12 permits private-sector pension plans and the Federal Thrift Savings Plan to buy and sell securities between certain types of investment funds that participate in passive or model-driven “cross-trading” programs pursuant to objective criteria specified in the exemption. The exemption extends only to crossing-trading conducted according to index- or model-driven programs that meet the specific requirements of the exemption, which generally seeks to create objective criteria sufficient to confine or eliminate the manager's discretion to affect the identity or amount of securities to be cross-traded and the timing of cross-trades. The exemption also covers cross-trades among such funds and certain large accounts that engage managers to carry out a specific portfolio restructuring program in order to convert the large account into a fund, or to otherwise act as a “trading adviser” for such a restructuring program. The information collection requirements that are conditions for reliance on the class exemption include third-party disclosures and recordkeeping. The exemption does not require any reporting or filing with the Federal government, but the designated records must be made available to specified parties, including the Department and the IRS, upon request.

Bank Collective Investment Funds, Prohibited Transaction Class Exemption 1991-38

Abstract

Prohibited Transaction Class Exemption (PTE) 91-38 provides an exemption from the restrictions of sections 406(a), 406(b)(2) and 407(a) of ERISA and the taxes imposed by section 4975(a) and (b) of the Code by reason of section 4975(c)(1)(A), (B), (C), or (D) of the Code for certain transactions between a bank collective investment fund in which an employee benefit plan has invested assets and persons who are parties in interest to the employee benefit plan, as long as the interest of the plan together with the interests of any other plans maintained by the same employer or employee organization in the collective investment fund does not exceed 10% of the total assets in the collective investment fund. In addition, the bank managing the common investment fund must not itself be a party in interest to the participating plan, the terms of the transaction must be at least as favorable to the collective investment fund as those available in an arm's length transaction with an unrelated party, and the bank must maintain records of the transactions for six years and make the records available for inspection to specified interested persons (including the Department and the Internal Revenue Service).

Semiannual Performance Report for Enhanced Training and Services to End Violence Against Women Later in Life Program

Abstract

The Enhanced Training and Services to End Abuse in Later Life Program (Abuse in Later Life Program) funds projects that support a comprehensive approach to addressing elder abuse in their communities. These projects will provide training to criminal justice professionals to enhance their ability to address elder abuse, neglect, and exploitation; provide cross-training opportunities to professionals working with older victims; establish or support a coordinated community response to elder abuse; and provide or enhance services for victims who are 50 years of age or older. Eligible applicants are limited to: states, units of local government, tribal governments or tribal organizations, population specific organizations with demonstrated experience in assisting individuals over 50 years of age, victim service providers with demonstrated experience in addressing domestic violence, dating violence, sexual assault, and stalking, and state, tribal, or territorial domestic violence or sexual assault coalitions. This program is authorized by 34 U.S.C. § 12421.
