Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

Pursuant to 46 U.S.C. § 501(b), the Maritime Administrator is required to make determinations of the availability of qualified United States flag capacity to carry coastwise cargo in connection with all requests for waivers of the Jones Act (46 U.S.C. § 55102). Based upon determinations made by the Maritime Administrator, and in consultation with the Maritime Administrator, the head of the Department of Homeland Security acting through Customs and Border Protection can waive compliance with the Jones Act. The collected information will be used by the Maritime Administration (MARAD), Office of Cargo and Commercial Sealift, to fulfill its statutory obligation in determining U.S. flag availability. The respondents are coastwise qualified vessel owners, operators, charterers, brokers and representatives. The collection of information is voluntary.

National Crime Victimization Survey

Abstract

The Bureau of Justice Statistics (BJS) is submitting a nonsubstantive change to remove the gender identity questions and other questions using the term “gender” on the NCVS per the Executive Order (EO) 14168 titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” This is a substantive change to the currently approved collection to obtain approval for full-scale implementation of the new NCVS instrument in 2025. The National Crime Victimization Survey (NCVS) collects analyzes publishes, and disseminates statistics on the amount and type of crime committed against households and individuals in the U.S. Since 1972, the NCVS has been providing national data on personal and household victimization, both reported and not reported to police. The data collection allows the BJS to fulfill its mission of collecting, analyzing, publishing, and disseminating information on victims of crime. Together with the Federal Bureau of Investigation’s (FBI) statistics on crimes reported to law enforcement agencies, the NCVS provides an understanding of the nature of and changes in the nation’s crime problems. The BJS is specifically requesting clearance for the core NCVS from January 2022 through December 2024. The core NCVS includes the administration of the basic screen questionnaire (NCVS-1, Attachment 19) and crime incident report (NCVS-2, Attachment 20) instruments to a nationally representative sample of persons age 12 or older living in households in the United States, including samples of persons representative of the 22 most populous states in the U.S. The core NCVS survey instrument covers nine general areas: 1) incidence of rape or sexual assault, robbery, aggravated assault, simple assault, personal larceny, burglary, motor vehicle theft, and other theft; 2) characteristics of these victimizations, including location, time, presence of a weapon, injury, and property/monetary loss; 3) characteristics of victims, including sex, age, race, Hispanic origin, disability, and occupation; 4) relationship between victim and offender; 5) emotional impact of victimization; 6) victim self-defense and bystander intervention; 7) offender characteristics including sex, age, race, and Hispanic origin; 8) reporting to police and police response; and 9) bias- or hate-motivated victimizations. NCVS core work also includes the analysis and dissemination of data products and reports stemming from the core collection, as well as technical and methodological analyses and reports based on the sampling for, administration of, and analysis of data from the NCVS basic screen questionnaire and crime incident report.

Nonsubstantive Change: The Bureau of Justice Statistics (BJS) is proposing to revise questions using the term “gender” on the SCS per the Executive Order (EO) 14168 titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” The Bureau of Justice Statistics (BJS) and the National Center for Education Statistics (NCES) request clearance to conduct the 2025 School Crime Supplement (SCS) as a supplement to the National Crime Victimization Survey (NCVS) to collect information about school-related victimization. The NCVS and all related contacts and protocols have been previously approved by the Office of Management and Budget (OMB) (OMB Control No: 1121-0111) and this request is specifically for a supplemental data collection instrument that will be added to the approved NCVS core from January 2025 through June 2025. Typically, the SCS is administered every two years. However, the SCS was postponed from 2021 to 2022 as a result of the impact of the COVID-19 pandemic on in-person learning. Due to implementation of the redesigned core NCVS instrument, 2025 was chosen for the next SCS data collection. Minor revisions were made to the 2022 SCS questionnaire for the 2025 administration. Certain items specifically related to COVID-19 and its impact on schooling were removed from the questionnaire. In addition, changes were made to the series of questions on drug and alcohol availability, such as adding a question on tobacco and updating examples of drugs available within existing questions.

Abstract

The Office of Workers’ Compensation Programs (OWCP) is the primary agency responsible for administration of the Energy Employees Occupational Illness Compensation Program Act of 2000, as amended (EEOICPA), 42 U.S.C. § 7384 et seq. EEOICPA provides for the payment of compensation to covered employees and, where applicable, survivors of deceased employees, who sustained either an “occupational illness” or a “covered illness” in the performance of duty for the Department of Energy and certain of its contractors and subcontractors. One element of the compensation provided to covered employees is medical benefits for the treatment of their occupational or covered illnesses that are accepted as compensable. OWCP contracts with a private sector bill processing agent that handles many of the tasks associated with paying bills for medical treatment provided to covered employees under EEOICPA. This bill processing agent uses an automated system that matches incoming bills with the authorized medical treatment of covered employees before it issues payments, and a provider of medical treatment, supplies or services to covered employees must provide the bill processing agent with information necessary for creation of an authorization within the agent’s automated system before a bill can be paid. The collection of this information is authorized by 20 CFR 30.400(a) and (c), 30.403, 30.404(b) and 30.700. The information collected by these forms will be used by both OWCP and its bill processing agent in connection with the automated payment of bills submitted by providers of medical treatment, supplies or services. The information submitted, along with other supporting documentation, is used to determine the correct amount to be paid to a provider of medical treatment, supplies or services to beneficiaries under EEOICPA.

Key Information

Abstract

The National Highway Traffic Safety Administration (NHTSA) is seeking approval for this new information collection request (ICR) to allow NHTSA to conduct a study on driver monitoring systems (DMS). DMS refers to in-vehicle technology that can detect driver state and interact with the driver through the human-machine interface (the user interface that connects the driver to the vehicle). NHTSA is proposing to conduct a study to improve NHTSA’s understanding of the differences in approaches to driver state detection and the potential safety impacts of DMS. The voluntary study would involve recruiting licensed drivers for the following information collections as part of a simulated driving study: (1) an online eligibility questionnaire to determine eligibility for participation; (2) an appointment reminder confirmation process; (3) informed consent form for participation in Track A; (4) informed consent form for participation in Track B; (5) breathalyzer measurements to ensure continued eligibility for the study drives; (6) facial shape and height measurements; (7) sleep and food intake questionnaire; (8) Karolinska Sleepiness Scale measurements; (9) Track A study drives; (10) Track B study drives; and (11) Track B end of visit release agreement . The objective of this simulator driving study is to assess the ability of DMS to assess driver states (e.g., distracted, drowsy) and understand how differences in DMS impact the ability of a system to reliably assess different driving states. This study will add to the state of knowledge by experimentally collecting data to support a full assessment of the factors associated with DMS and the modeling of driver state based on sensor data. Response to the collections of information is voluntary and the information collections are part of a one-time study, although some information collections are collected multiple times per respondent. Respondents are generally healthy individuals aged 18 and older. Efforts will be made to enroll a diverse age sample that broadly represents the age of the driving population and includes those at greater risk of crashing (e.g., less than 25 years of age and greater than 65 years of age). Additional efforts will be made to enroll individuals with diverse skin tones, oversampling those who rate themselves higher on the Fitzpatrick Skin Type Scale. The study will be reviewed and approved by the University of Iowa Institutional Review Board (IRB) before any data collection procedures begin.

Abstract

The Commission is required by section 9 of the Shipping Act of 1984 (46 U.S.C. 40701-40706) to ensure that controlled carriers (i.e., carriers owned or controlled by a government) publish and use rates, charges, classifications, rules, and regulations that are just and reasonable. Carriers are required to notify the Commission of certain events, including certain changes in ownership or control and their entry into the U.S. trade when they meet certain ownership or control conditions, so that that the Commission can determine whether they are controlled carriers under the Act. 46 CFR 565.4. This information allows the Commission to identify controlled carriers and to monitor their activities to ensure that they do not engage in the acts prohibited by section 9 of the Act (46 U.S.C. 40701-40706), i.e., to charge or assess rates below a just and reasonable level or to reduce effective tariff rates sooner than the 30th day after the date of publication.
