What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

The Administration for Children and Families (ACF) is requesting an extension with no changes to this information collection, which was originally approved in October 2023 through an emergency review, as authorized under 44 U.S.C. 3507 (subsection j). The forms under this request enable ACF’s Office of Human Services Emergency Preparedness and Response (OHSEPR) to provide case management support during disasters. The Disaster Human Services Case Management (DHSCM) program is authorized through appropriations language under the Children and Families Services account. It is operated by the Administration for Children and Families' (ACF) Office of Human Services Emergency Preparedness and Response (OHSEPR). OHSEPR is the lead in the Department for Health and Human Services (HHS) for human service preparation for, response to, and recovery from, natural disasters. The materials included in this request are necessary for OHSEPR to provide responsive disaster human services case management operations to support families that are currently displaced. The Administration for Children and Families (ACF) has updated the Disaster Human Services Intake Assessment Form to comply with Executive Order 14168, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government (Defending Women). Abstract

The U.S. Department of Health and Human Services (HHS) provides letters of certification to foreign national victims of severe forms of trafficking in persons under the authority of the Trafficking Victims Protection Act of 2000 (TVPA), as amended 22 U.S.C. Section 7105(b)(1)(C) and (E). HHS delegated this authority to the Administration for Children and Families (ACF) Office of Trafficking in Persons (OTIP). Certification is required for foreign national adult victims of human trafficking in the United States to apply for federally funded benefits and services. OTIP developed a form for potential victims and their advocates, including case managers, attorneys, law enforcement officers, service providers, and other representatives to provide the required information for certification to HHS in accordance with the TVPA of 2000, as amended. The Request for Certification of Adult Victims of Human Trafficking (RFC) form (formerly titled Trafficking Victims Tracking System) was renamed in order to create consistency between the RFC and Request for Assistance for Child Victims of Human Trafficking (RFA) forms (OMB Control Number 0970-0362). Request for Assistance for Child Victims of Human Trafficking

Key Information

Abstract

The Trafficking Victims Protection Act (TVPA) of 2000, as amended, directs the Secretary of the U.S. Department of Health and Human Services (HHS), upon receipt of credible information that a foreign national minor may have been subjected to a severe form of trafficking in persons and is seeking assistance available to victims of trafficking, to promptly determine if the child is eligible for benefits and services to the same extent as refugees. In 2015 HHS delegated this authority to the Office on Trafficking in Persons (OTIP). OTIP developed a form (Request for Assistance (RFA), OMB Control Number 0970-0362) for case managers, attorneys, law enforcement officers, child welfare workers, and other representatives to report these trafficking concerns to HHS in accordance with the TVPA of 2000, as amended, and allow for OTIP to review the concerns and determine eligibility for benefits. The information provided through the completion of the RFA form is essential for OTIP to make prompt determinations regarding a foreign national minor’s eligibility for assistance, to facilitate the required consultation process should the minor receive interim assistance, and to assess and address potential child protection issues. Without a form, OTIP would be limited to notifying potential requesters about the assistance the law permits and providing a phone number or email address at OTIP for further information. An OTIP Child Protection Specialist would then have to describe to each potential requester the information sought in the form, which would likely require multiple follow-up calls, and possibly multiple interviews with the child, which could re-traumatize the child. Furthermore, the absence of a form to collect information necessary to process a request for assistance could result in errors in the information collection causing a child that should be eligible for benefits and services as a victim of trafficking to be denied access to assistance. ACF has implemented changes to update gender collected data to denote sex as a biological variable in current approved information collection requests to comply with recent presidential directives.

State Court Improvement Program

Abstract

Authorizing legislation makes clear that an application is required in order for State courts to receive CIP funding. A copy of the statute is attached with this submission for review (Attachment A - SSA Section 438). There are two parts of the application, which are necessary to properly administer the State Court Improvement Program (CIP): an annual year-end self-assessment report with an updated strategic plan. A complete application is required from state courts every five years which includes the self-assessment and new strategic plan. Annually, the self-assessment should thoroughly be updated to reflect progress and challenges over the prior year. The strategic plan is to be written as a five-year plan which looks forward and is updated as needed annually. Because it is a high-level summary, and the two documents work in tandem, the primary burden annually is completing the more detailed self-assessment and updates to strategic plans are often minor notes that flow out of that review. These documents are required to monitor progress of the program according to statute. Both the self-assessment and strategic plan template were developed with in-depth grantee input and feedback. The goal has been to design a process and tools that meet reporting requirements but also serve as helpful documents to grantees in conducting their work. The Self-Assessment had one optional Diversity, Equity, Inclusion, and Accessibility question and one bulleted item in another question that we request be removed to comply with the above Executive Orders. The Strategic Plan template did not have any items relevant to the following Executive Orders: Ending Radical and Wasteful Government Diversity, Equity, and Inclusion Programs and Preferencing and Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government

ACF Performance Progress Report - Program Indicators

Key Information

Abstract

The Office of Grants Management (OGM), in the Administration for Children and Families (ACF) is proposing the continued collection of program performance data for ACF’s discretionary grantees. In 2016, OGM developed the ACF-OGM-SF-PPR-B to collect this data based on the basic template of the OMB-approved reporting format of the Program Performance Report. The form was renewed in 2019 with no changes. OGM now seeks to renew the ACF-OGM-SF-PPR-B for continued use by ACF with minor changes to improve the function of the form and utility to the federal government. This includes the addition of a program indicator to collect information on activities recipients conducted during the reporting period to address or advance equity. Addition of this program indicator supports the Biden-Harris Administration’s equity agenda as outlined in Executive Order 13985, Advancing Racial Equity and Support for Underserved Communities Through the Federal Government. Other minor updates are described in A15 of Supporting Statement A. The requirement for grantees to report on performance is OMB grants policy. Specific citations are contained in: (1) 2 CFR 215 Uniform Administrative Requirements, cost Principles, and Audit Requirements for Federal Awards and (2) 45 CFR 75, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Department of Health and Human Services Awards. The Office of Grants Management (OGM), in the Administration for Children and Families (ACF) is proposing to update the form used for the collection of program performance data for ACF’s discretionary grant recipients. In 2016, OGM developed the ACF-OGM-SF-PPR-B to collect this data based on the basic template of the OMB-approved reporting format of the Program Performance Report and has renewed approval since implementation. OGM has made updates to the instructions to ensure they are current and clear and revised a program indicator in response to Executive Order 14151, Ending Radical and Wasteful Government DEI Programs and Preferences. Collection of Encounter Data from MA Organizations, Section 1876 Cost HMOs/CMPs, MMPs, and PACE Organizations (CMS-10340)

Key Information

Abstract

CMS uses the risk adjustment data to develop individual risk scores for risk adjusted payment under Part C. As required by law, CMS also establishes the risk adjustment methodology and annually publishes the risk adjustment factors for MA organizations and other interested entities in the Advance Notice of Methodological Changes for MA Payment Rates (every February) and the Announcement of Medicare Advantage Payment Rates (every April). Risk adjustment data in particular is used to calibrate the CMS-HCC risk adjustment models using MA patterns of diagnoses, utilization, and expenditures. While establishing a risk adjustment model appropriate for the MA program is the paramount reason for collecting MA risk adjustment, there are other important uses of the data that will improve other key functions undertaken by CMS. Data is used for the calculation of Medicare Disproportionate Share Hospital (DSH) payments. CMS collects inpatient stay information for the Medicare managed care enrollees. In particular, we collect the admission date, discharge date, Health Insurance Claim Number (HICN), and Medicare hospital number/CCN. Further, we also use the data for quality review and improvement activities. For example, MA risk adjustment data may be used in the development and calculation of quality measures for MA organizations. Other uses for the data include geographical acuity studies, utilization trends and detection of abuse as defined in the False Claim Act. Additional uses for the data include verifying the accuracy and validity of the reasonable costs claimed on Cost Reports submitted by section 1876 Cost HMOs/CMPs and section 1833 HCPPs. Finally, as stated in the regulation, we use the data for Medicare coverage purposes. For example, we can use risk adjustment data for the determination of whether day limits have been exhausted and, if not, how many such days are left.

Abstract

The Personal Responsibility and Work Opportunity Re¬conciliation Act of 1996 (PRWORA) amended the Social Security Act and created the opportunity under §412 for Federally recognized Indian Tribes to design and operate their own Temporary Assistance for Needy Families (Tribal TANF) programs. Subject to approval by the Federal government of their plans, Tribes can receive block grants from the Federal government for this purpose (Tribal grantees). Indian Tribes and Tribal organizations are defined by PRWORA as having (except for Alaska) the meaning given such terms by section 4 of the Indian Self - Determina¬tion and Educa¬tion Assistance Act (25 U.S.C. 450b). For Alaska, the non-profit arms of the Alaskan Native Corporations and the Metlakatla Indian Community, Annette Island Reserve are specified as the only entities eligible to be Tribal TANF grantees. Section 412(g) of PRWORA imposed on Tribal grantees the data collection and reporting requirements of §411. Section 411(a)(1)(A) specifies the data items to be reported. Additional data collection requirements are imposed by §407 (work participation requirements) as modified by §412(c) ('negotiated' Minimum Work Participation Requirements and Time Limits) and §411(b) (Report to Congress). The data are used to assess Tribal TANF programs to determine if Tribal grantees have met their negotiated work participation rates and to meet Congressional mandated requirements of §411(a)(1)(A) of PRWORA. The data are also used to measure impacts of Tribal TANF for research and program improvement and to provide descriptions of the populations served, which are published annually on OFA’s website and in TANF’s annual report to Congress. Pursuant to the U.S. Office of Personnel Management (OPM) Initial Guidance Regarding Executive Order Defending Women provided on January 29, 2025, OFA proposes a few minor changes to the Tribal TANF Data Report Instructions to ensure alignment with OPM guidance. We are requesting expedited approval of these minor changes.

The need to communicate with DHS occurs when a newly referred child arrives at an ORR facility ill or requires emergent/urgent healthcare services shortly after placement and ORR was not notified in advance. For DHS to investigate the event, ORR must share confidential and sensitive health information including the child’s alien number, name, signs/symptoms, diagnoses, and date of diagnosis. The goal of this data sharing effort is to identify areas of potential improvement in delivery of healthcare services and continuity of care for children transferred from DHS to HHS custody. National Human Trafficking Hotline (NHTH) Performance Indicators

Key Information

Abstract

Section 107(b)(1)(B)(ii) of the Trafficking Victims Protection Act of 2000 (TVPA), as amended at 22 U.S.C. § 7105(b)(1)(B)(ii), authorizes the Secretary of Health and Human Services to make a grant for a national communication system—the National Human Trafficking Hotline (NHTH)—to assist victims of severe forms of trafficking in persons in seeking help, receiving referrals, and reporting potential trafficking situations. The Office on Trafficking in Persons (OTIP) made an award in the form of a Cooperative Agreement to a single, competitively selected grant recipient to maintain and support operation of the NHTH throughout the United States and U.S. territories. The NHTH is a toll-free hotline, that operates 24 hours a day, every day of the year. National Human Trafficking Hotline Performance Indicators (OMB #0970-0598) is an active and approved collection of aggregate information about signalers (individuals who contact the NHTH) and from signalers regarding potential victims of a severe form of trafficking in persons and potential human trafficking situations. The information collected is reported on a monthly, semi-annual, and annual basis, and is necessary to support the monitoring of work done through the cooperative agreement, to ensure signalers receive the information and support requested, and to provide appropriate technical assistance (TA) to the grant recipient. To address performance issues and streamline internal signal processing procedures, the NHTH has audited its data collection practices and has identified indicators that are no longer in use, relevant, or otherwise necessary that can be removed to reduce the data collection and reporting burden on Hotline Advocates, the individuals employed by the grant recipient organization to operate the NHTH. This process included efforts to collapse, condense, or otherwise simplify lists of data elements for clarity. Per the Supporting Statement, this information collection does not seek to collect any information from signalers (respondents) that they would not otherwise provide to Hotline Advocates in order to seek help, receive referrals, or report potential trafficking cases. None of the proposed changes impact front-end data collection, or the questions that Hotline Advocates ask to ascertain the purpose of a signal and the signaler’s desired response (i.e. to issue a referral or make a tip). By contrast, each of the proposed changes impact only the solely-awarded grant recipient and the changes are being informed by efforts by the recipient described above. This request aims to bring the collection into alignment with the grant recipient’s back-end data collection practices (i.e. what Hotline Advocates record in their case management database to summarize the signal and actions taken in response). Each of the changes proposed seek to improve data capture and data quality.

Abstract

The Chief Evaluation Office (CEO) of DOL seeks approval of this generic clearance to allow DOL to conduct a variety of formative data collections. Under this generic clearance, DOL would engage in a variety of formative data collections with researchers, practitioners, technical assistance providers, service providers and potential participants throughout the field to fulfill the following goals: (1) inform the development of DOL research, (2) maintain a research agenda that is rigorous and relevant, (3) ensure that research products are as current as possible and (4) inform the provision of technical assistance. DOL envisions using a variety of techniques including semi-structured discussions, focus groups, surveys, and telephone or in-person interviews in order to reach these goals. The findings from this data collection can inform and support future and current research but that are not highly systematic or intended to be statistically representative or otherwise generalizable.

Trafficking Victim Assistance Program (TVAP) Data

Abstract

The Trafficking Victims Protection Act of 2000 (TVPA), as amended, authorizes the Secretary of Health and Human Services (HHS) to expand benefits and services to foreign nationals in the United States who are victims of severe forms of trafficking in persons. Section 107(b)(1)(B)(i) of the TVPA of 2000, as amended, (22 U.S.C. § 7105(b)(1)(B)(i)) authorizes the Secretary of HHS to expand non-entitlement benefits and services to victims of severe forms of trafficking in persons in the United States and their family members with derivative T visas. It further states that such benefits and services “may include services to assist potential victims of trafficking in achieving certification and to assist minor dependent children of victims of severe forms of trafficking in persons or potential victims of trafficking.” Acting under a delegation of authority from the Secretary of HHS, the Administration for Children and Families (ACF), Office on Trafficking in Persons (OTIP) funds time-limited comprehensive case management services to foreign national adult confirmed and potential victims of a severe form of human trafficking, as defined by the TVPA of 2000, as amended, who are seeking or have received HHS certification. The Trafficking Victim Assistance Program (TVAP) must also establish local regional presence to coordinate project activities and direct services. Case management services must be provided to qualified persons directly by full-time case managers that are staffed by the prime recipient and may also be provided through a network of per capita service providers, which provide direct services and community referrals. TVAP is currently inclusive of three distinct award programs: the Trafficking Victim Assistance Program , Aspire: Child Trafficking Victim Assistance Demonstration Program, and Lighthouse: Services, Outreach, and Awareness for Labor Trafficking (Lighthouse) Demonstration Program. The performance indicators and data collection instruments under OMB #0970-0467 apply to all three TVAP programs. The primary objective of OTIP’s victim assistance programs, including TVAP, is to provide comprehensive, culturally and linguistically responsive case management to individuals who have experienced a severe form of trafficking in persons. Current TVAP recipients have reported concerns over competing requirements and priorities under their awards, which made it difficult to balance direct service provision against training activities for community-based providers and members of the general public. Grant recipients have also cited concerns over the lack of foundational knowledge within their communities as to what constitutes human trafficking victimization, which has impacted their ability to identify potential victims and connect those individuals with services. Beginning in FY 2024, so as to reduce reporting burden on recipients and strengthen public awareness within the geographic service areas where recipients implement their programs, training is no longer required or an allowable activity under TVAP. These updated requirements pertaining to allowable and required programmatic activities were made public through the most recent NOFOs and grant award processes and are already in effect. As such, we are requesting to remove the training indicators from OMB #0970-0467 and to make a minor update to the Outreach form for recipients to report on their public awareness activities. Additionally, based on information about clients served during FY 2022, we are requesting an update to the Client Case Closure form. ACF has implemented changes to update gender collected data to denote sex as a biological variable in current approved information collection requests to comply with recent presidential directives.

Abstract

FERC-505 includes applications, notices of intent, and related information collection activities for: • Small hydropower project licenses and relicenses; • Exemptions; and • Determinations of a qualifying conduit hydropower facility. Small hydropower projects are minor water power projects and major water power projects that have an installed capacity of 10 MW or less. They may be licensed under Part I of the Federal Power Act, but some small hydropower projects may be eligible for an exemption. There are two types of FERC hydropower exemptions: (1) exemptions for qualifying conduit hydropower facilities; and (2) exemptions for small projects of 10 MW or less. A qualifying conduit hydropower facility, as defined in section 30 of the FPA, is an existing or proposed hydroelectric facility that utilizes for electric power generation the hydroelectric potential of a conduit, or any tunnel, canal, pipeline, aqueduct, flume, ditch, or similar manmade water conveyance that is not primarily used for the generation of electricity. A Notice of Intent to Construct Qualifying Conduit Hydropower Facilities under 18 CFR 4.401, which is discussed above, is required in order to seek a determination by the Commission that the proposed facility is in accordance with criteria listed at section 30 of the FPA. If the Commission issues such a determination, the facility is not required to be licensed or exempted by the Commission under Part I of the FPA. A 10-MW exemption, as defined in section 405(d) of PURPA, is a project that utilizes for electric generation the water potential of either an existing non-federal dam or a natural water feature (e.g., natural lake, water fall, gradient of a stream, etc.) without the need for a dam or man-made impoundment. The respondents for this information collection include citizens of the United States, corporations organized under the laws of United States or any State thereof, State governments, and municipalities.

Abstract

The U.S. Repatriation Program (Program) is authorized by Section 1113 of the Social Security Act (42 U.S.C. § 1313) and the assistance provided to mentally ill repatriates found under 24 U.S.C. §§ 321 - 329. This Program also provides services for emergency repatriations which are authorized under Section 1113 and by the extension of the Executive Order (E.O.) precedent, E.O. 12656 (53 CFR 47491). Program regulations are in 45 CFR 211 & 212. The current collection includes eight forms with translations in six languages. The information collected through these forms allows the Office of Human Services Emergency Preparedness and Response (OHSEPR) to fulfill its statutory responsibilities to provide temporary assistance to repatriates. The Program also provides training and technical assistance to states and territories for routine and emergency repatriation. Additionally, OHSEPR provides funding to states for emergency repatriation planning, training, and exercises. The Administration for Children and Families (ACF) has updated two of the fourteen forms (RR-01 Emergency Repatriation Eligibility Application and RR-05 – Repatriation Repayment and Privacy Agreement) to comply with Executive Order 14168, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government (Defending Women). The remaining twelve forms are already in compliance and do not require changes.
