What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Currently, for pipelines, it takes days for a batch of crude oil to cross the United States border from Canada and eventually travel to the entry point within the United States, leaving no easily identifiable starting point for monitoring timely entry and entry summary filings. Moreover, Canadian crude oil is actively traded as a commodity while in transit though the North American pipeline network, so ownership (and thus the right to make entry) may not be known to CBP until after the commodity crosses the U.S. border. Further, the need for confidentiality of transactional data among private parties, means there are limitations on CBP’s, and the trade’s, visibility into product origin traceability through the supply chain to establish Free Trade Agreement (FTA) eligibility. The current absence of a technology capable of tracking changes in ownership and destination of pipeline-borne goods, from wellhead to refinery, has resulted in CBP creating a patchwork of local policies for data collection from carriers and importers over the course of five decades. Under the auspices of the Department of Homeland Security (DHS) Science and Technology Directorate’s (S&T) Silicon Valley Innovation Program (SVIP), with the endorsement of the Commercial Customs Operations Advisory Committee (COAC), and at the suggestion of the COAC's Pipeline Working Group (PWG), industry and CBP Subject Matter Experts conducted three and a half years of joint development with a cohort of SVIP software companies. They determined that entry summary data derived from private party transactions using a common platform of emergent technologies, which passes this data to CBP using the same platform, represents a viable means of regulating continuous flow commodities on a pipeline network. The new platform will consist of decentralized Identifiers (DIDs) and verifiable credentials (VCs), secured, exchanged and rendered to CBP’s Automated Commercial Environment (ACE) in accordance with Global Interoperability Standards (GIS). In CBP’s first operational use of GIS data, an SVIP cohort company will identify legitimate products and associated companies to build a transparent supply chain for pipeline-borne crude oil imported from Canada. This will enable recordation of bi-lateral transaction data at each step in a supply chain, secure it from disclosure to unauthorized parties, allow dynamic updates of ownership and destination information, and render these data to CBP in real time while creating an immutable chain of custody from wellhead to refinery. In addition to potentially eliminating all port level paper processes, adoption of these technologies could create a revolutionary automation environment in which pre-arrival data collection, in-bond tracking, and Free Trade Agreement compliance traceability – the business process goals of the PWG – are achieved as a matter of course. Therefore, the purpose of the requested pilot is to test the usefulness of supplying GIS data to ACE technology with a view toward resolving existing and anticipated issues, and by eventually, if the pilot is successful, changing existing policy and regulations to implement the new policies and regulations. This collection of information is authorized by 19 USC 1411 National Customs Automation Program.

Abstract

Title 38 U.S.C. Section 4322 of USERRA authorizes the Secretary of Labor (through the Veterans' Employment and Training Service) to investigate claims by individuals who believe their USERRA rights have been violated. The information is used to determine eligibility of veterans complaints to reemployment rights they are seeking as well as to state alleged violations by employers of the pertinent statutes and request assistance in obtaining appropriate reemployment benefits. The Veterans Employment Opportunities Act (VEOA) of 1998, P.L. 105-339, 112 Stat. 3182, contained in Title 5 U.S.C. § 3330a-3330(b), provides assistance to preference eligible individuals who believe their rights under the veterans' preference (VP) laws and the Veterans Benefit Improvement Act of 2008 (Public Law No: 110-389) have been violated. Section 3 of the VEOA provides the Secretary of Labor similar authority to investigate complaints brought by preference eligibles. The collection instrument completed by claimants contains the information required and needed for the Department to determine initial eligibility of the claimant.

Key Information

Abstract

The Environmental Protection Agency (EPA or the Agency) intends to initiate a new voluntary information collection for chemical industry research involving focus groups, one-on-one interviews, and other structured discussions to provide more comprehensive and accurate information to inform the risk evaluation and risk management of existing chemicals as required under section 6 of the Toxic Substances Control Act (TSCA). In 2016, the Frank R. Lautenberg Chemical Safety for the 21st Century Act (LCSA), which updated TSCA, was signed into law. Under TSCA, EPA must prioritize chemical substances for risk evaluation; conduct risk evaluations to determine whether chemical substances present unreasonable risk; and manage any unreasonable risks found to be presented, all under strict statutory deadlines. Many of these chemicals may have multiple conditions of use that fall under EPAs authority under TSCA. Under TSCA, for each chemical substance evaluated, EPA must evaluate hazards and exposures. The purpose of this ICR is to help fill data gaps for EPAs risk evaluations and risk management of existing chemicals under section 6 of TSCA. In accordance with TSCA section 26, EPA must make TSCA section 6 risk evaluation and risk management decisions consistent with the best available science and based on the weight of the scientific evidence. To carry out its statutory obligations, EPA needs sufficient information about chemicals undergoing risk evaluation and risk management, including information related to the chemicals conditions of use, hazards, exposures, potentially exposed or susceptible sub-populations, health and environmental effects, benefits, reasonably ascertainable economic consequences, alternatives, and other information. The collection of such information is subject to TSCAs strict statutory time frames (set forth in section 6). Therefore, EPA is seeking approval for a generic information collection request (ICR) to conduct interviews and focus groups of chemical users, processors, distributors, manufacturers (including importers), and recyclers, chemical waste handlers, consumers of chemical-containing products, employees who may be exposed to the chemical evaluated, state and local regulators, non-governmental organizations, industry experts, and knowledgeable members of the public (including potentially exposed or susceptible sub-populations) related to information collection for TSCA chemical risk evaluation and risk management. As appropriate, under this ICR EPA would collect data in several ways, such as interviews and focus groups. This research would consist of open-ended structured discussions or interviews with individuals or small groups of individuals, and therefore can provide in-depth information. These information collection efforts are intended to supplement other reasonably available information on chemicals in commerce and will provide support for the Agencys policy and regulatory activities regarding existing chemicals under TSCA section 6. Data collected under this generic clearance may be used in several ways during the risk evaluation and risk management processes, including establishing generic scenarios, developing models of various conditions of use of chemicals evaluated under TSCA or their alternatives, pretesting survey questions, and providing important context for publicly available information already available to EPA. By learning more about the conditions of use, hazards, exposures, potentially exposed or susceptible sub-populations, health and environmental effects, benefits, reasonably ascertainable economic consequences, alternatives, and other information for chemicals being evaluated or regulated, EPA would be able to more precisely and effectively carry out its risk evaluation and risk management obligations under TSCA.

The Job Openings and Labor Turnover Survey (JOLTS) collects data on job vacancies, labor hires, and labor separations. The data can be used as demand-side indicators of labor shortages. These indicators of labor shortages at the national level greatly enhance policy makers' understanding of imbalances between the demand and supply of labor. Presently there is no other economic indicator of labor demand with which to assess the presence of labor shortages in the U.S. labor market. The availability of unfilled jobs is an important measure of tightness of job markets, symmetrical to unemployment measures.

Key Information

Abstract

The Survey of Occupational Injuries and Illnesses is the primary indicator of the Nation's progress in providing every working man and woman safe and healthful working conditions. The survey measures the overall rate of work injuries and illnesses by industry. Survey data are also used to evaluate the effectiveness of Federal and State programs and to prioritize scarce resources. Respondents include employers who maintain Occupational Safety and Health Administration (OSHA) records in accordance with the Occupational Safety and Health Act and employers who are normally exempt from OSHA recordkeeping. Each year a sample of exempt employers is required to keep records and participate in the survey.

Nonprofit Research and Education Corporations (NPCs) - Annual Report, Remediation Plans & Assessment Questionnaires

Abstract

Title 38 U.S.C. Section 7366, Accountability and Oversight, states “(b) each such corporation (NPC) shall submit to the Secretary (Department of Veterans Affairs (DVA)) an annual report providing a detailed statement of its operations, activities, and accomplishments during that year.” The individual NPC annual reports are combined into one NPC Annual Report to Congress. VA oversight of NPCs includes reviews, audits, self-assessments, and remediation plans. This information collection is used for oversight of NPCs and includes the following: The NPC Annual Report Template, VA Form 10-10073 Since 1988, when the enabling legislation for the NPCs was passed, annual reports have been obtained from each NPC and combined into an NPC Annual Report to Congress. Congress uses the combined NPC Annual Report to Congress to monitor the progress of the overall NPC program it created. The NPC Annual Report to Congress is also used by top-level VA executives to evaluate the program and to recommend changes where needed. VHA’s Nonprofit Oversight Board and the Nonprofit Program Office use both the combined NPC Annual Report to Congress and the individual NPC Annual Report Templates to monitor and oversee the NPCs. Trend analyses and other financial information are analyzed for each NPC and judgments made about each NPC’s progress, financial viability, stewardship of assets, and accomplishments. Abstract

The Bureau of Labor Statistics' Behavioral Science Research Center (BSRC) conducts psychological research focusing on the design and execution of the data collection process in order to improve the quality of data collected by the Bureau. The BSRC conducts research aimed at improving data collection quality by assessing questionnaire/form management and administration, as well as issues which relate to interviewer training and interaction with respondents in the interview process. BSRC staff work closely with economists and/or program specialists responsible for defining the concepts to be measured by the Bureau of Labor Statistics' collection programs. The proposed laboratory research will be conducted from Fiscal Year (FY) 2024 through FY 2027 to enhance data quality in the Bureau of Labor Statistics' surveys. Improvements will be made by examining psychological and cognitive aspects of BLS's data collection procedures, including questionnaire design, interviewing procedures, collection modalities, and administrative technology.

Section 2(h)(1)(A) of the Commodity Exchange Act requires certain counterparties to submit for clearing certain swaps if they are required to be cleared by the Commission. Commission regulation 50.52 permits certain affiliated entities to elect not to clear certain inter-affiliate swaps that otherwise would be required to be cleared, provided that they meet certain conditions. The rule further requires the reporting of certain information if the inter-affiliate exemption is elected. This collection pertains to information the Commission needs to monitor use of the exemption and assess market risk in connection therewith.
