What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Director of the USPTO has the authority to establish regulations governing the conduct and discipline of agents, attorneys, or other persons representing applicants and other parties before the USPTO (35 U.S.C. 2 and 32–33). The USPTO Rules of Professional Conduct, set forth in subpart D, part 11 of title 37 of the Code of Federal Regulations, prescribe the manner in which agents, attorneys, and other persons (collectively "practitioners") representing applicants and other parties before the USPTO should conduct themselves professionally. Part 11 outlines practitioners’ responsibilities for recordkeeping and reporting violations or complaints of misconduct to the USPTO. Subpart C of part 11 sets forth the manner by which the USPTO investigates misconduct and imposes discipline. The USPTO Rules of Professional Conduct require a practitioner to maintain complete records of all funds, securities, and other properties of clients coming into his or her possession, and to render appropriate accounts to the client regarding the funds, securities, and other properties of clients coming into the practitioner’s possession, collectively known as ‘‘client property.’’ These recordkeeping requirements are necessary to maintain the integrity of client property. State bars require attorneys to perform similar recordkeeping. Part 11 also requires a practitioner to report knowledge of certain violations of the USPTO Rules of Professional Conduct to the USPTO. The Director of the Office of Enrollment and Discipline (OED) may, after notice and opportunity for a hearing, suspend, exclude, or disqualify any practitioner from further practice before the USPTO based on non-compliance with the USPTO Rules of Professional Conduct. Practitioners who have been excluded or suspended from practice before the USPTO, practitioners transferred to disability inactive status, and practitioners who have resigned must keep and maintain records of their steps to comply with the suspension or exclusion order, transfer to disability inactive status, or resignation. These records are necessary to demonstrate eligibility for reinstatement. Reports of alleged violations of the USPTO Rules of Professional Conduct are used by the Director of OED to conduct investigations and disciplinary hearings, as appropriate. This information collection covers the various reporting and recordkeeping requirements set forth in Part 11 for practitioners representing applicants and other parties before the USPTO. Also covered are petitions for reinstatement for suspended or excluded practitioners and the means for reporting violations or complaints of misconduct to the USPTO.

Analysis of Exoskeleton-Use for Enhancing Human Performance Data Collection

Key Information

Abstract

Exoskeletons – sometimes called wearable robots – are a very rapidly expanding domain with a range of applications and a broad diversity of designs. NIST’s Engineering Laboratory will be developing methods to evaluate performance of exoskeletons in two key areas 1) The fit and motion of the exoskeleton device with respect to the users’ body and 2) The impact that using an exoskeleton has on the performance of users executing tasks that are representative of activities in industrial settings and emergency response applications. The results of these experiments will inform future test method development at NIST, other organizations, and under the purview of the American Society for Testing Materials (ASTM) Committee F48 on Exoskeletons and Exosuits. For the first research topic, NIST will evaluate the usefulness of a NIST prototype apparatus for measuring the difference in performance of a person wearing an exoskeleton versus the person’s baseline without the exoskeleton while positioning loads and tools. The NIST Position and Load Test Apparatus for Exoskelons (PoLoTAE), which presents abstractions of industrial task challenges, will be evaluated in this research. Abstract

The mission of the Veterans Health Administration (VHA) is to provide high quality medical and dental care to eligible Veterans. Executive Order 12862, dated September 11, 1993, calls for the establishment and implementation of customer service standards, and for agencies to “survey customers to determine the kind and quality of services they want and their level of satisfaction with current services.” The overall purpose of the VHA Office of Dentistry Dental Patient Satisfaction Survey is to systematically obtain information from patients that can be used to identify problems or complaints that need attention and to improve the quality of dental health care services delivered to Veterans. The Office of Dentistry (OOD) currently tracks a number of clinical parameters indicative of quality care (e.g., appropriate use of fluoride products in high caries risk patients, frequency of dental examinations and care provided to medically compelling patients); however, patient satisfaction with this care is not specifically measured. Information obtained from this dental survey will be made readily available to VA Central Office (VACO), Veterans Integrated Service Network (VISN), VHA field staff, and stakeholders as part of the Network Performance Report and via the VA Intranet. This data will be used to demonstrate that VA is providing timely, high quality health care services to patients and to measure improvement toward performance goals. The VHA program office has now included an electronic version of the survey, which is ready to be implemented as an online option for collecting survey responses. Also, changes were made to some survey questions, including updates to the Race & Ethnicity options to reflect current collection requirements.

As a result of GSA actively pursuing technical alternatives to the collection of this information for all non-federal entities, GSA seeks to refine the requirement previously adopted, where a risk-based approach was used to justify the collection of the entity administrator appointment letter (EAAL) for all new entities, and only employ this method to establish an Entity Administrator to an existing entity where the previous administrator is no longer on staff. This information is essential to GSA's acquisition mission to meet the needs of all federal agencies, as well as the needs of the grant community. A key element of GSA's mission is to provide efficient and effective acquisition solutions across the Federal Government. SAM is essential to the accomplishment of that mission. In addition to federal contracts, federal assistance programs also rely upon the integrity and security of the information in SAM. Without assurances that the information in SAM is protected and is at minimal risk of compromise, GSA would risk losing the confidence of the federal acquisition and assistance communities that it serves. As a result, some entities may prefer not to do business with the federal government. GSA established an Information Collection Request (ICR) to collect additional information to support increased validation of entities registered in the System for Award Management (SAM). This additional information is contained in a notarized letter in which an officer or other signatory authority of the entity formally appoints the administrator for the entity when an administrator is not available to perform that function for that entity. The original, signed letter is submitted electronically to the Federal Service Desk (FSD) for SAM when an administrator needs to be appointed for an existing entity. GSA is actively pursuing technical alternatives to the collection of this information for all non-federal entities. GSA seeks to refine the requirement and adopt a risk-based approach. Abstract

Public Law 113–227 (Dec. 16, 2014) requires the United States Patent and Trademark Office (USPTO) to establish regulations and procedures for application to, and participation in, the USPTO Law School Clinic Certification Program (LSCCP). The LSCCP Program allows students enrolled in a participating law school’s clinic to practice patent or trademark law before the USPTO under the direct supervision of a faculty clinic supervisor. Each clinic provides legal services on a pro bono basis for clients who qualify for assistance from the law school’s clinic. By drafting, filing, and prosecuting patent and trademark applications, students gain valuable experience that would otherwise be unavailable to them while in law school. The program also facilitates the provision of pro bono services to trademark and patent applicants who lack the financial resources necessary for traditional legal representation. In 2020, there were 60 law schools participating. This information collection covers the applications from law schools that wish to enter the program, faculty advisors who seek to become a faculty clinic supervisor, and students who seek to participate in this program. The information collection also includes the required biannual reports from participating law school clinics and biennial renewals required by the program as well as the request to make special under the Law School Clinic Certification Program, which allows a limited number of applications per semester to be advanced out of turn (accorded special status) for examination if the applicant makes the appropriate showing, to provide law students with practical experience as they will be more likely to receive substantive examination of applications within the school year that the application is filed.

Abstract

Pursuant to sections 14(a) and (g) of the Consumer Product Safety Act (CPSA), 15 U.S.C. §§ 2063(a) and (g), the U.S. Consumer Product Safety Commission (CPSC) requires products subject to a consumer product safety rule under the CPSA or a similar rule, ban, standard, or regulation under any other statute enforced by the Commission, and which are imported for consumption or warehousing or distributed in commerce, to be accompanied by a certificate of compliance (certificate). . Manufacturers, including importers, and private labelers of privately labeled products, must issue certificates in the form of either a General Certificate of Conformity (GCC) for a non-children’s product or a Children’s Product Certificate (CPC) for a children’s product. 15 U.S.C. § 2063(a). Sections 14(a) and (g) of the CPSA set forth requirements for the content, form, and availability certificates, which are further implemented by the Commission’s rule on certificates at 16 C.F.R. part 1110. The Commission’s final rule to revise part 1110 aligns CPSC’s current certificates rule with other CPSC rules on testing and certification, and implements, for importation of products and substances regulated by CPSC, electronic filing of certificates (eFiling) with U.S. Customs and Border Protection (CBP) at the time of entry. This information collection implements the PRA requirements associated with the revised part 1110, including eFiling.

Abstract

49 CFR Part 192 Subpart N and Part 195 SubPart G require all individuals who operate and maintain pipeline facilities to be qualified and keep records of qualification. The purpose of this mandatory information collection request is to ensure compliance with the record keeping requirements prescribed in the federal pipeline safety regulations. Pipeline operators must make and maintain the records as described and have those records available for compliance inspection by PHMSA staff upon request. Examples of such records include the identification of qualified individuals; identification of covered tasks; dates of current qualification; and qualification methods. Records supporting an individual's current qualification shall be maintained while the individual is performing the covered task. Records of prior qualification and records of individuals no longer performing covered tasks shall be retained for a period of five years.

Title 13, United States Code, section 196 authorizes the Census Bureau to conduct Special Censuses on a cost reimbursable basis for the government of any state, county, city, or other political subdivision. This includes the District of Columbia, American Indian Reservations, Alaska Native villages, Puerto Rico, the U.S. Island Areas, and other Governmental Units that require current population data between decennial censuses. A full Special Census is a basic enumeration of population, housing units, group quarters, and units at transitory locations for an area entirely within the jurisdiction of a local Governmental Unit requesting the Special Census. A partial Special Census is conducted using the same methodologies and procedures as a regular or full Special Census, but it is for a subset of areas within the jurisdiction of the local Governmental Unit. The areas requested in a partial Special Census must contain at least one full tract that is completely within the jurisdiction of the Governmental Unit and can contain additional contiguous tracts or blocks. For example, Governmental Units may choose to conduct a partial Special Census with just those tracts that might have experienced a large population growth or a boundary change.

This information collection request would require pipeline operators to develop and implement public awareness programs. The public awareness programs should establish communications and provide information necessary to enhance public understanding of how pipelines function and the public's role in promoting pipeline safety. This mandatory, annual reporting and record keeping collection requires operators to submit their completed programs to PHMSA or, in the case of an intrastate pipeline facility operator, the appropriate State agency. The operator's program documentation and evaluation results must also be available for periodic review by appropriate regulatory agencies. Abstract

The National Registry of Pipeline and LNG Operators serves as the storehouse for the reporting requirements for an operator regulated or subject to reporting requirements under 49 CFR Parts 192, 193, or 195. This mandatory information collection would require jurisdictional pipeline operators to submit the required data to register with the National Registry of Pipeline and LNG Operators and notify PHMSA when they experience significant asset changes, including new construction, that affect PHMSA’s ability to accurately monitor and assess pipeline safety performance. Certain types of changes to, or within, an operator’s facilities or pipeline network represent potential safety-altering activities for which PHMSA may need to inspect, investigate, or otherwise oversee to ensure that any public safety concerns are adequately and proactively addressed. The forms for assigning and maintaining Operator Identification (OPID) information are the Operator Assignment Request Form (PHMSA F 1000.1) and Operator Registry Notification Form (PHMSA F 1000.2). The purpose of this information collection is to maintain an accurate assessment of the nation’s pipeline infrastructure and to be kept abreast of conditions that could potentially compromise the safety and economic viability of the U.S. pipeline system.
