Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

In order to implement section 3507 of the National Defense Authorization Act of 2018, Public Law 115-91 (the “Act”), codified at 46 United States Code (U.S.C.) 51706 (previously designated as 46 U.S.C. 54102), MARAD developed a procedure to recommend to the Secretary the designation of eligible institutions as Centers of Excellence (CoE) for Domestic Maritime Workforce Training and Education. Pursuant to the Act, the Secretary of Transportation may designate certain eligible and qualified training entities as CoEs. Authority to administer the CoE program is delegated to MARAD in 49 Code of Federal Regulations (CFR) 1.93(a). The previously approved policy for collecting information is required to administer the Center of Excellence program which supports the DOT strategic goal of Economic Competitiveness, and the MARAD strategic goal to Maintain and Modernize the Maritime workforce.

Abstract

This is a request for nonmaterial/non-substantive changes to clarify the meaning/intent of questions in both the Five Year Regional Workplace template and the Cooperative Agreement Workplan template.. The nonmaterial/non-substantive changes should not affect or lessen the burden in completing the forms. As some of the questions on both template were replaced with others; edited for clarity; or removed. In addition, the forms were transferred from WORD documents to a REDCap-based format, for ease of data entry by the respondents and collection by CDC’s program office. The REDCap-based form can easily export data either into EXCEL or PDF formats for comprehensive analysis by the program. There is no change in burden.

Abstract

The 2021 Consolidated Appropriations Act, Div. L, Title II - HUD Appropriations Act, 2021, provided $20,000,000 for competitive grants to nonprofit or governmental entities to provide legal assistance (including assistance related to pretrial activities, trial activities, post-trial activities and alternative dispute resolution) at no cost to eligible low-income tenants at risk of or subject to eviction. The collection of information in association with the Notice of Funding Opportunity (NOFO) will be used by the Office of Policy Development and Research to meet its program monitoring obligations under the Act, including ensuring that eligible tenants living in rural areas are served. The House of Representatives Explanatory Statement of the Consolidated Appropriations Act, 2021 Congressional Record 166, no. 218, book IV, at H8828, December 21, 2020, further emphasized the importance of implementing and overseeing this grant as a “demonstration program.” Accordingly, the collection of information enables HUD to meet its research and demonstration obligations under the Housing and Urban Development Act of 1970, section 501 (12 U.S.C. § 1701z-1) for this new program. This revision is being submitted because ongoing program execution has revealed grantee reporting questions and challenges, and the need for additional standardization, fillable formats, and data point clarifications and revisions. The forms are also revised to integrate the new Office of Management and Budget (OMB) race and ethnicity data standards. HUD is also seeking approval to implement a revised version of HUD Form 52698 and three additional forms. While these forms will require additional time to complete, they are expected to reduce confusion and corrections of administrative requirements, benefitting both HUD and grantees.

NOAA Competitive Research Program (CRP) Grants Proposal Application Package

Abstract

This request is for a revision and extension of a currently approved information collection. The National Oceanic and Atmospheric Administration’s Coastal Ocean Program (COP) now known as the Competitive Research Program (CRP) under the National Centers for Coastal Ocean Science provides direct financial assistance through grants and cooperative agreements for research supporting the management of coastal ecosystems and the NOAA Restore Science Program. The statutory authority for COP is P.L. 102-567, Section 201 (Coastal Ocean Program). NOAA was authorized to establish and administer the Restore Science Program, in consultation with the U.S. Fish and Wildlife Service, by the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies (RESTORE) of the Gulf States Act of 2012 (Public Law 112-141, Section 1604). Identified in the RESTORE Act as the Gulf Coast Ecosystem Restoration Science, Observation, Monitoring, and Technology Program, the Program is commonly known as the NOAA RESTORE Science Program (RSP). In addition to standard government application requirements, applicants for financial assistance for both programs are required to submit a project summary form, current and pending form, and a Data Management form template. The Data Management form template is a new addition to the application package. Data Management is a required element of the application package and the use of this form the will reduce the public burden by providing a specific format instead of requiring each applicant to create their own format. The Key Contacts form has been removed from the collection. CRP recipients are required to file annual progress reports and a project final report using CRP formats. The RSP recipients are required to file semiannual progress reports, a final report and a Gantt chart showing project milestones using RSP formats. All of these requirements are needed for better evaluation of proposals and monitoring of awards.

Abstract

This ICR covers reporting and recordkeeping requirements associated with EPAs workplace standards for the protection of state and local government employees who work with asbestos and who are not covered by a state plan approved by the Occupational Safety and Health Administration. Currently, some 23 states and state equivalent territories have reporting and recordkeeping requirements under the Toxic Substances Control Act, Section 8, documenting worker protection actions for state and local government employees involved in asbestos work. EPA's asbestos work protection regulations incorporate, by reference, the OSHA Construction Industry Standard for Asbestos, and the General Industry Standard for Asbestos. EPA does not collect any information under this collection. All information subject to this collection request is to be gathered and maintained by the employer.

Abstract

The New Source Performance Standards (NSPS) for the regulations published at 40 CFR Part 60, Subpart J were proposed on June 11, 1973; promulgated on March 8, 1974; and amended on both September 12, 2012, and December 1, 2015. These regulations apply to affected facilities at petroleum refineries that were constructed, modified or reconstructed on or before May 14, 2007. The affected sources are: 1) fluid catalytic cracking unit (FCCU) catalyst regenerator or fuel gas combustion device (FGCD) other than a flare that commenced construction, reconstruction or modification after June 11, 1973 and on/or before May 14, 2007; 2) FGCD that is also a flare that commenced construction, reconstruction or modification after June 11, 1973 and on/or before June 24, 2008; or 3) any Claus sulfur recovery plant with a design capacity of more than 20 long tons per day sulfur feed which commenced construction, reconstruction or modification after October 4, 1976 and on/or before May 14, 2007. These regulations also apply to flares which commenced construction, modification, or reconstruction on/or before June 24, 2008. At the time of this ICR renewal, all refinery flares are subject to the NSPS Subpart Ja requirements. This information is being collected to assure compliance with 40 CFR Part 60, Subpart J. In general, all NSPS standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility or any period during which the monitoring system is inoperative. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to NSPS.

Abstract

Title 30 CFR 57.22004(c) requires operators of underground M/NM mines to notify the Mine Safety and Health Administration (MSHA) as soon as possible if any of the following events occur: (a) there is an outburst that results in 0.25 percent or more methane in the mine atmosphere, (b) there is a blowout that results in 0.25 percent or more methane in the mine atmosphere, (c) there is an ignition of methane, or (d) air sample results indicate 0.25 percent or more methane in the mine atmosphere of a I-B, I-C, II-B, V-B, or Category VI mine. Under §§ 57.22239 and 57.22231, if methane reaches 2.0 percent in a Category IV mine or if methane reaches 0.25 percent in the mine atmosphere of a Subcategory I-B, II-B, V-B, or VI mine, MSHA shall be notified immediately. Although the standards do not specify how MSHA is to be notified, MSHA anticipates that the notifications would be made by telephone. Title 30 CFR 57.22229 and 57.22230 require that the mine atmosphere be tested for methane and/or carbon dioxide at least once every seven days by a competent person or atmospheric monitoring system or a combination of both. Section 57.2229 applies to underground M/NM mines categorized as I-A, III, and V-A mines where the atmosphere is tested for both methane and carbon dioxide. Section 57.22230 applies to underground M/NM mines categorized as II-A mines where the atmosphere is tested for methane. Where examinations disclose hazardous conditions, affected miners must be informed. Title 30 CFR 57.22229(d) and 57.22230(c) require that the person performing the tests certify by signature and date that the tests have been conducted. Certifications of examinations shall be kept for at least one year and made available to authorized representatives of the Secretary of Labor.

Division G, Title I of the Consolidated Appropriations Act, 2021 (Public Law No. 116–260), annual appropriation bill for the Department of the Interior, has prevented the BLM from processing mineral patent applications unless the applications were grandfathered under the initial legislation. While grandfathered applications are rare at present, the approval to collect the information continues to be necessary because of the possibility that the moratorium will be lifted and applicable regulations that contain the information are still part of the Code of Federal Regulations. Therefore, the Bureau of Land Management (BLM) is requesting that OMB renew this OMB control number of an additional three (3) years.

Key Information

Abstract

The Telemarketing Sales Rule requires certain disclosures in telemarketing calls for the sale of goods or services or the solicitation of charitable contributions by sellers and/or telemarketers. The disclosures provide consumers or prospective donors with information necessary to make informed decisions. The Final Rule newly requires inbound tech support calls (calls that consumers make in response to an advertisement through any medium or to a direct mail solicitation) to comply with the Rule’s recordkeeping and disclosure requirements. The Final Rule and these associated information collections are necessary in light of the widespread deception and consumer injury caused by tech support scams. The Final Rule provides the Commission with the ability to obtain stronger relief in cases involving tech support scams, including civil penalties and consumer redress.

Abstract

The Ike Skelton National Defense Authorization Act for Fiscal Year 2011 (FY11), Section 702, aligns TRICARE Program eligibility by providing a means to extend the age of eligibility of TRICARE dependents from age 21 or 23 up to age 26 to allow the purchase of extended dependent medical coverage across existing TRICARE program options (Standard, Extra, and Prime). This is consistent with the intent of the Patient Protection and Affordable Care Act, the implementing Health and Human Services regulations, and the limitations of Chapter 55 of Title 10. Information gathered through this collection will be used by the regional managed care support contractors to process the applications to start, change, or terminate TRICARE Young Adult coverage.

Diesel-Powered Equipment in Underground Coal Mines

Key Information

Abstract

MSHA requires mine operators to provide important safety and health protections to underground coal miners who work on and around diesel-powered equipment. The engines powering diesel equipment are potential contributors to fires and explosion hazards in the confined environment of an underground coal mine where combustible coal dust and explosive methane gas are present. Diesel equipment operating in underground coal mines also can pose serious health risks to miners from exposure to diesel exhaust emissions, including diesel particulates, oxides of nitrogen, and carbon monoxide. Diesel exhaust is a lung carcinogen in animals. This information collection includes maintenance and use of diesel equipment; tests and maintenance of fire suppression systems on both the equipment and at fueling stations; and exhaust gas sampling. Records are required to document that essential testing and maintenance of diesel- powered equipment are conducted regularly by qualified persons; that corrective actions are taken; and the persons performing the maintenance, repairs, examinations, and tests are trained and qualified to perform such tasks. Safety requirements for diesel equipment include many of the proven features required in existing standards for electric-powered mobile equipment, such as cabs or canopies, methane monitors, brakes and lights. Sampling of diesel exhaust emissions is required to protect miners from overexposure to carbon monoxide and nitrogen dioxide contained in diesel exhaust.
