Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

State SNAP Agency NDNH Matching Program Performance Report

Key Information

Abstract

State agencies that administer Supplemental Nutrition Assistance Programs (SNAP) are mandated by federal law to participate in a computerized matching program with the federal Office of Child Support Services (OCSS). The computerized matching program compares each state SNAP agency’s applicant and recipient information with employment information maintained in the National Directory of New Hires (NDNH). The outcomes of the computerized match provide each state SNAP agency with information that will help to establish or verify an individual’s eligibility for SNAP benefits. Determining eligibility also helps each state agency reduce payment errors, identify duplicate participants, and maintain program integrity. To receive NDNH information, each state SNAP agency must enter into a computer matching agreement with OCSS and adhere to its terms and conditions, including providing OCSS with an annual performance outcomes report. This is a revision of a currently approved information collection. See A.15 for details.

Abstract

Section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000e-8(c), requires State and local governments to make and keep records relevant to a determination of whether unlawful employment practices have been or are being committed and produce reports required by the EEOC. Accordingly, the EEOC issued regulations, 29 CFR 1602.30 and 1602.32-.37, which set forth the reporting requirements and related record retention policies for State and local governments. 29 CFR 1602.30 requires every covered State and local government to make or keep all records necessary for completion of an EEO-4 submission and retain those records for three years. 29 CFR 1602.32 requires filers to retain a copy of each filed EEO-4 report for three years. These requirements are related to record keeping which is part of standard administrative practices, and as a result, the EEOC believes that any impact on burden would be negligible and nearly impossible to quantify. State and local governments with 100 or more employees have been required to submit EEO-4 reports since 1973 (biennially since 1993). The EEOC uses EEO-4 data for research and to investigate charges of discrimination. The individual reports are confidential.

Effective August 6, 1996, the Commission fully implemented Section 207 of the 1996 Act by adopting final rules for a preemption of state, local, and non-governmental regulations that impair viewers' ability to receive over-the-air signals. State, local, and non-governmental entities were permitted to file petitions for waivers.

The federal Office of Child Support Services (OCSS), Division of Federal Systems, in the U.S. Department of Health and Human Services (HHS) maintains the Child Support Portal (Portal) as part of the Federal Parent Locator Service (FPLS). The Portal is a secure, web-based gateway to various child support applications for authorized users to view, update, upload, send, and receive vital information to support effective and efficient enforcement of child support cases. To provide authorized users with secure access to the Portal, OCSS creates profiles in the Portal for employers, insurers, and financial institutions from information provided in “Employer Services” (ES) Profile and “Insurance Match Debt Inquiry” (IM) Agreement and Profile forms. OCSS sets up Portal preferences using information from the program-specific electronic National Medical Support Notice (e-NMSN), the electronic Incoming Withholding Order (e-IWO), and Federally Assisted State Transmitted Levy (FAST Levy) Financial Institution Profile forms. State child support agencies do not register for the Portal through OCSS because they manage and authenticate authorization for individual users via the state proxy server; however, states must provide OCSS with a profile form containing information for OCSS to establish account preferences. The federal Child Support Portal Registration information collection activities are authorized by 1) 42 U.S.C. § 653(m)(2), which requires the Secretary to establish and implement safeguards to restrict access to confidential information in the FPLS to authorized persons and to restrict use of such information to authorized purposes; 2) E-Government Act of 2002 and Office of Management and Budget (OMB) Circular 03-22, Guidance for Implementing the Privacy Provisions of the E-Government Act of 2002, which requires agencies to ensure program integrity by verifying access to data; and 3) 44 U.S.C. § 3554, which requires OCSS to implement security protections to prevent unauthorized access to information maintained by OCSS. Servicemembers Civil Relief Act (SCRA): Interest Rate Limitation Request

Abstract

The Servicemembers Civil Relief Act (SCRA) provides that those on active-duty military service are entitled to have an interest rate in excess of 6% be capped at 6% for the duration of their qualifying military service. The Department is requesting an extension of the currently approved information collection. These Federal Family Education Loan (FFEL) Program and Direct Loan Program regulations have not changed. The regulations require a loan holder to match its database against the Department of Defense's Defense Manpower Data Center (DMDC) and automatically apply the interest rate limitation, as appropriate, to borrowers under the Servicemembers Civil Relief Act. The form in this collection would only be used in limited cases where the borrower is not found in the Defense Manpower Data Center, or does not have a copy of military orders, but still wishes to receive benefits under the SCRA.

Abstract

Benefits are authorized monthly based on the number of hours worked in a training capacity by the trainee as verified by the training establishment. Unscheduled terminations result in the termination of benefits. If hours are reduced to less than a full-time work schedule, a reduction of benefits will occur. Public Law 115-89 “Veterans Apprenticeship and Labor Opportunity Reform Act” (VALOR Act) was signed into law on November 21, 2017. Section 3 of this law amended 38 U.S.C. 3680(c) to eliminate the trainee’s certification requirement. As a result, this form is only completed, signed, and certified by the training establishment to report the trainee’s number of hours worked and/or to report the trainee’s date of termination. The form no longer requires the signature of the trainee. The form is then sent to the Regional Processing Office (RPO) for processing.

We believe this is an important step in advancing interoperability, putting patients at the center of their health care, and ensuring they have electronic access to their health information. We are committed to working with stakeholders to solve the issue of interoperability and getting patients access to information about their health care, and we are taking an active approach to move participants in the health care market toward interoperability and the secure and timely exchange of electronic health information by adopting policies for the Medicare and Medicaid programs, the Children’s Health Insurance Program (CHIP), and qualified health plan (QHP) issuers on the individual market Federally-facilitated Exchanges (FFEs). For purposes of this rule, references to QHP issuers on the FFEs excludes issuers offering only stand-alone dental plans (SADPs). Likewise, we are also excluding QHP issuers only offering QHPs in the Federally-facilitated Small Business Health Options Program Exchanges (FF-SHOPs) from the provisions of this rule. The International Trade Administration’s (ITA) is mandated by Congress to create prosperity by strengthening the international competitiveness of U.S. industry, promoting trade and investment, and ensuring fair trade and compliance with trade laws and agreements. ITA accomplishes this by providing counseling, programs and services to help U.S. organizations export and conduct business and overcome challenges abroad, addressing unfair trade practices, providing actionable data, information, and assistance related to trade agreements, and defending against unfair trade. ITA’s programs include information products, data tools, services, trade events, and educational events. To fulfill its mission effectively and demonstrate the agency’s commitment to continual improvement, ITA requires ongoing feedback on all of its programs. This information collection instrument allows ITA to solicit customer opinions about their use of and engagement with ITA websites, programs, products, services, and events. To promote optimal use and provide focused and effective improvements to ITA programs, we are requesting approval for this clearance package; including: use of Comment Cards (i.e. transactional-based surveys) to collect feedback immediately after ITA assistance is provided to customers; use of annual surveys (i.e. relationship-based surveys) to gauge overall satisfaction, impact and needs for customers with ITA assistance provided over a period time. Without this information, ITA is unable to systematically determine the actual and relative levels of performance for its programs and products/services and to provide clear, actionable insights for managerial intervention. This information will be aggregated as part of ITA’s Voice of Customer (VOC) program, an enterprise approach to analyze, report and act on customer feedback captured across key touchpoints. Abstract

Section 1033 of the Consumer Financial Protection Act of 2010 (CFPA). CFPA Section 1033(a) and (b) provide that, subject to rules prescribed by the CFPB, a covered person shall make available to a consumer, upon request, information in the control or possession of the covered person concerning the consumer financial product or service that the consumer obtained from such covered person, subject to certain exceptions. The information must be made available in an electronic form usable by consumers. Section 1002 of the CFPA defines certain terms used in CFPA Section 1033, including defining consumer as “an individual or an agent, trustee, or representative acting on behalf of an individual.”

Program of Comprehensive Assistance for Family Caregivers

Abstract

Public Law (P.L.) 111-163, Caregivers and Veterans Omnibus Health Services Act of 2010 amended title 38 United States Code Chapter 17 by adding a new section, 1720G, “Assistance and Support Services for Caregivers.” Section 1720G required the Department of Veterans Affairs (VA) to develop a Program of Comprehensive Assistance for Family Caregivers and Support Services. Under the law, Primary Family Caregivers may be eligible to receive a stipend, access to health care coverage, mental health counseling, comprehensive caregiver education and training, and expanded respite services. Caregivers also may be eligible for travel benefits when they accompany the Veteran for care or attending training. In order to administer these benefits to caregivers, it is necessary that VA receive information about the nature of benefit being sought and the persons who will be serving as caregivers and receiving benefits. This information is collected with VA Form 10-10CG. The AR96 regulation, in proposed 38 CFR 71.25(a), would require veterans, servicemembers and caregivers to submit a new joint application to participate in PCAFC and receive benefits. VA is proposing changes to PCAFC eligibility requirements. These changes are expected to result in an influx of new applications in the initial year of implementation, including from applicants who have previously applied and been denied. The number of applications submitted to VA is expected to fall back to more typical numbers after the initial influx. In addition, requests for certain types of discharges will now be included in this information collection. Veterans or their Family Caregivers may request discharge from PCAFC. Such requests may be submitted in writing or verbally, to include the date such discharge should take effect. If such request for discharge is due to cases of domestic violence (DV) or intimate partner violence (IPV) by the Veteran against the Family Caregiver, the provision of a protective order, police report, or documentation by a treating provider of disclosure of DV or IPV may be provided to support the provision of extended benefits to the Family Caregiver upon the discharge. AR96(P) also sets forth a process for eligible Veterans and Primary Family Caregivers to request reassessment for continued eligibility. While a written request is not required, if a written request is received, such written request may support an earlier effective date for any increased benefits for which the Family Caregiver may be eligible based on the reassessment.
