What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Supplemental Statement Regarding Farming Activities of Persons Living Outside the U.S.A.

Abstract

When a beneficiary or claimant reports farm work from outside the United States, SSA documents this work on Form SSA-7163A-F4. Specifically, SSA uses the form to determine if we should apply foreign work deductions to the recipient's Title II benefits. We collect the information either annually or every other year, depending on the respondent's country of residence. Respondents are Social Security recipients engaged in farming activities outside the United States. Once we learn a Social Security recipient is working on a farm outside the United States, SSA employees send the SSA-7163A-F4 either directly to the recipient or to the appropriate Foreign Service Posts if we need assistance in the delivery of the form. We are submitting this non-substantive change request to remove the signature requirement, replacing the Penalty of Perjury Statemenwith with a Penalty of Perjury Warning Statement

Abstract

Claimants for Social Security disability payments or their representatives can use Form SSA-773-U4 to waive their right to appear at a disability hearing. Respondents complete the SSA-773-U4 through a personal interview with field office (FO) staff; Disability Determinations Service (DDS) staff; or Disability Hearing Unit (DHU) staff to insure the individual understands the due process rights associated with the decision to waive personal appearance at a disability hearing by a DHO. We conduct these personal interviews either in person or via telephone with the claimants or their representatives. Once we obtain the information on the SSA-733-U4, the DHO uses the signed form as a basis for not holding a hearing, and for preparing a written decision on the claimant’s request for disability payments based solely on the evidence of record. The respondents are disability claimants for Social Security benefits or SSI payments, or their representatives, who wish to waive their right to appear at a disability hearing. We are submitting this non-substantive change request to remove the signature requirement, and we are revising the Privacy Act and Paperwork Reduction Act Statemet.

Abstract

This request is to conduct the 2023-24 National Postsecondary Student Aid Study (NPSAS:24) Full-Scale Student Data and Student Records Collections. This study is being conducted by the National Center for Education Statistics (NCES), within the Institute of Education Sciences (IES), part of the U.S. Department of Education. This submission covers materials and procedures related to institution sampling, enrollment list collection, and matching to administrative data files as part of the NPSAS:24 data collection. The materials and procedures are based on those developed for previous institution-based data collections, including the 2019-20 National Postsecondary Student Aid Study (NPSAS:20) [OMB #1850-0666 v.23], and the 2017-18 National Postsecondary Student Aid Study Administrative Collection (NPSAS:18-AC) [1850-0666 v.21]. The first NPSAS was implemented by NCES during the 1986-87 academic year to meet the need for national data about significant financial aid issues. Since 1987, NPSAS has been fielded every 2 to 4 years, most recently during the 2019-20 academic year (NPSAS:20). NPSAS:24 will be nationally-representative. The NPSAS:24 sample size will include about 2,000 institutions from which will be sampled 137,000 nationally representative undergraduate and 25,000 nationally representative graduate students who will be asked to complete a survey and for whom we will collect student records and administrative data. Also, NPSAS:24 is scheduled to serve as the base year for the 2024 cohort of the Baccalaureate and Beyond (B&B) Longitudinal Study, but no funding is available to field follow-up surveys. In the event Congress appropriates additional funds, the NPSAS:24 sampling design will include a nationally representative sample of students who will complete requirements for the bachelor-s degree during the NPSAS year (i.e., completed at some point between July 1, 2023, to June 30, 2024). Subsets of questions in the student survey will focus on describing aspects of the experience of students in their last year of postsecondary education, including student debt, education experiences, and preparation activities for those planning to teach at the preK through 12th grade level. Previous submissions were designed to adequately justify the need for and overall practical utility of the full study, presenting the overarching plan for all phases of the data collection and providing as much detail about the measures to be used as is available at the time of this submission. As part of the completed field test, NCES published a notice in the Federal Register allowing first a 60- and then a 30-day public comment period. Field test materials, procedures, and results have informed this request for clearance for the full-scale study. For this full-scale study, NCES first published a notice in the Federal Register allowing an additional 30-day public comment period on the final details of the NPSAS:24 full-scale study Institution Contacting and List Collection, which was approved in September 2023 (OMB# 1850-0666 v.35). NCES is now submitting a separate clearance package covering the student data collection, including the student record data abstraction and student surveys, for an additional 30-day public comment period.

Abstract

SSA investigates recipients of disability payments to determine their continuing eligibility for payments. Research indicates recipients may fail to report circumstances that affect their eligibility. Two such cases are: (1) When parents receiving disability benefits for their child marry; and (2) the removal of an entitled child from parents’ care. SSA uses Form SSA-1588-SM to ask mothers or fathers about both their marital status, and children currently under their care, to detect overpayments and to avoid continuing payment to those no longer entitled. Form SSA-1588-SM is a pre-filled form; SSA completes certain fields electronically before we send it to the recipient. SSA sends Form SSA-1588-SM to widowers, once a year for the first three years after entitlement, then six years after entitlement, and then nine years after entitlements. SSA employees then evaluate the information listed on the form for program compliance. Respondents are recipients of mothers’ or fathers’ Social Security benefits. We are submitting this non-substantive change request to remove the signature requirement, and are replacing the Penalty of Perjury Statemenwith with a Penalty of Perjury Warning Statement.

Abstract

This collection of information request is associated with our September 26, 2024 (89 FR 79020) final rule (CMS-2434-F; RIN 0938-AU28). We intend to fold the following collection of information requirements and burden estimates under CMS-10108 (OMB 0938-0920). However, there are a number of conflicting activities that make this impractical at this time. To address those conflicts, as a stop gap measure we are proposing to submit the collection of information requirements and burden estimates under CMS-10855 (OMB 0938-1445). When ready we will be folding them to their proper place under CMS-10108 (OMB 0938-0920). Most Medicaid beneficiaries receive either all or part of their health care benefits through Medicaid managed care programs, including their prescription drug benefits. Because of the specialized nature of the prescription drug benefit, many of the Medicaid managed care plans (MCOs, PIHPS, or PAHPS) either own, or contract with, PBMs to administer the pharmacy benefit. In § 438.3(s), Medicaid MCOs, PIHPs, and PAHPs that provide coverage of covered outpatient drugs (CODs) would be required to structure any contract that it has with any subcontractor (e.g., PBM) for the delivery or administration of the COD benefit so that the subcontractor is required to report separately the amounts related to the incurred claims described in § 438.8(e)(2) to the managed care plan. The provisions would ensure that medical loss ratios (MLRs) reported by MCOs, PIHPs and PAHPs that use subcontractors in the delivery of COD coverage would be more accurate and transparent. The separate payment requirements would help States and managed care plans better understand whether they are appropriately and efficiently paying for the delivery of CODs, a significant part of which is funded by the Federal Government.

Abstract

The Office of Refugee Resettlement (ORR) Unaccompanied Alien Children (UAC) Bureau provides care and custody for unaccompanied alien children until they can be safely released to a sponsor, repatriated to their home country, or obtain legal status. ORR funds residential care provider facilities that provide temporary housing and other services to children in ORR custody. Generally, care provider facilities are State-licensed (with the exception of those located in states unwilling to consider them for licensure and temporary influx care facilities) and must meet ORR requirements to ensure a high-level quality of care. Services provided at care provider facilities include, but are not limited to, education, recreation, vocational training, acculturation, nutrition, medical, mental health, legal, and case management. ORR uses several instruments directly related to the care of unaccompanied alien children. The instruments in this information collection allow ORR to provide legal and advocacy services to unaccompanied alien children, as required by the legal authorities that govern the bureau. This request is to remove five forms from this collection, add two new forms, move two forms from different information collections into this collection (with revisions to one of those forms), and revise three existing forms in this collection. The title of this collection has also been updated from “Legal Services for Unaccompanied Children” to “Legal and Advocacy Services for Unaccompanied Alien Children.” Details about requested revisions are described in section A15.

Guidelines Establishing Standards for Recovery Planning by Certain Large Insured National Banks, Insured Federal Savings Associations, and Insured Federal Branches

Abstract

In 2016, the OCC issued guidelines applicable to each insured national bank, insured Federal savings association, and insured Federal branch of a foreign bank (together, banks) with average total consolidated assets equal to or greater than $50 billion (covered banks). The guidelines stated that each covered bank should develop and maintain a recovery plan that is appropriate for its individual size, risk profile, activities, and complexity, including the complexity of its organizational and legal entity structure, in order to be able to respond quickly to and recover from the financial effects of severe stress. The guidelines established standards for this recovery planning. In 2018, the OCC raised the threshold from $50 billion to $250 billion. This filing is in connection with the OCC-issued final guidelines that revise the threshold to $100 billion or more. The final guidelines also incorporate a testing standard for recovery plans and clarify the roles of financial and non-financial (including operational and strategic) risk in recovery planning.

This information is collected using a grantee-level (state/territory or tribal entity) tool that provides CSAT with prevention, education, harm reduction, treatment, and recovery support information about all SOR/TOR grantees, including data on reported overdose reversals, purchase and distribution of naloxone and other opioid overdose reversal medications, training on the administration of naloxone and other opioid overdose reversal medications, implementation of prevention and education activities, the purchase and distribution of drug checking technologies as directed by SAMHSA, treatment services for opioid use disorder (OUD), and stimulant use disorder, the types of recovery support services, and expenditure amounts for each SOR and TOR grant sub-recipient. This program level information is collected quarterly for questions 1 to 13b, and annually for the sub-recipient entity inventory table. To be fully accountable for the spending of federal funds, SAMHSA/CSAT requires all SOR/TOR grantees to collect and report data to ensure that program goals and objectives are met. Data collected as part of this package are used as a tool to monitor performance through the grant period. All data under this request will be collected electronically in SAMHSA’s Performance and Accountability Reporting System (SPARS).

FERC-585, Reporting of Electric Shortages and Contingency Plans Under PURPA Section 206

Key Information

Abstract

The Commission uses the information collected within the FERC-585 to implement the statutory provisions of Section 206 of the Public Utility Regulatory Policies Act of 1979 (PURPA) . Section 206 of PURPA amended the Federal Power Act (FPA) by adding a subsection to Section 202 under which the Commission (by rule) requires each public utility to (1) report to the Commission and appropriate state regulatory authorities of any anticipated shortages of electric energy or capacity which would affect the utility's capability to serve its wholesale customers; and (2) report to the Commission and any appropriate state regulatory authority with contingency plan that would outline what circumstances might give rise to such occurrences. No changes are being made to the reporting requirements at this time; rather we are requesting a 3-year extension with no change. Historical background. In Order No. 575 , the Commission modified the reporting requirements in 18 CFR 294.101(b)(5) to provide in its rates and schedules to firm power wholesale customers that: (a) during electric energy and capacity shortages it will treat firm power wholesale customers without undue discrimination or preference, prejudice, or disadvantage firm power wholesale customers and (b) it will report any modifications to its contingency plan for accommodating shortages within 15 days to the appropriate state regulatory agency and to the affected wholesale customers. The utility then needs not file with the Commission an additional statement of contingency plan for accommodating such shortages since this revision merely changed the reporting mechanism. The public utility's contingency plan would be contained within its filed rate rather than in a separate document. The Commission modified the reporting requirements in 18 CFR 294.101(f) to set forth the means by which public utilities must comply with the requirements to report shortages and anticipated shortages. The original requirement mandated filing an original and at least two copies to the Commission as well as one copy to relevant state regulators and firm power wholesale customers. The revised requirement is to promptly submit a single electronic report to the Commission via the Office of Electric Reliability's emergency mailbox at emergency@ferc.gov. The Commission defines anticipated shortages of electric or energy as: "(1) Any situation anticipated to occur in which the generating and bulk purchased power capability of a public utility will not be sufficient to meet its anticipated demand plus appropriate reserve margins and this shortage would affect the utility's capability adequately to supply electric services to its firm power wholesale customers; or (2) Any situation anticipated to occur in which the energy supply capability of a public utility is not sufficient to meet its customers' energy requirements and this shortage would affect the utility's capability adequately to supply electric services to its firm power wholesale customers." 18 CFR 294 establishes the reporting requirements for public utilities. A report filed in compliance with Part 294 must include the nature and projected duration of the anticipated shortage, a list of firm wholesale customers likely to be affected by the shortage, procedures for accommodating the shortage, and a contact person at the public utility.

The Federal Office of Rural Health Policy (FORHP), Health Resources and Services Administration (HRSA), conducts an annual data collection of user information for the Black Lung Program, which has been ongoing with OMB approval since 2004. The purpose of the Black Lung Clinics Program is to improve the health status of coal workers by providing services to minimize the effects of respiratory and pulmonary impairments of coal miners, including treatment required in the management of problems associated with black lung disease, which improves the miner’s quality of life and reduces economic costs associated with morbidity and mortality arising from pulmonary diseases. Collecting this data will provide HRSA information on how well each grantee is meeting the needs of active and retired miners in their communities.

Abstract

In 2016, the U.S. Departments of Housing and Urban Development (HUD) and the Department of Justice (DOJ) entered into an innovative interagency collaboration that combines DOJ’s mission to promote safer communities by focusing on the reentry population with HUD’s mission to end chronic homelessness. This collaboration resulted in the Pay for Success Permanent Supportive Housing Demonstration, with $8.68M awarded in June 2016 to seven communities to develop permanent supportive housing (PSH) for persons cycling between the jail or prison systems using Pay for Success (PFS) as a funding mechanism. The PFS Demonstration grant supports activities throughout the PFS lifecycle. In January 2017, HUD awarded the evaluation contract to the Urban Institute, to assess whether PFS is a viable model for scaling supportive housing to improve outcomes for a re-entry population. The overarching goal of this formative evaluation is to learn how the PFS model is implemented in diverse settings with different structures, populations, and community contexts. Throughout the evaluation, two data collection instruments (Annual Partnership Survey and Time Use Survey) have been used to collect information regarding the implementation of the PFS PSH demonstration directly from staff at demonstration partner agencies in each of the study sites. The first OMB approval was in October 2018, the second approval was in 2021, and now the third approval is sought this year. This information collection renewal request includes: (1) the HUD-DOJ PFS Key Project Partners Annual Web-based Partnership Survey (referred to as the Partnership Survey), which is focused on the development and functioning of partnerships and community-level collaborations that may benefit the target population, and (2) the HUD-DOJ PFS Key Project Partners Quarterly Time Use Survey (referred to as the Time Use Survey), which is being conducted as part of a study of the staff time that is used to develop each PFS project, through the phases of its PFS life cycle of feasibility analysis, transaction structuring, and project implementation. The authority to collect information is in Sections 501 and 502 of the Housing and Urban Development Act of 1970 (Public Law 91-609) (12 U.S.C. §§ 1701z-1; 1701z-2(d) and (g)). If the transaction constitutes a bona fide loan, then the proceeds are not income to the borrower. Form SSA-2855 (Statement of Funds You Received) requests information from the SSI applicant/beneficiary by personal interview. Form SSA-2854 (Statement of Funds You Provided to Another) requests information by mail from the other party to the transaction.
