What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

This is a reinstatement of the information collection request that expired on 11/30/2017. The previous iteration of this OMB No. 0938-0328 (approved November 14, 2014) had a burden of 14,424,655 annual hours. For this requested reinstatement, with changes, the adjusted annual hourly burden for industry is 3,566,521 hours at an annual cost of $310,989,894. The decrease in burden hours is primarily due to the fact that many of the information collections that were previously required as CoPs by CMS are now customary and usual industry practice and would take place in the absence of the Medicare and Medicaid programs. In addition, where possible, CMS reduced the burden of CoPs with prior information collections.

This is a reinstatement of the information collection request that expired on March 31, 2024. The previous iteration of this OMB No. 0938-1043 (approved March 25, 2021) had a burden of 33,905 annual hours. For this requested reinstatement, with changes, the total annual burden hours for industry is 894,922 hours and the annual burden costs are $73,650,118. The increase in burden hours from the prior package is primarily due to new information collections associated with new CoPs for CAHs outlined in the two CMS rules referenced below. The new CoPs include multiple information collection requirements that are one-time burdens for developing new policies and protocols and ongoing reporting requirements, such as daily or biweekly reporting of respiratory illnesses as well as maternal deaths. The reasons for the increased information collections are discussed in more detail in the rules and are summarized later in this package.

Abstract

Insured domestically chartered commercial banks and savings associations (U.S. banks) that have one or more branch offices in a foreign country are required to report balance sheet information for each of their foreign branches on either the FFIEC 030 or FFIEC 030S. The FFIEC 030 is collected annually as of December 31 or quarterly for significant branches as of the last day of each calendar quarter. The FFIEC 030S is an abbreviated reporting form filed annually by smaller institutions. The Federal Reserve receives reports for all foreign branches of U.S. banks, regardless of charter type, on behalf of the U.S. banks’ primary federal bank regulatory agency (Board, Federal Deposit Insurance Corporation (FDIC), or Office of the Comptroller of the Currency (OCC) (collectively the agencies)). The agencies use the FFIEC 030 and FFIEC 030S reports to fulfill their statutory obligation to supervise foreign operations of domestic banks.

The Federal Communications Commission adopted rules to promote continued access to 911 during commercial power outages by requiring providers of facilities-based, fixed residential voice services, which are not line powered (covered services), to offer subscribers the option to purchase a backup solution capable of 8 hours of standby power, and within three years, an additional solution capable of 24 hours of standby power. The rules also promotes consumer education and choice by requiring providers of covered services to disclose to subscribers information about: availability of backup power sources; service limitations with and without backup power during a power outage; purchase and replacement options; expected backup power duration;) proper usage and storage conditions for the backup power source; subscriber backup power self-testing and monitoring instructions; and backup power warranty details, if any.

ACL Administration on Aging Formula Grant Programs

Abstract

As a center in the Administration for Community Living, the Administration on Aging (AoA) provides expertise on program development, advocacy, initiatives for older Americans, their caregivers, and families. Working with state agencies, local agencies, grantees, and community providers, AoA directs programs authorized by the Older Americans Act (OAA), Elder Justice Act (EJA), and other legislation that supports older adults. Through these programs multi-year state plans, assurances, and other financial forms are needed to provide approval and oversight of grant recipients. The purpose of this information collection is for programmatic and financial management of the aging and APS formula grants. The state plan on aging provides the opportunity report achievements and planned activities for the multi-year plan period. A wide range of constituents use or will use the state plans to coordinate, monitor, evaluate, and improve aging network by using the state plans on aging as a blueprint for service planning and delivery. Additionally, ACL leverages state plans on aging to understand the numerous services older adults use, and to utilize the information for advocating the needs of older adults. The financial forms will assist in the facilitation of OAA formula grant management. And the CAP document will assist in compliance of OAA and EJA formula grants.

Nursing Home Survey on Patient Safety Culture Comparative Database

Abstract

In 1999, the Institute of Medicine called for health care organizations to develop a "culture of safety" such that their workforce and processes focus on improving the reliability and safety of care for patients (IOM, 1999; "To Err is Human: Building a Safer Health System"). To respond to the need for tools to assess patient safety culture in health care, AHRQ developed and pilot tested the Nursing Home Survey on Patient Safety Culture with OMB approval (OMB NO. 0935-0132; Approved July 5, 2007). The survey is designed to enable nursing homes to assess provider and staff opinions about patient safety issues, medical error, and error reporting and includes 42 items that measure 12 dimensions of patient safety culture. AHRQ made the survey publicly available along with a Survey User's Guide and other toolkit materials in November 2008 on the AHRQ Web site (located at http://www.ahrq.gov/professionals/quality-patient-safety/patientsafetyculture/nursing-home/index.html). The AHRQ Nursing Home SOPS Comparative Database consists of data from the AHRQ Nursing Home Survey on Patient Safety Culture. Nursing homes in the U.S. are asked to voluntarily submit data from the survey to AHRQ through its contractor, Westat. The Nursing Home SOPS database (OMB NO. 0935-0195, last approved on October 26, 2021) was developed by AHRQ in 2011 in response to requests from nursing homes interested in knowing how their patient safety culture survey results compare to those of other nursing homes in their efforts to improve patient safety. The survey and database have the following goals: 1) Promote improvements in the quality and safety of healthcare in nursing home settings, 2) Present results from nursing homes that voluntarily submit their data, 3) Provide data to nursing homes to facilitate internal assessment and learning in the patient safety improvement process, and 4) Provide supplemental information to help nursing homes identify their strengths and areas with potential for improvement in patient safety culture.

Designee applicants come from private industry. Experts in the aviation and medical communities who are familiar with the regulations and certification requirements necessary to issue an FAA certificate report information to this collection on occasion. Abstract

This information collection request would establish the application requirements for prospective participants in the Transportation Access Pilot Program (APP). State Departments of Transportation, Metropolitan Planning Organizations, and Rural Transportation Planning Organizations choosing to apply to participate in APP would be required to provide the information requested in order to be considered. The collection of this information is required as part of the application process specified in the Infrastructure Investment and Jobs Act of 2021 (P.L. 117-58 §13010(e)). FHWA intends to solicit applications to participate in APP on an annual basis for up to eight years, or until the scope of the program required by law is sufficiently achieved. FHWA is seeking a three year Paperwork Reduction Act clearance at this time, but may seek to continue the information collection beyond that period if necessary. Abstract

The Urban Waters Federal Partnership (UWFP) is a voluntary program established in 2011. Its primary aim is to reconnect urban communities, particularly those that are overburdened or economically distressed, with their waterways, thereby fostering a sense of stewardship for clean urban waters. The program operates through a diverse network of partners, all working towards a common goal of helping communities restore and protect water quality and revitalize adjacent rural, suburban and urban neighborhoods throughout the watershed. The UWFP program provides a platform for communities to collaborate and work towards holistic environmental and social priorities, thereby enhancing their watersheds. These partnerships are a collective effort, bringing together federal agencies, Tribal governments, state and local agencies, and non-profit and community-led organizations. The program is spearheaded by the U.S. Environmental Protection Agencys Office of Water, in collaboration with fourteen other federal agencies. An organizations decision to participate in UWFP is entirely voluntary. A locations participation in the program generally begins when a group of organizations collaborate to form a local partnership to improve an urban watershed. The partnership consists of state and local government, non-governmental organizations, community-based organizations, federal agencies and may include Tribal government. Each partnership must apply to become a designated UWFP location and hire an Ambassador to manage the partnership who serves as the main point-of-contact between partners and the federal agencies. The UWFP designated twenty locations between 2011 and 2015 and one location in 2023. The twenty-one geographically dispersed locations are working to revitalize urban waterways and the surrounding communities, transforming overlooked watersheds into community assets. Each location conducts different activities depending on the needs of its watershed and communities. Ambassadors serve as the lead coordinator for each location and provide data and information to UWFP on a regular basis. Each location has an active partnership Workplan that will be prepared every other year and provided to the UWFP for review. Ambassadors will provide summary information on workplan achievements and collaborative activities during a year by submitting an Annual Reporting Form. The EPA will use the information collected to track the progress of the program at each location and celebrate the locations successes. In addition to quantitative metrics on the programs activities, the UWFP also will collect qualitative data on the impact and health of the partnership at each location. Partnership Evaluation Forms will be completed by the partner organizations at each location to help the UWFP national program understand the degree to which partnership locations are building organizational capacity, connectedness and collaboration between partner organizations. These forms are also used to plan future activities that support healthy and sustainable partnerships.

Abstract

Section 165 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act) authorizes the Board to implement enhanced prudential standards for certain bank holding companies (BHCs), nonbank financial companies supervised by the Board (nonbank systemically important financial institutions, or nonbank SIFIs), and foreign banking organizations (FBOs). Section 165 also imposes requirements relating to stress tests on the companies listed above and certain other financial companies, including state member banks (SMBs). The Board has relied on this authority to enact Regulation YY - Enhanced Prudential Standards (12 CFR Part 252), which applies to BHCs and FBOs with total consolidated assets of $100 billion or more, nonbank SIFIs, and U.S. intermediate holding companies (IHCs) of FBOs with total consolidated assets of $100 billion or more, as well as SMBs with total consolidated assets of $250 billion or more. The enhanced prudential standards and other requirements contained in Regulation YY include risk-based and leverage capital requirements, liquidity standards, requirements for overall risk management (including establishing a risk committee), stress test requirements, and debt-to-equity limits for companies that the Financial Stability Oversight Council (FSOC) has determined pose a grave threat to financial stability.

Abstract

The FAA sometimes includes a request for voluntary reporting of information (e.g., inspection results, etc.) in SAIBs. The inspection results may help the FAA in an ongoing investigation to determine the cause of a specific condition, or whether the condition is likely to exist or develop on other products of the same type design. We may also require reports if a potential unsafe condition is a result of manufacturing quality control problems. We need these reports to determine the scope of the problem and how adequate the design approval holder’s corrective actions are. As such, each reporting situation is unique. To date, our only means for obtaining reporting information is from design approval holders through 14 CFR § 21.3. We have no other authorized method for notification and collection of information from owner/operators to help in our assessment of a potential unsafe condition. If the FAA is unable to obtain this information, we may need to conduct a directed safety investigation. This is a burden on both the FAA and the owner/operator.

Abstract

The Foreign Branch Report of Condition (FFIEC 030) and the Abbreviated Foreign Branch Report of Condition (FFIEC 030S) are required by statute. Pursuant to 12 U.S.C. 602, every national bank operating a foreign branch, other than a national bank operating only exempt foreign branches, must file the applicable report. The OCC, FDIC and FRB (the agencies) need this information to monitor U.S. bank activity at overseas locations and funds flow worldwide. The agencies also need this information for planning foreign branch examinations. The Foreign Branch Report of Condition is the only report with balance sheet and contingent liability data collected by the agencies from foreign branches. The data collected are used by the agencies to monitor banking activity at overseas locations. On an aggregate basis, the agencies use the data to monitor U.S. bank activity in the Eurocurrency markets and in tracking funds flow worldwide. Data on specific branches or branches within a specific country or region are used in planning examinations. The scope of the FFIEC 030S is comparable to a report filed with the Federal Reserve by U.S. banking organizations for their foreign subsidiaries. The items for this report are considered the minimum information needed to serve as indicators of higher business volume, risk, and complexity in small-sized foreign branches. The reported information is also used to monitor potential developments that may pose risks to the overall operations of the parent bank.

Abstract

VA Form 28-0791, Pre and Post Independent Living Assessment (IL) is used by the Vocational Rehabilitation Counselor (VRC) during the initial and post IL evaluations. During this face-to-face meeting, the VRC identifies impairments and or barriers the Veteran may be experiencing with Activities of Daily Living (ADLs). The VRC then uses this information to identify the needs for services. The VRC compares the information obtained from the preliminary and post plan assessments to determine if there are improvements in the Veteran’s activities of daily living. Without the information gathered on this form, VR&E is not able to identify IL needs and provide needed services. There are no other invitations or other communications sent to the respondent associated with the information collection. Failure to collect this information would have a detrimental impact upon the determination of appropriate rehabilitation goals for Veterans participating in the IL program. This would negatively impact the Veteran’s participation in his or her rehabilitation program.

Abstract

The U.S. Department of Education’s Rehabilitation Services Administration (RSA) requests clearance for new data collection activities to support the evaluation of the evaluation of the Disability Innovation Fund (DIF) Subminimum Wage to Competitive Integrated Employment (SWTCIE) program. The aim of this project is to increase transitions to competitive integrated employment (CIE) among people working in subminimum wage employment (SWE)—or considering doing so—through innovative activities to build systemwide alternatives to subminimum wage employment. Advocacy, policy and practice have evolved in recent decades toward a shift to CIE, as reflected in the Workforce Innovation and Opportunity Act and most recently in the Consolidated Appropriations Act of 2021, which provides funding for DIF. This request covers primary data collection activities, including survey data, administrative data, site visits, and focus groups. In September 2022, the RSA awarded five-year grants for the 84.421D DIF. The grants provide 14 state vocational rehabilitation (VR) agencies with funding to implement SWTCIE Innovative Model Demonstration projects to decrease SWE and increase CIE among people with disabilities currently employed in or contemplating SWE. To achieve this purpose, the projects will create innovative models for dissemination and replication to (1) identify strategies for addressing barriers associated with accessing CIE, (2) provide integrated services that support CIE, (3) support integration into the community through CIE, (4) identify and coordinate wraparound services for project participants who obtain CIE, (5) develop and disseminate evidence-based practices, and (6) provide entities holding section 14(c) certificates with readily accessible transformative business models for adoption. The intervention models vary across the SWTCIE projects, but all of them will work with employers that hold 14(c) certificates, other employers, service providers, and additional community partners to empower transition-age youth and working-age adults with disabilities to pursue CIE. In addition, each project will use part of its funds for an independent evaluator to conduct a project-specific evaluation of its activities and outcomes. This data collection for the RSA DIF is critical as the evaluation is intended to make information more actionable for practitioners and policymakers and ensure the DIF program outcomes are duplicatable for VR agencies and partners. The evaluation will (1) describe the implementation and costs of the federally-funded program and strategies; (2) improve the identification of DIF program models and strategies related to the state VR programs, intended to improve outcomes for individuals with disabilities in CIE, including but not limited to accommodations and services for individuals with disabilities, utilization of technology, and supports; (3) interconnect the projects to evaluate the effectiveness of particular strategies in the context of how commonly that strategy is used across the projects; (4) analyze trends in CIE outcomes and potential impacts of federal grants; and (5) examine the effectiveness and cost effectiveness of the program and strategies that support CIE and reduce SWE.

The American Recovery and Reinvestment Act of 2009 (Recovery Act) (Pub. L. 111-5) was enacted on February 17, 2009, and includes measures to modernize our nation's infrastructure and improve affordable health care. Expanded use of health information technology (HIT) and certified electronic health record (EHR) technology will improve the quality and value of America's health care. Title IV of Division B of the Recovery Act amends Titles XVIII and XIX of the Social Security Act (the Act) by establishing incentive payments to eligible professionals (EPs), eligible hospitals and critical access hospitals, and Medicare Advantage organizations participating in the Medicare and Medicaid programs that adopt and successfully demonstrate meaningful use of certified EHR technology (CEHRT). These Recovery Act provisions, together with Title XIII of Division A of the Recovery Act, may be cited as the “Health Information Technology for Economic and Clinical Health Act” or the “HITECH Act.”. Beginning in 2018, the names of the Medicare and Medicaid EHR Incentive Programs were changed to the Medicare and Medicaid Promoting Interoperability Programs. We are collecting information from participants in these programs on objectives and measures focused on the meaningful use of CEHRT in order to incentivize the advanced use of CEHRT to support health information exchange, interoperability, quality measurement, and maximizing clinical effectiveness and efficiencies. In the FY 2025 IPPS/LTCH PPS proposed rule, we are proposing to separate the previously finalized Antimicrobial Use and Antimicrobial Resistance (AUR) Surveillance measure into two separate measures, beginning with the EHR reporting period in CY 2025: (1) the Antimicrobial Use (AU) Surveillance measure and (2) the Antimicrobial Resistance (AR) Surveillance Measure. We are also proposing to increase the total number of electronic clinical quality measures (eCQMs) eligible hospitals and CAHs report from six to nine for the CY 2026 reporting period, and then from nine to eleven beginning with the CY 2027 reporting period. We note that the information collection burden associated with reporting of eCQMs by eligible hospitals and CAHs is accounted for under OMB control number 0938-1022.

Commercial Air Tour Limitations in the Grand Canyon National Park Special Flight Rules Area

Abstract

Each operator seeking to obtain or in possession of an air carrier operating certificate is mandated to comply with the requirements of 14 CFR Part 135 or part 121, as appropriate. Thus, each of these operators conducting air tours in the Grand Canyon National Park is mandated to comply with the collection requirements for that airspace. The FAA will use the information it collects and reviews to evaluate compliance with the regulations and, if necessary, take enforcement action against violators of the regulations. The data collected also serves as the primary source of input into joint FAA/NPS modeling exercises to evaluate progress toward the “substantial restoration of the natural quiet and experience of the park”. The operators report the data to the FAA on a quarterly basis.
