Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

In April 1996, the Commission issued a notice of proposed rulemaking concerning certain provisions of the Telecommunications Act of 1996 (“1996 Act”), including section 251. Section 251 is designed to accelerate private sector development and deployment of telecommunications technologies and services by spurring competition. The Commission has adopted rules and regulations designed to implement certain provisions of section 251, and to eliminate operational barriers to competition in the telecommunications services market. In November 2017, the Commission adopted new rules concerning certain information collection requirements implemented under section 251(c)(5) of the Act, pertaining to network change disclosures. Most of the changes to those rules applied specifically to a certain subset of network change disclosures, namely notices of planned copper retirements. In addition, the changes removed a rule that prohibits incumbent LECs from engaging in useful advanced coordination with entities affected by network changes. one of rules pertaining to network change disclosures to include appropriate titles for public notices of copper retirement. In June 2018, the Commission revised its network change disclosure rules to (1) revise the types of network changes that trigger an incumbent LEC’s public notice obligation, and (2) extend the force majeure provisions applicable to copper retirements to all types of network changes.

Abstract

Under the reporting requirements established in the SCS Report and Order, terrestrial providers that utilize SCS arrangements to expand their coverage areas for providing service must disclose certain information to the Commission regarding SCS 911 voice calls and 911 text messages. Such requirements are consistent with reporting requirements that apply to MSS providers under section 9.18(b) of FCC rules and location-based routing reporting requirements that apply to terrestrial providers under section 9.10(s) of FCC rules. Accordingly, the Commission requires that terrestrial providers that utilize SCS to extend coverage must 1) Maintain records of SCS 911 voice calls and 911 text messages received under their SCS arrangements and received at their emergency call centers; 2) Submit annual reports according to the compliance dates of new section 9.10(t)(3) of the rules in the Commission’s Electronic Comment Filing System (ECFS); 3) Submit the required reports to the Commission by October 15th of each year regarding SCS 911 voice calls and 911 text messages, and emergency call center data, current as of September 30th of that year; 4) Certify that neither they nor any third party they rely on to obtain SCS location information will use that information or associated data for any non-911 purpose, except with prior express consent or as otherwise permitted or required by law; and 5) Each terrestrial provider that uses SCS arrangements to supplement its coverage must advise every subscriber, both new and existing, prominently and in plain language, of the circumstances under which 911 service for calls or texts may not be available through SCS or may be in some way limited by comparison to traditional E911 service.

Supplemental Restraint Systems: Passenger Safety Briefings

Key Information

Abstract

The FAA is finalizing a rule to prohibit civil aircraft operations conducted with supplemental restraint systems (SRS) unless operators meet certain requirements, including passenger briefing and demonstration requirements. The FAA also will impose requirements regarding persons participating in such operations. The FAA expects these requirements to increase the safety of passengers during civil aircraft operations conducted with SRS. The rule is applicable to all civil aircraft operations conducted with use of SRS. The rule will not interfere with parachute operations conducted under part 105 and will not apply to rotorcraft external-load operations conducted under part 133. Additionally, the rule does not apply to operations conducted as public aircraft operations under Title 49 of the United States Code (49 U.S.C.) §§ 40102(a)(41) and 40125.

Abstract

Section 641A of the Head Start Act, 42 U.S.C. 9836A, directs the U.S. Department of Health and Human Services (HHS) to develop “scientifically based and developmentally appropriate education performance standards related to school readiness” and “ensure that any such revisions in the standards do not result in the elimination of or any reduction in quality, scope, or types of health, educational, parental involvement, nutritional, social, or other services.” The Head Start Program Performance Standards (HSPPS) set forth the requirements local Head Start grant recipients must meet in the delivery of Head Start program services. This information collection accounts for the record keeping activities and burden that is required per the HSPPS. This submission is requesting a three-year extension with changes for the HSPPS record keeping activities (OMB #0970-0148). On August 21st, 2024, the Office of Head Start (OHS) published a final rule Supporting the Head Start Workforce and Consistent Quality Programming at https://www.federalregister.gov/documents/2024/08/21/2024-18279/supporting-the-head-start-workforce-and-consistent-quality-programming (89 FR 67720). Changes have been made to recordkeeping requirements, as described in this final rule.

Medical Necessity Disclosure under MHPAEA The Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA) (P.L.110-343) requires that group health plans and group health insurance issuers offering mental health or substance use disorder (MH/SUD) benefits in addition to medical and surgical (med/surg) benefits ensure that that they do not apply any more restrictive financial requirements (e.g., co-pays, deductibles) and/or treatment limitations (e.g., visit limits) to MH/SUD benefits than those requirements and/or limitations applied to substantially all med/surg benefits.Medical Necessity Disclosure under MHPAEA section 512(b) specifically amends the Public Health Service (PHS) Act to require plan administrators or health insurance issuers to provide, upon request, the criteria for medical necessity determinations made with respect to MH/SUD benefits to current or potential participants, beneficiaries, or contracting providers. The Interim Final Rules Under the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (75 FR 5410, February 2, 2010) sets forth rules for providing criteria for medical necessity determinations. The final rules retain the provisions from the interim final rules and extend them to small employers and the individual market. CMS oversees non-Federal governmental plans or related health insurance and health insurance plans offered in the individual market.MHPAEA section 512(b) specifically amends the Public Health Service (PHS) Act to require plan administrators or health insurance issuers to supply, upon request, the reason for any denial of payment for MH/SUD services to the participant or beneficiary involved in the case.

Abstract

The Impact Aid Program (IAP) in the Office of Elementary and Secondary Education (OESE) at the U.S. Department of Education (ED) requests an extension without change of the U.S. Office of Management and Budget (OMB) collection 1810-0764 for the Electronic Data Collection (EDC) Program Questionnaire. Local educational agencies (LEAs) are required to annually submit federally connected student count data with the grant application for Section 7003 Payments for Federally Connected Children. Traditionally, LEAs have used paper survey forms to collect this information. However, the IAP has allowed LEAs to demonstrate that they can successfully collect this information electronically through student information systems (SIS). This voluntary information collection request would give the opportunity for transportation pooled fund participants to provide award nomination information. The collection is done through a nomination form submitted voluntarily by the participant every two years. Information reported would include TPF study information and how the research or innovation has advanced transportation. The purpose of the collection is to highlight the importance of meaningful collaboration and partnership in transportation research. Administered through a partnership between FHWA and the AASHTO RAC, the biennial TPF Excellence Award will recognize one FHWA-led TPF study and one State department of transportation (DOT)-led study. Key Information

Abstract

This triennial survey is the only source of representative information on the structure of U.S. families’ finances. The survey collects data on the assets, debts, income, work history, pension rights, use of financial services, and attitudes of a sample of U.S. families. Because the ownership of some assets is relatively concentrated in a small number of families, the survey makes a special effort to ensure proper representation of such assets by systematically oversampling wealthier families. For the 2025 SCF, the Board will conduct (1) up to 150 interviews averaging about 110 minutes (pretest) to be obtained in a test or series of tests of the survey procedures in 2025 and (2) up to 7,000 interviews averaging about 110 minutes (main survey) between April 2025 and March 2026. The pretest interviews and surveys will be conducted by an outside contractor. The pretest and the main survey will be collected by a field interviewer, either in person or on the phone, using a computer-assisted personal interview (CAPI) instrument. There is no hardcopy version of the questionnaire other than the text of the computer program. The wording of the survey questions will be modified to reflect the outcome of the pretest, but it is anticipated that such changes will be relatively small.

For regulated freight transportation or transportation-related services, the clause requires an offeror to indicate whether it has the proper authorization from the Federal Highway Administration (or other cognizant regulatory body) before it can be allowed to move material under any contract awarded. ● FAR 52.247-6, Financial Statement. This provision requires an offeror to furnish the Government with a current certified statement of the offeror’s financial condition and such data as the Government may request with respect to the offeror’s operations. ● FAR 52.247-48, F.o.b. Destination—Evidence of Shipment. Abstract

Durable Medical Equipment (DME) is any equipment that provides therapeutic benefits to a patient in need because of certain medical conditions and/or illness. They consist of items that are primarily and customarily used to serve a medical purpose; are not useful to a person in the absence of illness or injury; are ordered or prescribed by a physician; are reusable; can stand repeated use, and are appropriate for use in the home. Other devices covered in this guidance include prosthetic equipment (cardiac pacemakers), hearing aids, orthotic items (artificial devices such as braces and splints), and prostheses (artificial body parts). The information collected will assist in the determination of Peace Corps eligibility. If eligible, it will assist with ongoing care during service. All applicants to the Peace Corps must have a medical clearance that will determine their ability to serve in a particular country.
