What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Durable Medical Equipment (DME).

Key Information

Abstract

Durable Medical Equipment (DME) is any equipment that provides therapeutic benefits to a patient in need because of certain medical conditions and/or illness. They consist of items that are primarily and customarily used to serve a medical purpose; are not useful to a person in the absence of illness or injury; are ordered or prescribed by a physician; are reusable; can stand repeated use, and are appropriate for use in the home. Other devices covered in this guidance include prosthetic equipment (cardiac pacemakers), hearing aids, orthotic items (artificial devices such as braces and splints), and prostheses (artificial body parts). The information collected will assist in the determination of Peace Corps eligibility. If eligible, it will assist with ongoing care during service. All applicants to the Peace Corps must have a medical clearance that will determine their ability to serve in a particular country.

Collection of Advance Information from Certain Undocumented Individuals on the Land Border

Key Information

Abstract

CBP collects certain biographic and biometric information from undocumented noncitizens prior to their arrival at a POE, to streamline their processing at the POE. The requested information is that which CBP would otherwise collect from these individuals during primary and/or secondary processing. This information is voluntarily provided by undocumented noncitizens, directly or through non-governmental organizations (NGOs) and international organizations (IOs). Providing this information is not a prerequisite for processing under Title 8, but reduces the amount of data entered by CBP Officers (CBPOs) and the length of time an undocumented noncitizen remains in CBP custody. The biographic and biometric information being collected in advance, that would otherwise be collected during primary and/or secondary processing at the POEs includes, but is not limited to, descriptive information such as: Name, Data of birth, Country of Birth, City of Birth, Country of Residence, Contact Information, Addresses, Nationality, Employment history (optional), Travel history, Emergency Contact (optional), U.S. and foreign addresses, Familial Information (optional), Marital Status (optional), Identity Document (not a WHTI compliant document) (optional), Gender, Preferred Language, Height, Weight, Eye color and Photograph. This information is submitted to CBP by undocumented noncitizens on a voluntary basis, for the purpose of facilitating and implementing CBP’s mission. This collection is consistent with DHS’ and CBP’s authorities, including under 6 U.S.C. §§ 202 and 211(c). Pursuant to these sections, DHS and CBP are generally charged with “[s]ecuring the borders, territorial waters, ports, terminals, waterways, and air, land, and sea transportation systems of the United States,” and “implement[ing] screening and targeting capabilities, including the screening, reviewing, identifying, and prioritizing of passengers and cargo across all international modes of transportation, both inbound and outbound.”Emergency Justfication:Following the normal clearance procedures under the PRA would delay their implementation and harm diplomatic relations with the Government of Mexico. As discussed, CBP certifies that this request meets the requirements of 5 C.F.R. § 1320.13(a) and it is vital that this revised collection be implemented immediately because: (1) this information is essential to the mission of the Agency and (2) this information is necessary prior to the timeframes established under the PRA.

The proposed project aims to evaluate processes and outcomes of the programs of 20 state entities funded by CDC's Division of Adolescent and School Health to improve health, academic achievement, and well-being of students in K-12 schools nationwide. CDC awarded funds through cooperative agreement DP23-0002 (2302 Program) to 20 funding recipients (states, universities, and a tribal nation) to improve health, academic achievement, and well-being of students in K-12 schools. A portion of the funding within each state is allocated to one priority local education agency (LEA) and its corresponding schools to support the implementation of policies, practices, and programs to increase physical activity, healthy dietary behaviors, and management of chronic health conditions among students. CDC is conducting a mixed-methods multi-level evaluation of the 2302 Program and associated outcomes. Evaluation findings will allow CDC to help recipients improve their programs as they progress over the five-year funding period.

Abstract

The Secretary of State may exercise authority, under 22 U.S.C. 211a, Executive Order 11295 (August 5, 1966), and 22 C.F.R. 51.63, to invalidate all U.S. passports for travel to a country or area if he determines that any of three conditions exist: the country is at war with the United States; armed hostilities are in progress in the country or area; or there is imminent danger to the public health or physical safety of U.S. travelers in the country or area. The regulations of the Department of State provide that an individual’s passport may be considered for validation for travel to, in, or through a country or area despite such restriction if the individual’s travel is determined to fall within one of several categories established by the regulations. 22 C.F.R. 51.64. Without the requisite validation, use of a U.S. passport for travel to, in, or through a restricted country or area may justify revocation of the passport for misuse under 22 C.F.R. 51.62(a)(2) and subject the traveler to felony prosecution under 18 U.S.C. § 1544 for misuse of a passport or other applicable laws. The categories of persons specified in 22 C.F.R. 51.64(b) as being eligible for consideration for passport validation are as follows: (a) An applicant who is a professional reporter and journalist whose trip is for the purpose of collecting and making available to the public information about the restricted country or area; (b) An applicant who is a representative of the American Red Cross or the International Committee of the Red Cross on official mission to the restricted country or area; (c) An applicant whose trip to the restricted country or area is justified by compelling humanitarian considerations; or (d) An applicant whose trip to the restricted country or area is otherwise in the national interest. The proposed information collection solicits data necessary for the Passport Services Directorate to determine whether an applicant is eligible to receive a special validation in his or her U.S. passport book permitting the applicant to make one round-trip to a restricted country or area.

Abstract

Section 402(a)(1)(J) of the Social Security Amendments of 1967 (42 U.S.C. 1395b-1(a)(1)(J)) authorizes the Secretary to “develop or demonstrate improved methods for the investigation and prosecution of fraud in the provision of care or services under the health programs established by the Social Security Act (the Act).” Pursuant to this authority, CMS seeks to develop and implement a Medicare demonstration project, which CMS believes will assist in developing improved procedures for the identification, investigation, and prosecution of Medicare fraud occurring in ambulatory surgical centers providing services to Medicare beneficiaries. The information required for the prior authorization request includes all documentation necessary to show that the service meets applicable Medicare coverage, coding, and payment rules. Prior to rendering the services, ASC providers should submit this information to the Medicare Administrative Contractors (MACs). Trained clinical reviewers at the MACs will review the information required for this collection to determine if the requested services are medically necessary and meet Medicare requirements. If an ASC provider does not submit a prior authorization request before rendering the service and submitting a claim to Medicare for payment, the MAC will request the required information from the ASC provider to determine if the service meets applicable Medicare coverage, coding, and payment rules before the claim is paid.

Abstract

The Services Provided to Unaccompanied Children information collection contains 22 instruments that allow the Office of Refugee Resettlement (ORR) to collect information necessary to provide services to unaccompanied children as required by the Homeland Security Act (6 U.S.C. 279), the Trafficking Victims Protection Reauthorization Act of 2008 (8 U.S.C. 1232), and the Flores Settlement Agreement (No. CV85-4544-RJK (C.D. Cal. 1996)).  The collection was last approved by OMB on April 21, 2022, and expires on April 30, 2025. ORR is proposing changes to one form in this collection, the Home Study/Post-Release Service (HS/PRS) Referral (Form S-19). The currently approved version of the HS/PRS Referral (Form S-19) was developed for UC Path, an alternative case management system that ORR has not rolled out and therefore does not align with existing forms in the UC Portal, its current case management system. Approval of a UC Portal version will allow ORR to come into compliance with Paperwork Reduction Act (PRA) requirements. Additionally, ORR solicited feedback and completed testing activities, as approved under the “Feedback for Post-Release Service (PRS) Solution Development and Iteration” information collection (0970-0401) and has identified improvements to improve user experience.

Key Information

Abstract

The final rule requires revisions to our existing information collections to enable SSA to directly pay entities fees we may authorize to their employees, and to register all entities who wish direct payment to register with us, using our revised, standardized registration system. For some sections in this rule, we previously accounted for the public reporting burdens under the following OMB approved information collections: 0960-0527 (SSA-1696 Claimant’s Appointment of a Representative, which allows an individual to appoint a representative, and requires the representative’s agreement to serve as representative), 0960-0731 (SSA-1694, Request for Business Entity Taxpayer Information, which requests specific taxpayer data from representatives requesting a fee), and 0960 0732 (SSA-1699, Representative Registration, which requires the representatives to prove eligibility when they register with SSA and allows them to request a fee). Consequently, we are not reporting those sections here. However, the application of the revisions under this final rule requires burden changes and information collection revisions to the currently approved information collections under the following information collection requests: 0960-0527 (SSA-1696, Claimant’s Appointment of a Representative, which allows an individual to appoint a representative, and requires the representative’s agreement to serve as representative), 0960-0731 (SSA-1694, Request for Business Entity Taxpayer Information, which requests specific taxpayer data from representatives requesting a fee), and 0960 0732 (SSA-1699, Representative Registration, which requires the representatives to prove eligibility when they register with SSA and allows them to request a fee). We anticipate these revisions will increase the burdens for the affected information collections. We published a Notice of Proposed Rulemaking (NPRM) on August 4, 2023, at 88 FR 51747. In that NPRM, we solicited comments under the PRA on the burden estimate; the need for the information; its practical utility; ways to enhance its quality, utility, and clarity; and on ways to minimize the burden on respondents, including the use of automated collection techniques or other forms of information technology. The comments section of the final rule includes our responses to the PRA-related public comments we received under the NPRM. Note: While this information collection request encompasses multiple information collection (IC) tools, not all of the ICs will become effective at the same time. We expect to make the SSA 1694 (OMB No. 0960-0731) and the SSA-1699 (OMB No. 0960-0732) effective on September 30, 2024. However, we expect to make the SSA-1696 (OMB No. 0960 0527) effective December 9, 2024. SSA is submitting a single new Information Collection Request which encompasses revisions to information collections currently under OMB Numbers 0960-0527, 0960-0731 and 0960-0732 to OMB for the approval of the changes due to the final rule. After approval at the final rule stage, we will adjust the figures associated with the current OMB numbers for these forms to reflect the new burden.
