Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

FEMA previously used the Community Assistance Contact (CAC) and the Community Assistance Visit (CAV) to make a comprehensive assessment of a community's floodplain management program. Through this assessment, FEMA assisted the community to understand the NFIP's requirements and implement effective flood loss reductions measures. Communities can achieve cost savings through flood mitigation actions by way of insurance premium discounts and reduced property damage. The CAV and CAC processes have been updated recently to the NFIP Compliance Audit process which aims to do a more efficient, consistent and transparent job of assessing the community’s floodplain management program, providing them with the needed technical assistance to improve it, and documenting the results for data analysis.

Abstract

This is a request for an extension of a currently approved collection. The National Marine Fisheries Service (NMFS) issues permits, under the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.; MSA), to foreign fishing vessels fishing or operating in U.S. waters. MSA and associated regulations at 50 CFR Part 600 require that vessels apply for fishing permits, that vessels and certain gear be marked for identification purposes, that observers be embarked on selected vessels, and that permit holders report their fishing effort and catch or, when processing fish under joint ventures, the amount and locations of fish received from U.S. vessels. These requirements apply to all foreign vessels fishing, transshipping, or processing fish in U.S. waters. Information is collected from persons who operate a foreign fishing vessel in U.S. waters to participate in a directed fishery or joint venture operation, transship fish harvested by a U.S. vessel to a location outside the U.S., or process fish in internal waters. Each person operating a foreign fishing vessel under MSA authority may be required to submit information for a permit, mark their vessels and gear, or submit information about their fishing activities. To facilitate observer coverage, foreign fishing vessel operators must provide a quarterly schedule of fishing effort and upon request must also provide observers with copies of any required records. For foreign fishing vessels that process fish in internal waters, the information collected varies somewhat from other foreign fishing vessels that participate in a directed fishery or a joint venture operation. In particular, these vessels may not be required to provide a permit application or mark their vessels. The information submitted in applications is used to determine whether permits should be used to authorize directed foreign fishing, participation in joint ventures with U.S. vessels, or transshipments of fish or fish products within U.S. waters. The display of identifying numbers on vessels and gear aid in fishery law enforcement and allows other fishermen to report suspicious activity. Reporting of fishing activities allows monitoring of fish received by foreign vessels.

Abstract

The National Center for Health Statistics (NCHS) is to assess the health of the population through the creation of a dataset that contains information on health care utilization as well as the demographic characteristics, medical conditions, and treatment of patients who use hospitals for inpatient and ambulatory medical care in the United States. The Centers for Disease Control and Prevention (CDC), requests a three-year approval for a revision to continue the National Hospital Care Survey (NHCS) (OMB No. 0920-0212, expires 12/31/2024). Although there are no new questions added to the data collection survey, the COVID-19 questions from the Annual Hospital Interview (AHI) have been removed. Despite an increase in sample size, the burden hours have decreased as fewer hospitals now need to complete the one-time initial intake questionnaire (see section 12 for more information about these changes). The use of the resulting data is to provide government, professional, scientific, academic, and commercial institutions, and private research organizations, as well as private citizens with information that can be used to monitor public health and to investigate research questions about health care utilization and delivery over time. Inpatient and ambulatory data will be collected from a sample of 601 hospitals via Uniform Billing (UB)-04 administrative claims or electronic health record (EHR) data. Additionally, hospital-level characteristics for all sampled hospitals are gathered through an Annual Hospital Interview. The target subpopulation of the NHCS is inpatient discharges, and patient visits made to Emergency Departments (EDs) and Outpatient Departments (OPDs) of non-Federal, non-institutional hospitals with six or more beds staffed for inpatient use in the 50 states and the District of Columbia. Findings will be released in NCHS reports, dashboards, journal articles, and research papers as well as released to researchers for analysis.

Docket No. RD22-5. Delegated order was published on November 23, 2022. The Facility Design, Connections, and Maintenance Reliability Standards address topics such as facility interconnection requirements, facility ratings, system operating limits, and transfer capabilities. Reliability Standard FAC-001-003 required Transmission Owners and applicable Generator Owners to complete coordinated studies for new or “materially modified” existing interconnections. Reliability Standard FAC-001-4 clarifies that requirement by applying it to “qualified changes” instead of “materially modified” interconnections. This clarification is intended to prevent confusion with the Commission-defined term “Material Modification” in the pro forma interconnection procedures and agreements. The Commission estimates no burden effects for this clarification. The delegated order also revises Requirement R6 of previously approved Reliability Standard FAC-002-3 by requiring planning coordinators to define the term “qualified change” and requiring public posting of the definition. This new information collection activity represents a minor additional burden to planning coordinators, who must develop the definition of “qualified change” for new and existing interconnections of generation, transmission, or electricity end user facilities. This burden is expected to be greater in years one and two than in year three and beyond for this new information collection activity. The implementation of Reliability Standards FAC-001-4 and FAC-002-4 will ensure that there is appropriate coordination and communication regarding the interconnection of facilities.

Abstract

This ICR renewal is for the mandatory reporting of foreign motor carriers to report information to FMCSA on an annual basis using the OP-2 form in order to operate in the United States. This collection of information is used by the FMCSA to register foreign motor carriers to operate across the Mexico- U.S. border into the United States in accordance with 49 U.S.C. 13902(c) and 49 CFR 368. Data contained on the Form OP-2 will provide the FMCSA with evidence to assess the foreign (Mexico-based) motor carrier’s safety program and its ability to comply with U.S. safety standards. It also provides information concerning changes in each carrier’s operating status to ensure actual compliance with safety requirements. This enables the Agency to maintain an accurate census of registered carriers and ensure safety. There is an increase in the number of respondents and in the burden hours calculated for this renewal. The annual burden hour increase of 831 is due primarily to the increase in the number of updated OP-2 forms filed from 2020 through 2022. The average number of entities which filed updated OP-2 forms in the three-year period 2020 and 2022 increased by 95 percent, compared to the number that registered from 2017 through 2019.

Abstract

Coal combustion residuals (CCR) are generated from the combustion of coal, including solid fuels classified as anthracite, bituminous, subbituminous, and lignite, for the purpose of generating steam for the purpose of powering a generator to produce electricity or electricity and other thermal energy by electric utilities and independent power producers. CCR includes fly ash, bottom ash, boiler slag, and flue gas desulfurization materials. CCR are solid wastes that are neither listed nor characteristic hazardous waste and thus, are subject to the requirements of Subtitle D of the Resource Conservation and Recovery Act, as amended (RCRA). RCRA Subtitle D establishes a framework for federal, state, and local government cooperation in controlling the management of non-hazardous solid waste. The federal role in this management structure is to establish the overall regulatory direction, by providing minimum national standards that will protect human health and the environment, and to provide technical assistance to states for planning and developing their own environmentally sound waste management practices. The actual planning and any direct implementation of solid waste programs under RCRA Subtitle D, however, remains a state and local function, and RCRA envisions that states will devise programs to deal with state-specific conditions and needs. 40 CFR Part 257 contains provisions regarding the management of CCR under RCRA Subtitle D. In 2015, EPA published a final rule to regulate the disposal of CCR from electric utilities as solid waste under RCRA Subtitle D (see 80 FR 21302; April 17, 2015). In the final rule, EPA established national minimum criteria for existing and new CCR landfills and CCR surface impoundments and all lateral expansions to include location restrictions, design and operating criteria, groundwater monitoring and corrective action, closure requirements and post-closure care, and recordkeeping, notification, and internet posting requirements. The 2015 rule requires any existing unlined CCR surface impoundment that is contaminating groundwater above a regulated constituents groundwater protection standard to stop receiving CCR and either retrofit or close, except in limited circumstances. The rule also requires the closure of any CCR landfill or CCR surface impoundment that cannot meet the applicable performance criteria for location restrictions or structural integrity established in this rule. CCR surface impoundments that are no longer receiving CCR as of the effective date of the rule, but still contain water and CCR, will be subject to all applicable regulatory requirements, unless the owner or operator of the facility closes the inactive unit (e.g., the impoundment is closed with a final cover system) no later than three years from the effective date of the rule.

Abstract

Section 6002 of the Affordable Care Act added section 1128G to the Social Security Act (Act), which requires applicable manufacturers and applicable group purchasing organizations (GPOs) of covered drugs, devices, biologicals, or medical supplies to report annually to CMS certain payments or other transfers of value to physicians and teaching hospitals, as well as, certain information regarding the ownership or investment interests held by physicians or the immediate family members of physicians in such entities. Specifically, applicable manufacturers of covered drugs, devices, biologicals, and medical supplies are required to submit on an annual basis the information required in section 1128G(a)(1) of the Act about certain payments or other transfers of value made to physicians and teaching hospitals (collectively called covered recipients) during the course of the preceding calendar year. Similarly, section 1128G(a)(2) of the Act requires applicable manufacturers and applicable GPOs to disclose any ownership or investment interests in such entities held by physicians or their immediate family members, as well as information on any payments or other transfers of value provided to such physician owners or investors. Applicable manufacturers must report the required payment and other transfer of value information annually to CMS in an electronic format. The statute also provides that applicable manufacturers and applicable GPOs must report annually to CMS the required information about physician ownership and investment interests, including information on any payments or other transfers of value provided to physician owners or investors, in an electronic format by the same date. This information collection will survey disenrollees from Medicare Prescription Drug Plans (PDPs) and Medicare Advantage Prescription Drug Plans (MA-PDs). The Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA) provides a requirement to collect and report performance data for Part D prescription drug plans. Specifically, the MMA under Sec. 1860D-4 (Beneficiary Protections for Qualified Prescription Drug Coverage) requires CMS to conduct consumer satisfaction surveys regarding PDPs and MA-PDs - pursuant to section 1860D-4(d). This data collection complements the satisfaction data collected through the Medicare CAHPS Survey by providing dissatisfaction data in the form of reasons for disenrollment from PDPs and MA-PDs.
