Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The current submission is a request for a new clearance number, to be discontinued once the burden and associated information collections can be transferred into 3150-0011, the clearance for information collections contained in 10 CFR Part 50. FINAL RULE: 10 CFR Part 50, American Society of Mechanical Engineers Code Cases and Inservice Testing and Inservice Inspection Program Update Frequency -- This final rule is the latest in a series of rulemakings that incorporate by reference the latest revisions of three regulatory guides (RGs) identifying new and revised unconditionally or conditionally acceptable ASME Code Cases that are approved for use. The NRC is proposing to amend its regulations to incorporate by reference proposed revisions of three regulatory guides, which would approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers. This action allows nuclear power plant licensees and applicants for construction permits, operating licenses, combined licenses, standard design certifications, standard design approvals, and manufacturing licenses to use the code cases listed in these draft regulatory guides as voluntary alternatives to engineering standards for the construction, inservice inspection, and inservice testing of nuclear power plant components. These engineering standards are set forth in the American Society of Mechanical Engineers Boiler and Pressure Vessel Code and American Society of Mechanical Engineers Operation and Maintenance Code, which are currently incorporated by reference into the NRC's regulations. Further, this final rule announces the availability of a related regulatory guide, not incorporated by reference into the NRC's regulations, that lists code cases that the NRC has not approved for use. In addition, this rulemaking provides more flexibility to licensees by expanding the code of record interval from ten years to two consecutive inservice testing and inservice inspection intervals.

Low Income Home Energy Assistance Program (LIHEAP) Carryout and Reallotment Report

Key Information

Abstract

The federal Low Income Home Energy Assistance Program (LIHEAP) statute requires the Department of Health and Human Services (HHS) to collect data annually from all LIHEAP grant recipients regarding the status of obligated and unobligated funding (42 U.S.C. § 8626). The amount held available from a prior fiscal year shall not exceed 10 percent of the funds awarded for that fiscal year (42 U.S.C. § 826(b)(2)(B)), with the excess reallotted in the following fiscal year among that year’s LIHEAP grant recipients (42 U.S.C. § 8626(b)(1)(C)). The federal HHS block grant regulations further require that the Carryover and Reallotment Report (Carryover Report) must contain the following information: (1) The amount of funds that the grant recipient requests to hold available for obligation in the following fiscal year; (2) A statement of the reasons that this amount to remain available will not be used in the fiscal year for which it was allotted; (3) A description of the types of assistance to be provided with the amount held available; and (4) The amount of funds, if any, to be subject to reallotment. See 45 C.F.R. § 96.81. OMB most recently approved the Carryover Report in June 2022 for three years. The form as approved includes three lines that cover unobligations from the following sources: (1) regular LIHEAP funds; (2) supplemental funds from the Infrastructure Investments and Jobs Appropriations Act (IIJA) [Public Law (P. L.) 117-58]; and (3) supplemental funds from other sources. Since the lines for these supplemental funds from other sources, including Coronavirus Aid, Relief, and Economic Security (CARES) Act (Public Law 116-136), American Rescue Plan Act (ARP) of 2021 (Public Law 117-2), are not available for obligation in Fiscal Year 2024 (FY24) they need to be removed prior to the next reporting period (planned to begin August 1, 2024). The addition of these lines for these supplemental funds was originally processed as nonsubstantive changes. Similarly, this change request is to update the form, instructions, and burden estimates to reflect the removal of these lines. Minor updates were also made to the instructions for clarity, such as wording and punctuation. HHS’s Administration for Children and Families (ACF) seeks to revise this form to zero-out the third line (unobligations from other sources of supplemental funds) and close it to user entry. It also seeks to make minor changes to wording and punctuation. ACF also seeks to accordingly revise the instructions associated with this form. Finally, for the version of the Carryover Report that was approved in July 2022, we estimated the total average burden to be 7 hours per respondent. This estimate combined (1) three hours per respondent for the standard lines; and (2) four additional hours per respondent to cover the breakouts of funds from non-IIJA supplemental appropriations. With the removal of the non-IIJA supplemental appropriations lines, we are reverting to the previous estimate of an average of 3 hours per response. Supporting Statement A was updated to explain these updates and to update the burden section.

Abstract

For this program, performance measures were developed to provide data on each RCORP initiative to enable HRSA to provide aggregate program data required by Congress under the Government Performance and Results Act of 1993. These measures cover the principal topic areas of interest to the Federal Office of Rural Health Policy (FORHP), including: (a) Provision of, and referral to, rural behavioral health care services, including Substance Use Disorder (SUD)/Opioid Use Disorder (OUD) prevention, treatment and recovery support services; (b) behavioral health care, including SUD/OUD prevention, treatment, and recovery, process and outcomes; (c) education of health care providers and community members; (d) emerging trends in rural behavioral health care needs and areas of concern; and (e) consortium strength and sustainability.

FTC Cigarette and Smokeless Tobacco Data Collection

Key Information

Abstract

Pursuant to Section 6(b) of the FTC Act, 15 U.S.C. 46(b), the Commission collects information on sales and/or marketing of cigarettes, smokeless tobacco products, tobacco-free nicotine lozenges and pouches, and electronic devices used to heat non-combusted cigarettes (collectively, “subject products”) from manufacturers of cigarettes and smokeless tobacco products. Depending on the type of product a manufacturer produces, the Commission requests the information using two different instruments—that is, a Cigarette Order and a Smokeless Tobacco Order. The Commission compiles and publishes the data in two periodic reports. Using compulsory process under Section 6(b) of the FTC Act, the Commission plans to continue sending information requests annually to the ultimate parent companies of the largest cigarette companies and smokeless tobacco companies in the United States (collectively, “industry members”). The information requests will seek data regarding, among other things: (1) the cigarette or smokeless tobacco sales of industry members; (2) how much industry members spend advertising and promoting their cigarette or smokeless tobacco products, and the specific amounts spent in each of a number of specified expenditure categories; (3) whether industry members are involved in the appearance of their cigarette or smokeless tobacco products or brand imagery in television shows, motion pictures, on the internet, or on social media; (4) how much industry members spend on advertising intended to reduce youth cigarette or smokeless tobacco usage; (5) the events, if any, during which industry members’ cigarette or smokeless tobacco brands are televised; and (6) how much industry members spend on public entertainment events promoting their companies but not specific cigarette or smokeless tobacco products or such products generally. The information requests will also seek information from the cigarette companies pertaining to the annual sales, give aways, and marketing expenditures for electronic devices used to heat non-combusted cigarette products. While, in previous years, the information requests only sought information pertaining to the annual unit and dollar sales of tobacco-free nicotine lozenges and pouches, the Commission plans to seek a modification of its existing clearance in order to collect information concerning advertising and promotional expenditures for tobacco-free nicotine lozenges and pouches. The need to collect this information is predicated upon the fact that sales of tobacco-free nicotine lozenges and pouches more than doubled between 2020 and 2022, and these products appear to be especially popular with youth.
