Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Survey of Staff Recruitment, Training, and Professional Development in Early Head Start

Abstract

On March 26th, 2024, OMB approved the information collection request to: (1) collect survey data from up to 600 Early Head Start programs representative of the population of Early Head Start programs in the continental United States; and (2) recruit Early Head Start program directors, or another program staff to answer the survey about (a) their program’s staff recruitment, training, and professional development strategies; (b) their programs’ successes and challenges with those strategies for hiring and maintaining staff with the qualifications and competencies to serve infants, toddlers, and pregnant women. The study team started collecting data in April of 2024 and preliminary analysis of our data showed that there was a survey logic error that made 43 of respondents skip over a subset of follow-up questions from instruments 1, 2, and 3. It is important that our team collects complete information from most participants to ensure representativeness of the Early Head Start program population. Finding this error highlighted a need for our team to be able to follow-up with certain participants about this specific question and other issues that might arise as we perform quality assurance checks of the data.

The Centers for Medicare & Medicaid Services (CMS) is requesting the Office of Management and Budget (OMB) approval for adding additional services to the established prior authorization process and requirements for certain outpatient department (OPD) services. This process is under the authority of §1833(t)(2)(F), which authorizes the Secretary to develop a method for controlling unnecessary increases in the volume of covered OPD services. CMS adds OPD services to the prior authorization process through the CY OPPS/ASC final rules. CMS' extensive data analysis of these additional OPD services demonstrated significant increases in the utilization volume. CMS believes a prior authorization process would ensure beneficiaries receive medically necessary care while protecting the Medicare Trust Funds from improper payments and unnecessary utilization.

Abstract

The FFIEC 002 must be submitted quarterly by U.S. branches and agencies of foreign banks. The report requests detailed schedules of assets and liabilities as a condition report with a variety of supporting schedules. This information is used to fulfill the agencies’ supervisory and regulatory requirements pursuant to the International Banking Act of 1978 (IBA). The FFIEC 002S is a mandatory supplement to the FFIEC 002 that collects information on assets and liabilities of any non U.S. branch that is managed or controlled by a U.S. branch or agency of a foreign bank. A separate FFIEC 002S supplement is completed by the managing or controlling U.S. branch or agency for each applicable foreign branch. The FFIEC 002S collects data on U.S. deposits, credit, and international indebtedness, and assists U.S. bank supervisors in determining the assets managed or controlled by the U.S. agency or branch of the foreign bank.

The SBS Recordkeeping Release adopted new Exchange Act Rule 18a-6 (in conjunction with the new Exchange Act Rule 18a-5) which establishes recordkeeping requirements applicable to stand-alone SBSDs, stand-alone MSBSPs, bank SBSDs, and bank MSBSPs. Rule 18a-6 is modeled on Exchange Act Rule 17a-4, which applies to broker-dealers, but Rule 18a-6 does not include a parallel requirement for every requirement in Rule 17a-4 because some of the requirements in Rule 17a-4 relate to activities that are not expected or permitted of stand-alone SBSDs, stand-alone MSBSPs, bank SBSDs, and bank MSBSPs. Proposed Partial Revision-- In November 2021, the Commission proposed amendments to the electronic recordkeeping requirements of security in Rule 18a-6. Abstract

Section 1833(t)(6) of the Act provides for temporary additional payments or “transitional pass-through payments” for certain drugs and biological agents. As originally enacted by the Balanced Budget Refinement Act (BBRA), this provision required the Secretary to make additional payments to hospitals for current orphan drugs, as designated under section 526 of the Federal Food, Drug, and Cosmetic Act (Pub. L. 107-186); current drugs and biological agents and brachytherapy used for the treatment of cancer; and current radiopharmaceutical drugs and biological products. For those drugs and biological agents referred to as “current,” the transitional pass-through payment began on the first date the hospital OPPS was implemented (before enactment of Benefits Improvement and Protections Act (BIPA) (Pub. L. 106-554), on December 21, 2000). Transitional pass-through payments are also required for certain “new” drugs, devices and biological agents that were not being paid for as a hospital outpatient department (OPD) service as of December 31, 1996, and whose cost is “not insignificant” in relation to the outpatient perspective payment system (OPPS) payment for the procedures or services associated with the new drug, device, or biological. Under the statute, transitional pass- through payments can be made for at least 2 years but not more than 3 years.

Integrated Postsecondary Education Data System (IPEDS) 2024-25 through 2026-27

Abstract

The National Center for Education Statistics (NCES) seeks authorization from OMB to make a change to the Integrated Postsecondary Education Data System (IPEDS) data collection. IPEDS is a web-based data collection system designed to collect basic data from all postsecondary institutions in the United States and the other jurisdictions. The IPEDS data collection enables the National Center for Education Statistics (NCES) to report on key dimensions of postsecondary education such as enrollments, degrees and other awards earned, tuition and fees, average net price, student financial aid, graduation rates, student outcomes, revenues and expenditures, faculty salaries, and staff employed. The IPEDS web-based data collection system was implemented in 2000-01. In 2022-23, IPEDS collected data from 5,983 Title IV postsecondary institutions in the United States and the other jurisdictions. All Title IV institutions are required to respond to IPEDS (Section 490 of the Higher Education Amendments of 1992 [P.L. 102-325]). IPEDS allows other (non-Title IV) institutions to participate on a voluntary basis; approximately 200 non-Title IV institutions elect to respond each year. Institution closures and mergers have led to a decrease in the number of institutions in the IPEDS universe over the past few years. Due to these fluctuations, combined with the addition of new institutions, NCES uses rounded estimates for the number of institutions in the respondent burden calculations for the upcoming years (estimated 6,000 Title IV institutions plus 200 non-title IV institutions for a total of 6,200 institutions estimated to submit IPEDS data during the 2024-25 through 2026-27 IPEDS data collections). IPEDS data are available to the public through the College Navigator and IPEDS Use the Data websites. The current clearance covers the 2022-23 through 2024-25 collections and is due to expire on August 31, 2025. We are requesting to make changes to multiple survey components and other updates to the identification, cross-cutting terminology, and the glossary. The largest changes in this package are (1) the addition of a new Cost (CST) survey component, which combines components taken from the Student Financial Aid (SFA) and Institutional Characteristics (IC) components and combines them with added questions to determine how and make publicly available more information about how postsecondary institutions ask for information above and beyond the FAFSA; and (2) the planned elimination of the Academic Libraries (AL) survey beginning in the 2025-26 administration. As part of the 30D public comment period review, NCES has added an Appendix E, containing NCES responses to 60D public comments. Further, NCES requests that IPEDS data submitters and other stakeholders respond to the directed questions found in Appendix D of this submission.

Abstract

Congress has directed the Commission to collect fees and annual charges equal to its annual appropriation. The Commission deposits the fees and annual charges it collects into the Department of Treasury's general fund. In order to determine annual charges, the Commission staff uses the data submitted under FERC-582 to establish the total megawatt-hours of transmission of electric energy in interstate commerce. All parties involved in the generation and sale of electric energy rely on the transmission system to move their product (i.e. transmitted energy). Power sellers contribute to the Commission's recovery of electric regulatory program costs in that they will use the transmission system and any cost-based rates that these entities pay for their transmission service that they may take will be incurred as a share of the Commission's costs.

Part 23 of the Commission’s regulations, adopted pursuant to section 4s(e) of the CEA, sets forth minimum capital requirements for swap dealers (“SDs”) and major swap participants (“MSPs”). Part 23 also imposes margin requirements for SDs and MSPs that engage in uncleared swap transactions. The collection reflects the reporting and recordkeeping requirements with which FCMs, SDs, and MSPs must comply in connection with their segregation, capital, and margin requirements. The Commission is adopting amendments to certain of its part 23 regulations that impose minimum capital requirements and financial reporting obligations on SDs and MSPs. Specifically, the amendments include revisions consistent with staff interpretive letter 21-15 to SDs addressing the Tangible Net Worth Capital Approach for calculating capital under Commission regulation 23.101 and no-action letter 21-18 (and its successor no-action letter 23-11) regarding alternative financial reporting by SDs subject to the capital requirements of a prudential regulator. The Commission is also adopting amendments to Commission regulation 23.105 applicable to SDs, in areas including the required timing of certain notifications, the process for approval of subordinated debt for capital, and the revision of financial reporting forms to conform to the rules. The amendments are intended to make it easier for SDs to comply with the Commission’s financial reporting obligations and demonstrate compliance with minimum capital requirements.

Abstract

This is a request for revision and extension of a generic clearance for voluntary customer surveys to be conducted by NOAA NWS program offices. In accordance with Executive Order 12862, the National Performance Review, and good management practices, NOAA NWS offices seek to be able to continue to gather customer feedback on services and/or products, which can be used in planning for service/product modification and prioritization. Under this generic clearance, NWS individual offices would continue use of an approved question bank and develop new questionnaires, as needed, by selecting subsets of the approved set of collection questions and tailoring those specific questions to be meaningful for their particular programs. This collection is being revised to expand the question bank of acceptable questions and limit the scope of use to NWS.

Abstract

This is an ICR revision. There is a 13,680 annual burden hour increase from the currently approved 72,808 annual burden estimate. The collection of information is mandatory and is for recordkeeping purposes. The Brokers of Household Goods Final Rule (75 FR 72987) requires brokers to obtain a signed and dated receipt from the individual shippers for the “Ready to Move” brochure and the “Your Rights and Responsibilities When You Move” pamphlet. Brokers that arrange the transportation of HHG in interstate or foreign commerce for consumers must provide: their U.S. DOT number on their advertisements and Internet Web sites; estimates of expected moving charges and brokerage fees; FMCSA pamphlets containing tips for successful moves and the consumer’s rights and responsibilities; and the broker’s policies concerning deposits, cancellations, and refunds. Brokers must either provide a hyperlink on their Internet website to the FMCSA website containing the brochure and pamphlet in FMCSA’s publications, or brokers must distribute to each shipper and potential shipper at the time they provide an estimate, copies of FMCSA’s publications. If an individual shipper elects to waive physical receipt of the Federal consumer protection information and elects to access the same information via the hyperlink on the Internet then the broker must include a clear and concise statement on the written estimate that the individual shipper expressly agreed to access the Federal consumer protection information on the Internet. The broker must obtain a signed, dated, electronic or paper receipt showing the individual shipper has received both booklets which includes, if applicable, verification of the shipper’s agreement to access the Federal consumer protection information on the Internet. The broker must maintain the signed receipt for three years from the date the individual shipper signs the receipt. The collected information assists shippers in their commercial dealings with interstate brokers. The collection of information is used by prospective shippers to make informed decisions about contracts and services to be ordered, executed, and settled within the interstate motor carrier industry. These actions are intended to help ensure the individual shippers who arrange for transportation of HHG through brokers receive necessary information regarding their rights and responsibilities in connection with interstate HHG moves, to educate shippers and prepare them for a successful move. The information will be collected when a shipper requests that a broker provide an estimate and when a shipper arranges for a broker to have a particular mover transport household goods. Therefore, frequency is based on the number of moves arranged and is not a factor that FMCSA or the broker can control. The frequency of information collection is done more often than quarterly as it is done as services are requested by the shipper.
