Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Executive Order 12862 directs Federal agencies to provide service to the public that matches or exceeds the best service available in the private sector. In order to work continuously to ensure that our programs are effective and meet our customers' needs, Cybersecurity and Infrastructure Security Agency (hereafter "the Agency") seeks to obtain OMB approval of a generic clearance to collect qualitative feedback on our service delivery. By qualitative feedback we mean information that provides useful insights on perceptions and opinions, but are not statistical surveys that yield quantitative results that can be generalized to the population of study. This collection of information is necessary to enable the Agency to garner customer and stakeholder feedback in an efficient, timely manner, in accordance with our commitment to improving service delivery. The information collected from our customers and stakeholders will help ensure that users have an effective, efficient, and satisfying experience with the Agency's programs. This feedback will provide insights into customer or stakeholder perceptions, experiences and expectations, provide an early warning of issues with service, or focus attention on areas where communication, training or changes in operations might improve delivery of products or services. These collections will allow for ongoing, collaborative and actionable communications between the Agency and its customers and stakeholders. It will also allow feedback to contribute directly to the improvement of program management.

Abstract

On March 27, 2024, the Commission adopted amendments to rule 203A-2(e) for investment advisers relying on the exemption in rule 203A-2(e). In connection with the amendments to rule 203A-2(e) ("internet investment advisers"), the Commission amended Form ADV to conform certain instructions and definitions to the amended rule. The amendments to Form ADV require an adviser relying on the rule as a basis for registration to represent on Schedule D of its Form ADV that it has an operational interactive website. These amendments require internet investment advisers, as an initial matter and periodically thereafter, to provide an additional affirmative representation on Form ADV that more clearly notes the requirements of the exemption, thus reinforcing the conditions of the exemption for the internet investment adviser. The Commission uses the information on Form ADV to determine eligibility for registration and to manage regulatory and examination programs. Clients use the information required in Form ADV to determine whether to hire or retain an investment adviser.

The USMCA Automotive Rules of Origin Motor Vehicle Producer Questionnaire

Key Information

Abstract

The United States International Trade Commission (Commission) is conducting a factfinding investigation (Inv. No. 332-600) to analyze the economic impact of the automotive rules of origin (ROOs) in the United States-Mexico-Canada Agreement (USMCA) and their impact on the U.S. economy and automotive industry, effect on U.S. competitiveness, and relevancy in light of technological changes. The report in connection with this investigation is required by the United States-Mexico-Canada Agreement Implementation Act (19 U.S.C. 4532(g)(2)) (USMCA Implementation Act). The USMCA Implementation Act requires the Commission to prepare a series of five biennial reports on the USMCA automotive ROOs, and to submit those reports to the President, the House Committee on Ways and Means, and the Senate Committee on Finance. The Commission is conducting a survey of motor vehicle producers in the United States for the second report, which will be published by July 1, 2025.

Abstract

EPA proposed a rule under section 6 of the Toxic Substances Control Act (TSCA) to address the unreasonable risk to human health presented by methylene chloride under its conditions of use. The proposed rule would: (1) prohibit the manufacture, processing, and distribution in commerce of methylene chloride for all consumer use; (2) prohibit most industrial and commercial uses of methylene chloride; (3) require a workplace chemical protection program (WCPP), including inhalation exposure concentration limits and related workplace exposure monitoring and exposure controls, for ten conditions of use of methylene chloride (including manufacture; import; processing as a reactant; processing as an incorporation into a formulation, mixture, or reaction product; processing in repackaging; processing as recycling; laboratory use; industrial or commercial use in aerospace and military paint and coating removal from safety-critical, corrosion-sensitive components by Federal agencies and their contractors; industrial or commercial use as a bonding agent for acrylic and polycarbonate in mission-critical military and space vehicle applications, including in the production of specialty batteries for such by Federal agencies and their contractors; and disposal); (4) require recordkeeping and downstream notification requirements for manufacturing, processing, and distribution in commerce of methylene chloride; (5) provide a 10-year time-limited exemption under TSCA section 6(g) for paint and coating removal uses by military and civilian aviation that EPA proposes are critical to national security and infrastructure, with conditions for this exemption to include compliance with the WCPP; and, (6) provide a 10-year time-limited exemption under TSCA section 6(g) for emergency use of methylene chloride in furtherance of NASAs mission for specific conditions which are critical or essential and for which no technically and economically feasible safer alternative is available, with conditions for this exemption to include compliance with the WCPP. The information collection activities contained in the proposed rule are: (1) Downstream notification requirements though Safety Data Sheets (SDS); (2)WCPP-related information generation, recordkeeping, and notification requirements, including: (a) development of exposure control plans; (b) exposure level monitoring and related recordkeeping; (c) development of documentation for a Personal Protective Equipment program and related recordkeeping; (d) development of documentation for a respiratory protection program and related recordkeeping; (e) development and notification to potentially exposed persons (employees and others in the workplace) about how they can access the exposure control plans, exposure monitoring records, PPE program implementation documentation, and respirator program documentation; and, (f) development of documentation demonstrating eligibility for an exemption from the proposed prohibitions, and related recordkeeping. Finally, the proposed rule would also require recordkeeping related to exemptions proposed under TSCA section 6(g) demonstrating compliance with the specific conditions of the exemptions (including compliance with the interim WCPP). The proposed rule would require that records be retained for 5 years from the date of generation.

Abstract

This is a request for clearance for the National Endowment for the Arts (NEA) to collect data for a developmental, descriptive evaluation study of the national ArtsHERE pilot initiative (https://usregionalarts.org/artshere/). This is a new data collection request, and the data to be collected are not available elsewhere unless collected through this information collection. ArtsHERE is a new subgrant program launched by the NEA in partnership with South Arts and in collaboration with the five other U.S. Regional Arts Organizations (RAOs). The program invests in a range of projects to strengthen the capacity of organizations that are already engaging with underserved groups/communities to boost arts participation, learn from their experiences in undertaking this work, and connect these organizations to each other and to other relevant entities through technical assistance and peer-learning opportunities. ArtsHERE will offer non-matching project subgrants (referred to as “grants”) from $65,000 to $130,000 to approximately 95 eligible organizations nationwide. Grantees will participate in peer-learning communities, technical assistance, and evaluation. Through this data collection, the National Endowment for the Arts will implement its monitoring, evaluation, and learning plan to guide efforts to monitor progress, make midcourse corrections if necessary, and evaluate outcomes of ArtsHERE. Information collection will include 7 instruments (web surveys and forms) to collect information regarding ArtsHERE stakeholder experiences, outcomes, and lessons learned. Through this data collection, the NEA will document and evaluate ArtsHERE to better understand the project activities supported through this program and how grantees approached the work. The evaluation will result in a summary of lessons learned and may inform the future of the ArtsHERE program. Beyond learning how it might improve its own activities and funding practices and activities, the data will be used to help generate insights to strengthen the arts and culture sector and to inform future practice and national strategy for public funding for the arts. The data collection activities are planned for May 2024 through September 2026. A second PRA clearance package or amendment to the first PRA package will be submitted in Fiscal Year 2025 for additional evaluation materials under the study’s monitoring and evaluation components, and a separate generic clearance package under Generic Clearance Protocol (OMB Co. Abstract

Form PF and rule 204(b)-1 under the Investment Advisers Act of 1940 (“Advisers Act”) require certain investment advisers registered with the SEC to report confidential information about the private funds they advise. The rules implement provisions of Title IV of the Dodd-Frank Wall Street Reform and Consumer Protection Act (“Dodd-Frank Act”), which amended the Advisers Act to require the SEC to, among other things, establish reporting requirements for advisers to private funds. The information collected on Form PF is designed to facilitate the Financial Stability Oversight Council’s (“FSOC”) monitoring of systemic risk in the private fund industry and assist FSOC in determining whether and how to deploy its regulatory tools with respect to nonbank financial companies. The SEC and the Commodity Futures Trading Commission (“CFTC”) also may use information collected on Form PF in their regulatory programs, including examinations, investigations, and investor protection efforts relating to private fund advisers. Form PF is a joint form between the SEC and the CFTC with respect to sections 1 and 2; the SEC solely adopted the other sections of the form.

Data Security Requirements for Accessing Confidential Data

Key Information

Abstract

When an application for confidential data is approved through the SAP Portal, ERS will collect information to fulfill its data security requirements. This is a required step before providing the individual with access to restricted use microdata for the purpose of evidence building. ERS’s data security agreements and other paperwork, along with the corresponding security protocols, allow ERS to maintain careful controls on confidentiality and privacy, as required by law. ERS’s collection of data security information will occur outside of the SAP Portal.
