What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

In Docket No. EP 711 (Sub-No. 2) (Final Rule), the Board issued a new set of regulations that would provide for the prescription of reciprocal switching agreements to address inadequate rail service, as determined using objective standards based on a carrier’s original estimated time of arrival, transit time, and first-mile and last-mile service. To help implement the new regulations, the Board proposes (1) to require Class I carriers to submit certain data, which would be publicly accessible and generalized; and (2) to adopt a new requirement that, upon written request by a customer, a rail carrier must provide to that customer individualized, machine-readable service data. The Class I carriers also required to update their definitions of original estimated time of arrival (OETA) and “industry spot and pull” (ISP) standard for its required reporting. Based on this information, the shippers/receivers would be required to file a petition seeking the prescription of a reciprocal switching agreement, and the Class I carriers would be able to file a petition to terminate that prescription.

Abstract

The Office for Civil Rights Section 1557 final rule contains information collection requirements that are subject to review by the Office of Management and Budget (OMB) under the Paperwork Reduction Act of 1995 (“PRA”). Under the PRA, agencies are required to submit to OMB for review and approval any reporting or record-keeping requirements inherent in a proposed or final rule and are required to publish such proposed requirements for public comment. The PRA requires agencies to provide a 60-day notice in the Federal Register and solicit public comment on a proposed collection of information before it is submitted to OMB for review and approval. Under Section 3506(c)(2)(A) of the PRA, the Department solicited comment on the following issues: 1. Whether the information collection is necessary and useful to carry out the proper functions of the agency; 2. The accuracy of the agency’s estimate of the information collection burden; 3. The quality, utility, and clarity of the information to be collected; and 4. Recommendations to minimize the information collection burden on the affected public, including automated collection techniques.

Procedures for Requesting a Chemical Risk Evaluation under TSCA (Final Rule)

Abstract

This ICR is related to a requirement contained in a proposed rule to implement provisions outlined in the Frank R. Lautenberg Chemical Safety of the 21st Century Act which passed in June 2016 and amended the Toxic Substances Control Act (TSCA). The Environmental Protection Agency (EPA) is proposing to amend the process for conducting risk evaluations under the TSCA to determine whether a chemical substance presents an unreasonable risk of injury to health or the environment under the known, intended, or reasonably foreseen conditions of use, without consideration of costs or non-risk factors, including unreasonable risk to potentially exposed or susceptible subpopulations. EPA has reconsidered the procedural framework rule for conducting such risk evaluations and determined that certain aspects of that framework should be revised to align with applicable court decisions and the statutory text, to reflect the Agency’s experience implementing the risk evaluation program following enactment of the 2016 TSCA amendments, and to allow for consideration of scientific advances in the risk evaluation process without need to further amend the Agency’s procedural rule. Revisions to this rule also includes changes to the process by which a manufacture may request that EPA conduct a risk evaluation on a chemical for which they manufacture. This proposed rule outlines the criteria and information chemical manufacturers must provide for EPA to consider a chemical substance for risk evaluation. Also included is Agency’s process and timing to review the request to determine whether to grant or deny. The information collection activities covered by this ICR are those carried out by a chemical manufacturer in requesting a specific chemical risk evaluation under TSCA be conducted by EPA.

Abstract

The Commission adopted a comprehensive regulatory scheme to ensure just and reasonable rates, terms, and conditions of access to utility infrastructure (usually called “poles or “pole attachments”), with a robust dispute resolution process when the parties are not able to agree on terms. The Commission also adopted requirements for providing communications providers with information about the status of the utility poles they plan to use as they map out their broadband builds. Access to poles involves requests, responses, notices, and coordination among utility pole owners, requesting attachers, and parties with existing facilities attached to the poles. The regulations in 47 CFR sections 1.1411, 1.1412, 1.1415, and 1.1416 include pole complaint and other dispute resolution processes, pole access timelines for one-touch, make-ready (OTMR) and non-OTMR attachments, and use by new attachers of utility-approved contract workers. In addition, the rules require utilities to allow attachers to “overlash” existing wires and they eliminate outdated disparities between the pole attachment rates that incumbent carriers must pay compared to other similarly-situated cable and telecommunications attachers.

Abstract

The Federal Trade Commission is issuing a final rule promulgating the Non-Compete Clause Rule. The final rule provides that it is an unfair method of competition and therefore a violation of Section 5 of the FTC Act for persons to enter into non-compete clauses (“non-competes”) with workers on or after the final rule’s effective date. With respect to existing non-competes—i.e., the non-competes entered into before the effective date—the final rule adopts a different approach for senior executives than for other workers. For senior executives, existing non-competes can remain in force, while existing non-competes with other workers are not enforceable after the effective date.

On February 15, 2019, the Commission released a Report and Order (“Order”), MB Docket No. 18-23, FCC 19-10; In the Matter of Elimination of Obligation to File Broadcast Mid-Term Report (Form 397) Under Section 73.2080(f)(2). The Order eliminated the provision of Section 73.2080(f)(2) which required broadcast stations to file Form 397 and replaced it with a technological approach designed to be more efficient and less burdensome to licensees. When uploading EEO public file reports to the Commission’s Online Public Inspection File (OPIF), broadcast radio and Satellite Digital Audio Radio Services (SDARS) licensees will be prompted to answer “Yes” or “No” to indicate whether they have eleven or more full-time employees, which is the threshold number of employees triggering a mid-term review for radio and SDARS employment units. All television stations uploading an EEO public file report to the OPIF are necessarily subject to a mid-term review because the requisite staff size for both obligations is five full-time employees for television employment units. Thus, the very act of posting the report to the OPIF will be sufficient to identify television stations subject to the mid-term review.

On July 18, 2022, the Commission adopted the Partition, Disaggregation and Leasing of Spectrum Report and Order and Second Further Notice of Proposed Rulemaking that modifies partitioning, disaggregation, and leasing rules to provide specific incentives for small carriers and Tribal Nations, and entities in rural areas, to voluntarily participate in ECIP (ECIP Report and Order in WT Docket No. 19-38, FCC 22-53). The ECIP proceeding is in response to Congressional direction in the Making Opportunities for Broadband Investment and Limiting Excessive and Needless Obstacles to Wireless Act (MOBILE NOW Act) to consider steps to increase the diversity of spectrum access and the availability of advanced telecommunications services in rural areas. The ECIP will promote greater competition in the provision of wireless services, facilitate increased availability of advanced wireless services in rural areas, facilitate new opportunities for small carriers and Tribal Nations to increase access to spectrum, and bring more advanced wireless service including 5G to underserved communities. The Commission seeks approval for revisions to its currently approved collection of information under OMB Control Number 3060-0800 to permit the collection of the additional information and changes in connection with assignments of authorizations pursuant to the rules adopted by the Commission’s ECIP Report and Order. Specifically, in the ECIP Report and Order, the Commission revised its rules to allow partition and/or disaggregation assignment applications pursuant to § 1.950. or full assignments pursuant to § 1.948, to designate a Qualifying Transaction identified in the application as seeking consideration under the ECIP. Respondents are also required to select the applicable ECIP prong to its Qualifying Transaction, pursuant to either § 1.60003 or § 1.60004. Abstract

This is a request for a revision and extension of the OMB control number 0648-0797: Tornado Watch/Warning Post-Event Evaluation. The NOAA National Severe Storms Laboratory (NSSL) designed the data collection instrument to allow for more routine collection of this information. This survey is delivered through a web application hosted by NSSL called Tornado Tales, available online at https://inside.nssl.noaa.gov/tornado-tales/. After approval of our initial data collection instrument (that shown on the website), researchers carried out post-event data collections for multiple tornado events, validating the questions and identifying issues for improvement. This fieldwork led to several needed improvements, including the addition of questions about the event more broadly, rephrasing some questions, and including questions about efficacy and the availability of forecast information. While these revisions have added questions to the survey, their improved clarity should allow for faster response times per question. We estimate the time to complete the survey is five to ten minutes on average. Subject recruitment will primarily be done by NOAA NSSL and its partners advertising the survey via websites and social media outlets. In addition to the changes to the survey instrument, researchers at NOAA NSSL and the University of Oklahoma would like to conduct interviews with emergency managers, broadcast meteorologists, and members of the public after certain tornado events to explore how they interpreted and used NOAA forecast information. Researchers will use a skip-logic approach, meaning participants will only answer questions about the time periods relevant to their personal experience. Given the in-person nature of these interviews, we expect them to take between 15 and 30 minutes on average.
