Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Commission is adopting a final rule that adds new § 37.6(b)(1) to permit SEFs to incorporate by reference into a swap confirmation the relevant terms set forth in underlying, previously-negotiated agreements without being required to obtain these agreements. This new provision will address technological and operational challenges that have prevented SEFs from fully complying with § 37.6(b), by reducing the administrative burdens for SEFs, who would not be required to request, accept, and maintain a library of every relevant previously negotiated agreement between counterparties. This revised information collection is necessary for SEFs to provide legal certainty of transactions executed on or pursuant to the rules of a SEF through the issuance of swap confirmations for each swap transaction.

Relocation Assistance and Real Property Acquisition Regulations for Federal and Federally Assisted Programs

Key Information

Abstract

Several amendments to the Uniform Act, 42 U.S.C. 4601–4655, were made by Public Law 105–117, enacted on November 21, 1997. Those amendments allow local, State, and Federal agencies to comply with the law by requesting information from each displaced person, business, farm, or non-profit organization to certify that they are eligible to receive relocation benefits under the Uniform Act. The frequency of response is dependent on the number of relocations caused by Federal and federally assisted programs and projects. One response is required per household or nonresidential displacement. The certifications and records maintained are used by local, State, and Federal agencies to provide evidence and record keeping that owners of real property and displaced persons are receiving the entitlements provided by the law. Such data adds to the potential pool of available information and assists in assessing the universe of people affected by the law and regulation.

The DOL Veterans' Employment and Training Service (VETS) administers funds for the multi-year Jobs for Veterans' State Grants (JVSG) to each State, the District of Columbia, Puerto Rico, the Virgin Islands and Guam on an annual basis on a fiscal year cycle. The Children’s Bureau (CB), Administration for Children and Families (ACF), U.S. Department of Health and Human Services (HHS), is proposing to establish a new overarching generic clearance to collect information to assess regulatory requirements of title IV-E agencies’ CCWIS and ensure that the CCWIS is utilized for purposes consistent with the efficient, economical, and effective administration of the title IV-B and IV-E plans per 45 CFR 1355.52(a). Flexibility is needed to support title IV-E agencies use of Technical Assistance (TA) tools quickly and in direct response to emerging technology needs and changing program requirements. This generic clearance will allow CB to pilot tools and provide support to IV-E agencies who choose to use them. Continuous feedback and ongoing dialogue will assist IV-E agencies in building capacity and identifying risk areas as technology systems are developed. The pilot process of using the TA tools will support improvement efforts and ultimately inform the development of a future CCWIS compliance review process.

Abstract

The Corps of Engineers uses public surveys for collecting data for planning, formulation, and evaluation of projects. Flood damage surveys are administered to determine the impacts and potential impacts of flooding and to determine how communities, residents, and businesses respond to flooding. The data are used for estimating damage and associated costs of flooding. Damage estimation models are calculated and used to estimate the cost of flooding and to evaluate the benefits of alternative flood mitigation plans, which are critical to determining the feasibility of flood risk management projects. Results of surveys will help communities to better determine and communicate their flood risks. The models are also used for programmatic evaluation of the Army Corps of Engineers’ National Flood Risk Management Program.

Abstract

31 U.S.C. 5331 of the BSA and 26 U.S.C. 6050I of the Internal Revenue Code require that certain transactions be reported to FinCEN and the Internal Revenue Service (IRS). Specifically, reporting is required by any person engaged in a trade or business who, in the course of such trade or business, receives more than $10,000 in currency in one transaction or two or more related transactions. Reporting is also required by any clerk of a federal or state court who receives more than $10,000 in currency as bail for any individual charged with a specified criminal offense. Reports filed under these authorities are made through the joint FinCEN/IRS Form 8300. Furthermore, verification requirements apply to transactions requiring the filing of Form 8300. On December 27, 2020, the Consolidated Appropriations Act, 2021 (CAA) was signed into law. Section 204 of Title II of Division BB of the CAA added parallel provisions at section 9825 of the Internal Revenue Code (the Code), section 725 of the Employee Retirement Income Security Act (ERISA), and section 2799A-10 of the Public Health Service Act (PHS Act) that require group health plans and health insurance issuers offering group or individual health insurance coverage to annually report to the Department of Treasury, the Department of Labor (DOL), and the Department of Health and Human Services (HHS) (collectively, “the Departments”) certain information about prescription drug and health care spending, premiums, and enrollment under the plan or coverage. This information will support the development of public reports that will be published by the Departments on prescription drug reimbursements for plans and coverage, prescription drug pricing trends, and the role of prescription drug costs in contributing to premium increases or decreases under the plans or coverage. The 2021 interim final rules, “Prescription Drug and Health Care Spending” (2021 interim final rules), issued by the Departments and the Office of Personnel Management (OPM) implement the provisions of section 9825 of the Code, section 725 of ERISA, and section 2799A-10 of the PHS Act, as enacted by section 204 of Title II of Division BB of the CAA. OPM joined the Departments in issuing the 2021 interim final rules, requiring Federal Employees Health Benefits (FEHB) carriers to report information about prescription drug and health care spending, premiums, and plan enrollment in the same manner as a group health plan or health insurance issuer offering group or individual health insurance coverage.
