What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Student Assistance General Provision Subpart I Immigration Status Confirmation

Abstract

This request is for approval of an extension of the reporting requirements currently in the Student Assistance General Provisions, 34 CFR 668, Subpart I. This subpart governs the Immigration-Status Confirmation, as authorized by section 484(g) of the Higher Education Act of 1965, as amended (HEA) (20 U.S.C. 1091). The regulations may be reviewed at 34 CFR 668, Subpart I. The regulations are necessary to determine eligibility to receive program benefits and to prevent fraud and abuse of program funds. This collection updates the usage by individuals and schools. While the regulations refer to a secondary confirmation process and completion of the paper G-845 form these processes are no longer in use. The Department of Homeland Security/U.S. Citizen and Immigration Services (DHS/USCIS) replaced the paper secondary confirmation method with a fully electronic process, Systematic Alien Verification for Entitlements (SAVE) system and the use of the Third Step Verification Process.

Key Information

Abstract

We administer the SSI program, which provides monthly payments to: (1) adults and children with a disability or blindness; and (2) adults aged 65 or older. Eligible individuals must meet all the requirements in the Social Security Act (Act), including having resources and income below specified amounts. Since SSI is a needs-based program for those with limited income and resources, SSA must consider the amount of income an applicant or recipient has when determining whether that person is eligible to receive SSI payments. If the individual is eligible, their income is also a factor when SSA calculates the amount of their monthly SSI payments. Specifically, once SSA determines an individual is eligible for SSI, SSA determines the individual’s monthly payment amount under section 20 CFR 416.1104 of the Code of Federal Regulations (CFR) by subtracting the individual’s countable monthly income from the Federal benefit rate (FBR), which is the monthly maximum Federal SSI payment. Applicants’ and recipients’ resources may affect their SSI eligibility, while their income may affect both their SSI eligibility and payment amounts. The Social Security Act (Act) in section 42 USC 1382a, and our regulations in in section 416.1110 defines income as “earned,” such as wages from work, and in section 416.1120 defines all income that is not earned as “unearned,” (e.g., gifted cash or in-kind support and maintenance (ISM)). Like other forms of income, ISM can reduce the amount of an applicant’s or recipient’s monthly SSI payment. Because ISM requires that applicants or recipients receive food, shelter, or both, by definition. Under our current regulations in section 20 CFR 416.1130(b), ISM means any food or shelter that is given to an individual or that the individual receives because someone else pays for it. In addition to counting ISM that an applicant or recipient receives, the current SSI program deems a portion of the income of certain individuals to the SSI applicant or recipient under section 42 U.S.C. 1382c(f) of the Act and as codified under 20 CFR 416.1160. Our current regulations in section 416.1161(a) and (b) exclude from the deemed income of an ineligible spouse or parent any public income maintenance (PIM) payments and any income used to compute this payment. This exclusion also applies to the income of an ineligible spouse or parent when used to compute a PIM payment of someone else. Section 416.1142(a) defines what we consider a public assistance household and lists PIM payments. Under section 20 CFR 416.1142(a) of this rule, we propose to expand the definition of “public assistance household” to include SNAP, which we anticipate will allow for deeming for more respondents under our revised ISM regulations. This proposed policy will better reflect current means-tested benefit programs and will simplify the development of living arrangements and ISM policies. In addition, this proposal will also allow for higher benefit payments to recipients, and therefore supports our goal of enhancing equality in the programs we administer for all applicants and recipients. We anticipate a 50% reduction in the number of respondents under this rule, based on those who indicate they are part of a Public Assistance Household and who may not need to complete the follow-up forms SSA-L5062, SSA L5063, SSA-8006, and SSA 8011. We also anticipate a small burden reduction per response for the SSA-8006 (0960-0174) as respondents will not need to develop the responses about their household. Respondents are applicants for, or recipients of, Social Security disability benefits (SSDI); SSI payments; or their representatives.

A generic clearance for purposes of conducting qualitative research to gain a better understanding of emerging issues related to the Administration for Community Living (ACL) at the Department of Health and Human Services (HHS) grantees, service providers, and programs; develop future intramural and extramural research projects; and to ensure HHS and ACL leadership, programs, and staff can obtain timely and relevant data and information. ACL defines qualitative feedback as information that provides useful insights on perceptions and opinions but are not statistical surveys that yield results that can be generalized beyond the population of study. This collection of information is necessary to enable ACL to receive feedback in an efficient, timely manner, in accordance with our mission to maximize the independence, well-being, and health of older adults, people with disabilities, and their families and caregivers. ACL implements critical disability and aging programs, serves as the advisor to the HHS Secretary on disability and aging programs, works with other HHS agencies, Departments and the White House on disability and aging issues, and engages a range of disability and aging partners to inform program development, improvement, and implementation. Integral to this role, ACL conducts research and evaluation studies to measure the needs, barriers, and facilitators for ACL programs. Qualitative research, evaluation, and assessment are the main objectives of the activities included in this clearance. The goal of developing these activities is to identify emerging issues and research gaps to ensure the successful implementation of ACL programs. The participants may include subject matter experts appropriate to the question of interest; national, state, and/or local representatives; individuals from aging and disability networks; human service, behavioral health, and healthcare providers; individuals from tribal communities; and/or representatives of other organizations appropriate to the question or questions of interest.

Abstract

Under Section 12(b) of the Securities Exchange Act of 1934, 15 (U.S.C. 78l(b)) ("Act"), Rule 12d2-2 requires all issuers and national securities exchanges seeking to delist and/or deregister a security in accordance with the rules of an exchange and the Commission to electronically file a Form 25. Rule 12d2-2 ("Rule") and Form 25 ("Form 25") were adopted in 1935 and 1952, respectively, pursuant to Sections 12 and 23 of the Act. The Rule sets forth the conditions and procedures under which a security may be delisted from an exchange and withdrawn from registration under Section 12(b) of the Act. The Commission adopted amendments to Rule 12d2-2 and Form 25. Under the amended Rule, all issuers and national securities exchanges seeking to delist and deregister a security in accordance with the rules of an exchange must file the adopted version of Form 25 with the Commission. The Commission has also adopted amendments to Rule 19d-1 under the Act to require exchanges to file the adopted version of Form 25 as notice to the Commission under Section 19(d) of the Act. Finally, the Commission has adopted amendments to exempt options and security futures from Section 12(d) of the Act. These amendments are intended to simplify the paperwork and procedure associated with a delisting and to unify general rules and procedures relating to the delisting process.

Abstract

Section 1473 of the Dodd-Frank Act included amendments to Title XI of FIRREA. Section 1103 of Title XI, Functions of Appraisal Subcommittee, was amended by the Dodd-Frank Act to require the ASC to maintain a national registry of appraisal management companies (AMCs) of those AMCs that are either: (1) Registered with and subject to supervision by a State that has elected to register and supervise AMCs; or (2) are operating subsidies of a Federally regulated financial institution. Abstract

Section 1311(c)(1) of the ACA directs the Secretary to establish criteria for the certification of health plans as qualified health plans (QHPs). Section 1321(a)(1)(B) of the ACA directs the Secretary to issue regulations that set standards for meeting the requirements of title I of the ACA for, among other things, the offering of QHPs through such Exchanges. In the HHS Notice of Benefit and Payment Parameters for 2024 Final Rule (2024 Payment Notice Final Rule), HHS exercised its authority under Sections 1311(c)(1) and 1321(a)(1)(B) of the ACA to limit the number of non-standardized plan options that issuers of QHPs can offer through Exchanges on the Federal platform, including both through Federally-facilitated Exchanges (FFEs) and State-Based Exchanges on the Federal platform (SBE-FPs), to four non-standardized plan options per product network type (as described in the definition of “product” at 45 C.F.R. 144.103), metal level (excluding catastrophic plans), inclusion of dental and/or vision benefit coverage, and service area for plan year (PY) 2024, and two for PY 2025 and subsequent plan years. The Social Security Act (Act), sections 42 U.S.C. 423(d)(1)(A) and 1382c(a)(3)(A)-(B), define disability as the inability to engage in any substantial gainful activity (SGA) by reason of any medically determinable physical or mental impairment which can be expected to result in death, or which has lasted or can be expected to last for a continuous period of not less than 12 months. The Act in section 42 U.S.C. 1382c(a)(3)(C), also states that, for adults, an individual shall be determined to have a disability only if their physical or mental impairment(s) are of such severity that they are not only unable to do their previous work but cannot, considering their age, education, and work experience, engage in any other kind of substantial gainful work which exists in the national economy, regardless of whether such work exists in the immediate area in which they live, or whether a specific job vacancy exists for them, or whether they will be hired if they apply for work. SSA uses a five-step sequential evaluation process to determine whether an individual is disabled, as explained under sections 20 CFR 404.1520 and 416.920 of the Code of Federal Regulations (Code). We evaluate at each step in the process to determine if the individual is disabled, and then go to the next step of the sequential evaluation process and continue in this way until we either find the individual disabled or find they do not meet our disability requirements. Under our final rule, Changes to the Intermediate Improvement to the Disability Adjudication Process, Including How We Consider Past Work, we are revising sections 20 CFR 404.1560 and 416.960 of the Code to reduce the relevant work period from the current 15 years to 5 years. In many cases, this revision will reduce the number of jobs in an individual’s work history that we will consider at step four of the sequential evaluation process when we determine whether an individual can perform their PRW. We expect that this change will more accurately reflect how an individual’s acquired skills and knowledge may become less relevant over time after they have stopped performing previous work. In addition, as we largely rely on individuals’ self-reporting for information about past work, and we find that self-reported information is often less accurate and complete with the passage of time. In addition, this change will reduce the information collection burden on individuals by reducing, on average, the number of jobs about which they must provide us with information. We anticipate that requesting work history ending at the 5-year mark will be significantly less burdensome than the current longer work history. We use different forms to collect the work history information necessary for the type and level of adjudication of a claim. Therefore, we anticipate a burden reduction for each of these forms when using a 5-year relevant work period. Under the Final Rule for the Intermediate Improvement to the Disability Adjudication Process, Including How we Consider Past Work, we anticipate reducing the amount of PRW needed for the following information collections: 0960-0300, HA-4633, Claimant's Work Background; 0960-0578, SSA-3369, Work History Report; and 0960-0579, SSA-3368, Disability Report – Adult. We anticipate this will result in a reduction in the overall burden for these information collections. Respondents are applicants for, or recipients of, Social Security disability benefits (SSDI); SSI payments; or their representatives.

Abstract

The Senior Community Service Employment Program (SCSEP), is a community service and work-based training program for older workers. The program provides subsidized, work-experience training for low-income persons 55 or older who are unemployed and have poor employment prospects. SCSEP national grants are awarded through a competitive process; state and territorial grants are awarded through a formula outlined in the OAA-2016 Section 506 (b-c). The dual goals of the program are to promote useful community service employment activities and to move SCSEP participants into unsubsidized employment, so that they can achieve economic self-sufficiency. The Department is required to collect the information in order to comply with the OAA statutory and regulatory requirements. The information is also necessary for grantee performance accountability and program management.

Abstract

MSHA proposes to lower the existing exposure limit (PEL) for respirable crystalline silica from 100 µg/m3 to 50 µg/m3 at mining operations due to the serious health hazard such exposure presents to miners. Exposure at the existing PEL is known to cause silicosis, an irreversible but preventable lung disease; non-malignant respiratory disease (other than silicosis); lung cancer; and renal and autoimmune effects in susceptible individuals. The proposed rule, once implemented, would significantly enhance health protection for metal and nonmetal miners as well as coal miners. MSHA’s proposed respirable silica rule includes provision for lowering the respirable crystalline silica permissible exposure limit; MSHA’s longstanding practice that the hierarchy of controls be used at metal and nonmetal as well as coal mines to lower exposures; prohibiting rotation of miners for compliance with this rule; a written respiratory protection program; medical evaluation and transfer rights for metal and nonmetal as well as coal miners who are medically unable to wear required respiratory protection under this standard; exposure assessment and monitoring, including rights of miners or their representatives to observe monitoring and have access to records; medical evaluation of miners’ health; and recordkeeping. Proposed paperwork requirements would be contained in a written respiratory protection program, involve medical records, copying and posting of sampling results, and the creation and maintenance of records.

Section 224(g)-(n) of the PHS Act (42 U.S.C. 233(g)-(n)) states that entities receiving funds under section 330 of the PHS Act and specified individuals of that entity may be deemed to be PHS employees for the purpose of eligibility for liability protections, including FTCA coverage, for the performance of medical, surgical, dental, and related functions within the scope of deemed employment upon approval of an application for deemed employment. The Health Center Program and Health Center FTCA Program are administered by HRSA. Health centers submit deeming applications annually to HRSA in the prescribed form and manner in order to obtain deemed PHS employee status, with the associated eligibility for FTCA coverage. Such applications must be approved by HRSA in a Notice of Deeming Action. Deemed health centers must resubmit applications annually meeting all deeming requirements in order to maintain deemed status.
