Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The New Source Performance Standards (NSPS) for Asphalt Processing and Roofing Manufacture (40 CFR Part 60, Subpart UU) were promulgated on August 6, 1982, and most- recently amended on February 27, 2014. These regulations apply to both existing and new saturators and mineral handling and asphalt storage facilities at asphalt roofing manufacturing plants and to asphalt storage tanks and blowing stills at asphalt processing plants, petroleum refineries, and asphalt roofing plants. New facilities include those that commenced either construction, or modification, or reconstruction after the date of proposal. This information is being collected to assure compliance with 40 CFR Part 60, Subpart UU. In general, all NSPS standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility or any period during which the monitoring system is inoperative. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to NSPS. Any owner/operator subject to the provisions of this part shall maintain a file of these measurements and retain the file for at least two years following the date of such measurements, maintenance reports, and records. All reports required to be submitted electronically are submitted through the EPA's Central Data Exchange (CDX), using the Compliance and Emissions Data Reporting Interface (CEDRI), where either the delegated state or local authority can review them. If there is no such delegated authority, the EPAs regional offices can review them. All other reports are sent to either the delegated state or local authority. If there is no such delegated authority, the reports are sent directly to the EPAs regional offices. The use of the term "Designated Administrator" throughout this document refers to the U.S. EPA or a delegated authority, such as a state agency. The term "Administrator" alone refers to the U.S. EPA Administrator. The Affected Public includes asphalt processing and roofing manufacturing facilities in the United States. The burden to the Federal Government is attributed entirely to work performed by either Federal employees or government contractors. There are approximately 144 facilities, which are owned and operated by the asphalt processing and roofing manufacture industry. None of the 144 facilities in the United States are owned by either state, or local, or tribal entities or by the Federal government. They are all owned and operated by privately-owned, for-profit businesses. We assume that they will all respond to EPA inquiries. Based on our consultations with industry representatives, there are an average of 4 affected facilities at each plant site and each plant site has only one respondent (i.e., the owner/operator of the plant site). Over the next three years, approximately 144 respondents per year will be subject to these standards, and 2 respondents per year will undergo reconstruction and become new sources subject to these same standards. In accordance with OMBs previous Terms of Clearance, the supporting statement has been updated to comply with the standard 18 Question Template.

This is to request approval from the Office of Management and Budget (OMB) for a three-year renewal for the information collection titled, "Container Certification Statements." This reporting requirement is mandatory for the person responsible for packing or loading a freight container or transport vehicle containing hazardous materials for transportation by manned vessel in ocean or coastwise service. Furthermore, there are additional requirements for persons who ship Class 1 hazardous materials (explosives), other than Division 1.4 in a similar manner. The documentation is required when a package is offered for transportation via vessel. This certification statement is a statement made by the required persons that they ascertain that the package was loaded, marked, and placarded properly. This may be indicated on a shipping paper or another accompanying document. Carriers receive this information to ensure that they are transporting packaging that has been certified as packaged properly.

Reporting and recordkeeping requirements contained in this request have been determined by PHMSA to be essential. The HMR prescribe requirements for the operation, maintenance, repair, and re-qualification of all DOT specification cargo tanks to decrease the probability and number of hazardous material releases due to an accident or tank failure. These requirements are based on ongoing research, petitions for rulemaking, and incident reports on the release of hazardous materials related to cargo tank motor vehicle transportation. Abstract

The Commission submits this revised information collection to the Office of Management and Budget (OMB) to merge OMB Control Number 3060-0687 into OMB Control Number 3060-0422 and to extend the information collection requirements relating to the Commission’s hearing aid compatibility (HAC) requirements. Section 710 of the Communications Act of 1934, as amended (the Act), requires that almost all telephones manufactured in, or imported into, this country must be hearing aid compatible. The HAC requirements ensure that people with hearing loss (regardless of whether they use hearing aids or not) can effectively use wireline telephone handsets with the legacy telephone network and with advanced communications services (ACS), which include Voice over Internet Protocol (VoIP). The HAC requirements are structured for handsets to provide sufficient magnetic fields to be used by people with hearing aids and to provide volume control. Congress recognized that there may be technological or economic reasons why some new telephones may not meet the hearing aid compatibility (HAC) requirement. Therefore, Congress provided a waiver request procedure. Section 68.5 of the Commission’s rules, 47 CFR § 68.5, provides the criteria to be used to assess waiver requests.

FERC-546, Certificated Rate Filings: Gas Pipeline Rates (PL24-1-000)

Abstract

The following list outlines four circumstances under which the FERC-546 information collection requirements for certificated rates must be met: A company decides to: 1. Construct and operate a new jurisdictional pipeline; 2. Expand its certificated pipeline capacity by constructing a lateral pipeline, adding compression or providing storage at incremental or cost-based rates; 3. Build a new liquefied natural gas facility; or 4. Provide gas storage and negotiate market based rates. Under the circumstances 1-3, the company must file its FERC-546 cost data along with an application for a certificate of public convenience and necessity under the statutory requirements of NGA Section 7(c). For circumstance 4, the company must file its FERC-546 information with an application under NGA Section 4(f). The FERC-546 includes the following: • Supporting information for proposed initial rates (e.g. cost-based, market based, incremental rates); • Pro forma tariffs; • Motions to put proposed initial rates into effect subject to Commission findings on the related certificate; and • Unexecuted precedent agreements. Section 16 of the NGA grants the Commission administrative powers including the ability to define accounting, technical and trade terms, prescribe forms, statements, declarations or reports and to prescribe rules and regulations. Section 403 of the Department of Energy Organization Act authorizes the Commission to establish and review priorities for curtailments under the Natural Gas Act. The Commission reviews the FERC-546 materials in order to approve rates and tariff changes associated with an application for a certificate under NGA Section 7(c). Additionally, the Commission reviews FERC-546 materials in 4(f) storage applications to evaluate market power and decide whether to grant, deny, or condition market based rate authority for the applicant. The Commission also uses the FERC-546 information to monitor jurisdictional transportation, natural gas storage, and unbundled sales activities of interstate natural gas pipelines and Hinshaw pipelines. In addition to fulfilling the Commission’s obligations under the NGA, the FERC-546 enables the Commission to monitor activities, evaluate transactions, ensure competitiveness, and improved efficiency of the gas industry's operations. In summary, the Commission uses the FERC-546 information to: • Ensure adequate customer protections under section 4(f) of the NGA; • Review rate and tariff changes by natural gas companies for the transportation of natural gas and natural gas storage services; • Provide general industry oversight; and • Supplement documentation during its audits process. Failure to collect this information would prevent the Commission from being able to monitor and evaluate transactions and operations of interstate pipelines and perform its regulatory functions.

Abstract

The purpose of FERC-538 is to implement the information collections pursuant to Sections 7(a), 10(a) and 16 of Natural Gas Act (NGA) , and part 156 of the Commission Regulations. These statutes and regulations upon application by a person or municipality authorized to engage in the local distribution of natural gas, allow for the Commission to order a natural gas company to extend or improve its transportation facilities and sell natural gas to the municipality or person and, for such purpose, to extend its transportation facilities to communities immediately adjacent to such facilities or to territories served by the natural gas pipeline company. The Commission uses the application data in order to be fully informed concerning the applicant, and the service the applicant is requesting. In the final policy statement, PL24-1-000, the Commission is clarifying that the cost data (submitted via the FERC-538) should include project-wide labor wages and include union and non-union wages. The Commission clarified it will look to applicable collective-bargaining agreements or Project Labor Agreements as an appropriate default source of project-area wage standards because collectively bargained wages reflect actual wage and fringe benefit rates paid to the project workforce. Collective-bargaining agreements reflect the actual labor cost that should be included in cost estimate submitted in conjunction with request for a municipality or to person extend its transportation facilities to communities immediately adjacent to such facilities or to territories served a natural gas pipeline company.

Abstract

FRA proposes regulations establishing safe minimum requirements for the size of train crews depending on the type of operation. A minimum requirement of two crewmembers is proposed for all railroad operations, with exceptions proposed for those operations that do not pose significant safety risks to railroad employees, the public, or the environment. This proposed rule would also establish minimum requirements for the location of crewmembers on a moving train and promote safe and effective teamwork. FRA also proposes a special approval procedure to allow railroads to petition FRA to continue legacy operations with one-person train crews and allow any railroad to petition FRA for approval to initiate a new train operation with fewer than two crewmembers. This collection of information is mandatory, collected as needed, and is associated with FRA's rule 49 CFR part 218, subpart G.

Agencies within the Department of the Interior collect the information in accordance with the Federal Cave Resources Protection Act (FCRPA), which requires the Secretaries of Agriculture and Interior to identify and protect significant caves on Federal lands within their respective jurisdictions. This OMB control number covers Federal lands managed by agencies within the Department of the Interior, but not Federal lands managed by agencies within the Department of Agriculture (e.g., U.S. Forest Service). Agencies within the Department of the Interior use the information in a cave nomination to determine if the nominated cave will be listed as significant in accordance with the FCRPA and the Department's regulations at 43 CFR 37.11(c). The information is thus necessary for full compliance with agencies' responsibilities to identify and protect significant caves and their resources. Agencies within the Department of the Interior use the information in confidential cave information requests to determine whether to grant access to confidential cave data. Agencies need this information in order to comply with their statutory responsibilities to communicate, cooperate, and exchange information about significant caves, within the limits prescribed by FCRPA. The Federal Maritime Commission (Commission) is seeking public comment on a proposed rule that requires common carriers and marine terminal operators to include specific minimum information on demurrage and detention invoices and outlines certain billing practices relevant to appropriate timeframes for issuing invoices, disputing charges with the billing party, and resolving such disputes. The proposed rule addresses considerations identified in the Ocean Shipping Reform Act of 2022. The proposed rule would (1) adopt minimum information that common carriers must include in a demurrage or detention invoice that is listed in 46 U.S.C. 41104(d)(2); (2) add to this list additional information that must be included in or with a demurrage or detention invoice; (3) further define prohibited practices by clarifying which parties may be appropriately billed for demurrage or detention charges; and (4) establish billing practices that billing parties must follow when invoicing for demurrage or detention charges.
