What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Federal Maritime Commission (Commission) is seeking public comment on a proposed rule that requires common carriers and marine terminal operators to include specific minimum information on demurrage and detention invoices and outlines certain billing practices relevant to appropriate timeframes for issuing invoices, disputing charges with the billing party, and resolving such disputes. The proposed rule addresses considerations identified in the Ocean Shipping Reform Act of 2022. The proposed rule would (1) adopt minimum information that common carriers must include in a demurrage or detention invoice that is listed in 46 U.S.C. 41104(d)(2); (2) add to this list additional information that must be included in or with a demurrage or detention invoice; (3) further define prohibited practices by clarifying which parties may be appropriately billed for demurrage or detention charges; and (4) establish billing practices that billing parties must follow when invoicing for demurrage or detention charges.

Abstract

The U.S. Department of Transportation (Department/DOT) requests the Office of Management and Budget’s (OMB) approval of information collection instruments in the Department’s Final Rule. These changes update the Disadvantaged Business Enterprise (DBE) and Airport Concession DBE (ACDBE) program regulations at 49 CFR Parts 26 and 23, respectively. The changes include new collection instruments as well as updates to existing collection instruments. This Supporting Statement includes the DBE program collection instruments for which OMB renewed approval on March 1, 2022. The Department is including them in this Supporting Statement because the final rule would modify the paperwork burdens associated with those instruments. On March 10, 2022, OMB took under consideration the Department’s request for an OMB Control Number for an additional 18 DBE program information collection instruments that had not previously been submitted for OMB’s approval. Abstract

Section 10332 of the Patient Protection and Affordable Care Act (ACA) requires the Secretary to make standardized extracts of Medicare claims data under Parts A, B, and D available to ''qualified entities'' for the evaluation of the performance of providers of services and suppliers. The statute provides the Secretary with discretion to establish criteria to determine whether an entity is qualified to use claims data to evaluate the performance of providers of services and suppliers. We are proposing at section CFR 401.703 to evaluate an organization's eligibility across three areas: organizational and governance capabilities, addition of claims data from other sources (as required in the statute), and data privacy and security. This is the application through which organizations will provide information to CMS to determine whether they will be approved as a qualified entity.

Data Collection for a National Evaluation of the American Data Rescue Plan

Abstract

Upon passage of the American Rescue Plan (ARP) President Biden stated his expectation that ARP programs would be implemented in ways that align with the goals of Executive Order 13985, Advancing Racial Equity and Support for Underserved Communities Through the Federal Government. The charge to the agencies was further communicated in OMB M-21-20 and OMB M-21-24, and in early direction from the White House ARP Implementation Coordinator. OES’s ARP National Evaluation includes a portfolio of studies that supports this goal by providing a systematic look at the contributions of selected ARP-funded programs toward achieving equitable outcomes to inform program design and delivery across the Federal government. The subset of programs of interest is the list of 32 programs covered in the May 2022 White House “Advancing Equity through the American Rescue Plan” report, which represent nearly $900 billion or 60 percent of American Rescue Plan funds, excluding Economic Impact Payments (i.e., stimulus checks). The National Evaluation aims to learn how lessons from examination of ARP programs and interventions with shared outcomes, common approaches, or overlapping recipient communities may inform equitable program design and delivery across the federal government. This multi-part study includes three mixed or multi-method evaluations that focus on different subsets of ARP programs. The evaluations will address: • State Strategies for Cross-Program Coordination to Serve Low Income Children and Families Through the American Rescue Plan • Evaluating Equitable Implementation of ARP Housing Programs in Communities with Homelessness and Housing Instability • Integration of Funding to Increase Equitable Access to Behavioral Health Crisis Services Each of the three evaluations will use a different combination of quantitative and qualitative methods for data collection and analysis. The current information collection request is related to the preliminary and formative components of the study. This includes initial outreach to the relevant State and local contacts in the geographic areas selected for in-depth study as well as establishing community advisory boards to ensure equitable engagement with members of the affected communities. Future information collection requests will be submitted under this umbrella package as the specific research questions, designs, and protocols for each of the three in-depth evaluations are finalized.

Northwest Region, Pacific Coast Groundfish Fishery: Trawl Rationalization Cost Recovery Program

Abstract

This request is for a revision to a currently approved information collection. The Magnuson-Stevens Fishery Conservation and Management Act (MSA) authorizes and requires that the Secretary of Commerce maintain a cost recovery program to recover the management, data collection and analysis, and enforcement costs of the limited access privilege programs, such as the Pacific Coast Groundfish Trawl Rationalization Program (Trawl Program). Cost recovery fees may not exceed three percent of the ex-vessel value. The Trawl Program cost recovery program requires fish sellers to submit fees to fish buyers who then submit those fees to NOAA’s National Marine Fisheries Service (NMFS). Fish buyers must also submit information to NMFS on the volume and value of harvested groundfish when submitting the fees. Information is collected from monthly and annual payment transactions and reports as well as non-payment documents when necessary. This revision would add the applicable fish ticket number to each IFQ Pay.Gov payment transaction.The information collected is used to track the payment of cost recovery fees, reconcile cost recovery payments with landings data from other sources, calculate average ex-vessel values, and, if necessary, help in the resolution of non-payment issues. This program is authorized under the Pacific coast groundfish fishery regulations, trawl rationalization cost recovery program at 50 CFR 660.115.

Abstract

This information collection request requires state DOTS to annually report summary information regarding SIBs, GARVEEs, Toll Credits and OTRB in order for FHWA to maintain compliance with respective Federal statutes. The information collected is also used to develop reports to Congress on program activities and compliance. Examples of records include toll credits applied to Federal-aid projects within the fiscal year, compliance with OTRB equal access, and ending balances of SIBs and GARVEEs. State DOTS with balances in SIBs, GARVEEs, or toll credits must report the activity and any Federal-aid toll facility must report compliance with OTRB equal access. Depending on the state, the information on toll credits and OTRB may need to be obtained from other non-State DOT owned entities that toll, locally owned toll facilities, or private toll facilities that operate toll facilities on behalf of these entities. The SIB, GARVEE, and Toll Credit information is annually collected in a SharePoint tool created for states and summary information is publicly posted on the FHWA’s website. The FHWA Division offices collect OTRB compliance information within their states and submit to the Divisions as part of the required annual audit for toll facilities.

Abstract

SSA’s Ticket to Work (TTW) Program transitions Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) recipients toward independence by allowing them to receive Social Security payments while maintaining employment under the auspices of the program. SSA uses service providers, called Employment Networks (ENs), to supervise participant progress through the stages of TTW Program participation, such as job searches and interviews; progress reviews; and changes in ticket status. ENs can be private for-profit and nonprofit organizations, as well as state vocational rehabilitation agencies (VRs). SSA and the ENs utilize the TTW program manager to operate the TTW Program and exchange information about participants. For example, the ENs use the program manager to provide updates on tasks such as selecting a payment system, or requesting payments for helping the beneficiary achieve certain work goals. Since the ENs are not PRA-exempt, the multiple information collections within the TTW program manager require OMB approval. Most of the categories of information are necessary for SSA to: (1) comply with the Ticket to Work legislation; and (2) provide proper oversight of the program. SSA collects this information through several modalities, including forms, electronic exchanges, and written documentation. The respondents are the ENs or state VRs, SSDI beneficiaries, and blind or disabled SSI recipients working under the auspices of the TTW Program. We are making non-substantive changes to the title to be more descriptive of how the form is to be used; changing "Data Universal Numbering System (DUNS)" to Provider Identification (PID); and revising the instructions on where the form should be sent.

Abstract

The purpose of this data submission request is to support oversight and program integrity for Part D enrollees who participate in the Medicare Prescription Payment Plan program, which was established under Section 11202 of the Inflation Reduction Act of 2022, Public L. 117-169 (IRA). Under this program, MA Organizations offering Part D coverage and Part D sponsors are required to offer enrollees the option to pay their Part D cost sharing in monthly amounts spread out over the plan year based on the formula described in section 1860D-2(b)(2)(E)(iv) of the Act. To effectively monitor the program, Part D plans will be required to report data elements related to the program at the beneficiary, contract, and Plan Benefit Package (PBP) levels beginning in Contract Year (CY) 2025. CMS proposes to require Part D plans to submit beneficiary-level data elements into the MARx system via a program-specific transaction. Our fundamental goal is to have the least burdensome data submission requirements necessary to acquire the data needed for accurate Medicare Prescription Payment Plan program oversight. CMS believes that collecting beneficiary-level data through MARx is the most effective way for us to oversee implementation of this program. Beneficiary-level data will enable CMS to better understand participation patterns across different populations, address enrollee concerns related to the program in near real-time and inform CMS of changes to potential guidance and program requirements in the future.

Abstract

The Commission's regulatory jurisdiction over oil pipelines includes: • the regulation of rates and practices of oil pipeline companies engaged in interstate transportation; • the establishment of equal service conditions to provide shippers with equal access to pipeline transportation; and • the establishment of reasonable rates for transporting petroleum and petroleum products by pipeline. The filing requirements for oil pipeline tariffs and rates under the FERC-550 data collection provide the Commission with the information it needs to analyze the rates, practices, and service conditions of oil pipelines. As a result, the Commission can implement statutory directives for the federal regulation of these carriers. Major statutory and rate-making milestones in the Commission’s regulation of oil pipelines rates (“Historical Background of Oil Pipeline Ratemaking”) are included in reginfo.gov and ROCIS under “Supplementary Documents” and posted at https://www.ferc.gov/federal-statutes. In the final policy statement, PL24-1-000, the Commission is clarifying that the cost data (submitted via the FERC-550) should include project-wide labor wages and include union and non-union wages. The Commission clarified it will look to applicable collective-bargaining agreements or Project Labor Agreements as an appropriate default source of project-area wage standards because collectively bargained wages reflect actual wage and fringe benefit rates paid to the project workforce. Collective-bargaining agreements reflect the actual labor cost that should be include in oil pipeline cost-of-service rate filings and depreciation studies, including future retirement costs.

Claimants will submit a Notice of Loss to the Agency, meet with a FEMA Claims Reviewer, obtain documentation needed to substantiate claims, sign a Proof of Loss, and complete and return a Release and Certification form.

These records serve as the basis for required rate filings and reports submitted to FERC. The records are retained in order to be reviewed by FERC staff during compliance reviews, audits, special analyses performed as deemed necessary by FERC, and serve as a basis in complaint proceedings. The requirement to submit additional data will cause a slight increase in overall amount of data that must be retained under the FERC-555 data collection. Therefore, the changes in the final policy statement will require additional retention under the FERC-555 data collection.

Abstract

The NRC provides reimbursement for people on invitational travel for the NRC. As such, the NRC would reimburse them through our Financial Accounting and Integrated Management Information System (FAIMIS). Additionally, the travel itself would be processed in our electronic travel systems (ETS2). Both the financial and travel systems must be set up appropriately for the invitational traveler to travel and receive reimbursement from the NRC. The information collected on Form 149 meets the requirements for the invitational traveler to have a profile created in FAIMIS and in ETS2. The information collected is necessary to meet the criteria for both systems.
