Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

In accordance with section 70914 of the Build America Buy America Act (Pub. L. No. 117-58 70901-70953) (BABAA), grantees funded under Department of Education (the Department) programs that allow funds to be used for infrastructure projects (infrastructure programs), i.e., construction and broadband infrastructure, may not use their grant funds for these infrastructure projects or activities unless they comply with the following BABAA sourcing requirements: 1. All iron and steel used in the infrastructure project or activity are produced in the United States. 2. All manufactured products used in the infrastructure project or activity are produced in the United States. 3. All construction materials are manufactured in the United States. The Department may, in accordance with sections 70914(b) and (d), 70921(b), 70935, and 70937 of BABAA, and the Office of Management and Budget Memorandum M 24-02, Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, approve waivers to BABAA sourcing requirements under programs it has identified as infrastructure programs when it determines that exceptions to these requirements apply. The Department may approve these waivers, subject to notice and comment requirements and the Office of Management and Budget Made in America Office (MIAO) review. The information submitted by grantees using the BABAA Data Collection Form will be used by the Department to track the type of waivers (i.e., agency level waivers or approved grantee waivers) implemented by grantees. The data may also be used for reporting purposes.

Key Information

Abstract

Prohibited Transaction Class Exemption 84–14 permits a party that is related to an employee benefit plan to engage in transactions involving plan assets if, among other conditions, the assets are managed by a qualified professional asset manager (QPAM) that is independent of the parties in interest. Additional relief is also available under specific circumstances that are fully addressed within the exemption. The information collection requirements that are conditions of the exemption include written policies and procedures by a QPAM and audit requirements. An independent auditor uses the written policies and procedures to determine whether the QPAM is in compliance with the written policies and procedures and whether the exemption conditions have been met. These information collections are designed to safeguard participants and beneficiaries in plans that are involved in transactions covered by the exemption. The exemption does not require any reporting or filing with the Federal government.

[NCHS] National Survey of Family Growth

Key Information

Abstract

National Survey of Family Growth (NSFG) collects and disseminate “statistics on family formation, growth, and dissolution.” The NSFG supplements and complements the data from birth and fetal death certificates by monitoring factors (such as sexual activity, contraception, marriage and cohabitation, and infertility) that affect birth and pregnancy rates. The NSFG provides nationally representative data on factors related to fertility, family formation, and reproductive health for NCHS and its cosponsors within DHHS. Throughout its history, NSFG has been administered in person, in English and Spanish, with a self-administered portion added in more recent survey periods. Under the plan laid out in this clearance request, NSFG builds on its past survey design and procedures and incorporates online administration into a multi-phase, multi-mode design. This design calls for about 5,000 people aged 15-49 to be interviewed each year, however higher yields are sought in Year 3 and beyond to compensate for the underproduction seen in the first 2 years of data collection due to the COVID-19 pandemic and associated labor market challenges. This Non-Substantive Change Request is submitted for addition of experiments with redesigned invitation materials that are mailed to improve survey response rates and contain costs associated with nonresponse follow-up. There is no change to the data collection instruments or burden to respondents associated with this collection.

This clearance covers the information that offerors and contractors must submit to comply with the following FAR part 22 labor requirements: ● FAR 52.222-2, Payment for Overtime Premiums. This clause requires the contractor to request authorization for overtime premiums costs that exceed the amount negotiated in the contract. The request shall include information on the affected work unit current staffing and workload, how a denial of the request would impact performance on the instant contract or other contracts, and reasons why the work cannot be performed by using multishift operations or by employing additional personnel. ● FAR 52.222-6, Construction Wage Rate Requirements, and the Standard Form (SF) 1444. This clause requires the contractor to establish additional classifications, if any laborer or mechanic is to be employed in a classification that is not listed in the wage determination applicable to the contract. In such cases, the contractor is required to complete and submit a SF 1444, Request for Authorization of Additional Classification and Rate, along with other pertinent data, containing the proposed additional classification and minimum wage rate including any fringe benefits payments. ● FAR 52.222-11, Subcontracts (Labor Standards), and the SF 1413. This clause requires a contractor to submit an SF 1413, Statement and Acknowledgment, for each subcontract for construction within the United States, including the subcontractor's signed and dated acknowledgment that the required labor clauses necessary to implement various labor statutes have been included in the subcontract. ● FAR 52.222-18, Certification Regarding Knowledge of Child Labor for Listed End Products. This provision (and its commercial equivalent in the provision at 52.212-3) requires the offeror, as part of its annual representations and certifications, to either certify in paragraph (c)(1) that it will not supply an end product of a type identified on the Department of Labor (DOL) List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor (https://www.dol.gov/agencies/ilab), or certify in paragraph (c)(2) that it has made a good faith effort to determine whether such child labor was used to mine, produce, or manufacture such end product, and is unaware of any such use of child labor. ● FAR 52.222-33, Notice of Requirement for Project Labor Agreement. Abstract

The Institute of Education Sciences (IES) within the U.S. Department of Education (ED) requests clearance for data collection activities to support a pilot study of the reliability and validity of survey items used to assess the use of research evidence (URE) among education agencies and other partners served by the Regional Educational Laboratories (RELs). The REL program is an essential IES investment focused on partnering with state and local education agencies to use evidence to improve education outcomes by creating tangible research products and providing engaging learning experiences and consultation. IES seeks to better understand how REL partners use research evidence to improve education outcomes and the role of RELs in promoting URE among partners. This study will test the reliability and validity of new and extant URE items in the REL context. Specifically, the study will (1) assess how existing items from the URE literature perform in a REL context and (2) assess the reliability and validity of a small set of items from the Stakeholder Feedback Surveys (SFS) that are currently administered to REL partners and used by IES to improve the work of REL contractors, inform the REL program as a whole, and address internal requests such as the Congressional Budget Justification. The reliability and validity of the new and existing survey items will be assessed through two data collection activities: an online survey administered to a set of partnerships across RELs and follow-up interviews with a subset of REL partners.

Abstract

This is a mandatory collection from large certificated air carriers. Section 401 of the Federal Election Campaign Act of 1971 (2 U.S.C. 451) directed the Civil Aeronautics Board to promulgate regulations with respect to the extension of credit for air transportation furnished to candidates for Federal office, or any person acting on their behalf, in connection with political campaigns. Title 14 Code of Federal Regulation Part 374a (14 CFR Part 374a) was adopted to implement this requirement. Form 183 was designed as the means for reporting credit extended to political candidates for air transportation services and is reported on a monthly basis. It is then reported to the Federal Elections Commission. Section 4(a)(7) of the Civil Aeronautics Board Sunset Act of 1984 transferred the responsibility for administering this reporting to the Secretary of Transportation. This is an extension to a current collection.

Abstract

In the Fifth Report and Order (re;. Nov. 24, 2019), the Commission adopted rules that build on the last major revision to its 911 indoor location accuracy rules. Specifically, the Commission established a vertical location accuracy metric consistent with the framework adopted in 2015 Fourth Report and Order. In the Fourth Report and Order (rel. Feb. 3, 2015), the Commission adopted rules that significantly enhance the ability of Public Safety Answering Points (PSAPs) to identify, with improved accuracy, the location of indoor wireless 911 callers. The rules also strengthen existing E911 location accuracy requirements to improve location determine for outdoor calls as well. The actions in the Fifth and Fourth Report and Orders come in response to major changes in the landscape of wireless technology and consumer usage. The Commission seeks to extend these previously approved information collection requirements.

Jurisdictional Determination Forms and Aquatic Resources Delineation Forms

Abstract

In an effort to address regional wetland characteristics and improve the accuracy and efficiency of wetland delineation procedures, the U.S. Army Corps of Engineers Engineer Research and Development Center (ERDC) developed ten regional supplements to the Corps Manual, the most recent of which were issued in 2006. In developing the regional supplements, the Corps recognized that a single national manual is unable to consider regional differences that are important to the identification and functioning of wetlands. The wetland indicators and guidance provided in the 10 regional supplements are designed to be used in combination with the Corps Manual to identify wetland waters of the United States. The Automated Wetland Determination Sheets (ADSs) in this collection package streamline the information collection process by incorporating reference material and analytical processes directly into the form, which is provided as a Microsoft Excel document rather than the PDF form included in the regional supplements. Jurisdictional Determination Forms are tools used by the U.S. Army Corps of Engineers (Corps) to help implement Section 404 of the Clean Water Act (CWA) and Sections 9 and 10 of the Rivers and Harbors Act of 1899 (RHA). JDs specify what geographic areas will be treated as subject to regulation by the Corps under one or both statutes. Applicants for Corps permits are generally required to submit JDs as part of their permit application or in support of the permit evaluation process. If wetlands are present, the Corps generally requires that JDs include adequately documented wetland data sheets in order for the JD to be considered technically adequate. The ADSs are formatted such that they may be readily converted to Portable Document Format (PDF) for inclusion as part of the applicant’s JD report.

Abstract

This information collection request supports FDA rulemaking. We are revising current regulations (21 CFR part 170) relating to the procedures for determining that a premarket notification for a food contact substance (FCN) is no longer effective. The regulations provide for additional reasons that could form the basis for FDA to determine that an FCN is no longer effective. The regulations are also intended to ensure that manufacturers or suppliers have the opportunity to provide input before FDA determines that an FCN is no longer effective.

Federal Fish and Wildlife Permit Applications and Reports – Requirements for African Elephants

Abstract

Our final rule (RIN 1018-BG66) will: (1) to increase protection for African elephants in response to the recent rise in international trade of live African elephants by establishing ESA permit requirements and specific enhancement requirements for the import of wild-sourced elephants, as well as requirements to ensure that proposed recipients of live African elephants are suitably equipped to house and care for them; (2) to clarify the existing enhancement requirement during our evaluation of an application for a permit to import African elephant sport-hunted trophies; and (3) to incorporate a Party’s designation under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) National Legislation Project into the decision-making process for the import of live African elephants, African elephant sport-hunted trophies, and African elephant parts and products other than ivory. We find it is appropriate for the United States to propose requirements under the ESA to ensure that activities with live African elephants under U.S. jurisdiction contribute to enhancing the conservation of the species and that live African elephants are well cared for, so that any domestic demand for live African elephants enhances the conservation of the species and does not contribute to the decline in populations of the species in the wild. In addition, clarifying the enhancement requirement for the import of African elephant sport-hunted trophies and receiving information from the range countries will enable us to ensure that authorized imports contribute to enhancing the conservation of the species and do not contribute to the decline in populations of the species. Benefits of clarifying the enhancement standards for the import of African elephant sport-hunted trophies also include increased transparency with stakeholders in the decision-making process. We propose allowing certain types of imports only from countries that have met the basic requirements to implement CITES under their national laws in order to support U.S. African elephant efforts. Finally, we anticipate these measures will affect implementation in foreign countries of management measures that enhance African elephant conservation.

ASC Progress Report Standardized Instructions and Format for Interim and Final Progress Reporting (ASC PR)

Key Information

Abstract

The ASC developed this Progress Report (Report) for both interim and final progress reports for grants issued under ASC authority. The Report is submitted to the ASC semi-annually. The Report benefits award recipients by making it easier for them to administer federal grant programs through standardization of the types of information required in Reports, thereby reducing their administrative effort and costs. The ASC Grants Office reviews the Reports and determines if the grantee is progressing adequately towards meeting grant objectives. If the ASC Grants Office identifies any performance issues, staff will notify the grantee and work with them on corrective action.
