What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

Completed by applicants as the basis of a criminal history check to establish that an individual is suitable for Federal employment or should be granted a security clearance. Executive Order 10450, as amended, requires that investigations be conducted on all persons entering Federal service. E.O. 10450, as amended, also requires that each investigation include a check of the Federal Bureau of Investigation's (FBI) fingerprint files to identify any criminal records on the subject. Although roughly 60% of all submissions are received electronically, the need remains to conduct checks based on hardcopy requests. The Standard Form (SF) 87 is a fingerprint chart submitted to the FBI in order to fulfill that part of the background investigation. The SF 87 is a fingerprint card, which is utilized to conduct a national criminal history check, which is a component of the background investigation. The SF 87 is completed by individuals who are under consideration for appointment to or retention in a Federal position or performance of work on behalf of the Government. The SF 87 fingerprint chart is used in background investigations to establish that such persons are eligible for logical and physical access to Government facilities and systems; suitable or fit to perform work for, on behalf of, the Federal Government; suitable for employment or retention in a public trust position, suitable for employment or retention in a national security position, and/or eligible for access to classified national security information. The SF 87 form is only utilized when a hardcopy fingerprint chart must be obtained, as opposed to the electronic collection of fingerprints. Due to the SF 87 form’s small size and the fact that it may be maintained in multiple systems of records, it does not list all potentially applicable routine uses under the Privacy Act. Accordingly 5 U.S.C. 552a(e)(3)(C) requires that an agency issuing the SF 87 form must also give the subject a copy of the routine uses for the applicable system of records and FBI’s Privacy Act Notice and Privacy Rights.

Abstract

The Lacey Act (Act, 18 U.S.C. 42) prohibits the importation of any animal deemed to be and prescribed by regulation to be injurious to: • Human beings; • The interests of agriculture, horticulture, and forestry; or • Wildlife or the wildlife resources of the United States. Implementation and enforcement of the Lacey Act is the responsibility of the Department of the Interior. The Service, in concert with our diverse partners, works to conserve, restore, and maintain the nation's fishery resources and aquatic ecosystems for the benefit of the American people, to include managing and controlling four species of invasive carp—bighead, black, grass, and silver—native to Asia. Under the authority of the Act, the Service listed bighead, black, and silver carp species as injurious wildlife to protect humans, native wildlife, and wildlife resources from the purposeful or accidental introduction of invasive carp into the nation's aquatic ecosystems. The Service takes part in a broad, partner-driven approach to strategically control the movement of invasive carp. The spread of these invasive species in the nation's river systems threatens the conservation efforts conducted by our agency, our State partners, and other stakeholders, to promote self-sustaining aquatic resources and healthy aquatic ecosystems. In addition to widespread and longstanding ecological consequences, aquatic invasive species often result in significant economic losses and cost our nation's economy billions of dollars per year. To effectively carry out our responsibilities under the Act and protect the aquatic resources of the United States, the Service, in collaboration with the U.S. Geological Survey, proposes to administer applications of Carbon Dioxide-Carp by registered management partners (applicators) and to collect information regarding the usage of Carbon Dioxide-Carp, an Environmental Protection Agency (EPA) registered product #6704-95 to control invasive carp. The Federal pipeline safety regulations at 49 CFR §§192.612 and 195.413 require pipeline operators to conduct appropriate underwater inspections in the Gulf of Mexico. This mandatory information collection request would require the operator to contact the National Response Center by telephone within 24 hours of discovery and report the location of the exposed pipeline if the operator finds pipeline exposed on the seabed floor or a hazard to navigation. Operators must also notify PHMSA of each abandoned offshore pipeline facility or each abandoned onshore pipeline facility that crosses over, under or through a commercially navigable waterway.

Abstract

This information collection request requires operators of gas service lines who do not maintain their customers’ buried piping between service lines and building walls or gas utilization equipment to send written notices to their customers prescribing the proper maintenance of these gas lines and of the potential hazards of not properly maintaining these gas lines. Operators also have to maintain records that include a copy of the notice currently in use and evidence that notices were sent to customers within the previous 3 years. The purpose of the collection is to prevent pipeline safety failures and to enforce regulatory compliance. Examples of written notices include informational inserts included in customer's billing statements. For multi-family residences such as mobile parks, housing projects, or apartment complexes, the requirement allows master meter operators to post a general notice in a predominant location frequented by customers rather than issuing individual notices to each customer. The time frames for developing notices are immediate and operators must retain proof of notice for 3 years.

Abstract

This collection of information is necessary for the FAA to confirm compliance with fuel efficiency requirements for certification of certain airplanes. These certification requirements are proposed as new part 38 to 14 CFR, and are intended to implement the emissions standards adopted by the Environmental Protection Agency (EPA), allowing manufacturers to certificate their aircraft for fuel efficiency in the United States. The establishment of these standards by the EPA and their implementation by the FAA are required under the Clean Air Act. Further, these standards were initially established by the International Civil Aviation Organization (ICAO) with the participation of the United States; and, as a signatory to the Chicago Convention, the United States is adopting these standards that are consistent with those established internationally. The proposed appendix to new part 38 would require the submission of certain fuel efficiency certification test data that would be submitted to the FAA as part of the applicant’s certification test report. The regulation also requires a manufacturer to include one or more values in the flight manual of a certificated airplane.

Abstract

The Institute of Education Sciences within the U.S. Department of Education requests an extension of the Comprehensive Literacy Program Evaluation: Comprehensive Literacy State Development Grant Program (1850-0945, approved on February 26, 2021). The extension is to complete the collection of state administrative data. The extension is needed because the state administrative data for the 2022-23 school year will not be ready to collect prior to the February 29, 2024 expiration date in all 13 CLSD grantee states. No material change in the collection instrument, instructions, frequency of collection, or use of information is being requested. The Comprehensive Literacy State Development (CLSD) Program Evaluation was mandated by Congress. The CLSD evaluation includes an examination of implementation, a randomized trial to estimate the impact of CLSD funding on teacher and student outcomes, and a longitudinal comparison of trends in achievement in CLSD and similar, non-CLSD schools. With the exception of the state administrative data collection--for which this extension is being requested--all other data collection for the study previously approved (including state interviews, district, school leader, and teacher surveys) have been completed.

49 CFR 199.227 requires operators to retain records for three years if they decide not to administer post-accident/incident drug testing on affected employees). OCC Guidelines Establishing Heightened Standards for Certain Large Insured National Banks, Insured Federal Savings Associations, and Insured Federal Branches

Abstract

The OCC's codified guidelines (12 CFR part 30, appendix D) establish minimum standards for the design and implementation of a risk governance framework for insured national banks, insured Federal savings associations, and insured Federal branches of a foreign bank (bank). The guidelines apply to a bank with average total consolidated assets: (i) equal to or greater than $50 billion; (ii) less than $50 billion if that institution's parent company controls at least one insured national bank or insured Federal savings association that has average total consolidated assets of $50 billion or greater; or (iii) less than $50 billion, if the OCC determines such bank's operations are highly complex or otherwise present a heightened risk as to warrant the application of the guidelines (covered banks). The guidelines also establish minimum standards for a board of directors in overseeing the framework's design and implementation. The OCC is now seeking to renew the information collection associated with these guidelines.
