What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

This proposed rule would place new requirements on Medicare Advantage organizations, Medicaid managed care plans, CHIP managed care entities, state Medicaid and CHIP fee-for-service (FFS) programs, and Qualified Health Plan (QHP) issuers on the Federally-facilitated Exchanges (FFEs) to improve the electronic exchange of healthcare data, and streamline processes related to prior authorization, while continuing CMS’ drive toward interoperability, and reducing burden in the health care market. This proposed rule would also add new requirements for eligible hospitals and critical access hospitals participating in the Medicare Promoting Interoperability Program and for Merit-based Incentive Payment System eligible clinicians participating in the Promoting Interoperability performance category of the Quality Payment Program. These policies taken together play a key role in reducing overall payer and provider burden and improving patient access to health information.

Abstract

The Form I-956 is used to request U.S. Citizenship and Immigration Services (USCIS) designation as a regional center under Immigration and Nationality Act (INA) section 203(b)(5)(E), or to request an amendment to an approved regional center designated under INA 203(b)(5)(E). The Form I-956F is used by a designated regional center to request approval of each particular investment offering through an associated new commercial enterprise. The Form I-956G is used by regional centers to provide required information, certifications, and evidence to support their continued eligibility for regional center designation. Each approved regional center must file Form I-956G for each Federal fiscal year (October 1 through September 30) on or before December 29 of the calendar year in which the Federal fiscal year ended. The Form I-956H must be completed by each person involved with a regional center, new commercial enterprise, or affiliated job-creating entity and submitted as a supplement to Form I-956, Application for Regional Center Designation, or other forms where persons are required to attest to their eligibility to be involved with the EB-5 entity and compliance with INA section 203(b)(5)(H). The Form I-956K must be completed by each person acting as a direct or third-party promoter (including migration agents) of a regional center, any new commercial enterprise, an affiliated job-creating entity, or an issuer of securities intended to be offered to alien investors in connection with a particular capital investment project.

Abstract

In 2018, Congress passed the FAA Reauthorization Act of 2018 (Public Law 115-254). § 44809 of Public Law 115-254 allows a person to operate a small unmanned aircraft (sUA) without specific certification or operating authority from the Federal Aviation Administration (FAA) if the operation adheres to certain limitations. These limitations require the FAA to recognize Community Based Organizations (CBOs), develop and administer an aeronautical knowledge and safety test, establish fixed flying sites, and approve standards and limitations for unmanned aircraft weighing more than 55lbs. Information related to fixed flying sites and CBOs will be collected by the FAA through the DroneZone website at https://faadronezone.faa.gov, while test-administration information will be collected through the FAA's TRUST database. The information collected will be available for review by FAA Flight Standards and Air Traffic personnel. The FAA uses the information collected under Section 44809 Operational Applications to recognize, accept, approve, or deny applications required under § 44089. This includes airspace authorizations though fixed sites, CBO recognition, comprehensive safety guideline review, heavier than 55 pound unmanned aircraft standards and limitations approval, and aeronautical knowledge and safety test administration. Responding to this collection is voluntary. Only those entities that wish to be recognized as a CBO, establish fixed flying sites, or administer the aeronautical knowledge and safety test need to respond. Information collected will be on an as-needed basis, used to review applications, and will be kept as a record.

Abstract

This information collection relates to the Wagner-Peyser Act, published January 6, 2020, which gives States increased flexibility in their administration of Employment Service activities funded under the Wagner-Peyser Act. The regulations align with the flexibility allowed under the Workforce Innovation and Opportunity Act (WIOA). Pursuant to 20 CFR 653.109, SWAs use ETA Form 5148 to submit quarterly data to ETA on the services they provide to MSFWs. ETA uses that data to monitor and measure the extent and effectiveness of SWA service delivery to MSFWs and overall compliance with 20 CFR 651, 653, and 658. Additionally, 20 CFR 658.602(e) requires the ETA National Office to develop tools and techniques for reviewing and assessing SWA performance and compliance with ES regulations; and 20 CFR 658.602(f)(2) requires the National Monitor Advocate to review the performance of SWAs in providing the full range of employment services to MSFWs. The collection of data through ETA Form 5148 allows ETA to comply with these regulations and monitor SWA performance. ETA requires that staff must ensure a complainant (or his/her representative) submits a complaint on the Complaint/Apparent Violation Form or another complaint form prescribed or approved by the Department or submits complaint information. The Complaint/Apparent Violation Form must be used for all complaints, including complaints about unlawful discrimination. ETA Form 8429 is helpful because it identifies whether a complainant is a Migrant and Seasonal Farmworker which implicates additional actions that must be taken.

Agreement States will be asked to provide information about uranium recovery and complex sites undergoing decommissioning regulated by the Agreement States on an annual basis. The information request will allow the NRC to compile, in a centralized location, more complete information on the status of decommissioning and decontamination in the United States in order to provide a national perspective on decommissioning. The information will be made available to the public by the NRC in order to ensure openness and promote communication to enhance public knowledge of the national decommissioning program. This does not apply to information, such as trade secrets and commercial or financial information provided by the Agreement States, that is considered privileged or confidential. Information such as financial assurance and the status of decommissioning funding would need to be identified by the Agreement State as privileged or confidential, whereupon the NRC would withhold such information from public access and treat it as sensitive or non-sensitive, per the considerations in 10 CFR Parts 2.390 and 9.17. This does not apply to financial assurance or decommissioning funding information that is already available to the public. Although specific details of the funding mechanisms are treated as confidential, beneficial lessons learned regarding the improvement of decommissioning-related funding will be shared with the Agreement States.

Abstract

The Administration on Children, Youth and Families' (ACYF) Family and Youth Services Bureau (FYSB) administers the Personal Responsibility Education Program (PREP), which funds states and territories to implement personal responsibility education programs that educate adolescents on both abstinence and contraception for the prevention of pregnancy and sexually transmitted infections, including HIV/AIDS. PREP projects must also implement at least three adulthood preparation subjects and replicate evidence-based effective programs or substantially incorporate elements of effective programs that have been proven on the basis of scientific research to change behavior. This means delaying sexual activity, increasing condom or contraceptive use for sexually active youth, or reducing pregnancy among youth. States and territories are required to submit plans for the implementation of personal responsibility education. The plans provide information about how the state or territory plans to use their state allotment for the development and implementation of education programs aimed to reduce the pregnancy rates and birth rates for youth populations, especially youth populations that are the most high-risk or vulnerable for pregnancies or otherwise have special circumstances, including youth in foster care, homeless youth, youth with HIV/AIDS, pregnant youth who are under 21 years of age, mothers who are under 21 years of age, and youth residing in areas with high birth rates for youth. No changes are proposed to the state plan. States and territories must also submit a performance progress report (PPR) on a semi-annual basis that informs the monitoring of their program design, program evaluation, management improvement, service quality, and compliance with agreed upon goals. The PPRs provide FYSB with information to assure effective service delivery for youth participants, report outcomes and efficiencies, and provide valuable information to policy makers and key stakeholders in the development of program and research efforts. FYSB proposes updates to the PPR to include a request for information related to equity activities and strategies to mitigate challenges. The inclusion of information on equity activities will support the FYSB Equity Action Plan objectives and identify opportunities to inform the development of T&TA resources, as needed. The inclusion of strategies to mitigate challenges will allow grant recipients to demonstrate how they overcome challenges which can inform peer to peer sharing.

Social Services Block Grant (SSBG) Post-Expenditure Report, Pre-Expenditure and Intended Use Plan

Key Information

Abstract

The Social Services Block Grant (SSBG) program is authorized under Title XX of the Social Security Act, as amended, and is codified at 42 U.S.C. §1397 through §1397e. The implementing regulations for this and other block grant programs authorized by the Omnibus Budget Reconciliation Act of 1981 are published at 45 C.F.R. Part 96. Those regulations include both specific requirements and general administrative requirements instead of 45 CFR Part 92 (the HHS implementation of the A-102 Common Rule) for the covered block grant programs. Requirements specific to SSBG are found in 45 C.F.R. §96.70 through §96.74. The SSBG program provides funds to States, the District of Columbia, Guam, Puerto Rico, American Samoa, the Virgin Islands, and the Commonwealth of the Northern Mariana Islands (hereinafter referred to as States) to support social services for adults and children in support of five statutory goals (42 U.S.C. §1397). Funds are allocated to the States based on population as block grants for the administration of their social services programs. Within specific legal limitations (42 U.S.C. §1397d), States have substantial discretion in the use of funds and may determine what services will be provided, who will be eligible, and how funds will be distributed among the various services. State or local SSBG agencies (i.e., county, city, and regional offices) may provide the services or purchase them from qualified agencies or organizations. States report recipients of SSBG-funded services as any individuals who receive a service funded, in whole or in part, by SSBG. Before a State receives SSBG funds, it must provide information specifying the intended use of the block grant. Annually, states must provide the ACF Office of Community Services (OCS) with information on the types of activities to be supported, the characteristics of individuals to be served, and the estimated amount of SSBG funding that will be allocated to each service category (42 U.S.C. §1397c). Historically, there was no specific format required for states to submit this information and ACF recommended that grant recipients use the post-expenditure reporting form to identify the intended use of funding estimates. A state’s plan for the intended use of funds is used to provide funding OCS with pre-expenditure estimates, which are most commonly provided through the post-expenditure reporting form and are referred to as the pre-expenditure report. The estimated burden for the submission of pre-expenditure report data has historically been included within the burden estimates for the SSBG Post-Expenditure Report (0970-0234). Information reported includes an annual total of adults and children served and expenditures in each of the 29 service categories. Post-expenditure reporting requirements for SSBG are codified at 45 C.F.R. § 96.74. States must submit their annual Post-Expenditure Report within 6 months of the end of the period covered by the report. This request is to extend approval of all materials approved under this OMB number and to make minor updates to the standard pre-and post-expenditure reports. Specifically, we have modified four column titles on the standard pre-and post-expenditure reports, which are required of states to report planned and actual expenditures of SSBG funds, respectively. The proposed changes will clarify what data to include, which will increase accuracy in reporting and assessment for grant recipients and federal staff.

Abstract

The Consumer Product Safety Act (CPSA), as amended by the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the Consumer Product Safety Commission (CPSC or the Commission) to publish, as a mandatory consumer product safety standard, the American National Standard for Four-Wheel All-Terrain Vehicles (ATVs) developed by the Specialty Vehicle Institute of America (ANSI/SVIA 1–2007). CPSC published that mandatory consumer product safety standard in November 2008. In March 2023, ANSI/SVIA issued a 2023 edition of its standard. In accordance with the CPSA, CPSC is issuing this final rule to amend the Commission’s mandatory ATV standard. The rule amends the ATV standard to mandate industry compliance with ANSI/SVIA 1–2023, American National Standard for Four-Wheel ATVs. The standard’s requirements include provisions that fall within the definition of ‘‘collection of information,’’ as defined in 44 U.S.C.3502(3).

Abstract

Section 2718 of the PHS Act and its implementing regulation requires health insurance issuers (issuers) offering group or individual health insurance coverage to submit an annual report to the Secretary of the Department of Health and Human Services concerning the amount the issuer spends each year on claims, quality improvement expenses, non-claims costs, Federal and State taxes, licensing and regulatory fees, the amount of earned premium for the reporting year, its medical loss ratio and any rebate it may owe to subscribers. In addition, the implementing regulation requires issuers to maintain all documents and other evidence which support the data that is provided in an issuer's annual report to the Secretary.

The PBI Program makes 5-year grant awards to eligible colleges and universities to plan, develop, undertake and implement programs to enhance the institution's capacity to serve more low- and middle-income Black American students; to expand higher education opportunities for eligible students by encouraging college preparation and student persistence in secondary school and postsecondary education; and to strengthen the financial ability of the institution to serve the academic needs of these students.

The Standard imposes the following paperwork requirements on each employer who establishes a fire brigade: Write an organizational statement; ascertain the fitness of workers with specific medical conditions to participate in fire related operations; and provide appropriate training and information to fire brigade members.
