Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

There is also a waiver provision incorporated into section 212(a)(9)(B)(v) of the Act, which allows the Secretary of Homeland Security to exercise discretion to waive the unlawful presence grounds of inadmissibility on a case-by-case basis. The information collection required on an Application for Provisional Unlawful Presence Waiver of Inadmissibility, Form I-601A, is necessary for U.S. Citizenship and Immigration Services (USCIS) to determine whether the applicant meets not only the requirements to participate in the streamlined waiver process provided by regulation, but also whether the applicant is eligible to receive the provisional unlawful presence waiver.

Abstract

Sections 212(a)(9)(A) and 212(a)(9)(C) of the Immigration and Nationality Act (Act) render an alien inadmissible to the United States unless he or she obtains the consent to reapply (also known as permission to reapply) for admission to the United States. Abstract

Form I-131A has two uses: 1) A lawful permanent resident, who is traveling overseas and is not in possession of a valid, unexpired Permanent Resident Card or other evidence of lawful permanent resident status, may use this form to apply for Carrier Documentation within one year of his or her last departure from the United States; 2) a non-immigrant who is traveling overseas on an Advance Parole Document (Form I-512 or I-512L) or Employment Authorization Document with travel endorsement (Form I-766), may use this form to apply for Carrier Documentation where his or her document has been lost, stolen, or damaged overseas and that document has not expired. In both of the above circumstances, the applicant must submit the application in person at a U.S. Embassy or U.S. Consulate. The decision on Form I-131A is entirely discretionary and may not be appealed. Furthermore, DHS may revoke or terminate Carrier Documentation at any time. If the Form I-131A is approved, DOS will issue a boarding foil, generally valid for 30 days, which will allow the individual to board a vessel or aircraft, travel to the United States, and present him or herself at a U.S. port-of-entry. Carrier Documentation is not a guarantee of admission or other form of entry into the United States, and U.S. Customs and Border Protection (CBP) will carry out all required inspection procedures upon the alien’s arrival at a U.S. port of entry.

This is an extension request to the Office of Information and Regulatory Affairs (OIRA) of the previously approved 2125-0529. Formal agreements between State Transportation Departments and the FHWA are required for Federal-aid highway projects. These agreements, referred to as "project agreements" are written contracts between the State and the Federal government that define the extent of work to be undertaken and commitments made concerning a highway project. Section 1305 of the Transportation Equity Act for the 21st Century (TEA-21, Public Law 105-178) amended 23 U.S.C. 106(a) and combined authorization of work and execution of the project agreement for a Federal-aid project into a single action. States continue to have the flexibility to use whatever format is suitable to provide the statutory information required, and burden estimates for this information collection are not changed.

Abstract

The National Marine Fisheries Service (NMFS) Alaska Region requests extension of this currently approved information collection, which supports the arbitration system, a component of the Crab Rationalization Program. The arbitration system was designed to fairly and equitable resolve price, delivery terms, performance standards, and other disputes in the event that individual fishing quota and individual processor quota holders are unable to reach agreement on price and related issues. The arbitration system is necessary to reduce contention in and provide certainty of resolution to price negotiations. The information collected is necessary to verify arbitration organization membership and maintain the arbitration system. There are five elements of this information collection, four of which are submitted to NMFS annually: the Annual Arbitration Organization Report, Market Report, Non-binding Price Formula Report, and Cost Allocation Agreement. However, these reports are only prepared and collected by NMFS for open fisheries. Arbitrations only occur if the parties are unable to reach a directly negotiated agreement. If there is an arbitration, the Contract Arbitrator Report for that fishery’s arbitration is submitted to NMFS. With this extension, the template for the Annual Crab Arbitration Organization Report is updated to include email as a submission method, and the miscellaneous costs for the Cost Allocation Agreement are updated to more accurately reflect the costs for this information collection.

This collection encompasses mandatory requirements to collect and retain (recordkeeping requirement), and to report (reporting requirement), flight data and cockpit voice data using a Flight Data Recorder (FDR) and Cockpit Voice Recorder (CVR). Respondents to the collection include operators of aircraft for which the operating requirements of parts 91, 121, 125, 129, or 135 require the aircraft to have and use a CVR or FDR. Collection frequency is as follows: Recordkeeping - Continuous •The FDR and CVR continuously record data, which is stored and continuously overwritten by new data, while retaining the last 2 hours (CVR) or 25 hours (FDR) of recorded data. Reporting – As-needed •The data is reported/provided to the FAA and/or NTSB on an as-needed basis (i.e., after an aircraft has been involved in a reportable accident or incident), or •The data is stored (off aircraft), upon request by the FAA and/or NTSB, until the investigation can be conducted. Use of Information Collected: The data collected by an FDR or CVR is received and used by the NTSB and/or FAA for accident and incident investigation: •Following an accident, the FDR and CVR are immediately removed from the accident site and transported to NTSB headquarters in Washington, D.C. for processing. Using sophisticated computer and audio equipment, the information stored on the recorders is extracted and translated into an understandable format. •Depending on the severity of an aircraft incident, the FAA or NTSB may request the FDR and/or CVR data for an aircraft directly from the aircraft owner or operator.

Abstract

This ICR presents EPA's estimates for the burden and costs associated with the information collection activities related to pollution prevention grant programs and the collection of activity and results data from the grantees via a standard electronic format. P2 means reducing or eliminating pollutants from entering any waste stream or otherwise being released into the environment prior to recycling, treatment, or disposal. EPA's P2 program operates three grant programs and is developing two new grant programs. The three existing programs are: The Pollution Prevention State Tribal Assistance Grants (P2 STAG); the Bipartisan Infrastructure Law Pollution Prevention Grants (P2 BIL); and the Source Reduction Assistance (SRA) Grants. The P2 STAG and SRA grants are funded through recurring appropriations and require grantees to provide matching funds. The P2 BIL grants, which are funded through the 2021 Infrastructure Investment and Jobs Act (IIJA), also referred to as the Bipartisan Infrastructure Law (BIL), are also STAG but do not require grantees to provide matching funds. The two new grant programs under development are: The Pollution Prevention Grant: Environmental Justice Through Safer/Sustainable Products (P2 EJ Products); and the Pollution Prevention Grant: Environmental Justice in Communities (P2 EJ Facilities). The P2 EJ Products and P2 EJ Facilities grants will also be supported by BIL funding and, as such, do not require grantee matching funds.
