What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

The Federal Cigarette Labeling and Advertising Act, 15 U.S.C. § 1333 et. seq., sets forth certain warnings that are required to appear on cigarette packaging and advertising. The Act requires cigarette manufacturers and importers to rotate these warnings on a quarterly basis. See id. However, under certain circumstances, manufacturers and importers with sales below a specified threshold can apply for equalization with respect to the rotation of the warnings on their packaging—meaning that they only need to display the statutorily prescribed warnings an equal number of times over the course of a year—instead of rotation “with respect to a brand style of cigarettes.” See 15 U.S.C. § 1333(c)(1) and (c)(2). Regardless of whether a manufacturer or importer chooses to apply for equalization, it must submit a plan, which is subject to the FTC’s approval and must establish how the manufacturer or importer plans to comply with the statutory labeling and advertising (if it intends to engage in advertising) requirements. See 15 U.S.C. § 1333(a). The applicant must also keep records demonstrating its compliance with the plan approved by the FTC. Manufacturers and importers may apply for equalization if “(i) the number of cigarettes of such brand style sold in the fiscal year of the manufacturer or importer preceding the submission of the application is less than one-fourth of 1 percent of all the cigarettes sold in the United States in such year, and (ii) more than one-half of the cigarettes manufactured or imported by such manufacturer or importer for sale in the United States are packaged into brand styles which meet the requirements of clause (i).” See 15 U.S.C. § 1333(c)(2)(A). Additionally, as part of this application, the manufacturer or importer must include “a plan describing how the manufacturer plans to achieve equalization within the twelve-month period.” See 15 U.S.C. § 1333(c)(2)(B). If the FTC approves the application for equalization, that approval is valid for one year from the date of the approval. See 15 U.S.C. § 1333(c)(2)(C). A manufacturer or importer that has received approval for quarterly rotation of the warnings on its packages does not need further approval from the Commission unless it intends to add new brands or brand styles to its previously-approved plan. Similarly, approval for an advertising plan does not expire, although the manufacturer or importer will need additional approval for new brands, types of advertising, or sizes of advertising formats.

Key Information

Abstract

The Charter Service program ensures that private charter bus providers (who register on FTA's Charter Registration Website) are given the first opportunity to provide charter bus service and protects them from unauthorized competition from public transit providers that receive federal funding from FTA. This is a voluntary collection of information from private charter bus companies and transit agencies. The collection of information from private charter bus companies is conducted during their initial registration on FTA’s Charter Service Registration website. Registration allows the company to be notified electronically of third-party charter service request in their geographic region that are submitted to FTA grantees. The companies are requested to update their information every two years. Although, private charter companies are given priority, a FTA grant recipient may also provide charter service. However, they are required to electronically report such information on a quarterly basis. The Charter Service program was unchanged with the passing of the Bipartisan Infrastructure Law (BIL) however, this information collection request reflects a decrease in the respondents from 2180 in 2020 to 2,000 currently. This decrease was not associated with any federal regulation or action but the result of consolidation among charter bus respondents and some private bus operators no longer doing business due to the pandemic. This submission also includes updates in cost to the respondents based on the 2022 Bureau of Labor Statistics wage rates and the federal costs which were updated as a result of the 2024 OPM salary table.

Key Information

Abstract

The EPA has established a suite of PM2.5 standards based on numerous health studies and other evidence demonstrating that serious health effects are associated with exposure to elevated levels of PM2.5. Estimates show that attainment of the PM2.5 standards would result in tens of thousands fewer premature deaths each year, tens of thousands fewer hospital admissions each year, and hundreds of thousands fewer doctor visits, absences from work and school, and respiratory illnesses in children annually. EPA initially established annual and 24-hour PM2.5 standards in 1997. The 24-hour standard was subsequently revised in 2006, and the primary annual standard was revised in 2012. The EPA finalized the PM2.5 NAAQS State Implementation Plan (SIP) Requirements Rule (81 FR 58010) effective October 24, 2016, to describe the Clean Air Act (CAA) requirements that must be met by states with nonattainment areas to develop plans for attaining and maintaining the NAAQS. The intended effect of the PM2.5 NAAQS SIP Requirements Rule is to provide certainty to states regarding their planning obligations related to SIP development. Only states with nonattainment areas are required to submit SIPs that meet the requirements of the rule. The information collection activities in this proposed renewal have been submitted for approval to the Office of Management and Budget (OMB) under the Paperwork Reduction Act (PRA). The PRA requires the EPA to assess the administrative burden (in hours and dollars) for state air agencies to develop plans to attain the PM2.5 NAAQS, and for EPA to review and take action on such plans.

The GSA “Equity Study on Remote Identity Proofing” will assess the impact of ethnicity, race, gender, income, and other demographic factors on the multiple components of identity proofing, which is the process of verifying that a person is who they say they are. GSA will test remote identity-proofing tools provided by multiple vendors that include both biometric checks using facial verification technology as well as non-biometric methods like mobile-device account ownership and credit history. Abstract

EPA adopted the Tier 4 marine diesel engine standards in June 2008, under the authority of the Clean Air Act (73 FR 37096). The Tier 4 standards were phased in, with an effective date beginning in 2016 through 2018 for most engines. In August 2020, EPA amended those regulations in response to industry concerns about the availability of suitable Tier 4 certified engines for installation in certain kinds of high-speed vessels. The amendments provided focused relief for qualifying engines and vessels in two phases, depending on engine and vessel size. Builders of qualifying vessels were required to submit to EPA information describing their need for regulatory relief and demonstrating that their vessels met the size and power conditions. As part of the Phase 2 relief, EPA also adopted a waiver provision that can be applied for, if necessary, beginning in 2024, if suitable engines continue to be unavailable; this waiver requires the vessel builder to submit an application which would be reviewed by EPA before issuing the waiver. This information collection request renewal covers the reporting burden associated with applying for the waiver for vessels meeting the criteria for Phase 2 relief.

Abstract

EPA is required under Section 183(e) of the Clean Air Act to regulate Volatile Organic Compound (VOC) emissions from the use of consumer and commercial products. Under regulations promulgated on February 26, 2007 (72 FR 8428) manufacturers of new portable gasoline containers are required to obtain certificates of conformity with the Clean Air Act, effective January 1, 2009. This ICR covers the burdens associated with this certification process. EPA reviews information submitted in a manufacturers application for certification to determine if the gasoline container design conforms to applicable regulatory requirements and to verify that the required testing has been performed. The certificate holder is required to keep records on the testing and collect and keep warranty and defect information for annual reporting on in-use performance of their products. The respondent must also retain records on the units produced, apply serial numbers to individual containers, and track the serial numbers to their certificates of conformity. Any information submitted for which a claim of confidentiality is made is safeguarded according to EPA regulations at 40 CFR 2.201 et seq.

The CSB Rebates Program currently collects information under an existing ICR; namely the Diesel Emissions Reduction Act (DERA) and Clean School Bus (CSB) Rebate Program ICR No. 2060-0686. The Environmental Protection Agency currently uses ICR No. 2060-0686 to collect information for the CSB Program, but the Agency now needs additional information to ensure successful administration and management of the Clean School Bus Program. This ICR is requesting information collection of all components found in ICR 2461.04 and 2461.05 EPA uses approved procedures and forms to collect necessary information to operate a rebate program and has been providing rebates under CSB since 2022. Abstract

FRA is amending its regulations related to occupational noise exposure in three ways. First, in response to a Congressional mandate, FRA is expanding those regulations to require that railroads provide an appropriate atmosphere-supplying emergency escape breathing apparatus to every train crew member and certain other employees while they are occupying a locomotive cab of a freight train transporting a hazardous material that would pose an inhalation hazard in the event of release during an accident. Second, FRA is changing the name of this part of its regulations from “Occupational Noise Exposure” to “Occupational Safety and Health in the Locomotive Cab” to reflect the additional subject matter of this final rule and to make other conforming amendments. Third, FRA is removing the provision stating the preemptive effect of this part of FRA’s regulations because it is unnecessary. The information collection will enable FRA to ensure compliance with the Congressional mandate requiring railroads to provide suitable emergency escape breathing apparatus that covers the head and neck and offers respiratory protection for all covered employees. Additionally, FRA will use the collected information to verify that railroads properly inspect, maintain, repair, and replace EEBAs and provide the necessary EEBA instruction/training to all employees covered by this regulation. This information collection is mandatory, submitted to FRA as needed, and there is a requirement for reporting and recordkeeping.

Abstract

Section 713 of the Communications Act of 1934, as amended (the Act), 47 U.S.C. § 613, which was added pursuant to section 305 of the Telecommunications Act of 1996, requires the Commission to prescribe rules and implementation schedules for closed captioning of televised video programming. In enacting section 713, Congress generally required that video programming be closed captioned, regardless of distribution technology, to ensure access to persons who are deaf and hard of hearing. The purpose of this submission is to seek Office of Management and Budget (OMB) approval for a three-year extension to the currently approved information collections under Control No. 3060-0761, which relates to the closed captioning on television rules (found in 47 CFR § 79.1).
