Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The FDIC is requesting approval from the OMB to establish a new information collection comprised of reporting, recordkeeping and third-party disclosure requirements contained in a notice of proposed rulemaking on “FDIC Official Sign and Advertising Requirements, False Advertising and Misrepresentation of Insured Status and Misuse of FDIC's Name or Logo” (the Proposed Rule), The Proposed Rule would amend 12 CFR part 328 (part 328), which governs the use of the official FDIC sign and insured depository institutions’ (IDIs) advertising statements. The Proposed Rule would also update part 328 to reflect how depositors do business with IDIs today, including through automated teller machines and like devices (ATMs) as well as digital and mobile channels. In addition, the Proposed Rule would clarify subpart B of part 328 regarding misrepresentations of deposit insurance coverage by addressing specific scenarios where consumers may be misled as to whether they are doing business with an IDI and whether their funds are protected by deposit insurance. The Proposed Rule is intended to enable consumers to better understand when they are doing business with an IDI and when their funds are protected by the FDIC’s deposit insurance coverage. The Proposed Rule affects all IDIs as well as all non-bank entities who use the official FDIC sign, advertising statements, or otherwise make representations that their products are insured or guaranteed by the FDIC (covered non-bank entities).

Abstract

The R-value Rule establishes uniform standards for the substantiation and disclosure of accurate, material product information about the thermal performance characteristics of home insulation products. The R-value of an insulation product is its resistance to the flow of heat. Consumers can use this information to determine how well a product is likely to perform as an insulator, and to compare the product's cost-efficiency with other products to determine whether the cost of the insulation is justified. The R-value Rule requires manufacturers and sellers of home insulation products to disclose the R-value to consumers before sale. The Rule also requires manufacturers and sellers making representations concerning fuel or energy cost savings to keep records to substantiate claims.

Abstract

Section 1853(o) of the Social Security Act requires us to make Quality Bonus Payments (QBPs) to Medicare Advantage (MA) organizations that achieve performance rating scores of at least 4 stars under a five star rating system. Beginning in 2012, the star ratings we assign for purposes of QBPs under section 1858(o) of the Act will directly affect the monthly payment amount MA organizations receive from us under their contracts. In effect, this information collection request addresses a review process through which MA organizations may seek review of determinations governing their star rating ("QBP status") when the MA organization's rating is less than 4 stars. Regarding the appeals process, MA organizations have 5 calendar days from the date of CMS' release of its QBP determinations to request a technical report from CMS explaining the development of their QBP status. The technical report will be provided in writing by electronic mail to the MA organization and CMS within 30 days of CMS' receipt of the organization's request for the report by the technical report contractor. If, after reviewing the technical report, the MA organization believes that CMS was incorrect in its QBP determination, within 7 calendar days, the MA organization may request an appeal to be conducted by a hearing officer designated by CMS. The hearing officer's decision would be final and binding on both the MA organization and CMS. The hearing officer will be required to issue his/her decision on or before May 15 of the year preceding the year in which the plans for which the QBP is to be applied will be offered.

Abstract

The Federal Trade Commission (FTC) seeks renewed clearance for the information collection requirements in its Privacy of Consumer Financial Information Rule (Privacy Rule). The Privacy Rule is designed to ensure that customers and consumers, subject to certain exceptions, will have access to the privacy policies of the financial institutions with which they conduct business. As mandated by the Gramm-Leach-Bliley Act, 15 U.S.C. 6801-6809, the Rule implements consumer disclosure requirements that are subject to the provisions of the PRA. The Rule requires financial institutions to disclose to consumers: (1) initial notice of the financial institution's privacy policy when establishing a customer relationship with a consumer and/or before sharing a consumer's non-public personal information with certain nonaffiliated third parties; (2) notice of the consumer's right to opt out of information sharing with such parties; (3) annual notice of the institution's privacy policy to any continuing customer; and (4) notice of changes in the institution's practices on information sharing. The Rule does not require recordkeeping. For PRA burden calculations the FTC has attributed to itself the burden for all motor vehicle dealers and then shares equally the remaining PRA burden with the Consumer Financial Protection Bureau (CFPB) for other types of financial institutions for which both agencies have enforcement authority regarding the Privacy Rule.

The Gulf of Mexico Fishery Management Council has finalized a Framework Action to convert the remaining four (4) Historical Captain for hire permits into Standard Federal Charter/Headboat permits. This revision removes the request for Historical Captain information in Section 10 of the Federal Permit Application for Vessels Fishing in the Exclusive Economic Zone (Vessel EEZ Application). The information collections in 0648-0205 consist of applications for permits that are a mandatory part of the National Marine Fisheries Service (NMFS) program in the Southeast Regional Office (SERO) to manage commercial, recreational, and aquaculture fisheries in the Gulf of Mexico (Gulf), Atlantic, and U.S. Caribbean. In addition, this collection also contains fisheries’ reporting, notification, and registration forms and requirements. The fisheries in the southeast region are managed under the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) (16 U.S.C. 1801 et seq.), and regulations at 50 CFR parts 300, 622, and 635. NMFS issues permits to fishing vessels, vessel operators, and dealers, among others, to collect information necessary to comply with domestic and international fisheries obligations, secure compliance with regulations, and disseminate necessary information.

Managed Aquifer Recharge Planning and Guidance Study

Abstract

The survey will inform the development of a screening tool and other resources for USACE Districts to identify optimal sites for Managed Aquifer Recharge (MAR), which uses captured surface water to replenish groundwater. The Water Resources Development Act (WRDA) of 2016 (Title I of Pub. L. 114-322) provides authority for water supply conservation projects for drought resilience and water supply availability studies for water resources development (Sections 1116 and 1118, respectively). The WRDA of 2016 further requires USACE to consider natural and nature-based features, such as MAR, as potential solutions to address various challenges along with other measures. However, USACE has not developed a strategic framework for incorporating MAR into its operations. Furthermore, the Institute for Water Research (IWR) concluded that Districts only engage with aquifer recharge in an “ad hoc” manner and recommended that USACE “upgrade its internal capacity in MAR.” (IWR 2020). Section 8108 of the WRDA of 2022 (Title LXXXI of Pub. L. 117-263) instructs USACE to “conduct a study at Federal expense to determine the feasibility of carrying out managed aquifer recharge projects to address drought, water resiliency, and aquifer depletion.” Following these recommendations, the proposed work contributes to the development of guidance on MAR. This aligns with Civil Works strategies for flood risk management, restoration of aquatic ecosystems in floodplains, and developing environmentally sustainable technical services that enhance public safety and require collaborative partnerships.

Community Noise Mitigation Program Grant Proposals

Section 8120 of the Consolidated Appropriations Act, 2022 (Pub. L. 117-103) provided $75 million to the Office of Local Defense Community Cooperation (OLDCC) of the Department of Defense to “make grants to communities impacted by military aviation noise for the purpose of installing noise mitigating insulation at covered facilities.” These funds expire if they are not obligated prior to September 30, 2025. To implement this congressional direction, OLDCC may award grants to local governments under the competitive Community Noise Mitigation Program (CNMP) for the purpose of reducing the impact of fixed wing military aviation noise on covered facilities. This information collection facilitates the awarding of grants under CNMP via an initial grant proposal package prepared by applicants in accordance with the CNMP Notice of Funding Opportunity Announcement posted on the Grants.gov website.

User Testing of Aftershock Forecast

Key Information

Abstract

The USGS produces and releases forecasts for earthquake aftershocks following damaging earthquakes in an automated manner. Currently, these forecasts are communicated to the public and to specialist users with text and tables. The aim of our larger project is to produce graphics and maps for aftershock forecasts that can best serve user needs. We seek to make sure new forecast graphics serve user needs through online user testing. In this information collection, we will ask users questions about the forecast using a variety of graphical representations of it. This will help identify how different graphics affect how users understand and use aftershock forecast information. The results of this user testing will improve the way the USGS communicates aftershock forecasts to the public.
