Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

30 CFR 57.11053 requires the development of specific escape and evacuation plans by the operator that address the unique conditions and mining system of each underground metal and nonmetal mine (MNM). The plan must show assigned responsibilities of all key personnel in the event of an emergency and set out in written form. 30 CFR 57.11053 also requires that mine operators make modifications to the escape and evacuation plan for an underground metal and nonmetal mine as mining progresses and conditions at the mine change. The plan must be available to the Secretary or their authorized representatives from MSHA, and conspicuously posted at the mine at locations convenient to all persons on the surface and underground. The mine operator and MSHA are required to jointly review the plan at least once every 6 months. The information is prepared by the mine operator for use by miners, MSHA, and persons involved in rescue operations. A miner must be aware, at all times, of the emergency escape route for his/her particular working place. Rescue personnel must be aware of the miners’ escape routes.

Abstract

This request is for a new OMB approval to collect the Annual Performance Report (APR) data from Charter School Programs (CSP) Credit Enhancement for Charter School Facilities Program (CE) grantees. The Charter School Programs was originally authorized under Title V, Part B, Subpart 1, Sections 5201 through 5211 of the Elementary and Secondary Education Act (ESEA) of 1965, as amended by the No Child Left Behind (NCLB) Act of 2001. For fiscal year 2017 and thereafter, ESEA has been amended by the Every Student Succeeds Act (ESSA), (20USC 7221-7221i), which reserves funds to improve education by supporting innovation in public education and to: (2) provide financial assistance for the planning, program design, and initial implementation of charter schools; (3) increase the number of high-quality charter schools available to students across the United States; (4) evaluate the impact of charter schools on student achievement, families, and communities, and share best practices between charter schools and other public schools; (5) encourage States to provide support to charter schools for facilities financing in an amount more nearly commensurate to the amount States typically provide for traditional public schools; (6) expand opportunities for children with disabilities, English learners, and other traditionally underserved students to attend charter schools and meet the challenging State academic standards; (7) support efforts to strengthen the charter school authorizing process to improve performance management, including transparency, oversight and monitoring (including financial audits), and evaluation of such schools; and (8) support quality, accountability, and transparency in the operational performance of all authorized public chartering agencies, including State educational agencies, local educational agencies, and other authorizing entities. Specific to the CE program, grant funds are awarded to demonstrate innovative methods of helping charter schools to address the costs of acquiring, constructing, and renovating facilities by enhancing the availability of loans or bond financing and used by grantees to assist one or more charter schools to access private-sector capital to accomplish one or more of the following objectives: (1) The acquisition (by purchase, lease, donation, or otherwise) of an interest (including an interest held by a third party for the benefit of a charter schools) in improved or unimproved real property that is necessary to commence or continue the operation of a charter schools; (2) The construction of new facilities, or the renovation, repair, or alteration of existing facilities, necessary to commence or continue the operation of a charter school; (3) The predevelopment costs required to assess sites for purposes of paragraph (1) or (2) and that are necessary to commence or continue the operation of a charter school. The U.S. Department of Education (ED) is requesting authorization to collect data from CSP grantees within the CE program with new APR tool. The former APR data collection package for CE grantees was discontinued in March 2023. The CSP made revisions to the questionnaire aimed at reducing grantee burden (e.g., eliminating questions) and collecting more accurate and useful program data (e.g., identifying joint transactions with other CE grantees). To further these aims, CSP is planning to collect the APR data through a web-based system used to collect APR data from other CSP program grantees.

Key Information

Abstract

Section 13 of the Bank Holding Company Act of 1956 (BHC Act) and the Board’s implementing regulation, Regulation VV - Proprietary Trading and Certain Interests in and Relationships with Covered Funds (12 CFR Part 248), contain certain prohibitions and restrictions on the ability of a banking entity to engage in proprietary trading or to have certain interests in, or relationships with, a hedge fund or private equity fund (covered fund). Certain provisions of Regulation VV contain information collection requirements intended to facilitate the monitoring and enforcement of compliance with its requirements. For example, Regulation VV requires banking entities engaged in significant trading activities to collect, evaluate, and furnish data regarding covered trading activities as an indicator of areas meriting additional attention by the banking entity and the Board. In addition, section 248.20(d) of Regulation VV requires banking entities engaged in proprietary trading activity to comply with the reporting requirements described in Appendix A; the Board has implemented this requirement through the Regulation VV Quantitative Measurements (FR VV-1). The Board’s burden estimate for the FR VV includes all banking entities for which the Board is the primary financial regulatory agency, as well as any other banking entity controlled by a bank holding company or savings and loan holding company. Separately, the OCC and FDIC each have Paperwork Reduction Act clearances with respect to their respective rules implementing section 13 of the BHC Act. The burden estimates for the OCC’s and FDIC’s clearances include banking entities that they regulate, and that are not subsidiaries of holding companies.

30 CFR 56.19057 and 57.19057 require the annual examination and certification of hoist operators' fitness by a qualified, licensed physician. The information is used by mine operators and MSHA enforcement personnel to verify that persons operating hoisting equipment are physically able to safely perform their functions. . If MSHA cannot verify that hoist operators are capable of performing their assigned tasks, the individuals themselves, and those requiring hoisting into or out of a mine, may be at risk. Hoist operators provide a critical service to all personnel and equipment going into and out of some surface and underground mines, as well as emergency responders on an as-needed basis. Improper hoisting, caused by the inability of a hoist operator to function effectively due to a medical problem, can cause serious injury or death.

Abstract

Section 103(h) of the Mine Act, 30 U.S.C. 813, authorizes MSHA to collect information necessary to carry out its duty in protecting the safety and health of miners. It has long been known that inadequate maintenance of electric equipment is a major cause of serious electrical accidents in the coal mining industry. MSHA regulations require the mine operator to establish an electrical maintenance program by specifying minimum requirements for the examination, testing, and maintenance of electric equipment. The regulations also contain recordkeeping requirements that help operators in implementing an effective maintenance program. This ICR requires coal mine operators to frequently exam, test, and properly maintain all electrical equipment and high voltage longwall mining systems and to keep records of the examinations and tests.

Abstract

This request is for an extension of a current information collection. Collisions with vessels continue to be a source of serious injury and mortality for the endangered North Atlantic right whale and are a threat to the species’ recovery. On October 10, 2008, NMFS published a final rule (0648-AS36) implementing seasonal speed restrictions along the east coast of the U.S. to reduce the incidence and severity of vessel collisions with North Atlantic right whales (73 FR 60173). Abstract

Section 141 of Title 23 U.S.C. requires an annual certification from each State in order to qualify for the next year’s apportionment of Federal-aid funds for highway construction and maintenance. Less frequent collection is, therefore, not appropriate. The information which each State is required to submit to the FHWA includes a signed, certifying statement attesting to the actual resources applied during the prior fiscal year to enforcement operations aimed at assuring compliance with commercial vehicle size and weight provisions. The submission also identifies State vehicle size and weight laws and regulations that recently have been proposed or enacted, and includes a data report on numbers of enforcement actions taken and sanctions imposed. Beginning in the 4th Quarter of FY 2005, FHWA activated its on-line website, allowing electronic submissions, thereby eliminating the compilation and submission of a paper document. All States submit their certification statements electronically. The vehicle size and weight data may be collected electronically by the States at fixed platform scales, or manually at portable and semi-portable scales. Weigh-in-motion (WIM) screening equipment is also employed to screen at speed in the roadway. WIM identifies vehicles potentially operating above allowable weight limits and is typically employed in conjunction with permanent scale operations located immediately down the road from the WIM site. This information is collected by the Federal Highway Administration in their VSW software application.

The Medicare Advantage and Prescription Drug Program: Part C Explanation of Benefits and Supporting Regulations (CMS-10453) - IRA

Abstract

Section 11201 of the IRA makes significant changes to the Part D benefit design which require CMS to make corresponding revisions to the Part D EOB model. Beginning in 2024, the IRA revises section 1860D-2(b)(4)(A)(i)(II) of the Act to eliminate enrollee cost sharing after the enrollee has incurred costs equal to the annual out-of-pocket threshold specified in section 1860D-2(b)(4)(B)(i) of the Act. Beginning in 2025, the IRA eliminates the coverage gap benefit phase, sunsets the Coverage Gap Discount Program, and introduces new manufacturer discounts in the initial and catastrophic coverage phases. Medicare Advantage organizations (MAOs) and Medicare Prescription Drug Program (Part D) plan sponsors are required to provide their enrollees with a written explanation of benefits (EOB) when benefits are provided under the plan. Section 1860D-4(a)(4) of the Social Security Act, requires that Part D sponsors distribute to enrollees a notice of benefits used in relation to the Part D initial coverage limit and annual out-of-pocket threshold. CMS codified Part D EOB requirements at 42 CFR § 423.128(e). Section 1852(k)(2)(C)(i) of the Act requires MAOs that offer a private fee-for-service (PFFS) plan to provide enrollees with a written EOB, including a clear statement about the enrollee’s liability, when payment is sought under the plan. CMS regulations specifying that all MAOs provide an EOB when Part C benefits are used are codified at 42 CFR § 422.111(k). Information in this collection is needed to ensure that MA and Part D enrollees receive consistent and timely information about costs associated with their medical claims. Part C and Part D EOBs allow enrollees to track their out-of-pocket expenses and benefit utilization in relation to their plan’s deductible and out-of-pocket threshold.
