What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

The Federal Communication Commission (FCC) is revising this Information Collection to reflect the FCC’s September 22, 2017, adoption of the Third Report and Order in MB Docket No. 13-249, FCC 17-119, In the Matter of Revitalization of AM Radio Service (AMR Third R&O). In the 2015 AM revitalization proceeding, the FCC proposed streamlining certain technical requirements to assist AM broadcasters in providing radio service to consumers. For example, many AM stations must directionalize their signals during some or all of the broadcast day in order to avoid interference with other AM stations. Maintaining a directional signal pattern can be technically complex, time-consuming, and expensive. Such stations are subject to a variety of rules requiring signal strength measurements and other engineering analyses to ensure compliance with their authorizations. In the AMR Third R&O, the FCC eliminated, clarified, or eased several of the rules governing AM stations using directional antenna arrays, which comprise almost 40 percent of all AM stations. First, the FCC relaxed the rule for partial proofs of performance of certain directional AM antenna systems, by reducing the number of field strength measurements required. Second, the FCC modified several rules pertaining to AM stations that use Method of Moments (MoM) models of directional array performance. MoM modeling allows broadcasters to verify antenna system performance through computer modeling, as opposed to sending engineers in the field to take field strength measurements. Thus, a proof using a MoM model is less expensive than taking field strength measurements of an AM station’s directional pattern.

Abstract

On December 13, 2011, the FCC released a Report & Order ("R&O"), FCC 11-182, adopting rules to implement the Commercial Advertisement Loudness Mitigation ("CALM") Act. Among other things, the CALM Act directs the Commission to incorporate into its rules by reference and make mandatory a technical standard developed by an industry standard-setting body that is designed to prevent television commercial advertisements from being transmitted at louder volumes than the program material they accompany. Specifically, the CALM Act requires the Commission to incorporate by reference the Advanced Television Systems Committee ("ATSC") A/85 Recommended Practice ("ATSC A/85 RP") and make it mandatory "insofar as such recommended practice concerns the transmission of commercial advertisements by a television broadcast station, cable operator, or other multichannel video programming distributor." As mandated by the statute, the rules will apply to TV broadcasters, cable operators and other multichannel video programming distributors ("MVPDs").

The R&O adopted a number of revisions to the Commission’s rules to reorganize and clarify the Commission’s technical licensing, operating, and interference rules for full power and Class A television, including revisions to 47 CFR Section 73.1675 and 73.1690. The revisions to this information collection are only with respect to 47 C.F.R. 73.1675 and 47 C.F.R. 73.1690, and are made for informational purposes only, and do not create new or modify existing burdens. 47 C.F.R. 73.1675(c)(1) continues to state that where an FM, TV, or Class A TV licensee or permittee proposes to mount an auxiliary facility on an AM tower, it must also demonstrate compliance with § 1.30003 in the license application. The R&O revises paragraph (b) to note that the application for a construction permit is now made electronically via the Commission’s Licensing and Management System using Form 2100, but this change does not modify any existing paperwork burdens or establish any new ones. 47 C.F.R. 73.1690(c) continues to require FM, TV, or Class A TV station applicants to submit an exhibit demonstrating compliance with § 1.30003 or § 1.30002, as applicable, with a modification of license application, except for applications solely filed pursuant to paragraphs (c)(6) or (c)(9) of this section, where the installation is located on or near an AM tower, as defined in § 1.30002. The R&O adopted a number of revisions to the Commission’s rules to reorganize and clarify the Commission’s technical licensing, operating, and interference rules for full power and Class A television. 47 CFR 73.1750 requires that the licensee of each station provide a notification to the FCC in a Cancellation Application via the Commission’s Licensing and Management System (LMS) of the permanent discontinuance of operation at least two days before operation is discontinued. Immediately after discontinuance of operation, the licensee must forward the station license and other instruments of authorization to the FCC, Attention: Audio Division (radio) or Video Division (television), Media Bureau, for cancellation. 47 CFR 73.3549 requires that requests for extension of authority to operate without required monitors, transmission system indicating instruments, or encoders and decoders for monitoring and generating the EAS codes and Attention Signal should be made to the FCC by electronically filing via LMS. Such requests must contain information as to when and what steps were taken to repair or replace the defective equipment and a brief description of the alternative procedures being used while the equipment is out of service. 47 CFR 73.3550(a) requires that all requests for new or modified call sign assignments for radio and television broadcast stations be made via LMS with the FCC. Paragraph (j) provides that a change in call sign assignment will be made effective on the date specified in the Call Sign Request Authorization generated by LMS acknowledging the assignment of the requested new call sign and authorizing the change.

Abstract

The Research Infrastructure Improvement (RII) Programs Integrative (e.g., RII Track-1, RII Track-2, RII Track-4, E-CORE RII, and E-RISE RII) program provides multiyear (up to 5 years) support to Experimental Program to Stimulate Competitive Research (EPSCoR) awardees as continuing awards that are among the largest (up to $4 million a year) awarded by the National Science Foundation (NSF). Since the duration and size of these awards are extensive, it is necessary for the NSF to ensure that its substantial investment is spent appropriately, that each of the project meets the goals stated in its multi-year strategic plan, and that activities satisfy the goals and objectives of the EPSCoR program. The RII program currently funds 103 projects. To enable effective oversight of its investment, the NSF requires that each currently funded project submit an annual progress report that describes all activities of the project (research, integration of research and education, diversity, workforce development, external engagement, evaluation and assessment, management and sustainability).

NMFS Observer Programs' Information That Can Be Gathered Only Through Questions

Abstract

This request is for an extension and revision to an existing information collection (OMB Control No. 0648-0593): Observer Programs’ Information That Can Be Gathered Only through Questions. This collection will be revised as follows. First is the expansion of observers to include an additional fishery. The Southeast region will begin sending observers out on Southeast reef fish fishery trips and thus needs to add this fishery to this collection. Second, NOAA is combining the Southeast observer efforts into one program. The third change is the West Coast Groundfish Observer Program (WCGOP) would like to start collecting the names of crew members within their observer logbooks. The data will be recorded on paper, scanned in, and stored according to vessel name. This information will only be accessed if there is an enforcement issue. The final change is also within the West Coast Groundfish Observer Program. They have introduced a new phone app that captains are using to declare upcoming fishing trips and NMFS is using to let them know if they have been selected for observer coverage. Other observer programs are also working on converting to smart phone applications, but they have not yet been implemented. The National Oceanic and Atmospheric Administration (NOAA) National Marine Fisheries Service (NMFS) deploys fishery observers on United States (U.S.) fishing vessels and to fish processing plants in order to collect biological and economic data and to monitor industry regulatory compliance. Under an OMB approved information collection observers collect information from fishing vessel captains/crew or fish processing plant managers/staff prior to deployment. This information is used to assess whether the vessel or plan satisfies applicable safety requirements.

The R&O adopted a number of revisions to the Commission’s rules to reorganize and clarify the Commission’s technical licensing, operating, and interference rules for full power and Class A television, including a revision to 47 CFR Section 73.2080. No other changes to OMB Control Number 3060-0113, approved August 2021, and restated below, have been made, with the exception of an added description regarding the revision to Section 73.2080. That description is for illustrative purposes only, and also does not create any new or modified paperwork obligations. The Broadcast Equal Employment Opportunity (EEO) Program Report, FCC Form 2100, Schedule 396 is a device that is used to evaluate a licensee’s EEO program to ensure that satisfactory efforts are being made to comply with the FCC's EEO requirements. FCC Form 2100, Schedule 396 is required to be filed at the time of renewal of license by all AM, FM, TV, Class A and Low Power TV and International stations as well as Satellite Digital Audio Radio Service (SDARS) licensees. If a licensee owns more than one station in the same market that shares employees, it is required to file one Schedule 396 for those stations collectively as a “station employment unit” (SEU). SEUs with five or more full-time employees must complete the identification, certification and discrimination complaint portions of the form as well as attach its two most recent EEO Public File Reports—an annual report summarizing various recruitment activities of the licensee—and a narrative statement describing its employment outreach generally. If a SEU has four or fewer full time employees, it must file only the identification, certification and discrimination complaints portions of the form. Abstract

The Securities and Exchange Commission (“Commission”) has adopted a set of rules (“Regulation SE”) and forms under Section 3D of the Securities Exchange Act of 1934 (“SEA”) that creates a regime for the registration and regulation of security-based swap execution facilities (“SBSEFs”) and address other issues relating to security-based swap (“SBS”) execution generally. Key rules within Regulation SE include Rule 803, which establishes a process for SBSEF registration; Rules 804 to 810, which establish procedures for rule and product filings by SBSEFs; Rules 818 to 831, which implement the 14 Core Principles for SBSEFs set forth in Section 3D(d) of the SEA; Rules 832 to 833, which address cross-border matters relating to SBS execution; and Rule 834, which impose requirements addressing conflicts of interest involving SBSEFs and SBS exchanges, as required by Section 765 of the Dodd-Frank Act. In addition to the rules described above, the Commission is also adopting Form SBSEF, which is the form that an entity will use to register with the Commission as an SBSEF; adopting a submission cover sheet, which will be required to accompany filings with the Commission made by SBSEFs for rule and rule amendments and for product listings; adopting amendments to existing Rule 3a1-1 under the SEA to exempt from the SEA definition of “exchange” registered SBSEFs that provide a market place for no securities other than SBS and certain registered clearing agencies; adopting new Rule 15a-12 under the SEA that, while affirming that an SBSEF also would be a broker under the SEA, would exempt a registered SBSEF from certain broker requirements; providing for the sunsetting of an existing exemption from the requirement to register as a clearing agency for entities performing the functions of an SBSEF but that are not yet registered as such; and adopting new rules and amendments to the Commission’s Rules of Practice, to allow persons who are aggrieved by certain determinations by an SBSEF to apply for review by the Commission and to delegate certain regulatory tasks to various persons and offices within the Commission.

A modern, streamlined and responsive customer experience means: raising government-wide customer experience to the average of the private sector service industry; developing indicators for high-impact Federal programs to monitor progress towards excellent customer experience and mature digital services; and providing the structure (including increasing transparency) and resources to ensure customer experience is a focal point for agency leadership. Abstract

The Comprehensive Literacy State Development (CLSD) program is authorized under the Elementary and Secondary Education Act of 1965, as amended (ESEA), Sections 2222-2225. The CLSD program awards competitive grants to advance literacy skills—using evidence-based practices, activities, and interventions, including preliteracy skills, reading, and writing—for children from birth through grade 12, with an emphasis on disadvantaged children, including children living in poverty, English learners, and children with disabilities. Eligible entities include the state education agencies (SEAs) of the 50 states, the District of Columbia, and Puerto Rico. Additionally, directed awards are made to four (4) Outlying Areas: American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the U.S. Virgin Islands. A portion of funds is also awarded directly to the Bureau of Indian Education. CLSD requires that at least 95% of funds awarded to SEAs be distributed to local education agencies through a subgrant award process. However, the current OMB-approved ED generic grant performance report does not include fields to capture program (subgrantee) demographic data or performance measures to ensure grantees are meeting statutory and regulatory requirements and making progress toward meeting the goals and objectives of their approved projects. The proposed performance report metrics reflect the need to collect pertinent grantee- and subgrantee-level data that could be used to guide future program policy and practice and respond to stakeholder, congressional, and agency inquiries. Thus, the CLSD program staff would better understand whom they serve, programmatic needs, strategies to meet those needs, and how collecting program-level data would benefit the students and support their learning. The new CLSD performance report metrics would (a) collect programmatic data that demonstrate aggregate program-level impact; (b) provide subgrantees’ aggregated data, such as the number of students and professionals served, how funds have been used (e.g., professional learning, curricular materials), and staffing; and (c) provide the CLSD program staff the data to report the performance and outcomes of the CLSD program, at both the grantee and the subgrantee levels. These new measures also would help to add specificity to ED’s monitoring efforts.

Accurate and clear information is crucial to a well functioning market. Today, broadband consumers in the United States have little information about the actual speed and performance of the broadband services available to them. The FCC has contracted with a third party measurement company to measure the speeds and performance of a representative, cost effective, statistically relevant sample of US fixed broadband household and Internet Service Providers (ISP) across geographies, technologies and providers. The third party measurement contractor deploys testing devices to begin measurement, and these results are then be used to inform measurement standards for performance of broadband services in support of the FCC led National Broadband Plan. In 2013 the program has expanded to include consumer mobile broadband performance information using a crowd sourcing Android application that will reach a significantly greater number of subscribers and provide data on mobile broadband that is increasingly important to U.S. consumers.
