Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

The Department of Education is requesting an extension without change of the current information collection 1845-0162, Reporting Additional Direct Assessment Programs. 34 CFR 600.21 requires an institution to only report the addition of a second or subsequent direct assessment program without the review and approval of the Department when it previously been awarded such approval. The regulations also require an institution to report the establishment of a written arrangement between the eligible institution and an ineligible institution or organization in which the ineligible institution or organization would provide more than 25 percent of a program. This information will be provided to the Secretary to ensure that the institutions are properly reporting subsequent direct assessment programs at the same degree level after it has had its first direct assessment program reviewed and shown the ability to create a program that has been approved by the Secretary. The reporting time is 10 days after the first day that the program is offered. The reporting requirement for subsequent programs allows the Department to monitor the growth and development of direct assessment programs.

Abstract

The final rule at Docket No. RM22-8-000 revises the information requirements applicable to prospective applicants and applicants who seek authorization under section 3 of the Natural Gas Act to site, construct, expand, or operate an LNG terminal. The revisions are intended to update the Commission’s regulations regarding engineering and design materials related to natural hazards and reduce confusion related to the preparation and filing of applications. In the Notice of Proposed Rule (NOPR) in Docket No. RM22-8-000, FERC-539A and FERC-577A were temporary placeholder designations for FERC-539 and FERC-577, respectively. The temporary placeholder designations were necessary because only one request is allowed at a time for any information collection, and requests were pending at OMB for both FERC-539 and FERC-577. As part of its review of the information collections associated with the NOPR in Docket No. RM22-9-000, OMB issued “comment and continue” types of decision for FERC-539A. OMB also assigned new control numbers (i.e., 1902-0326 and 1902-0327) for FERC-539A and FERC-577A, respectively. The previously pending requests for FERC-539 and FERC-577 have been approved and this information collection request seeks revision of those collections in connection with the Final Rule in Docket No. RM22-8. Key Information

Abstract

FERC-577 identifies information collection activities relating to Parts 2, 157, 284, and 380 of the Commission's regulations implementing the National Environmental Policy Act (NEPA) and information collections relating to landowner notifications. The Final Rule in Docket No. RM22-8-000 updates the language in 18 CFR 380.12(o)(15) with new regulatory text that requires applicants to provide the engineering and design information that they have typically provided in accordance with the Commission’s “Guidance Manual for Environmental Report Preparation for Applications Filed Under the Natural Gas Act,” which was issued in February of 2017. This new regulatory language thus codifies practices traceable to the 2017 Guidance Manual. State and EIS Record Keeping and Reporting Requirements under Part C

Key Information

Abstract

The Office of Special Education and Rehabilitative Services needs to extend its Office of Management and Budget (OMB) Information Collection (IC): 1820-0682 State and Early Intervention Services (EIS) Record Keeping under Part C which is set to expire on 11/30/2023. These record-keeping requirements are not new and do not require reporting to the Secretary. The record keeping requirements outlined in this IC were created to reflect the requirements in Part C of the Individuals with Disabilities Education Act (IDEA) in 20 U.S.C. 1431-1443 and the final Part C regulations. These regulations require the 56 State lead agencies (LAs) that receive IDEA Part C funds to collect and maintain information or data and, in some cases, report information or data to other public agencies or to the public. Key Information

Abstract

FCC 605 is a multi-part, consolidated, general application form that is part of the Universal Licensing System (ULS). Form 605 includes a main form containing administrative information and a series of Schedules used to file technical information applicable to a specific radio service. The form is used to file for authorization to operate radio stations, amend pending applications, modify existing licenses, renew or renew/modify existing licenses, request cancellation of a license, withdraw a pending application, request a duplicate license, or request an administrative update of an existing license (i.e., name change without change to corporate structure or control, change mailing address, change name of vessel, etc.) in the Ship (Part 80), Aircraft (Part 87), Amateur (including Amateur Vanity (Part 97)), Restricted and Commercial (Part 13), and General Mobile Radio Services (GMRS) (Part 95). This form is also used to apply for a Developmental License or a Special Temporary Authority (STA) in these services and to self-certify for temporary authorization to operate where applicable. Respondents are encouraged to submit FCC 605 electronically. The Commission is requesting OMB approval for a minor revision to the reporting, recordkeeping and/or third-party disclosure requirements. The Commission is removing Certification #3 for the General Mobile Radio Service, as well as minor clarifications to the General Filing Instructions. Additionally, FCC Report and Order Amendment of the Schedule of Application Fees Set Forth in Sections 1.1102 through 1.1109 of the Commission’s Rules, Report and Order, FCC 20-184 (rel. Dec. 29, 2020), streamlined the Commission’s application fees associated to the FCC Form 605 and all applicants are now charged a $35 fee. Previously Amateur Radio applicants were non-feeable and the previous 29% that were paying a $71 fee are now reduced to a $35 fee. Abstract

Section 1848(q) of the Social Security Act, as amended by section 101 of the Medicare Access and CHIP Reauthorization Act of 2015, authorizes the establishment of a Merit-based Incentive Payment System (MIPS) for eligible clinicians. Beginning in CY 2017, eligible clinicians are required to collect and submit data on four performance categories to CMS (quality, cost, advancing care information and improvement activities). This program replaces and consolidates portions of the PQRS, Value-based Modifier, and the Medicare EHR Incentive Program. The Act also establishes a second track, Advanced Alternative Payment Models (APMs) for clinicians to participate in instead of MIPS.

45 CFR 303.7 - Provision of Services in Intergovernmental IV-D; Federally Approved Forms

Key Information

Abstract

The federally-approved intergovernmental forms are used to facilitate interstate child support case processing when more than one state child support agency is involved, estimated to be in about 15-25% of child support cases. Use of these federal forms is required by 45 CFR 303.7(a)(4) and Section 311(b) of the Uniform Interstate Family Support Act (state law that states must adopt as a condition of receiving federal funding for child support). This information collection was first approved in 1988 and has evolved over time. The current set of forms will expire in February 2026. Currently, there are 13 intergovernmental forms each addressing different case processing actions that may be needed in a case. Some of the forms are for agency use only, while some may be completed by private individuals or entities involved in the case. For a list of the forms, see the OCSS website: Intergovernmental Child Support Enforcement Forms | The Administration for Children and Families (hhs.gov). Many families receiving child support services may be English-language learners for whom forms in English are a barrier to receiving effective services. Over the years, states have asked OCSS for translated versions of the forms, especially to serve the large numbers of Spanish-speaking families in many states. According to 2019 Census data, as many as 41 million people speak Spanish in their homes in the U.S. Better serving these families with translated forms aligns with Secretary Becerra’s commitment to improve and provide language access services to English-language learners (i.e., individuals with Limited English Proficiency) under Executive Orders 13166, 13985, and 14031.

Abstract

The ACF Office of Refugee Resettlement (ORR) places unaccompanied children in their custody in care provider programs until unification with a qualified sponsor. Care provider programs are required to ensure children receive appropriate medical, mental health and dental services. Children identified as having complex medical/dental conditions may require a procedure while in ORR custody to maintain and promote their health and wellbeing. Procedures requiring general anesthesia, surgeries, and invasive diagnostic procedures (e.g., cardiac catheterization, invasive biopsy, amniocentesis) require advance ORR approval. Before ORR can approve, the following data must be collected and submitted to ORR by the care provider program and the lead surgeon - diagnoses, procedure name(s), current procedural terminology (CPT) code(s), clinical indications, potential risks/complications of procedure, timing for procedure/proposed date, potential adverse outcomes if the procedure is not performed, timeframe for recovery, potential follow-up procedures, follow-up care, and points of contact. In certain circumstances, ORR will waive the completion of the SMR form if it is deemed to be in the best interest of the child’s safety and well-being (e.g., during a hospitalization or emergency department visit, medical emergencies).

Abstract

The information collection under OMB control number 2132-0529 Metropolitan and Statewide and Nonmetropolitan Transportation Planning is requesting a 3-year extension without change of a currently approved information collection. This is a mandatory collection that authorizes the use of federal funds to assist Metropolitan Planning Organizations (MPOs), States, and local public bodies in developing transportation plans and programs to serve the transportation needs of urbanized areas over 50,000 in population and other areas of States outside of urbanized areas. The information collection activities involved is the development of transportation plans. There is a different level of effort in the development of the plans, depending on the size of the agency, transportation issues and the population served. This supporting statement clearly shows the level of effort involved. The types of plans developed varies but could include; the Unified Planning Work Program (UPWP), the Metropolitan Transportation Plan, the Long-Range Statewide Transportation Plan, the Transportation Improvement Program (TIP), and the Statewide Transportation Improvement Program (STIP). It is necessary to identify and evaluate the transportation issues and needs in each urbanized area and throughout every State. These products of the transportation planning process are essential elements in the reasonable planning and programming of federally funded transportation investments. The entities that respond to this collection are State Departments of Transportation and MPOs. This information is submitted on an annual basis are used by FTA and FHWA on a national scale to establish national out year budgets and regional program plans, develop policy on using funds, monitor State and local consistency with national planning and technical emphasis areas, respond to Congressional inquiries, prepare congressional testimony, and ensure efficiency in the use and expenditure of federal funds by determining that planning proposals are reasonable, cost-effective, and supportive of full compliance with all applicable federal law and regulations. There have been no programmatic changes to this program since approval in 2020. However, this request is associated with an increase in the respondent universe from 456 in 2020 to 502 with the current proposed IC due to the 2020 census. As a result, there is a corresponding increase in burden hours from 4,198,379 hours to 5,869,921. In addition, there is a change in the cost to the respondents and the cost to the federal government. Both areas have been updated to reflect the current Department of Labor wage category and the 2022 OPM Federal salary table.

Abstract

The information collection under OMB control number 2132-0544 “Pre-Award, Post-Delivery Audit Requirements Under Buy America” currently does not require any revisions. As a result, the Federal Transit Administration (FTA) is requesting a 3-year extension without change for OMB approval. This is a mandatory collection that is designed to ensure that any vehicle purchased with Federal Transit Administration funds has at least a 60 percent domestic content and undergoes final assembly in the United States. It prevents FTA from obligating any funding that may be appropriated to carry out its program for a project unless “the steel, iron, and manufactured goods used in the project are produced in the United States. The information being reported is a certification document. A transit grantee must include in its bid or request for proposal (RFP) specification for procurement of steel, iron or manufactured goods an appropriate notice of the Buy America provision and require, as a condition of responsiveness, that the bidder or offer or submit with the bid or offer a completed Buy America certificate. Under limited circumstances, FTA may waive Buy America requirements. The entities that respond to this collection are transit agencies procuring rolling stock from transit bus and transit railcar manufacturers. This information is submitted as needed, triggered whenever a transit agencies procures rolling stock. Transit agencies maintain the certification on site and only need to produce the document upon request by FTA. There is no change to the number of respondents or responses. The only change associated with this submission is a change in the cost to the respondents and the cost to the federal government. Both areas have been updated to reflect the current Department of Labor wage category and the 2023 OPM Federal salary table.

FINAL RULE - EMERGENCY PREPAREDNESS FOR SMALL MODULAR REACTORS AND OTHER NEW TECHNOLOGY The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations to include new alternative emergency preparedness (EP) requirements for small modular reactors (SMR) and other new technologies (ONT). This final rule acknowledges technological advancements and other differences from large light-water reactors that are inherent in small modular reactors and other new technologies. The information collections create a transparent alternative EP regulatory framework that allows SMR and ONT applicants and licensees to submit for NRC approval a performance-based EP program, to include a scalable plume exposure pathway EPZ and licensee-defined performance objectives and metrics, while continuing to provide reasonable assurance that adequate protective measures can and will be implemented in a radiological emergency. Applicants or licensees requesting approval to construct or operate utilization or production facilities are required by the Atomic Energy Act of 1954, as amended, to provide information and data that the NRC may determine necessary to ensure the adequate protection of health and safety of the public. The submission of emergency plans to the NRC is required in order to allow the NRC to determine that the emergency plans and EP programs provide reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency. Information is used by the NRC to evaluate the adequacy of the alternative EP program for approval, assess ongoing adequacy once implemented, determine whether to take actions, such as to conduct inspections or to alert other licensees to prevent similar events that may have generic implications, and to update information in the NRC Emergency Operation Center used in support of an NRC response to an actual emergency, drill, or exercise. Responses to these collections of information are required for applicants and licensees choosing to comply with 10 CFR 50.160. Confidential and proprietary information submitted to the NRC is protected in accordance with NRC regulations at 10 CFR 9.17(a) and 10 CFR 2.390(b).

Truck and Bus Maintenance Requirements and Their Impact on Safety

Abstract

The purpose of this research effort is to improve FMCSA’s understanding of the safety impact of preventative vehicle maintenance and to - Develop an operational definition of “systematic maintenance;” - Evaluate whether current regulations are sufficient to address: (i) preventative maintenance intervals, (ii) preventative maintenance inspections with adequately trained/equipped mechanics, and (iii) motor carriers’ maintenance facilities; and - Gather information to assist in establishing minimum standards for inspection intervals, mechanic qualifications and training, and certification of maintenance facilities. Under contract to FMCSA, the Virginia Tech Transportation Institute (VTTI) at the Virginia Polytechnic Institute and State University (VT) will obtain the data required to address the study objectives. In accordance with USDOT policy on research involving human subjects, this study will be submitted to VTTI’s Institutional Review Board (IRB) for review and approval prior to beginning data collection. This information collection will be administered exclusively online, using a two-phase survey process. Links to both surveys will be emailed directly to potential respondents. Carriers asked to participate in the Carrier Maintenance Management Survey (Phase II) will receive, via email, an informed consent form (ICF). The ICF, which contains no questions and does not require a signature, will outline the study objectives and methods, any possible risks, compensation, and participant rights. The Phase I survey will ask carriers to provide name and contact information (email and phone number); name of carrier and USDOT number; current position/job title at carrier; length of time carrier has been in operation; size of carrier; types of vehicles operated (e.g., bus, truck, tractor-truck, or tractor-trailer); and involvement in the past 24 months with a Federal or State intervention due to vehicle maintenance violations. Phase II includes questions about demographics; maintenance practices, intervals, personnel, and facilities; and State and Federal inspections, etc. This one-time survey is voluntary for truck carriers and bus carriers to report information online.
