What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

FINAL RULE - EMERGENCY PREPAREDNESS FOR SMALL MODULAR REACTORS AND OTHER NEW TECHNOLOGY The U.S. Nuclear Regulatory Commission (NRC) is amending its regulations to include new alternative emergency preparedness (EP) requirements for small modular reactors (SMR) and other new technologies (ONT). This final rule acknowledges technological advancements and other differences from large light-water reactors that are inherent in small modular reactors and other new technologies. The information collections create a transparent alternative EP regulatory framework that allows SMR and ONT applicants and licensees to submit for NRC approval a performance-based EP program, to include a scalable plume exposure pathway EPZ and licensee-defined performance objectives and metrics, while continuing to provide reasonable assurance that adequate protective measures can and will be implemented in a radiological emergency. Applicants or licensees requesting approval to construct or operate utilization or production facilities are required by the Atomic Energy Act of 1954, as amended, to provide information and data that the NRC may determine necessary to ensure the adequate protection of health and safety of the public. The submission of emergency plans to the NRC is required in order to allow the NRC to determine that the emergency plans and EP programs provide reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency. Information is used by the NRC to evaluate the adequacy of the alternative EP program for approval, assess ongoing adequacy once implemented, determine whether to take actions, such as to conduct inspections or to alert other licensees to prevent similar events that may have generic implications, and to update information in the NRC Emergency Operation Center used in support of an NRC response to an actual emergency, drill, or exercise. Responses to these collections of information are required for applicants and licensees choosing to comply with 10 CFR 50.160. Confidential and proprietary information submitted to the NRC is protected in accordance with NRC regulations at 10 CFR 9.17(a) and 10 CFR 2.390(b).

Abstract

The Department of Homeland Security (DHS) is working with its interagency partners to allow certain noncitizens from Venezuela and their qualifying immediate family members who lack United States entry documents to submit information through the newly developed CBP Advance Travel Authorization (ATA) capability within the CBP One™ application as part of the process to request an advance authorization to travel to the United States to seek a discretionary grant of parole. Implementation of ATA will require the collection of a facial photograph via CBP One™ from those eligible noncitizens who voluntarily elect to participate in the process. Participation will be limited to those individuals who meet certain DHS established criteria, including possession of a valid, unexpired passport, as well as having an approved U.S.-based supporter.Emergency Justfication:DHS is requesting an emergency information collection revision under 5 CFR 1320.13, with the intention of carrying out all the regular requirements for publication and review after implementation. These processes and the related information collection changes are urgently needed to make available additional lawful pathways as an alternative to irregular migration to help relieve pressure at the Southwest Border (SWB) by providing a mechanism for which to make case-by-case decisions on granting parole based on urgent humanitarian needs or significant public benefit. This approach is consistent with the U.S. national interest and its foreign policy priorities. DHS requests an emergency approval to expand the existing ATA data collection to allow CBP to collect certain biographic and biometric information from individuals from Ecuador to request an advance authorization to travel to the United States to seek a discretionary grant of parole under the FRP process. DHS will soon be publishing an accompanying Federal Register notice to announce and establish the FRP process for nationals of Ecuador to support this effort. The agency cannot reasonably comply with the normal clearance procedures under the PRA because delayed implementation may further raise pressure on U.S. border operations and the migration management conducted by our foreign partners, and could jeopardize our relations with foreign partners. The FRP processes represent one part of the United States’ ongoing efforts to engage hemispheric partners to increase their efforts to collaboratively manage irregular migration. The expansion of lawful pathways for noncitizens to enter the United States is necessary to ensure partners’ continued collaboration on migration issues, including the ability of the United States to meet other immigration-management priorities. After implementation of the revised collection to expand the respondent group, CBP will undergo the normal PRA revision process, beginning with a 60-day notice for public comment as described at 5 CFR 1320.10, within 45 days of approval. After publication of the Federal Register notice required under the PRA, DHS will address comments and concerns as necessary and submit the information collection to OMB for three-year approval within the required timeframe.

The Commission has taken the actions discussed below to immediately stem increasing instances of interference to 800 MHz public safety communications systems as well as address the underlying cause of 800 MHz interference. The PRA burden involves the exchange of information to avoid interference and to resolve interference complaints. The PRA burden also involves the exchange of information to facilitate incumbent relocation. This information exchange is necessary to effectuate band reconfiguration, i.e. to spectrally separate incompatible technologies, which is the underlying cause of interference to public safety. Overall the PRA burden is necessary to enable the Commission to determine the parties are acting in good faith in resolving the 800 MHz public safety interference problem and to keep the 800 MHz transition moving efficiently.

Abstract

The U.S. Access Board is statutorily charged with enforcing the Architectural Barriers Act (ABA), which is aimed at ensuring that federal and federally-funded (non-government) buildings and facilities (such as schools, public housing, and public transit facilities) are accessible to individuals with disabilities. Any individual who is are concerned about the accessibility of an ABA-covered building or facility may file a complaint with the Access Board. The agency investigates each ABA complaint and, if violations are found, works with the agency to remedy the accessibility barriers. ABA complaints can be filed any one of several ways, but, the Online ABA Complaint Form is - by far - the most popular mode. The online form is user-friendly and promotes greater efficiency, clarity, and timeliness in the filing of ABA complaints. The online form contains fields that prompt users to provide the information needed by the agency to evaluate ABA jurisdiction and conduct investigations, such as the building’s name or address and brief description of accessibility barriers encountered. Complainants may optionally upload digital photos or other materials to support their complaints. The online form does not require entry of personal information for complaint submission; ABA complaints may be submitted anonymously. However, individuals who wish to be kept informed of the status or resolution of their complaint must, at minimum, provide some type of contact information (i.e., email address, phone number, mailing address). Abstract

Section 403 of the John S. McCain III, Daniel K. Akaka, and Samuel R. Johnson VA Maintaining Internal Systems and Strengthening Integrated Outside Networks (MISSION) Act of 2018 (Public Law 115-182) mandated that VA create a pilot program to establish additional graduate medical education (GME) physician residency placement positions at certain covered facilities. The pilot program will place no fewer than 100 resident physicians at covered facilities (sites) operated by Indian tribe or tribal organization (25 USC 5304), Indian Health Service, Federally-Qualified Health Centers (42 USC 1396d(1)(2)(B)) and Department of Defense. Participants in this pilot program are required by the statute to collect and provide VA with programmatic data. VA is required to include this information in an annual report to Congress until the program terminates on August 7, 2031. The information will be collected by the GME sponsoring institutions and the physician residents they place in the participating covered facilities. The sponsors themselves will determine the best method for collection of the necessary data depending on their own resources and staffing. The information to be collected will include required elements, such as number of patients seen per day by each resident placed in a covered facility, for the annual report on implementation of the pilot program submitted by VA to Congress.

Part 119 certificate holders with the authority to operate under part 121 and 135, air tour operators as defined in 14 CFR § 91.147, non-FAA or Military Air Traffic Control Facilities, contractors or repair stations under 14 CFR part 145 that conduct drug and alcohol testing programs are mandated to report information to this collection. The FAA uses this information for determining program compliance or non-compliance of regulated aviation employers, oversight planning, determining who must provide a mandatory annual Management Information System (MIS) testing information, and communicating with entities subject to the program regulations. In addition, the information is used to ensure that appropriate action is taken in regard to crewmembers and other safety-sensitive employees who have tested positive for drugs or alcohol or have refused to submit to testing. The collection includes reporting, recordkeeping, and disclosure information. Using the information reported on the annual MIS allows the FAA Administrator to determine the random testing rates for the following year, which is published in the Federal Register.

Abstract

This clearance covers the information that offerors must submit to comply with the following FAR requirements: Standard Form (SF) 330, Architect-Engineer Qualifications. As specified in FAR 36.702(b), an architect-engineer firm must provide information about its qualifications for a specific contract when the contract amount is expected to exceed the simplified acquisition threshold (SAT). Part I—Contract-Specific Qualifications. The information on the form is reviewed by a selection panel composed of professionals and assists the panel in selecting the most qualified architect-engineer firm to perform the specific project. The form is designed to provide a uniform method for architect-engineer firms to submit information on experience, personnel, and capabilities of the architect-engineer firm to perform along with information on the consultants they expect to collaborate with on the specific project. Part I of the SF 330 may be used when the contract amount is expected to be at or below the SAT, if the contracting officer determines that its use is appropriate. Part II—General Qualifications. The information obtained on this form is used to determine if a firm should be solicited for architect-engineer projects. Architect-engineer firms are encouraged to update the form annually. Part II of the SF 330 is used to obtain information from an architect-engineer firm about its general professional qualifications. The SF 330 accomplishes the following: ● Expands essential information about qualifications and experience data including: ✔ An organizational chart of all participating firms and key personnel. ✔ For all key personnel, a description of their experience in 5 relevant projects. ✔ A description of each example project performed by the project team (or some elements of the project team) and its relevance to the agency’s proposed contract. ✔ A matrix of key personnel who participated in the example projects. This matrix graphically illustrates the degree to which the proposed key personnel have worked together before on similar projects. ● Reflects current architect-engineer disciplines, experience types and technology. ● Permits limited submission length thereby reducing costs for both the architect-engineer industry and the Government. Lengthy submissions do not necessarily lead to a better decision on the best-qualified firm. The proposed SF 330 indicates that agencies may limit the length of a firm's submissions, either certain sections or the entire package. The Government’s right to impose such limitations was established in case law (Coffman Specialties, Inc., B-284546. N-284546/2, 2000 U.S.Comp.Gen. LEXIS 58, May 10, 2000).

The collection of information requires railroads to clearly mark defective toilet facilities as unavailable for use when these locomotive units are placed in a trailing position or in switching, transfer train service. This information is used by locomotive crewmembers as a warning to avoid using a locomotive toilet facility which is defective, unsanitary, or both. Additionally, the information collection is used by FRA to promote rail safety and the health of railroad workers by ensuring that all locomotive crew members have access to adequate sanitary facilities.

This information request is mandatory for offerors and carriers of certain hazardous materials to develop and implement a security plan. This collection is a reporting and recordkeeping requirement, which must be evaluated on an annual basis, as long as the hazardous materials subject to security plan requirements are still offered and/or carried. Security plans are required to be maintained at the principal place of business and must be made available, at a reasonable time and location, to an authorized official of the Department of Transportation or Department of Homeland Security. This information collection requires the evaluation of transportation security risks, including site-specific or location-specific risks associated with facilities at which the hazardous materials are prepared for transportation, stored, or unloaded incidental to movement. In addition, rail carriers of certain hazardous materials, are subject to additional security plan requirements, including the selection of the most practicable route posing the least overall safety and security risk. Security plans reduce the possibility that a hazardous material shipment will be used as a weapon of opportunity by terrorists. The requested change stems from a final rule published on September 1, 2023, titled “Hazardous Materials: Suspension of HMR Amendments Authorizing Transportation of Liquefied Natural Gas by Rail” [HM-264A; 09/01/2023] which prohibits Liquified Natural Gas (LNG) transportation in rail tank cars until issuance of a final rule concluding the rulemaking proceeding under RIN 2137-AF54, or June 30, 2024, whichever is earlier.

Abstract

Section 709(c) of Title VII of the Civil Rights Act of 1964 (Title VII) requires employers to make and keep records relevant to the determination of whether unlawful employment practices have been or are being committed, to preserve such records, and to produce reports as the Commission prescribes by regulation or order. Pursuant to this statutory authority, the EEOC in 1966 issued a regulation requiring certain employers to file executed copies of the EEO–1 in conformity with the directions and instructions on the form, which called for reporting employee data by job category and by sex and race or ethnicity. Pursuant to Executive Order 11246, the Office of Federal Contract Compliance Programs (OFCCP), U.S. Department of Labor, in 1978 issued its regulation describing the EEO–1 as a report ‘‘promulgated jointly with the Equal Employment Opportunity Commission’’ and requiring certain contractors to submit ‘‘complete and accurate reports’’ annually. Under these authorities, private employers with 100 or more employees and federal contractors that have 50 or more employees and meet certain criteria are required to report annually the number of individuals they employ by job category and by sex and race or ethnicity.

Abstract

In 2018, HHS designated the Centers for Disease Control and Prevention (CDC) as the National Authority for Containment of Poliovirus (U.S. NAC) for the United States. The U.S. NAC is located in the Center for Preparedness and Response (CPR). The role of the U.S. NAC is to ensure that the requirements established in the World Health Organization (WHO) Global Action Plan (GAP) III and IV standards are effectively implemented and maintained in poliovirus- essential facilities. Part of this standard includes emergency planning, the implementation of surveillance following an incident, and the reporting of facility-associated poliovirus events to the U.S. NAC. Risk assessments following an incident are a critical component for adequate application of the GAPIII/GAPIV standard and efficient emergency response. The goal of the project is to collect data in the event of a poliovirus breach of containment - as well as to understand the biosafety practices of facilities working on poliovirus and mitigations strategies in place to reduce risks. These goals are in line with World Health Organization's Global Action Plan (GAP) for Poliovirus containment efforts. This information will assist with meeting the goals of the Section 361 of the Public Health Service (PHS) Act (42 U.S.C. 264) and prevents the introduction, transmission, or spread of communicable diseases from foreign countries into the States or possessions, or from one State or possession into any other State or possession.

CBP Form 1300 is submitted upon the arrival of a vessel into the U.S. CBP needs this information to record tonnage fees and to obligate the vessel captain to the truth of the manifest. CBP Form 1300, Vessel Entrance or Clearance Statement, was developed through agreement by the United Nations Intergovernmental Maritime Organization (IMO) in conjunction with the United States and various other countries. The form was developed as a single form to replace the numerous other forms used by various countries for the entrance and clearance of vessels.
