Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

The Children’s Bureau (CB) in the Administration on Children, Youth and Families (ACYF), Administration for Children and Families (ACF), U.S. Department of Health and Human Services (HHS) is partnering with the Centers for Disease Control and Prevention to support child welfare agency staff in the identification and support of children in the child welfare system living with prenatal substance exposure (PSE), including prenatal alcohol exposure (PAE). To this end, we are developing a toolkit of resources that child welfare agencies can use to: • Increase awareness, understanding, and knowledge of PAE/PSE; and • Plan and implement internal and cross-system processes, in partnership with key stakeholders, that help identify, assess/evaluate/screen, share information about, and provide care and support to children with prenatal exposure and their families. The CB is undertaking a multi-stage evaluation designed to understand the extent to which the toolkit is achieving these intended outcomes. The following activities will contribute to the evaluation: (1) usability testing and (2) a formative evaluation. The second stage of the evaluation builds on the first stage. Usability testing of the toolkit was conducted November 2022-March 2023 (under Formative Generic for Program Support OMB #0970-0531, exp 9/30/25) to gather feedback from child welfare staff in the field to determine the usability of toolkit modules before the toolkit is finalized. Based upon usability testing findings, an equity review was conducted and the toolkit has undergone modifications based upon the findings. Data collection for the formative evaluation was approved in April 2023 (OMB# 0970-0608, exp 4/30/26).

Advanced Capital Adequacy Framework Regulatory Reporting Requirements - FFIEC 101

Key Information

Abstract

These quarterly reporting requirements were established by the Federal Financial Institutions Examination Council (FFIEC) for banks that quality for and adopt the Advanced Capital Adequacy Framework or are in the parallel run state of qualifying for the framework. The information is collected using the form “FFIEC 101.” The FFIEC 101 contains nineteen schedules, A through S, for banks to submit detailed data on the components of their capital and risk-weighted assets. The FDIC uses the information collected through these reporting requirements in the following ways: • To assess and monitor the levels and components of each reporting bank’s regulatory capital requirements and the adequacy of the bank’s capital under the Advanced Capital Adequacy Framework and the supplementary leverage ratio, as applicable; • To evaluate the impact and competitive implications of the Advanced Capital Adequacy Framework and the supplementary leverage ratio, as applicable, on individual reporting banks and on an industry-wide basis; and • To supplement on-site examination processes at individual reporting banks. The reporting schedules also assist banks in understanding expectations around the system development necessary for implementation and validation of the Advanced Capital Adequacy Framework and the supplementary leverage ratio, as applicable. Submitted FFIEC 101 report data that are released publicly on an individual institution basis also provide other interested parties with information about advanced approaches institutions’ and Category III institutions’ regulatory capital. By incorporating the complete international leverage ratio common disclosure template into SLR Tables 1 and 2 of FFIEC 101 Schedule A, the agencies also ensure transparency and comparability of reporting of regulatory capital elements among internationally active banks.

Key Information

Abstract

On July 20, 2023, the Commission adopted Amendment of Parts 73 and 74 of the Commission’s Rules to Establish Rules for Digital Low Power Television and Television Translator Stations, Fifth Report and Order, FCC 23-58 (rel. July 20, 2023) (FM6 Report and Order). The Commission adopted a new requirement that FM6 LPTV stations certify in their license renewal application that they have continued to provide FM6 operations in accordance with the FM6 rules during their prior license term. The Commission delegated authority to the Media Bureau to determine the most appropriate means for these stations to make such certification, be it by an attachment to the renewal application or some other reasonable means. This requirement is contained in 47 CFR 74.790(o)(10). This submission was made to the Office of Management and Budget (OMB) for approval of the renewal certification requirement for FM6 LPTV stations as adopted in the FM6 Report and Order. Since the certification will be included as an additional exhibit to the existing form, it did not necessitate changes to LMS Form 2100 Schedule 303-S.

Because there has been no established guidelines or instructions on how to submit allegations of misconduct to CDRH, such allegations often contain minimal information and are received via phone calls, emails, or conversationally from any CDRH staff. CDRH seeks to establish a consistent format and process for the submission of allegations of regulatory misconduct that will enhance our timeliness in receiving, assessing and evaluating this voluntary information. The information provided in the allegations received by CDRH may be used to clarify the recurrence or emergence of significant device-related risks to the general public and the need to initiate educational outreach or regulatory action to minimize or mitigate identified risks.

Non-Substantive Change Request: The Agency is making modifications to EPA Form number 8570-1“Application for Pesticide Registration/Amendment” for pesticide registration to include optional fields for the application and award of the Agency’s new Vector Expedited Review Voucher (VERV) program established under the Pesticide Registration and Improvement Act (PRIA) enacted in December 2022. EPA must establish the VERV program to incentivize expedited review of new insecticides to control the spread of vector-borne disease by December 29, 2023. EPA developed the attached modified form 8570-1 in compliance with PRIA 5. Base Collection Abstract: This new ICR consolidates the collection activities and related burdens currently contained in eight ICRs that are approved by OMB under the PRA. The OMB Terms of Clearance for several of the existing ICRs directed EPA to consolidate these ICRs to simplify the burden presentation and calculations for the public due to the shared or anticipated collection method involving submissions via the Pesticide Submission Portal in EPA’s Central Data Exchange (CDX). This consolidation is expected to clarify the capabilities of the Pesticide Submission Portal for respondents and will streamline the activities related to tracking the ICR renewal activities for both the public and EPA. Abstract

The collection of information associated with CFR parts 217 and 218, Railroad Operating Rules and Practices, requires railroads to file with FRA copies of their operating rules, timetables, timetable special instructions, and subsequent amendments. The regulations also require railroads to retain copies of these documents at their systems headquarters and make these documents available to FRA upon request. FRA is requiring the installation of inward and outward-facing locomotive image recording devices on all lead locomotives in passenger trains, as required by the Fixing America's Surface Transportation Act (FAST Act). In general, this final rule requires that these devices record while a lead locomotive is in motion and retain the data in a crashworthy memory module. This collection of information involves both reporting and recordkeeping requirements. The collection frequency of the required information occurs on an occasional basis as well as annually.

The information collected by The EDN Tuberculosis Follow-Up Worksheet for Newly-Arrived Persons with Overseas Tuberculosis Classifications, also commonly known as the TB Follow-Up Worksheet, will provide outcomes for improving national TB prevention programs. The Division of Global Migration and Quarantine (DGMQ) staff, along with other federal partners will use this information to assess overseas panel physician performance, overseas prevention activities, and TB control program performance in the United States. Specifically, to improve overseas panel physician performance and TB prevention activities, CDC needs information on the U.S. domestic chest x-rays, chest x-ray comparison sputum smear and culture, and diagnosis results along with U.S. domestic reviews of overseas treatment. To monitor and assess U.S. domestic TB program performance, CDC needs to collect data on all elements of TB U.S. domestic follow-up evaluations, including chest x-rays, diagnosis, and U.S. treatment outcomes. This Non-Substantive Change Request is submitted to make minor modifications that do not alter the overall scope of the currently approved collection. In brief, the labor force data can be broken down by sex, age, race, ethnicity, marital status, family composition, educational level, certification and licensing status, disability status, and various other characteristics. Through such breakdowns, one can focus on the employment situation of specific population groups as well as on the general trends in employment and unemployment. Moreover, the survey yields data on the characteristics of people who have stopped looking for work because they believe no jobs are available, also referred to as discouraged workers. This submission seeks to correct a typographical error in Form 2303(a) (Excel template). This change does not affect the Commission’s previous burden estimates, the reporting requirements, or the costs of this collection. This submission is being made for proposed non-substantive changes to an existing information collection pursuant to 44 U.S.C. § 3507. This submission provides the final versions of FCC Form 2303(a) (consisting of Word and Excel Templates) and of FCC Form 2303(b) (Certification Form) to reflect OMB approval on September 13, 2023. It also reflects the assignment of OMB Control No. 3060-1314 to this new collection. On March 17, 2023, the Commission released the 2023 IPCS Order (FCC 23-19), in which it began the process of implementing the Martha Wright-Reed Just and Communications Act of 2022, which directs the Commission to promulgate any regulations implementing the provisions of the Act, including its mandate that the Commission establish a compensation plan ensuring that all rates and charges for incarcerated people's communications services (IPCS) are "just and reasonable," not earlier than 18 months and not later than 24 months after its January 5, 2023 enactment. The Act gives the Commission authority to enact rates and charges for voice, video, and advanced communications between incarcerated people and their families and loved ones, including communications within a state's borders. Previously, the Commission had authority only over interstate and international voice calls. To ensure that it has the data needed to meet the Commission's responsibilities under the Act, the Wireline Competition Bureau (WCB) and the Office of Economics and Analytics (OEA) must "update and restructure" the Commission's most recent mandatory data collection, OMB Control No. 3060-1300. The Commission delegated authority to WCB and OEA to collect data on IPCS from all providers now subject to the Commission's authority. WCB/OEA developed proposals for the 2023 Mandatory Data Collection and issued a Public Notice on April 28, 2023 seeking comments on all aspects of the proposed revisions to the collection. After considering all filings, the Commission released an Order adopting the instructions, reporting template, and certification form to implement the collection.

The original estimate was made prior to the commencement of this program. Now that this program is active, there have been more respondents than anticipated so CBP is updating the estimated number of respondents for ABTC, plus the estimates for Global Entry and the Global Entry kiosks because the ABTC participants must submit information under these programs as well. This collection of information is for CBP's Trusted Traveler Programs including the Secure Electronic Network for Travelers Rapid Inspection (SENTRI), which allows expedited entry at specified southwest land border ports of entry, and the Free and Secure Trade program (FAST), which provides expedited border processing for known, low-risk commercial drivers, and Global Entry which allows pre-approved, low-risk air travelers expedited processing upon arrival into the United States. Abstract

EPA is requiring reporting and recordkeeping requirements for Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) under the Toxic Substances Control Act (TSCA) as amended by the Fiscal Year 2020 National Defense Authorization Act (NDAA). As mandated by the amendment, EPA will require certain persons that manufacture (including import) or have manufactured these chemical substances in any year since January 1, 2011, to electronically report to EPA certain information. This is a one-time reporting event to provide greater transparency on the uses and risks associated with PFAS and is mandated by the NDAA. The total one-time burden and cost of the action are summarized in Table 1. Table 2 annualizes the burden and cost over a three-year ICR approval period (although the reporting is a one-time activity).

Report of Dispute Resolution Under Part C of the Individuals with Disabilities Education Act

Abstract

The Individuals with Disabilities Education Act (IDEA; P. L. 108-446) directs the Secretary of Education to obtain data on the dispute resolution process described in Section 615 of the law. Specific legislative authority in Section 618 of IDEA requires that: “(a) IN GENERAL- Each State that receives assistance under this part, and the Secretary of the Interior, shall provide data each year to the Secretary of Education and the public on the following: (1)(F) The number of due process complaints filed under section 615 and the number of hearings conducted. (H) The number of mediations held, and the number of settlement agreements reached through such mediations”. In addition to the specific data requirements described in Section 618, Section 616(a)(3)(B) of IDEA identifies the dispute resolution process as a monitoring priority. The law states specifically that: “(3) MONITORING PRIORITIES- The Secretary shall monitor the States, and shall require each State to monitor the local educational agencies located in the State (except the State exercise of general supervisory responsibility), using quantifiable indicators in each of the following priority areas, and using such qualitative indicators as are needed to adequately measure performance in the following priority areas: (B) State exercise of general supervisory authority, including child find, effective monitoring, the use of resolution sessions, mediation, voluntary binding arbitration, and a system of transition services as defined in sections 602(34) and 637(a)(9)”. The data collection form provides instructions and information for States when submitting their dispute resolution data. The form collects data on the number of written, signed complaints; mediation requests; and hearing requests and the status of these actions initiated during the reporting year with regards to children served under Part C of IDEA. The purposes of these data are to: (1) assess the progress, impact, and effectiveness of State and local efforts to implement the legislation and (2) provide Congress, the public, and Federal, State, and local educational agencies with relevant information. These data are used for monitoring activities, planning purposes, congressional reporting requirements, and dissemination to individuals and groups.
