What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Report of Dispute Resolution Under Part C of the Individuals with Disabilities Education Act

Key Information

Abstract

The Individuals with Disabilities Education Act (IDEA; P. L. 108-446) directs the Secretary of Education to obtain data on the dispute resolution process described in Section 615 of the law. Specific legislative authority in Section 618 of IDEA requires that: “(a) IN GENERAL- Each State that receives assistance under this part, and the Secretary of the Interior, shall provide data each year to the Secretary of Education and the public on the following: (1)(F) The number of due process complaints filed under section 615 and the number of hearings conducted. (H) The number of mediations held, and the number of settlement agreements reached through such mediations”. In addition to the specific data requirements described in Section 618, Section 616(a)(3)(B) of IDEA identifies the dispute resolution process as a monitoring priority. The law states specifically that: “(3) MONITORING PRIORITIES- The Secretary shall monitor the States, and shall require each State to monitor the local educational agencies located in the State (except the State exercise of general supervisory responsibility), using quantifiable indicators in each of the following priority areas, and using such qualitative indicators as are needed to adequately measure performance in the following priority areas: (B) State exercise of general supervisory authority, including child find, effective monitoring, the use of resolution sessions, mediation, voluntary binding arbitration, and a system of transition services as defined in sections 602(34) and 637(a)(9)”. The data collection form provides instructions and information for States when submitting their dispute resolution data. The form collects data on the number of written, signed complaints; mediation requests; and hearing requests and the status of these actions initiated during the reporting year with regards to children served under Part C of IDEA. The purposes of these data are to: (1) assess the progress, impact, and effectiveness of State and local efforts to implement the legislation and (2) provide Congress, the public, and Federal, State, and local educational agencies with relevant information. These data are used for monitoring activities, planning purposes, congressional reporting requirements, and dissemination to individuals and groups.

Abstract

On January 18, 2022, the Department convened a negotiated rulemaking committee, the Institutional and Programmatic Eligibility Committee, to consider proposed regulations for the Federal Student Aid programs authorized under title IV of the Higher Education Act of 1965, as amended, (HEA). Through the Notice of Proposed Rulemaking (NPRM) published on May 19, 2023, docket number ED-2022-OPE-0062, the Secretary proposed new regulations to promote transparency, competence, stability, and effective outcomes for students in the provision of postsecondary education. The Final Rule under new § 668.407 establishes that prospective students must acknowledge having seen the information on the program information website maintained by the Secretary if an eligible non-Gainful Employment (non-GE) program has failed the debt-to-earnings (D/E) measure and requires that students must provide the acknowledgment before the institution may disburse any title IV, HEA funds. The change to the regulations since the NPRM has changed the estimated burden for this collection as identified in the NPRM. The required acknowledgments now exclude undergraduate degree programs from the acknowledgment requirements at § 668.407(a). This is a request for a change to the collection designated 1845-0174 by OMB during the NPRM stage of this information collection filing.

Section 313 of the Joseph Maxwell Cleland and Robert Joseph Dole Memorial Veterans Benefits and Health Care Improvement (Cleland-Dole) Act of 2022 (P.L. 117-328) requires the VA to conduct a study on financial and credit counseling by querying financial and credit counselors, homeless programs providers, and subject matters experts regarding the use of financial and credit counseling services. The intent of this study is to identify financial and credit counseling needs of Veterans experiencing homelessness or at risk of experiencing homelessness, the financial and credit counseling services offered to these Veterans, the specific barriers that these Veterans have in accessing these financial and credit counseling services, and the effects of financial and credit counseling services on such outcomes as employment, housing status, income, and credit score. The information collected will be used to inform VA policy makers, program managers, and process improvement investigators about how to enhance financial and credit counseling services that are offered to Veterans experiencing homelessness or at risk of experiencing homelessness. The results of this study, which will not include personally identifiable information about the individual respondents, will be shared with Congress via a congressionally mandated report.

This request is for a revision to an existing information collection. This revision addresses minor updates to four existing forms and the addition of a fifth form that relate to the analysis of and participation in ocean exploration video products and expeditions. NOAA Ocean Exploration (OER) uses voluntary surveys to identify the needs of users of data, best approaches to leverage the expertise of shore-based participants, feedback on expeditions, and for meaningful public engagement with ocean exploration products. The one required form in the collection is for the limited number of scientists who sail aboard NOAA Ship Okeanos Explorer to collect information pertaining to health and safety while at sea. Revisions to this collection include updated informational attachments (e.g., links to updated COVID guidance, medical clearance, underwater cultural heritage protocols) and updated expedition names and dates for a given calendar year. The Okeanos Explorer Participation Assessment form contains revisions to include optional feedback questions that relate to communication, leadership, and workplace climate during OER’s ocean exploration expeditions. This request also includes a new voluntary form to solicit interest within the scientific community to sail aboard the Okeanos Explorer as a Science Lead. The existing collection has a current expiration date of December 31, 2023. Revisions are requested at this time to improve the form collection for 2024.

Any person to whom a procurement quota has been issued, authorizing that person to procure and use a quantity of a basic class of controlled substances listed in Schedules I or II and ephedrine, pseudoephedrine, phenylpropanolamine during the current calendar year, shall, at or before the time of giving an order to another registrant requiring the distribution of a quantity of such basic class and the chemical, certify in writing to such other registrant that the quantity of such basic class and list I chemical ordered does not exceed the person's unused and available procurement quota of such basic class and chemical for the current calendar year. Abstract

To obtain a certificate of coverage, SSA requires the worker or employer to write to SSA and provide personally identifiable information and details of employment. The information required to issue a certificate differs depending on the agreement negotiated with a particular country. As a result, SSA created 30 forms for each agreement corresponding to the 30 countries with which we have agreements. The forms require respondents to provide personally identifiable information about the worker; the employer; and residential locations for the worker and employer. Some of the questions include the applicant’s name, U.S. Social Security number, date of birth, country of birth, country of citizenship, country of permanent residence, date of hire, country of hire, beginning and ending date of work assignment in the foreign country, the employer, and residential location in the U.S. and abroad. The respondents are U.S. citizens and residents who wish to work in a foreign country, and their employers. Authorization for the Social Security Administration to Obtain Wage and Employment Information from Payroll Data Providers

Abstract

Section 824 of the Bipartisan Budget Act (BBA) of 2015, Public Law 114-74, authorizes SSA to enter into information exchanges with payroll data providers for the purposes of improving program administration and preventing improper payments in the SSDI and SSI programs. SSA uses Form SSA-8240, Authorization for the Social Security Administration to Obtain Wage and Employment Information from Payroll Data Providers, to secure the authorization needed from the relevant members of the public to obtain their wage and employment information from payroll data providers. Ultimately, SSA uses this wage and employment information to help determine program eligibility and payment amounts. The public can complete Form SSA-8240 using the following modalities: a paper form; the Internet; and an in-office or telephone interview, during which an SSA employee documents the wage and employment information authorization information on one of SSA’s internal systems (the Modernized Claims System (MCS); the SSI Claims System; eWork; or iMain). The individual’s authorization will remain effective until one of the following four events occurs: (1) SSA makes a final adverse decision on the application for benefits, and the applicant has filed no other claims or appeals under the Title for which SSA obtained the authorization; (2) the individual’s eligibility for payments ends, and the individual has not filed other claims or appeals under the Title for which SSA obtained the authorization; (3) the individual revokes the authorization verbally or in writing; or (4) the deeming relationship ends (for SSI purposes only). SSA requests authorization on an as-needed basis as part of the following processes: (a) SSDI and SSI initial claims; (b) SSI redeterminations; and (c) SSDI Work Continuing Disability Reviews. The respondents are individuals who file for, or are currently receiving, SSDI or SSI payments, and any person whose income and resources SSA counts when determining an individual’s SSI eligibility or payment amount.

Marine Fisheries Advisory Committee Survey on Marine Mammal Deterrents

Abstract

This is a request for a new collection of information. The summary of a series of marine mammal deterrent workshops by NOAA Fisheries states, “under a recent proposed rule, NOAA Fisheries developed guidelines for deterring marine mammals under its jurisdiction, and recommended specific measures for species listed under the Endangered Species Act (ESA). The guidelines focus on how to safely use deterrents to avoid injuring or killing marine mammals. However, evaluation of the efficacy of each deterrent was beyond the scope of the rulemaking process, and available data on deterrent effectiveness is lacking.” Consequently, the Protected Resources Subcommittee of the Marine Fisheries Advisory Committee (MAFAC) was asked to help NMFS narrow down the scope for assessing the effectiveness of the marine mammal deterrents listed in the proposed guidelines and create a decision making process to prioritize areas to begin characterizing the effectiveness. To achieve this, the Subcommittee plans to rank relative risk of expected losses from interactions with marine mammals by various user groups nationwide, which will identify where the biggest impacts of marine mammals are likely to be occurring. The information for the relative risk and expected loss analysis will be generated through a survey of five user groups (commercial fishermen, recreational fishermen, tribal fishermen (inclusive of tribal nations and other coastal indigenous populations), aquaculture operators, and waterfront property managers (e.g. harbormasters and harbor facility assistants).

There is currently no national, standardized hypothesis generating interview data collection instrument for use during single or multi state shigellosis cluster or outbreak investigations. The Shigella Hypothesis Generating Questionnaire (SHGQ) will be administered by state and local public health officials among cases as part of outbreak and cluster response. Is to define a core set of data elements to be used for hypothesis generation as part of investigations of clusters or outbreaks of shigellosis. The SHGQ will be used by federal, state, and local public health officials responsible for conducting interviews with reported cases of shigellosis in their jurisdiction in order to systematically assess core exposure elements and risk factors among cases of shigellosis.

Abstract

Claimants have a statutory right under the Act and current regulations to request review of an ALJ’s hearing decision or dismissal of a hearing request on Title II and Title XVI claims. Claimants may request Appeals Council review by filing a written request using Form HA-520, or the Internet version of Form HA-520, the i520. SSA uses the information to establish the claimant filed the request for review within the prescribed time, and to ensure the claimant completed the requisite steps permitting the Appeals Council review. The Appeals Council uses the information to: (1) Document the claimant’s reason(s) for disagreeing with the ALJ’s decision or dismissal; (2) determine whether the claimant has additional evidence to submit; and (3) determine whether the claimant has a representative or wants to appoint one. The respondents are claimants requesting review of an ALJ’s decision or dismissal of hearing. We are making non-substantive changes to update the mailing address for the HA-520, and to incorporate inclusive language consistent with executive orders on diversity, equity, and inclusion.

USGS is authorized under SECURE Water Act Section 9508 to assist state water resource agencies with improving their water use data collection activities. USGS has implemented the Water Use Date and Research program (WUDR), to work with state water agencies in gathering and analyzing their data, and assists this effort via cooperative agreements. WUDR will be used to improve the collection and reporting of water use categories by state agencies, including the inclusion of categories that have been discontinued in the past due to limited resources. This collection will also be used in reports to Congress on water resources in the nation.

Abstract

This request is for an extension without revision of the Atlantic Highly Migratory Species (HMS) electronic monitoring (EM) and vessel monitoring system (VMS) information collection. The burden and cost estimates have been updated to reflect minor changes in the number of permit holders, and hourly labor costs from the Bureau of Labor Statistics. EM and VMS provide essential data to monitor vessel-based bluefin tuna quotas, while VMS also provides location data needed to enforce fishery closed areas. The legislative authorities to collect data from the various sectors of the economy that harvest marine resources in the exclusive economic zone are the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) and the Atlantic Tunas Convention Act (ATCA). Under this dual authority, the Secretary of Commerce has promulgated rules that require specific types of record keeping and data submissions. HMS are species that travel long distances and often cross domestic and international boundaries. NOAA Fisheries manages HMS fisheries—tunas, sharks, swordfish, and billfish—in U.S. Atlantic Ocean, Gulf of America, and Caribbean waters.
