Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Complaint Involving Employment Discrimination by a Federal Contractor or Subcontractor

Abstract

OFCCP is seeking reauthorization of the ICR for its complaint program. The ICR includes the form that applicants and employees of contractors, authorized representatives, or third parties can use to file an employment discrimination complaint with OFCCP. Construction Fall Protection Systems Criteria, Practices, and Training Requirements

Abstract

The Standards on Construction Fall Protection Systems Criteria and Practices (29 CFR 1926.502) and Training Requirements (29 CFR 1926.503) ensure that employers provide the required fall protection for their workers. Accordingly, these standards have the following paperwork requirements: Paragraphs (c)(4)(ii) and (k) of 29 CFR 1926.502, which specify certification of safety nets and development of fall protection plans, respectively, and paragraph (b) of 29 CFR 1926.503, which requires employers to certify training records. The training certification requirement specified in paragraph (b) of 29 CFR 1926.503 documents the training provided to workers potentially exposed to fall hazards in construction. A competent person must train these workers to recognize fall hazards and in the use of procedures and equipment that minimize these hazards. An employer must verify compliance with this training requirement by preparing and maintaining a written certification record that contains the name or other identifier of the worker receiving the training, the date(s) of the training, and the signature of the competent person who conducted the training, or of the employer.

Abstract

The goal of the information clearance request is to reinstate without change the Teen Pregnancy Prevention (TPP) program performance measures to cover data collection during the one-year no-cost extension period from grantees funded in FY2020. The performance measures data collection will fulfill several important functions. First, OPA expects its grantees to utilize the measures to make continuous quality improvement in their program implementation and inform their partners and stakeholders about implementation and sustainability progress. Second, performance measures provide OPA with metrics for monitoring TPP grantees so that project officers can provide technical assistance when needed. Finally, OPA uses the measures to report to OASH, OS, our budget office, and Congress on the grantees' progress. Performance Measure data collection is a requirement of all TPP grant awards and is included in the funding announcements.

This information collection activity concerns an agency-specific form, GSA Form 5039, Living Quarters Allowance Eligibility Questionnaire. Abstract

Sections 1886(d) (5) (K) and (L) of the Act establish a process of identifying and ensuring adequate payment for new medical services and technologies (sometimes collectively referred to in this section as ‘‘new technologies’’) under the IPPS. Section1886(d)(5)(K)(vi) of the Act specifies that a medical service or technology will be considered new if it meets criteria established by the Secretary after notice and opportunity for public comment. Section 1886(d)(5)(K)(ii)(I) of the Act specifies that a new medical service or technology may be considered for new technology add-on payment if, ‘‘based on the estimated costs incurred with respect to discharges involving such service or technology, the DRG prospective payment rate otherwise applicable to such discharges under this subsection is inadequate.’’ The regulations at 42 CFR 412.87 implement these provisions and specify three criteria for a new medical service or technology to receive the additional payment: (1) The medical service or technology must be new; (2) the medical service or technology must be costly such that the DRG rate otherwise applicable to discharges involving the medical service or technology is determined to be inadequate; and (3) the service or technology must demonstrate a substantial clinical improvement over existing services or technologies.

Abstract

OMB approved the IWO for an additional three years on August 23, 2023. During the OMB review period, OCSS found references to “child support enforcement (CSE) agencies” that were not updated to “child support agency (CSA)” as intended. As a result, the IWO program team submitted the forms for additional quality review, which resulted in additional minor edits to the form and instructions. States are required to use the IWO form to issue income withholding orders. OCSS would like to give states the option to use the previously approved IWO form for an additional 12 months so that child support agencies remain compliant with federal law while making any system changes to accommodate the proposed edits to the IWO form. States will be required to use the proposed form once programming is complete. The original submission and the recently approved materials do not reflect an extension request for this transition. OCSS requests an extension of the previously approved IWO form for an additional 12 months to allow states to program their systems to accommodate the recently approved revisions to the IWO form and instructions. OCSS made the following changes as a result of the additional quality review and to clarify instructions around forms during programming transitions: 1.) Revised all “child support enforcement (CSE) agencies” references to “child support agencies (CSA)” on the IWO form, instructions, and sample IWO form 2.) Made minor edits to simplify the language in the instructions 3.) Added an explanation under #1.d of the instructions to clarify that the “Expiration Date” pertains to OMB approval of the form and is not the date enforcing the withholding order expires. 4.) Added an explanation under #1.d of the instructions notifying state to issue orders using the previous form while programming to use the new form. The IWO Record Specifications did not change.

Assessment of Flooding Impacts and Climate Inequities

Key Information

Abstract

We will investigate social vulnerability to coastal-storm flooding in urban neighborhoods to assess inequities in the burden of flood risk. Recent flood disasters arising from severe coastal storms and hurricanes (i.e., Hurricane Ida 2021) have demonstrated the critical importance of incorporating rainfall into assessments of coastal flood risk. Climate change is leading to both increasing rainfall intensity and higher water levels during floods, creating increased risk for residents of low-lying areas such as those living in basement apartments who are often low-income or from minority racial groups. We will collect data on vulnerability to flooding from rainfall and tidal flooding through interviews and household/small business surveys. Participants will be drawn from residents and businesses in the Jamaica Bay watershed in and around Brooklyn, New York, who have experienced rainfall and/or tidal flooding within the last four years. Interview participants will be identified through snowball sampling and contact with community leaders. We plan to interview or conduct focus group discussions (FGDs) with 20 residents and to interview 5 small business owners, with each interview or FGD lasting 1-2 hours. Participants will share their experiences, concerns, and responses to flooding events and risks. Interviews will be recorded and transcribed. Transcripts will then be analyzed using qualitative data analysis software such as Atlas.ti. We will survey 300 households and 150 small- to medium business owners, with each survey lasting about 30 minutes. We will select survey participants through stratified random sampling. We will use regression analysis on the survey data to investigate indicators of vulnerability.
