What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

FMCSA seeks the Office of Management and Budget’s (OMB) approval of a new ICR titled, Non-Insulin-Treated Diabetes Mellitus Assessment Form, MCSA-5872. This ICR is voluntary and may be utilized by medical examiners (ME), who issue Medical Examiner’s Certificates, Form MCSA-5876, to individuals who operate commercial motor vehicles (CMV) in interstate commerce, to communicate with treating healthcare providers responsible for managing the individuals’ diagnosed non-insulin-treated diabetes mellitus. The purpose of the Non-Insulin-Treated Diabetes Mellitus Assessment Form, MCSA-5872, is to assist the ME in determining whether an individual diagnosed with non-insulin-treated diabetes mellitus is physically qualified and the individual’s physical condition is adequate to enable the individual to operate a CMV safely. Because this collection is voluntary, there is no set schedule for CMV operators or MEs to complete the form MCSA-5872. FMCSA estimates that MEs will request that forms be completed for 242,057 individuals with a corresponding number of treating healthcare providers.

Joint Standards for Assessing the Diversity Policies and Practices of Entities Regulated by the Agencies

Key Information

Abstract

Section 342 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act) requires the Board, Office of the Comptroller of the Currency, Federal Deposit Insurance Corporation, National Credit Union Administration, Consumer Financial Protection Bureau, and Securities and Exchange Commission (collectively, the agencies) each to establish an Office of Minority and Women Inclusion (OMWI) to be responsible for all matters of the respective agency relating to diversity in management, employment, and business activities. Section 342 requires each OMWI Director to develop standards for “assessing the diversity policies and practices of entities regulated by the agency.” The Interagency Policy Statement Establishing Joint Standards for Assessing the Diversity Policies and Practices of Entities Regulated by the Agencies, published jointly by the agencies in June 2015, contains these standards (Joint Standards). The Joint Standards encourage a regulated entity to be transparent about its diversity and inclusion activities by voluntarily disclosing certain information available to the public annually on its websites or through other appropriate communication methods, in a manner reflective of the entity’s size and other characteristics (Transparency Standard). The Joint Standards also encourage a regulated entity, in a manner reflective of its size and other characteristics, to voluntarily conduct a self-assessment of its diversity policies and practices and to report information pertaining to its self-assessment to the OMWI Director of its primary federal financial regulator, as well as to publish information pertaining to its efforts with respect to the Joint Standards (Self-Assessment Standard). The Board has developed a voluntary reporting template entitled “Diversity Self-Assessment Template” for use by institutions regulated by the Board to facilitate the provision of self-assessment information. The Transparency Standard, Self-Assessment Standard, and reporting template comprise the FR 2100.

Contracting officers, prior to award, must make an affirmative determination that the prospective contractor is responsible, i.e., capable of performing the contract. Special Requirements for Rural Emergency Hospitals (REHs) (CMS-10863)

Abstract

This is a request for a new information collection request related to the special requirements for Rural Emergency Hospitals (REHs) and is associated with final rulemaking. The statutory authority for REHs as a new provider type, effective January 1, 2023, is set forth at §125 of the Consolidated Appropriations Act (CAA), 2021, which added §1861(kkk) to the Social Security Act (the Act). In the final rule, which went on display on the Federal Register website on August 1, 2023, we finalized new regulations which implement requirements for the additional information that an eligible facility is required to submit when applying for enrollment as a Rural Emergency Hospital (REH), as required by section 125 of the Consolidated Appropriations Act (CAA), 2021. We also finalized updates to certain definitions in the survey and certification regulations to include REHs as a provider type. Specifically, we finalized updates to “Provider of services or provider” at 42 CFR 488.1; to “Statutory basis” at §488.2; “Documentation of findings” at §488.18; and “Requirements for providers” at §489.102. In this final rule, we also finalized new regulations at 42 CFR § 488.70, titled Special Requirements for Rural Emergency Hospitals, which codify the statutory requirement that eligible facilities that submit an application for enrollment as an REH under section 1866(j) of the Act must also submit additional information and also what information must be submitted. In an earlier final rule that was published on November 23, 2022 (87 FR 71748), we finalized regulations which set forth the eligibility requirements for REHs, including the type of health care facilities that are eligible to apply for participation and an REH, and a requirement that eligible facilities be enrolled and certified to participate in Medicare as of December 27, 2020. Also in the November 23, 2022 final rule, CMS established REH CoPs at new Subpart E of 42 CFR Part 485, which are Medicare standard REHs must meet to ensure the health and safety of patients who will receive REH services.

Optimizing Virtual Care Grant Program Performance Measures

Key Information

Abstract

The Health Resources and Services Administration’s (HRSA) Bureau of Primary Health Care (BPHC) is requesting Office of Management and Budget (OMB) approval to electronically collect data for Optimizing Virtual Care (OVC) grant recipient activities and performance measures over an approximately 14-month period. In February 2022, HRSA awarded nearly $55 million to 29 HRSA-funded health centers through the OVC grant program to increase health care access and quality for underserved populations through virtual care such as telehealth, remote patient monitoring, digital patient tools, and health information technology platforms. The goal of the OVC grant program is to continue to support innovation that began during the COVID-19 pandemic, when health centers quickly expanded their use of virtual care to maintain access to essential primary care services for underserved communities. HRSA-funded health centers serve special and vulnerable populations facing barriers to virtual care access, such as low digital literacy, low connectivity capabilities, or limited technology access. The 29 grant recipients will serve as a model for how to increase equitable virtual care, generating and refining strategies that can be adapted and scaled across the Health Center Program. The data on grant recipient activities and performance will help HRSA demonstrate, adapt, assess, and disseminate promising practices, strategies, and novel models of virtual care across the nation’s health centers. The grant recipient activities related to implementation of novel models of virtual care, including aggregate data on patients served and the services they received, will be captured via monthly progress reports. A set of health center performance measures will be captured via a biannual measures report and will provide evidence-informed insight into health equity and virtual care. The Health Center Program and supplemental awards to health centers are authorized by Section 330 of the Public Health Service (PHS) Act, as amended (42 U.S.C. 254b). Notably, HRSA is authorized under 42 U.S.C. 254b(d) to make supplemental awards for health centers to “implement evidence-based models for increasing access to high-quality primary care services, which may include models related to… expanding the use of telehealth and technology-enabled collaborative learning and capacity building models .” As per 45 CFR §75.301, HRSA is obligated to collect performance information on its grants “in a way that will help the HHS awarding agency and other non-Federal entities to improve program outcomes, share lessons learned, and spread the adoption of promising practices.” The original version of the information collection instruments submitted to OMB inadvertently included the April 2022 versions of the data collection instruments developed prior to the 60-day public comment period (Biannual 12-Items Measures Progress Report version 3.1 and OVC Grant Recipient MPR template version 3.5b, dated April 5, 2022). Thus, HRSA is now submitting the revised instruments (OVC Biannual Measures Report Template version 6.0 and OVC Grant Recipient MPR version 4.0, dated December 8, 2022), which include minor revisions made in response to grant recipient and OVC project officer feedback.

Ambulatory Surgical Center (ASC) Covered Procedure List (CPL) Pre-Proposed Rule Recommendation Request (CMS-10809)

Key Information

Abstract

The ASC CPL (Ambulatory Surgical Center Covered Procedures List) was authorized in accordance with section 1833(i)(1) of the Social Security Act, which requires the Secretary to specify surgical procedures which are appropriately performed on an inpatient basis in a hospital but which also can be performed safely on an ambulatory basis in an ASC, critical access hospital, or hospital outpatient department. The statute also requires the Secretary to regularly review and update the ASC CPL. CMS annually reviews and updates the ASC CPL. Surgical procedure codes nominated and sent in by external interested parties, for example, medical specialty societies or other members of the public, are a key part of this review.. During annual rulemaking, CMS receives surgical procedure code nominations from a variety of external interested parties and evaluates them for inclusion to the CPL in the OPPS/ASC proposed rule. After reviewing the nominations and evaluating them against the relevant criteria, CMS proposes the list of procedures that they will add to the CPL for the following calendar year. The public has 60 days to comment on the proposals, CMS takes these perspectives into account, and the final list of procedure nominations are finalized in the OPPS/ASC final rule. In the CY 2022 OPPS/ASC final rule, CMS finalized a formalized process for interested parties to nominate procedures to be added to the ASC CPL. CMS anticipated that interested parties, such as specialty societies that specialize in and have a deep understanding of the complexities involved in providing certain procedures, would be able to provide valuable suggestions as to which additional procedures may reasonably and safely be performed in an ASC. While members of the public may already suggest procedures to be added to the ASC CPL through meetings with CMS or through public comments on the proposed rule, CMS believed it would be beneficial to enable the public, particularly specialty societies who are very familiar with procedures in their specialty, to formally nominate procedures based on the latest evidence available as well as input from their memberships.

Key Information

Abstract

Authorized under the Bipartisan Budget Act of 2018, the Social Impact Partnerships to Pay for Results Act (SIPPRA or Act), amends Title XX of the Social Security Act, 42 U.S.C. 1397 et seq., to provide $100 million in funding to implement “Social Impact Partnership Demonstration Projects” (projects) and feasibility studies to assist states and local governments in applying for project funding. SIPPRA authorizes the Secretary of the Treasury (Secretary) to enter into award agreements with state or local governments for projects addressing entrenched social problems. SIPPRA requires the Department of the Treasury (Treasury) to conduct a request for proposals for projects, make award decisions, and enter into project award agreements. Treasury is publishing a Notice of Funding Availability (NOFA) seeking applications for projects, and anticipates that ten or more persons will respond to its notice announcing availability of funding for SIPPRA projects. Although Treasury is asking applicants to use the SF-424 family of common forms for their applications, in order to effectively and efficient assess and evaluate applications and ensure that projects comply with statutory requirements, Treasury is also soliciting additional detailed information from applicants. This request only includes the burden for this additional information. SAMHSA Data Security Requirements for Accessing Confidential Data

Abstract

When an application process starts in the SAP Portal, the SAP system will collect information and SAMHSA will review the application to fulfill its data security requirements. This is a required step before providing the individual with access to confidential microdata for the purpose of evidence building. SAMHSA’s data security agreements and other paperwork, along with the corresponding security protocols, allow SAMHSA to maintain careful controls on confidentiality and privacy, as required by law. This collection will occur outside of the SAP Portal. On November 22, 2022, SAMHSA published a 60-day Federal Register Notice 87 FR 71346 announcing plans for this collection.

Abstract

On May 12, 2020, the Commission adopted Amendment of Section 73.3580 of the Commission’s Rules Regarding Public Notice of the Filing of Applications; Modernization of Media Regulation Initiative; Revision of the Public Notice Requirements of Section 73.3580, Second Report and Order, MB Docket Nos. 17-254, 17-105, & 05-6, FCC 20-65 (rel. May 13, 2020). The Commission adopted new, streamlined procedures for stations to provide public notice of the filing of certain applications. Stations, including stations filing for new construction permits or major modifications to facilities, that were previously required to post public notice in a local newspaper, must now post notice online, either on the station website or a website affiliated with the station, its licensee, or its parent entity, or else must post notice on a publicly accessible, locally targeted website, for 30 continuous days following acceptance of the application for filing. Stations that are required to make on-air announcements of the filing of certain applications, must continue to do so, but the announcements are shorter and direct viewers and listeners to the application as filed and displayed in either the station’s Online Public Inspection File or another Commission database. A total of six on-air announcements are required, at least one per week and no more than one per day or two per week, to be broadcast between 7:00 a.m. and 11:00 p.m. local time, Monday through Friday, beginning after the application is accepted for filing. This submission is being made to OMB for approval of the modified third-party disclosure requirements for this Information Collection, as adopted in the 2020 Public Notice Second Report and Order. The changes pertaining to this Information Collection and to 47 CFR § 73.3580 adopted in the 2020 Public Notice Second Report and Order, which are listed below, do not necessitate changes to the Schedule 301, nor do they affect the substance, burden hours, or costs of completing the forms. The rule changes do, however, reduce burdens and costs associated with filing the application.

Abstract

The Bayh-Dole Act (35 USC §§ 200-212) and its implementing regulations (37 CFR 401) require Contractors to report information related to inventions and patents to the federal agency which awarded the relevant funding. The purpose of this legislation included promoting utilization of inventions resulting from federal R&D funding, encourage collaboration between non-profit and for-profit entities, increase commercialization and public availability of inventions made in the United States, and to ensure that the Government obtains sufficient rights in federally funded inventions to meet the needs of the Government and protect the public. To facilitate these and other objectives as well as to track both compliance with and effectiveness of this legislation, collection of data is required.

Abstract

The U.S. Department of Education (the Department) is requesting an extension of the 1810-0756 information collection to continue collecting data from states annually about how Title II, Part A funds are used; how funds are used to improve equitable access to teachers for-low income and minority students; and where applicable, evaluation and retention data for teachers, principals, and other school leaders. The reporting requirements are outlined in Section 2104(a) of the Elementary and Secondary Education Act (ESEA), as authorized by the Every Student Succeeds Act of 2015 (ESSA). The survey will include the universe of states, the District of Columbia, and Puerto Rico. The information obtained from the survey will provide the Department with a description of how Title II, Part A State activities funds are used by teach State. In addition, the survey will provide data on teacher, principal, and other school leader evaluation and retention. The survey will be sent to State Title II, Part A coordinators in each of the 50 states, District of Columbia, and Puerto Rico. The survey will be administered using an electronic instrument.

Abstract

The Commission recently adopted amendments to Rules 101 and 102 of Regulation M that remove the Investment Grade Exceptions and add, in their place, new exceptions for Nonconvertible Securities. Certain provisions of the final amendments contain “collection of information” requirements, which were submitted to OMB in a revision to 3235-0464. In addition, and to facilitate Commission examinations of broker-dealers who rely on the new exception in Rule 101 or Rule 102 of Regulation M, the Commission adopted a new paragraph (17) of Rule 17a-4(b) that requires broker-dealers to preserve the written probability of default determination relied upon pursuant to Rule 101(c)(2)(i) or Rule 102(d)(2)(i), as applicable. The new collection of information in Rule 17a-4(b)(17) is in this control number 3235-0806.

Incoming and Outgoing Intergovernmental Personnel Act (IPA) Assignment Agreement

Abstract

The Intergovernmental Personnel Act (IPA) mobility program provides for the temporary assignment of civilian personnel between the Federal Government and State and local governments; colleges and universities; Indian tribal governments; federally funded research and development centers; and other eligible organizations. The Office of Personnel Management (OPM) created a generic form, the OF-69, for agencies to use as a template when collecting information for the IPA assignment. The OF-69 collects specific information about the agreement including: (1) the enrolled employee’s name, Social Security number, job title, salary, classification, and address; (2) the type of assignment; (3) the reimbursement arrangement; and (4) an explanation as to how the assignment benefits both SSA and the non-federal organization involved in the exchange. OPM directs agencies to use their own forms for recording these agreements. Accordingly, SSA modified the OF-69 to meet our needs, creating the SSA-187 for incoming employees and the SSA-188 for outgoing employees. SSA collects information on the SSA-187 and SSA-188 to document the IPA assignment and to act as an agreement between the agencies. Respondents are personnel from State and local governments; colleges and universities; Indian tribal governments; federally funded research and development centers; and other eligible organizations who participate in the IPA exchange with SSA.
