What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

In CC Docket No. 93-240, the Commission considered the issue of the accounting rules and ratemaking policies that should apply to litigation costs incurred by carriers subject to Part 32 of its rules and regulations. The Commission concluded that there should be special rules to govern the accounting treatment of federal antitrust judgements and settlements, in excess of the avoided costs of litigation, but not for litigation expenses. The Commission further concluded that these special rules should not apply to costs arising in other kinds of litigation. A carrier must make a showing to receive recognition of its avoided costs of litigation.

The Creating Helpful Incentives to Produce Semiconductors for America Incentives Program (hereafter, “The CHIPS Incentives Program” or “CHIPS”) aims to catalyze long-term growth in the domestic semiconductor industry in support of U.S. economic resilience and national security. The CHIPS Incentives Program can provide direct funding (via grants, cooperative agreements, or other transactions), loans, and loan guarantees (collectively, “CHIPS Incentives”) for eligible projects. CHIPS Incentives will support investments in the construction expansion, and modernization of commercial facilities in the United States for the front- and back-end fabrication of leading-edge, current-generation, and mature-node semiconductors. CHIPS expects to engage with a wide range of customers across a variety of business needs, and requires a CRM solution to track, manage, and report on these customer interactions. Each year employers report the wage amounts they paid their employees to IRS for tax purposes, and separately to SSA for retirement and disability coverage purposes. In theory these reported amounts should equal each other; however, each year some of the employer wage reports that SSA receives are less than the wage amounts reported to IRS. SSA attempts to ensure that employees receive full credit for the wages they have earned through the use of the SSA-L 93 (cover letter); SSA-L 94 (cover letter); SSA-95 and SSA-97 (questionnaires). Respondents are employers who reported less wage amounts to SSA than they reported to IRS.

Northeast Multispecies Reporting Requirements

Abstract

The National Marine Fisheries Service (NMFS) requests OMB merge the 0648-0800 temporary information collection into the recently approved 0648-0605 information collection, Northeast Multispecies Reporting Requirements. Due to the concurrent timing of the rulemaking for 0648-BK17 and the timing of the renewal of the collection of information 0648-0605, Northeast Multispecies Reporting Requirements, a temporary collection was created for the rule-related collection. This request seeks to merge the new temporary collection (0648-0800) with 0648-0605 now that all actions have been resolved. The National Marine Fisheries Service (NMFS) promulgated a rule (0648-BK17) in 2022 to add a dockside monitoring requirement for vessels electing to use maximized retention electronic monitoring (MREM) to meet the existing monitoring requirement. Notice was provided to the public in both the proposed rule (87 FR 11014) and final rule (87 FR75852) of the creation of a temporary collection for the collection of dockside monitoring service provider requirements that would be merged into 0648-0605 upon resolution of the extension to 0648-0605 and the approval of the final rule package in 0648-0800. The merging of these collections would add 49,204 responses, 16,276 burden hours, and $2,805,888 in miscellaneous costs to 0648-0605.

Section 80.503 requires that a licensee of a private coast station or marine utility station on shore may install ship radio stations on board United States commercial transport vessels of other persons. In each case these persons must enter into a written agreement verifying that the ship station licensee has the sole right of control of the ship stations, that the vessel operators must use the ship stations subject to the orders and instructions of the coast station or marine utility station on shore, and that the ship station licensee will have sufficient control of the ship station to enable it to carry out its responsibilities under the ship station license. Abstract

The U.S. Department of Education (Department) is seeking a continuation of this data collection with revisions necessitated by: (1) a limited exception to the definition of “equipment” in 2 C.F.R. §200.1; (2) guidance issued by the Rehabilitation Services Administration (RSA) with respect to “Allowable Sources of Non-Federal Share for the State Vocational Rehabilitation Services Program;” (3) citation changes made to the definitions contained in the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance); and (4) requests for clarity from State licensing agencies (SLAs) regarding which non-Federal expenditures incurred for the benefit of the Randolph-Sheppard Vending Facilities Program (RSVFP) may be used for satisfying the match and maintenance of effort (MOE) requirements under the VR program. This proposed information collection request (ICR) also proposes a few other technical edits to improve clarity. Current approval for this data collection expires February 29, 2024, but is it requested to use the new instructions at the start of FY 2024 for FY 2023. The Randolph-Sheppard Act (Act), at 20 U.S.C. § 107a(6)(a), directs the Secretary of Education, through the Commissioner of RSA, to conduct periodic evaluations of the programs authorized under the Act. In addition, Section 107b(4) requires State government entities designated as the SLA to “make such reports in such form and containing such information as the Secretary may from time to time require….” Sections 107a(a)(2) and (4) of the Act also require the Secretary of Education to “...make annual surveys of concession vending opportunities for blind vendors on Federal and other property...” and to “...make available to the public...information obtained as a result of such surveys.” The information to be collected is a necessary component of the data gathering and evaluation process and forms the basis for the Randolph-Sheppard Act section of the RSA annual report to Congress, which is required by Section 13 of the Rehabilitation Act of 1973 (Rehabilitation Act) (29 U.S.C. 710). The RSA-15 form includes information on the activities under this program and is used in monitoring the States’ implementation of the program. In addition, the fiscal data collected by the RSA-15 highlight the fiscal nexus between the RSVFP and VR program in each State, particularly with respect to the use of Federal VR This information collection (IC) will be implemented upon the expiration of the current IC on February 29, 2024; however it is requested to begin the use of this form and the new instructions for the FY 2023 data collection (October 1, 2023). The RSA-15: Report of Randolph-Sheppard Vending Facility Program 1820-0009 is available both in hard copy and electronically; however, data will be submitted and collected through the RSAMIS on the rsa.ed.gov website by each of the 51 SLAs.

Abstract

The Federal Audit Clearinghouse (FAC) operates on behalf of the Office of Management and Budget (OMB) and serves as the central collection point and repository for single audit reporting packages prepared and submitted for non-federal entities, such as states, local governments, nonprofit organizations, Indian tribes and tribal organizations, and institutions of higher education that expend $750,000 or more in federal awards during their fiscal periods. While the Uniform Guidance refers to such entities as “auditees,” such entities are referenced as “grantees” here for added clarity. This data collection is mandated by the Single Audit Act Amendments of 1996 (PL 104-156) and OMB Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (Uniform Guidance or 2 C.F.R. Part 200). Grantees meeting the dollar threshold defined in OMB Uniform Guidance must submit SF-SAC (Form) and their single audit reporting package to the FAC. The grantee must complete the single audit submission every fiscal period they meet the reporting dollar threshold. These submissions assist federal agency inspectors general and grant administrators in monitoring the use of more than $1.3 Trillion in federal award expenditures annually. Data collected by the FAC is available to the public through a FAC data dissemination/query system. Historically the U.S. Census Bureau (Census) has operated the FAC as the OMB-designated repository of record for single audits. However, OMB designated the General Services Administration (GSA) as the new provider for the FAC, effective October 1, 2023.

The purpose of this information collection is to survey stakeholders currently using the EPAs Office of Research and Developments (ORD) scientific research products to increase transparency and public participation, and to ascertain the quality, usability, and timeliness of the research products. ORD will collect these data to inform the annual end of year performance reporting to the Office of Management and Budget (OMB) that will be published each year in the Annual Performance Report (APR), which is part of the Presidents Budget Request and mandated under the Government Performance and Results Act (GPRA). Abstract

The Navy Reserve Health of the Force Survey is a strategic level engagement survey of the Navy Reserve population that addresses core measures relating to the health of the force. The core survey questions support trend analysis on the following metrics: (1) Career plans and influences to stay or leave; (2) Stress, command morale, work/life balance, leadership as well as validated metrics for burnout and workplace incivility; (3) Health of the Force Metrics: connectedness, cohesion, job satisfaction, organizational commitment, job satisfaction, trust, and inclusion; (4) Diversity, equity, and inclusion in the Navy. The Reserve survey also includes questions about Reserve specific issues including reasons for joining the Reserves and experiences during drill weekends and while mobilized. There is no other Navy sponsored survey that captures data on the experiences of the Navy Reserve population. The results of the survey enable the Chief of Navy Reserves to assess the effectiveness of existing programs and policies and inform reports to the Vice Chief of Naval Operations and Congress. This survey is conducted under the authority of the Chief of Navy Reserves, in coordination with OPNAV N1, Chief of Navy Personnel.

Abstract

Section 320 of the Clean Water Act (CWA) amendments of 1987 established the National Estuary Program (NEP) to promote long-term planning and management in nationally significant estuaries threatened by pollution, development, or overuse. The NEP's objectives are to protect, preserve, and restore estuaries. The strategy of the program is to focus on estuaries that are nationally significant in recreational and commercial value, and of great importance for fish and wildlife resources. Another facet of national significance is whether lessons learned in working with the estuary can be applied to other coastal areas. The NEP strategy emphasizes estuaries with problems which detract from the estuary=s value and where there is a greater likelihood that NEP efforts will result in improvements in water and sediment quality, as well as in the abundance and variety of living resources. Information on the implementation of the NEP is collected every one or three years to determine the effectiveness of the program.

Abstract

On January 28, 1999, the Department published a notice of proposed rulemaking on electronic disclosure and recordkeeping issues (64 FR 4506). Where, previously, only group health plans had specifically been provided with a safe harbor for electronic disclosure, the proposal expanded the use of electronic disclosure to include all pension and welfare benefit plans covered by Title I of ERISA. In addition, the proposal added summary annual reports to the list of disclosure documents included in the safe harbor provisions. On April 9, 2002, the Department published a notice of final rulemaking on electronic disclosure and recordkeeping issues (67 FR 17264) to establish a “safe harbor” for the use of electronic media to satisfy the general furnishing requirement. In 2020, the Department issued a final rule providing a new safe harbor (Notice-and-Access Safe Harbor) for plan administrators who wish to satisfy ERISA's delivery requirements for retirement plan documents by posting them on a website and notifying workers of the online availability of such documents (85 FR 31884). This information collection contains a third-party disclosure. The consent serves to demonstrate to the plan administrator that an individual has the ability to access information in the electronic form that will be used for disclosure purposes. Such confirmation will ensure the compatibility of the hardware and software between the individual and the plan and will also serve to demonstrate that the administrator has taken appropriate and necessary measures reasonably calculated to ensure that the system for furnishing documents results in actual receipt, as required under the Employee Retirement Income Security Act. Where applicable, the consent provides a means for the individual to provide the plan with the correct email address to facilitate the efficiencies that may arise from the use of electronic technologies where appropriate. Retirement plan administrators may satisfy their obligation to furnish ERISA-required disclosures by making the information accessible online and furnishing a notice of internet availability of these disclosures to covered individuals. The notice of internet availability must be sent to the electronic address of the participant, for example to the participant's email address and include, among other things, a brief description of the document being posted online, a website address where the document is posted, and instructions for requesting a free paper copy or electing paper delivery in the future. It must be sent each time a retirement plan disclosure is posted to the internet website. To prevent “email overload,” the 2019 final rule allows a notice of internet availability to incorporate or combine other notices of internet availability in limited circumstances. The Department has received approval from OMB for this ICR under OMB Control No. 1210-0121. The current approval is scheduled to expire on August 31, 2023.

Abstract

Individuals pursuing an FAA certificate or rating to operate in the National Airspace System (NAS) must meet the standards established in the FAA regulations specific to the certificate sought by the individual. FAA certification requires that an individual must successfully pass an Airman Knowledge Test as part of the requirements to obtain an FAA certificate or rating. The FAA develops and administers 90 different knowledge tests in many different areas that are required as part of the overall airman certification process. Airman Knowledge Tests are administered at approved Knowledge Testing Centers by an approved test proctor who is required to administer the appropriate Airman Knowledge Test to the individual pursuing FAA certification through the ATLAS test delivery software. It is voluntary for individuals taking an FAA Airman Knowledge Test to report the following information on occasion in order to complete the registration process before the administration of the Airman Knowledge Test: Name, username, password, FAA Tracking Number (FTN), physical address, Date of Birth, email address, phone number, country, citizenship, branch of service, previous number of test attempts, flight school or field experience, graduation date, authorization category, accommodation selections, scheduled exam date, photo identification, and test authorization (credentials of the individual such as an instructor endorsement). The information below is collected by the approved knowledge test delivery vender in electronic format for the purposes stated below: • Name: First, Middle, Last, Suffix • Username • Password • FAA Tracking Number (FTN) – provided to identify individual’s name as established by individual in IACRA. • Email Address • Date of Birth: - Airman Knowledge Tests have minimum age requirements in order to take specific test based on minimum age for FAA certification • Phone number • City • State • Postal Code • Country • Citizenship • Branch of Service Designation • Number of Attempts: Number of attempts to be in compliance with regulations that mandate how long an individual must wait to take the test again after failure. • Flight School or Field Experience (when applicable) • Graduation Date (when applicable) • Authorization Category • Accommodation Selections (when applicable) • Scheduled exam date • Photo identification that contains the individuals photograph, address, signature, and DOB for compliance with U.S. Code § 44703, part 61 and part 107. • Test authorization indicating individual is qualified for the specific knowledge test (instructor endorsement, graduation certificate, etc) according to the specific regulation of the certificate being pursued by the airman. Community Environmental Concerns Survey for U.S. Navy Clean-Up Actions

Abstract

Per Environmental Readiness Program Manual (OPNAV M-5090.1) and Environmental Compliance and Protection Manual (MCO P5090.2A), the Department of the Navy (DON) requires a formal Community Involvement Plan (CIP) at all installations undergoing environmental restoration activities as part of the Navy's Environmental Restoration Program (ERP). The development and execution of a CIP promotes community involvement and provides information on how community members can stay informed and share information or concerns. This is an important component to the overall success of the Navy’s Environmental Restoration Program (ERP). The CIP is based on information gathered from the community through qualitative surveys or interviews with local officials, residents, public interest groups, and other interested or affected parties to ascertain community concerns, community information needs, and how or when citizens would like to be involved in the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) process. To strengthen and maintain community involvement as a useful tool for these purposes, DoD has directed installations to combine pertinent data gathered from surveys or interviews and the U.S. Bureau of the Census and various databases maintained by the military departments, defense agencies, local and tribal agencies, and other agencies to ensure that the CIP adequately characterizes the affected community and addresses community needs. To ascertain community concerns, community information needs, and how or when citizens would like to be involved in the CERCLA process, the Navy typically provides a qualitative survey several months before the development of a CIP. The survey includes multiple choice questions on areas of concern, as well as a section for open comments. The survey is typically open for one to three months. Survey respondents include local officials, residents, public interest groups, and other interested or affected parties within a specific mile range of the given ERP site. Community members are responding to the information collection to provide input for the required updated CIP. The survey is also used to solicit new RAB members and inform the Navy on community awareness and understanding of the ERP process.

Abstract

Section 107(a) of the CHIPS Act of 2022 (CHIPS Act), enacted as Division A of Public Law 117–167, 136 Stat. 1366, 1393 (August 9, 2022), added section 48D to the Code to establish the advanced manufacturing investment credit (section 48D credit) as an investment credit for purposes of section 46 of the Code, which is a current year general business credit under section 38 of the Code. On August 16, 2022, section 6417 was added to the Internal Revenue Code (Code) by Public Law 117-169, title I, section 13801(a), 136 Stat. 1818, commonly referred to as the Inflation Reduction Act of 2022 (IRA). Section 6417 is effective for tax years beginning after December 31, 2022. Section 6418 of the Code was enacted by section 13801(b) of the IRA to permit eligible credits to be transferred from eligible taxpayers to an unrelated taxpayer. This temporary regulation prescribes the registration procedures of the IRS electronic registration portal. The temporary regulations will also cover a new return filing requirement for current non-filers (for example, state and local governments will have to a file a Form 990-T (1545-0047), to make the elective payment election).
