What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

This information collection requires plan fiduciaries to disclose plan- and investment-related fee and expense information to participants and beneficiaries in all participant directed individual account plans (e.g., 401(k)-type plans) for plan years that began on or after January 1, 2010 and at least annually thereafter (defined as at least once in any 14-month period, without regard to whether the plan operates on a calendar or fiscal year basis). The final rule, 29 CFR 2550.404a-5(c), requires three sub-categories of Plan-related information to be provided to participants and beneficiaries. The first sub-category is General Plan Information, which includes how participants may give investment instructions or exercise proxy voting or tendering rights, restrictions on transferring account assets among investment alternatives, and identification of the plan's designated investment alternatives and designated investment managers (29 CFR 2550.404a-5(c)(1)). The second sub-category of Plan-related information is Administrative Expense Information, which refers to explanations of any fees and expenses for general plan administrative services (e.g., legal, accounting, recordkeeping) charged to individual accounts and the basis for allocating such charges among the accounts (e.g., pro-rata, per capita). (29 CFR 2550.404a-5(c)(2)). The third sub-category of Plan-related information is Individual Expense Information, which describes expenses assessed against accounts based on the actions taken by individual participants or beneficiaries. This would include charges for processing participant loans and qualified domestic relations orders. (29 CFR 2550.404a-5(c)(3)). The rule also requires plan administrators to disclose three sub-categories of investment-related information to participants and beneficiaries on or before their date of eligibility, which relates to the plans designated investment alternatives. The first sub-category of information is information required to be provided automatically. (29 CFR 2550.404a-5(d)(1)). For each designated investment alternative, the plan must disclose specified identifying information, past performance data, comparable benchmark returns, fee and expense information, and an internet website address that is sufficiently specific to lead participants and beneficiaries to specified supplemental information for each investment alternative. The latest information available to the plan must be furnished annually. Material changes to this information must be disclosed at least 30 days but no more than 90 days before the effective date of the change except for unforeseen events or circumstances beyond the plan administrator's control. Investment-related information must be furnished in a chart or similar format designed to help participants compare the plan's investment alternatives across each category of information. (29 CFR 2550.404a-5(d)(2)). To facilitate compliance, the rule includes a model chart that may be used by plan fiduciaries to satisfy this requirement. The second sub-category of investment-related information is Post-Investment Information. Following a participant's investment in an alternative, the plan administrator must provide any materials it receives regarding voting, tender or similar rights in the alternative (“pass-through materials”) to the extent such rights are passed through to the participant or beneficiary. (29 CFR 2550.404a-5(d)(3)). The third sub-category of investment-related information is Information to be provided upon Request (29 CFR 2550.404a-5(d)(4)). Participants may request the plan to provide prospectuses, financial reports, as well as statements of valuation and a list of assets held by an investment alternative.

Inflation Reduction Act - Fueling Aviation's Sustainable Transition Grant Program

Abstract

Section 40007 of the Inflation Reduction Act of 2022 (P.L. 117-169) directs the Secretary of Transportation to implement a “competitive grant program for eligible entities to carry out projects located in the United States that produce, transport, blend, or store sustainable aviation fuel, or develop, demonstrate, or apply low-emission aviation technologies.” The Department of Transportation (DOT), Federal Aviation Administration (FAA) is seeking to establish this new grant program—named the Fueling Aviation’s Sustainable Transition (FAST) Grant Program—and collect project proposals via a Notice of Funding Opportunity (NOFO). FAST will have elements focused on sustainable aviation fuel (SAF), to be termed FAST-SAF, and elements focused on low-emission aviation technologies, to be termed FAST-Tech. The program aims to reduce the greenhouse gas emissions (GHG) associated with the aviation sector, in line with the net-zero GHG by 2050 goal outlined in the U.S. Aviation Climate Action Plan. The amount of available funding for the two programs is $244.53M and $46.53M for FAST-SAF and FAST-Tech, respectively. The NOFO will solicit project proposals from eligible entities. The collected information is required for FAA to evaluate proposals and distribute IRA funds to address U.S. climate goals.

Abstract

The Federal Communications Commission (Commission) is requesting approval of a collection for the coordination of certain wireless microphone operations with television licensees. Low power auxiliary station ("LPAS") operations are intended for uses such as wireless microphones, cue and control communications, and synchronization of TV camera signals (referenced collectively as "wireless microphones"). The Commission's rules provide for licensed LPAS operations on unused television channels on a secondary, non-exclusive basis. In the Incentive Auction Report and Order, FCC 14-50, the Commission adopted rules to implement the broadcast television spectrum incentive auction, which will involve reorganizing the existing television band and repurposing a portion of the UHF television band for new wireless broadband services, and which will affect wireless microphone operations across the current TV bands. To ensure that wireless microphones users have access to as many television channels as possible following the repacking process, the Commission determined to revise its rules for co-channel operations in two ways to provide wireless microphones with access to additional television channels in particular locations without raising interference concerns to television licensees.

This document contains proposed rules concerning the low-income communities bonus energy investment credit program established pursuant to the Inflation Reduction Act of 2022. Applicants investing in certain solar and wind powered-electricity generation facilities may apply for an allocation of environmental justice solar and wind capacity limitation to increase the amount of an energy investment credit for the taxable year in which the facility is placed in service. Generic Clearance for Citizen Science and Crowdsourcing Projects

Abstract

NOAA is requesting a new generic clearance for its citizen science and crowdsourcing (CSC) projects. NOAA relies on scientific information. CSC projects allow NOAA to collect qualitative and quantitative data that help inform scientific research and monitoring, validate models or tools, support STEM learning, and enhance the quantity and quality of data collected to support NOAA’s mission. NOAA will use the information gathered under this generic clearance to support the activities listed above and might provide unprecedented avenues for conducting breakthrough research. The information collected under this generic clearance will be from voluntary participants who actively seek to participate on their own initiative through an open and transparent process and the data will be available to support the scientific research (including assessments, tools, models, etc.) of NOAA and its partners. Its partners include states, tribal or local entities, business or other for-profit organizations, and not-for-profit institutions or organizations. In collaborating with other federal agencies and/or non-federal entities, NOAA may sponsor citizen science or crowdsourcing projects to collect information that supports its mission. The records maintained by registrants must be kept and be available for at least two years for inspection and copying by officers or employees of the United States as authorized by the Attorney General. 21 U.S.C. 827(b)(3). The records must be in accordance with and contain such relevant information as may be required by regulations promulgated by DEA. 21 U.S.C. 827(b)(1). Application for Use of Public Space by Non-DOL Agencies in the Frances Perkins Building

Key Information

Abstract

Consistent with 40 U.S.C. § 581(h)(2), Federal Management Regulation (FMR) Part 102, and the GSA Delegation under which the Department of Labor (DOL) operates the Frances Perkins Building (FPB), DOL allows the use of public space within the FPB for non-commercial purposes. As provided by FMR 102-74, Subpart D, (41 CFR 102-74-460, et seq.) any person or entity that wishes to use public space in a Federal building is required to submit an application for a permit. In order to capture the nature of the request, information such as the requester, description of event, date, time, and approvals are collected in order to review the appropriateness of the request and make a determination of the availability of the requested public space. DOL experience shows that the agency actually receives fewer than 10 non-DOL Agency requests to use FPB public space in any given year; however, as the information is contained in a rule of general applicability, the information collection is deemed to involve 10 or more persons. See 5 CFR 1320.3(c)(4)(ii). DOL, consequently, must maintain PRA authority to conduct this information collection.

2023 Law Enforcement Management and Administrative Statistics (LEMAS) supplement survey Post-Academy Training and Officer Wellness (PATOW)

Key Information

Abstract

The goal of the 2023 LEMAS PATOW is to obtain information from law enforcement agencies (LEAs) on two topics: post-academy law enforcement training and officer wellness programs that address suicide. The sample will consist of approximately 3,500 state, county, and local general-purpose law enforcement agencies in the United States. The sample will be nationally-representative, following the sampling strategy approved for the 2020 LEMAS core survey (OMB No. 1121-0240, expires 07/31/2023) and using the Law Enforcement Agency Roster (LEAR) that includes approximately 16,000 general-purpose agencies as a frame. The LEAR has been used as the frame for law enforcement establishment surveys since the 2016 LEMAS. BJS plans to field the 2023 LEMAS PATOW survey from September 2023 through May 2024. The LEMAS PATOW is part of BJS’s Law Enforcement Core Statistics (LECS) program. This program includes surveys on law enforcement operations, which is within BJS’s authorizing statute (see 34 USC § 10132(c)(4)). Core to BJS’s effort in describing the operations of LEAs are the Census of State and Local LEAs (CSLLEA) (OMB Control Number 1121-0346) conducted every four years since 1992, and the LEMAS core survey (OMB Control Number 1121-0240) conducted every 3-5 years since 1987.

This request is for a revision of the State Report Card and Institution and Program Report Card required by the Higher Education Act of 1965, as amended in 2008 by the Higher Education Opportunity Act (HEOA). States must report annually on criteria and assessments required for initial teacher credentials using a State Report Card (SRC), and institutions of higher education (IHEs) with teacher preparation programs (TPP), and TPPs outside of IHEs, must report on key program elements on an Institution and Program Report Card (IPRC). IHEs and TPPs outside of IHEs report annually to their states on program elements, including program numbers, type, enrollment figures, demographics, completion rates, goals and assurances to the state. States, in turn, must report on TPP elements to the Secretary of Education in addition to information on assessment pass rates, state standards, initial credential types and requirements, numbers of credentials issued, TPP classification as at-risk or low-performing. The information from states, institutions, and programs is published annually in The Secretary's Report to Congress on Teacher Quality. Under 21 U.S.C. section 361.1(d)(7), no basic research study involving any administration of a radioactive drug to research subjects is permitted without the authorization of an FDA approved Radioactive Drug Research Committee (RDRC). The purpose of this collection of information is to determine whether the research studies are being conducted in accordance with required regulations and that human subject safety is assured. If these studies were not reviewed, human subjects could be subjected to inappropriate radiation or pharmacologic risks.

Abstract

The Federal Permitting Improvement Steering Council will be providing funding to Tribal governments that meet the requirements outlined in the ERIF Tribal Assistance Program application instructions. The ICR is for the information we plan to request as part of this program. The ICR requests that Tribal governments identify contact information for the Tribe's request, the amount of funding requested, what will be accomplished with the funding (both activities and results) and which FAST-41 projects the Tribe is consulting on or engaged in.Emergency Justfication:$350 million was provided to FPISC's Environmental Review Improvement Fund (ERIF) via the Inflation Reduction Act. The IIJA amended FPISC's authorizing statute to allow for the transfer of ERIF funds to Tribal governments to facilitate timely and efficient envrionmental reviews of FAST-41 projects. IRA and IIJA funded activities and support to Tribal governments to facilitate environmental review of large infrastructure projects are priorities of the Administration. Many of the FAST-41 projects are large-scale infrastructure projects moving through the envionmental review process and Tribes lack the capacity to meaningful engage.

Abstract

In 1975, Congress enacted the Indian Self-Determination and Education Assistance Act (ISDEAA) to authorize tribes and tribal organizations (T/TOs) to assume control of certain Federal programs, e.g., health care programs that Federal agencies would otherwise provide to American Indians and Alaska Natives. As originally enacted, the ISDEAA only authorized the Federal agencies to transfer the “Secretarial amount,” which is the amount the agency would have otherwise spent on the programs, functions, services, and activities (PFSAs) transferred to the T/TO in its ISDEAA agreement. In 1988, Congress amended the ISDEAA to authorize contract support costs (CSC) funding for the first time. CSC funding also is authorized only for reasonable, actual costs, and only to support the Federal PFSAs. Tribal governments and tribal organizations that intend to establish a new or expanded contract with Indian Health Service (IHS) are required to provide proposal information identified at §900.8 of the ISDEAA, which describes what a contract proposal must contain. This information is used by the IHS to determine applicant eligibility, evaluate applicant capabilities, protect the service population, and safeguard Federal funds and resources.
