What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Commodity Exchange Act (CEA) Section 4s(a) (7 U.S.C. 6s(a)) makes it unlawful for a swap dealer (SD) or major swap participant (MSP) to act as such unless registered with the Commodity Futures Trading Commission (CFTC). CEA Section 4s(b) (7 U.S.C. 6s(b)) requires that registration of SDs and MSPs be accomplished by filing an application in such form and manner as provided by the CFTC, containing such information as the CFTC considers necessary concerning the applicant’s business. Pursuant to regulations adopted by the CFTC pursuant to CEA Section 4s(b), SDs and MSPs are required to register on Form 7-R and principals listed by SDs and MSPs must submit Form 8-R. CFTC Form 7-R (for firms) and Form 8-R (for natural persons) request information about the applicant that is necessary to assess the applicant’s fitness to engage in business in the registration categories referenced above, subject to regulation and oversight by the CFTC. (1st IC) Commission Regulation 3.21(e) provides generally that, in lieu of submitting a fingerprint card for a foreign natural person who has not resided in the U.S. since the person’s 18th birthday, a swap dealer or major swap participant may certify that a criminal history background check of such foreign natural person has not revealed any matter that would statutorily disqualify him or her from being registered or listed as a principal. (2nd IC) Commission Regulation 23.23 addresses the cross-border application of the registration thresholds and certain requirements applicable to SDs and MSPs,and establishes a formal process for requesting comparability determinations from the Commission to permit substituted compliance with such requirements. The Earth Mapping Resources Initiative (EARTH MRI) Mine Waste Cooperative Agreements

Abstract

The Earth Mapping Resources Initiative (Earth MRI; https://www.usgs.gov/special-topics/earth-mri) is a component of MRP and is a national effort to carry out the fundamental resources and mapping mission of the U.S. Geological Survey (USGS). The goal of Earth MRI is to improve our knowledge of the geologic framework in the United States and to identify areas that may have the potential to contain critical mineral resources. Enhancement of our domestic mineral supply will decrease the Nation’s reliance on foreign sources of minerals fundamental to national security and the economy. USGS developed a new competitive cooperative agreement program with the State geological surveys to support mine waste activities authorized and funded by the BIL. State geological surveys apply for funds through an annual competitive agreement process. The Earth MRI Mine Waste Cooperative Agreements support three goals of the USGS-Earth MRI effort: 1) building a national mine waste inventory, 2) characterizing mine waste at sites across the nation, and 3) partnering with State geological surveys to plan Earth MRI data acquisition. Individual State projects last for up to two years.

Key Information

Abstract

The Case Service Report (RSA-911) is used to collect individual level data on State Vocational Rehabilitation (VR) program participants on a quarterly basis. The data collected in this report are mandated by section 101(a)(10) and 607 of the Rehabilitation Act of 1973 (Act) and section 116(d) of the Workforce Innovation and Opportunity Act. In addition, the Rehabilitation Services Administration (RSA) uses data reported through this collection to support its other responsibilities under the Act. Section 14(a) of the Act calls for the evaluation of programs authorized under the Act, as well as an assessment of the programs’ effectiveness in relation to cost. Many of these evaluations use RSA-911 data. RSA also uses data captured through the RSA-911 during the conduct of both the annual review and periodic on-site monitoring of VR agencies required by section 107 of the Act to examine the effectiveness of program performance. Other important management activities, such as the provision of technical assistance, program planning, and budget preparation and development, are greatly enhanced through the use of RSA-911 data. In addition, RSA uses RSA-911 data in the exchange of data under a data sharing agreement with the Social Security Administration and the U.S. Department of Health and Human Services as required by section 131 of the Act. Finally, the RSA-911 is considered to be one of the most robust databases in describing the demographics of the disabled population in the country and as such is used widely in researchers’ disability-related analyses and reports. The current RSA-911 expires on 05/31/2024, which occurs during Program Year 2023 (07/01/2023-06/30/2024). Because RSA must collect the same performance data for the entirety of a Program Year, RSA must begin Program Year 2024 with approval of this proposed revision in place. Thus, RSA is proposing to extend with revisions the RSA-911 for three years. If this revision is approved, VR agencies will collect and report data under this collection for Program Years 2024 through 2026. (07/01/2024-06/30/2027).

Abstract

The National Highway Traffic Safety Administration (NHTSA) is seeking approval from OMB of this information collection request (ICR) for an extension with modification of its currently approved information collection for the Automated Vehicle Transparency & Engagement for Safe Testing (AV TEST) initiative. This initiative involves the collection of information for a safety information sharing initiative for testing in the United States of vehicles equipped with Automated Driving System (ADS, commonly referred to as “AV”) technology. The voluntarily-provided information is collection on a digital platform on NHTSA’s website and published on NHTSA’s website to provide information about ADS testing to members of the public. The platform collects and provides information from States and local authorities about laws and guidelines for ADS operations and information about specific operations within the U.S. from ADS manufacturers and operators. The annual burden has been adjusted from 2,520 to 2,270 hours (a decrease of 250 hours). The adjustment in burden hours is due to the reduction in the number of participants. The number of participants is less than the original estimate. However, the agency believes the annual hours per respondent has not changed.

The federal credit union must obtain and have on file financial documentation demonstrating that the guarantor has the resources to meet the guarantee. If a manufacturer is involved, the federal credit union must review financial statements for the period that would establish a reasonable financial trend. If an insurance company is involved, it must have a major company rating of at least a B+. The federal credit union will use the information as part of the risk assessment process to analyze and evaluate the financial capabilities and resources of a party that guarantees the residual value used in a leasing arrangement.

Revenue Procedure 2023-1 explains how the Service provides advice to taxpayers on issues under the jurisdiction of the Associate Chief Counsel (Corporate), the Associate Chief Counsel (Financial Institutions and Products), the Associate Chief Counsel (Income Tax and Accounting), the Associate Chief Counsel (International), the Associate Chief Counsel (Passthrough and Special Industries), the Associate Chief Counsel (Procedure and Administration), and the Associate Chief Counsel (Tax Exempt and Government Entities). It explains the forms of advice and the manner in which advice is requested by taxpayers and provided by the Service. This information is required to evaluate and process the request for a letter ruling or determination letter. Rev. Proc. 2022-10 establishes an 18-month pilot program to provide an opportunity for fast-track processing of certain requests for letter rulings solely or primarily under the jurisdiction of the Associate Chief Counsel (Corporate). Rev. Proc. 2017-52 (1)introduces a pilot program expanding the scope of letter rulings available from the Internal Revenue Service (Service) to include rulings on the tax consequences of a distribution of stock and securities of a controlled corporation under § 355 for a specified period of time (see section 6 of this revenue procedure), (2) provides procedures for taxpayers requesting these rulings, and (3) clarifies procedures for taxpayers requesting rulings on significant issues relating to these transactions. The likely respondents are businesses or other for-profit institutions and tax exempt organizations.

Abstract

The FUTURE Act allows Federal Student Aid to receive customers’ federal tax information (FTI) from the Internal Revenue Service (IRS) through the Internal Revenue Code § 6103 for the purposes of administering the Free Application for Federal Student Aid (FAFSA®) form, and income-driven repayment (IDR) plans. Since customers will be required to provide consent for this process, we also need to provide an option for them to revoke consent. This is a request for a new information collection for the form which will allow individuals to revoke previous consent for FTI for the purposes of administration of title IV, Higher Education Act of 1965, as amended, student financial aid activities. The paper form is an alternative option to the web flow to revoke consent for the IDR application. There has been a change in the burden estimate. The revocation now only applies to IDR forms and the information is collected for no other purpose than to apply the applicants request to the IDR application and to keep it on file for any subsequent requests.

SelectUSA, within the International Trade Administration, provides programs and services that focus on facilitating job-creating business investment into the United States and raising awareness of the critical role that economic development plays in the U.S. economy. These programs include information products, services, and trade events to potential foreign investors into the United States and to U.S.-based economic development organizations. To accomplish its mission effectively, SelectUSA requires detailed information from clients in order to provide resources and services that meet each specific client’s needs. This information collection item allows ITA to solicit clients’ interest for the use of ITA products, services, and trade events. To promote optimal use and effective response to client needs through ITA services and programs, we are requesting approval for this clearance package; including: use of Comment Cards (i.e. transactional-based surveys) to collect input immediately prior to ITA assistance being provided to clients; use of multiple data collection methods (i.e. web-enabled surveys sent via email, telephone interviews, automated telephone surveys, and in-person surveys via mobile devices/laptops/tablets at trade events/shows) to enable clients to conveniently respond to requests for input; and a forecast of burden hours. Without this information, ITA is unable to systematically determine the actual and relative levels of user needs for its programs and products/services and to provide clear, actionable insights for client use. This information will be used for strategic planning, allocation of resources, and stakeholder reporting.

Environmental Education Local Grants Progress Report Form

Abstract

EPA proposes to collect information from this programs grant recipients. Specifically, EPA proposes to have all EE grantees use the progress report form, detailed in the Supporting Statement, when drafting their Quarterly Progress Reports and Final Reports. By requiring all EE Grantees to use the EE Local Grant Progress Report Form, EPA's Office of Environmental Education will be equipped to gather data on this grant programs outputs, outcomes, the total number of individuals reached, and the total number of under served communities reached. This information will help EPA ensure projects are on schedule to meet their goals and produce high quality environmental outputs. Additionally, requiring all EE grantees to submit their Quarterly and Final reports using the proposed form will allow EPA's Office of Environmental Education to accurately track and report the overall impact of this grant program as well as contribute to the Agency's Justice40 reporting requirements.
