What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Certification of Proper Cellar Treatment for Imported Natural Wine

Key Information

Abstract

Under the Internal Revenue Code (IRC) at 26 U.S.C. 5382(a)(3), importers of natural wine produced after December 31, 2004, must provide the Secretary of the Treasury with a certification, accompanied by an affirmed laboratory analysis, that the practices and procedures used to produce the wine constitute proper cellar treatment. That IRC section also contains alternative certification requirements or exemptions for natural wine produced and imported under certain international agreements, as well as for such wine imported by an owner or affiliate of a domestic winery. In addition, the Federal Alcohol Administration Act (FAA Act) at 27 U.S.C. 205 vests the Secretary with authority to prescribe regulations regarding the identity and quality of alcohol beverages. Under those authorities, the TTB wine labeling regulations in 27 CFR part 4 and its alcohol beverage import regulations in 27 CFR part 27 implement the proper cellar treatment certification requirement for imported natural wine.

Key Information

Abstract

The goal of the Standardized National Hypothesis Generating Questionnaire (SNHGQ) is to define a core set of data elements to be used for hypothesis generation once a given situation is determined to be a “multistate foodborne outbreak investigation”. The SNHGQ will be used by federal, state, and local public health officials responsible for conducting interviews with reported cases of enteric disease in their jurisdiction in order to systematically assess core exposure elements among cases of enteric disease during multistate investigations. Reinstatement changes include addition of new exposure questions of interest, deletion of exposure questions that do not need to be assessed, and re-wording of existing questions to better align with other OMB-approved questionnaires and to improve question comprehension.

Abstract

On May 12, 2020, the Commission adopted Amendment of Section 73.3580 of the Commission’s Rules Regarding Public Notice of the Filing of Applications; Modernization of Media Regulation Initiative; Revision of the Public Notice Requirements of Section 73.3580, Second Report and Order, MB Docket Nos. 17-254, 17-105, & 05-6, FCC 20-65 (rel. May 13, 2020). The Commission adopted new, streamlined procedures for stations to provide public notice of the filing of certain applications. Applicants, including applicants for assignment or transfer of control of authorizations for FM or TV translators or LPTV stations, that were previously required to post public notice in a local newspaper, must now post notice online, either on the station website or a website affiliated with the station, its licensee, or its parent entity, or else must post notice on a publicly accessible, locally targeted website, for 30 continuous days following acceptance of the application for filing. Stations that are required to make on-air announcements of the filing of certain applications, including an applicant for assignment or transfer of control of an LPTV station that locally originates programming, must continue to do so, but the announcements are shorter and direct viewers and listeners to the application as filed and displayed in either the station’s Online Public Inspection File or another Commission database. A total of six on-air announcements are required, at least one per week and no more than one per day or two per week, to be broadcast between 7:00 a.m. and 11:00 p.m. local time, Monday through Friday, beginning after the application is accepted for filing.

On March 24, 2017, the Federal Communications Commission released a Report and Order and Further Notice of Proposed Rulemaking, Promoting Technological Solutions to Combat Contraband Wireless Devices in Correctional Facilities, GN Docket No. 13-111, FCC 17-25 (Report and Order and Further Notice), in which the Commission took important steps to help law enforcement combat the serious threats posed by the illegal use of contraband wireless devices by inmates. Across the country, inmates have used contraband devices to order hits, run drug operations, operate phone scams, and otherwise engage in criminal activity that endangers prison employees, other inmates, and innocent members of the public. In the Report and Order, the Commission streamlined the process of deploying contraband wireless device interdiction systems – systems that use radio communications signals requiring Commission authorization – in correctional facilities. The action will reduce the cost of deploying solutions and ensure that they can be deployed more quickly and efficiently. In particular, the Commission waived certain filing requirements and provided for immediate approval of the spectrum lease applications needed to operate these systems.

The purpose of this project is to design and implement a comprehensive evaluation of the MCHB Autism CARES Act Initiative programs. The data will be used as follows: • Conduct performance monitoring of the programs. • Provide credible and rigorous evidence of program effectiveness. • Meet program needs for accountability, decision making, and quality assurance. • Strengthen the evidence base for best practices. Data collection instruments will include (1) surveys with the Research and State Systems grantees and (2) interview guides with all grantees (Research, State Systems, Training, and Resource Centers). Through the surveys, we will collect quantitative data on program activities and publications. Through the interviews, we will collect detailed qualitative data about the program activities and perceptions of successes, challenges, and barriers. The evaluation team will conduct individual or group semi-structured, in-depth interviews with the program directors and other grantee team members (if the program directors select additional team members for interviews). The data collection activities are summarized in table A.1. Information collected in the surveys will include quantitative data not included in available secondary sources. Through the interviews, the team will draw on the survey data and collect new, unique qualitative data about the programs.

Abstract

The CFTC requests approval for the renewal of the information collections associated with this Swap Recordkeeping regulations under OMB Clearance No. 3038-0090. The information collection obligations imposed by the “Adaptation of Regulations to Incorporate Swaps” regulations are necessary to implement section 721 of the Dodd-Frank Act, which amended the definitions of futures commission merchant (“FCM”) and introducing broker (“IB”) to permit these intermediaries to trade swaps on behalf of customers. They also are necessary to implement section 733 of the Dodd-Frank Act which introduced swap execution facilities (“SEFs”) as a new trading platform for swaps. As a result of the enactment of sections 721 and 733, the Commission amended certain recordkeeping regulations (1.31, 1.33, 1.35, 1.37, and 1.39) so that records of swap transactions are maintained analogously to how futures transactions are maintained. Further, the “Exclusion of Utility Operations-Related Swaps With Utility Special Entities From De Minimis Threshold for Swaps With Special Entities” regulation amended the Commission’s swap dealer definition to permit a person to exclude “utility operations-related swaps” with “utility special entities” in their de minimis threshold calculations. The regulation requires a person claiming the exclusion to maintain in accordance with Commission regulation 1.31 any written representations that the person receives form utility special entities related to this exclusion.

RSA-509, Annual Protection and Advocacy of Individual Rights Program Performance Report

Key Information

Abstract

The Annual Protection and Advocacy of Individual Rights (PAIR) Program Performance Report (Form RSA-509) will be used to analyze and evaluate the PAIR Program administered by eligible protection and advocacy (P&A) systems in states and the P&A serving the American Indian Consortium. These systems provide services to eligible individuals with disabilities to protect their legal and human rights. RSA uses the form to meet specific data collection requirements of Section 509(k) of the Rehabilitation Act of 1973 (Rehabilitation Act), as amended by Title IV of the Workforce Innovation and Opportunity Act (WIOA), 29 U.S.C. 794e(k), and its implementing Federal regulations at 34 C.F.R. § 381.32. The data reported by PAIR grantees using the form include demographic information about the individuals served, information describing the types of issues addressed through individual and systemic advocacy, and information about the results of these activities. PAIR grantees must report annually using the form that is due on or before December 30 each year. The collection of information through Form RSA-509 is necessary for RSA to furnish the President and Congress with data on the provision of PAIR services, as required by sections 13(a) and 509(k) of the Rehabilitation Act. Data reported by PAIR grantees through the RSA-509 have also helped RSA to establish a sound basis for future funding requests. RSA also uses data from the form to evaluate the effectiveness of eligible systems within individual States and the PAIR serving the American Indian Consortium in meeting annual priorities and objectives, pursuant to section 13(b) of the Rehabilitation Act. Last, RSA has found the RSA-509 data useful in projecting trends in the provision of services from year to year. Several respondents are private not-for-profit organizations. RSA included the respondents and the national organization that represents them (National Disability Rights Network (NDRN)) in the initial development of this collection of information in an effort to ensure that the information requested could be provided with minimal burden to the respondents.

These ICRs are typically conducted on an as-needed basis. The information in these ICRs consist of testing reports conducted by the entities and provided to enforcement personnel. The information within these ICRs may be requested by PHMSA for enforcement purposes. The purpose of these ICRs are to ensure that equipment used in the loading or unloading of liquid hazardous materials involving bulk packagings is done so in compliance with the Hazardous Materials Regulations (HMR) ensuring their safe transportation. Revisions to the ICRs within this control number were due to PHMSA going from one broad ICR to two ICRs in order to more accurately quantify the burdens under this OMB control number. During PHMSA’s review of the burden, it was noted that historically the information collections were grouped into a single collection. Following this review, PHMSA has adjusted this burden to eleven different information collections. Because of this adjustment, there has been a change to the number of respondents and responses.

Department of Health and Human Services (DHHS), National Institutes of Health (NIH), and National Cancer Institute (NCI) seek to obtain OMB approval to extend the Specimen Resource Locator (SRL) collection for an additional three (3) years. The availability of specimens and associated data is critical to increase our knowledge of cancer biology and to translate important research discoveries into clinical applications. The discovery and validation of cancer prevention markers require access, by researchers, to quality clinical biospecimens. In response to this need, the National Cancer Institute’s (NCI) Cancer Diagnosis Program has developed and is expanding a searchable database: Specimen Resource Locator (SRL). The SRL allows scientists in the research community and the NCI to locate specimens needed for their research. The SRL list non-commercial, either NCI or non-NCI-supported human biorepositories and their links. This administrative submission is an online form that collects information to manage and improve a program and its resources for the use of all scientists. This submission does not involve any analysis.

Abstract

The Child Abuse Prevention and Treatment Act (CAPTA) (42 U.S.C. 5101 et seq.) was amended in 1988 (P.L. 100–294) to direct the Secretary of Health and Human Services (HHS) to establish a national data collection and analysis program, which would make available state child abuse and neglect reporting information. HHS responded by establishing the National Child Abuse and Neglect Data System (NCANDS) as a voluntary national reporting system. During 1996, CAPTA was amended (42 U.S.C. 5106a(d)) to require all states that receive funds from the Basic State Grant program to work with the Secretary of HHS to provide specific data elements, to the maximum extent practicable, about children who had been maltreated. Most of the required data elements were added to the NCANDS data collection. Subsequent CAPTA reauthorizations and amendments added required data elements. The Children’s Bureau (CB) collects NCANDS data using two files of the Detailed Case Data Component (DCDC): (1) Child File, the case-level component of NCANDS and (2) Agency File, the aggregate data component. The current OMB expiration data for the DCDC is August 31, 2023. Through this request, CB is seeking an extension with no changes to this data collection.

FERC-1005, Credit Related Information Sharing Between RTOs/ISOs (Final Rule RM22-13-000)

Abstract

FERC issued the Final Rule in Docket No. RM22-13-000 discussing the need for RTOs/ISOs to share credit related information with each other. The credit related information sharing is intended to reduce the risk of liquidity failures amongst utilities. As described in the Final Rule, the Commission is proposing to revise section 35.47 of Title 18 of the Code of Federal Regulations to permit credit-related information sharing between organized wholesale electric markets. The rule does not create an information collection that is submitted to FERC, rather it permits the ability to share information between RTOs/ISOs, and directs RTOs/ISOs to update their tariff provisions. To do this, it will require RTOs/ISOs to update their tariff provisions to enable credit-related information sharing. The FERC 1005 collection is new and captures the burden calculations related to two collections. The first collection is a compliance filing from the RTOs/ISOs complying with the updates in their tariff provisions. The second is the ongoing burden associated with facilitating the information sharing between entities.

Abstract

This ICR is a renewal of mandatory reporting and record keeping. FMCSA is required to develop and establish minimum driver training standards for applicants for a commercial driver’s license (CDL) and/or certain CDL endorsements. These standards are found in 49 CR part 380, subparts F and G, and in five Appendices to part 380. The standards include two separate information collection actions: (1) Training providers must electronically submit information to FMCSA’s Training Provider Registry (TPR) to ensure that they meet the new training provider eligibility requirements and may therefore be listed on a new TPR; and (2) after an individual driver-trainee completes training administered by a training provider listed on the TPR, that training provider must electronically submit training certification information regarding the driver-trainee to the TPR. These FMCSA minimum training requirements for ELDT are intended to enhance the safety of CMV operations on our Nation’s highways. Therefore, this ICR supports the DOT Strategic Goal of Safety. The first portion of this ICR (IC-1), “Training Provider Registration,” collects information from each training provider for each of their training locations by means of the online TPR. The use of an electronic, online, web-based information system for this collection of information is expected to reduce burden on respondents. This information is collected when a training provider is first registering in the TPR, on a biennial basis thereafter, or otherwise when key information changes (training provider name, address, phone number, type(s) of training offered, training provider status, and, if applicable, any change in State licensure, certification, or accreditation status). The “Training Provider Registration” information is used by FMCSA to ensure that training providers meet the training provider eligibility requirements found in 49 CFR part 380, and can therefore be listed on the TPR. From the “Training Provider Registration” information submitted by training providers, certain basic identifying information (e.g., company name, location, contact information, etc.) and descriptive attributes regarding the training offered (e.g., which types of CDL and/or endorsement training are offered, etc.) by each training provider at each training location is made available to the public on the TPR website (unless the training provider chooses to not have this information displayed). This information is used by entry-level drivers looking for training. The second portion of this ICR, (IC-2) “Driver Training Certification,” collects information from training providers after driver-trainees complete training. This “Driver Training Certification” information is used by SDLAs to verify that the required driver training has been completed by the driver-trainee prior to the SDLA administering any skills or knowledge tests that require completion of training prior to their administration. The information collected from training providers is also used by the Agency to improve its understanding of the number of training providers and the types of training they provide, and the number of entry-level drivers and the types of training, CDLs, and endorsements that they obtain. Retrospective review of the data and of the safety performance of drivers that complete ELDT will allow FMCSA to better assess the impact of ELDT on motor carrier safety, and to monitor the effectiveness of individual training providers and identify those that may not be conducting training in compliance with the regulations and that may therefore be candidates for an on-site review by FMCSA. The use of an electronic, online, web-based information system for this collection of information is expected to reduce burden on respondents.
