Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

TD 8609 contains final regulations relating to gasohol blending and the tax on compressed natural gas (CNG). Abstract

This information collection requirement incorporates many reporting requirements established by various statutes, as discussed below. Federal regulations implementing the CFSP, APSR, and CFS-101 are codified at 45 CFR 1357.15. States, territories, and tribes are required to submit the CFSP, APSR, and CFS-101’s in order to receive funding under title IV-B, subparts 1 and/or 2 (section 422 of title IV-B, subpart 1 [42 U.S.C. 622] and section 432 of title IV-B, subpart 2 [42 U.S.C. 629b] of the Social Security Act (the Act) respectively.) A title IV-B reporting requirement for states, established by The Child and Family Services Act of 2006 (P.L.109-288, codified at section 424(e) of the Act) requires states to collect and report caseworker visit data for children under the care and responsibility of the state. The legislation requires states to report (1) the percentage of children in foster care under the responsibility of the state who were visited on a monthly basis by a caseworker; and (2) the percentage of the visits that occurred in the residence of the child. States and tribes, as applicable, that receive funding through the Child Abuse Prevention and Treatment Act (CAPTA), Chafee Foster Care Program for Successful Transition to Adulthood (the Chafee Program), and/or the Chafee Education and Training Vouchers (ETV) have additional reporting requirements that are incorporated into the CFSP, APSR, and CFS-101’s to ease the collection burden on grantees. Tribes are not eligible to receive funding under CAPTA and, therefore, do not have to meet its reporting requirements. CAPTA requires states to submit a CAPTA State Grant Program Plan that remains in effect for the duration of the state's participation in the grant program. The CAPTA plan is to be coordinated “to the maximum extent practicable” with the title IV-B state plan (section 106(b)(2)(A) of the CAPTA, as amended). States are also required to prepare and submit an annual report describing how the funds provided under CAPTA were used to address the purpose and achieve the objectives of the grant program (section 108(e)). In addition, section 477 of title IV-E of the Social Security Act [42 U.S.C. 677], authorizing the Chafee and ETV programs, requires the submission of a state/tribal program plan every five years describing how the state/tribe intends to “design and deliver programs to achieve the purposes of the section” (section 477(b) of the Act). In order to help states and tribes plan comprehensively for the full array of child welfare services and minimize the collection burden, applicants (states and tribes, as applicable) are required to report on the progress in achieving stated goals and service delivery under title IV-B, CAPTA, Chafee, and ETV in the CFSP and APSR (45 CFR 1357.15(a)). The CFSP and the CAPTA plans were consolidated in FY 2000 and the Chafee Foster Care Independence Program (Chafee) was incorporated in the CFSP beginning in FY 2001. ETV was added in FY 2004. The caseworker visit data requirement was added in 2007. The Children's Bureau (CB) believes this integrated approach reduces the burden on the state by allowing the state to submit one plan and to submit all plans on the same schedule. This approach encourages comprehensive planning and service delivery to children being served by the state’s child welfare system. Since June 2021, the CFSP/APSR submission has also included information on the use of the Family First Transition Grants and Funding Certainty Grants authorized by the Family First Transition Act included in Public Law (Pub. L.) 116–94. The current request includes minor revisions to the CFS-101 forms to streamline data entry and to update fields. The forms have been made Section 508 compliant, so checkboxes have been removed and form names have been re-formatted.

Operation Allies Welcome Afghan Supplement Survey

Key Information

Abstract

Under the Afghanistan Supplemental Appropriations Act, 2022, and Additional Afghanistan Supplemental Appropriations Act, 2022, Congress authorized the Office of Refugee Resettlement (ORR) to provide resettlement assistance and other benefits available to refugees to specific Afghan populations, in response to their emergency evacuation and resettlement. Section 412(a)(3) of the Immigration and Nationality Act (INA) (8 U.S.C. § 1522(a)(3)) requires that the Director of the ORR make a periodic assessment of the needs of refugees for assistance and services and the resources available to meet those needs. To meet INA requirements and ensure the relative needs of the populations ORR serves are assessed, ORR proposes the Operation Allies Welcome (OAW) Afghan Supplement Survey to collect relevant information from Afghan families who arrived in the United States between July 30, 2021 and December 16, 2022 under OAW, among which 95% are eligible for ORR services and assistance. ORR initially piloted this survey under the umbrella generic for Formative Data Collections for ACF Program Support (OMB #0970-0531) with a narrowed focus on assessing resettled OAW Afghans’ service needs and gaps, informing refinement and improvements to ORR’s programs and services, and identifying targeted training and technical assistance needs. ORR is now expanding the collection to reach additional respondents through this full information collection request and using a new survey instrument modeled on the most recent Annual Survey of Refugees (ASR) questionnaire (OMB #0970-0033) to generate nationally representative data on OAW Afghans’ well-being, integration outcomes and progress towards self-sufficiency. The new questionnaire will ensure additional topical areas reflect OAW Afghan arrivals’ specific needs and challenges during different resettlement phases.

Under the Affordable Care Act (ACA), and implementing regulations at 42 CFR, Medicare Advantage (MA) organizations and Prescription Drug Plan (PDP) sponsors are required to submit annual medical loss ratio (MLR) reports (at the contract level) to the Secretary of HHS concerning the amount spent on claims, quality improvement expenses, non-claims costs, Federal and State taxes, licensing and regulatory fees, and revenue. Plan sponsors must provide a remittance to the Secretary if the amount spent in a reporting year on certain costs compared to its revenue (excluding Federal and States taxes and licensing and regulatory fees) is below a certain ratio, referred to as the medical loss ratio (MLR). MA organizations and Part D sponsors are required to report their MLR to CMS, and are subject to financial and other penalties for a failure to meet a statutory requirement that they have an MLR of at least 85 percent. The Affordable Care Act requires several levels of sanctions for failure to meet the 85 percent minimum MLR requirement, including remittance of funds to CMS, a prohibition on enrolling new members, and ultimately contract termination. Plan sponsors will use the MLR Reporting Tool to provide contract-level MLR information to CMS. The information provided in this MLR Report is the basis for computing the contract's MLR percentage and remittance amount, if any, for a contract year.

Crash Causal Factors Program: Knowledge of Systems and Processes

Abstract

On November 14, 2021, the President signed into law the Infrastructure Investment and Jobs Act (IIJA, Public Law No: 117-58), which contains requirements for a larger study under Section 23006, “Study of Commercial Motor Vehicle Crash Causation.” To meet the requirements of Section 23006, FMCSA is establishing a CMV Crash Causal Factors Program. Through this program, FMCSA will execute a multi-phased CMV Crash Causal Factors Study, with Phase 1 focused on fatal crashes involving Class 7/8 large trucks. This study is mandatory reporting. To plan and execute this study, FMCSA must collect information from the States and local jurisdictions to understand their interest or ability to participate in the study; existing crash data collection processes, systems, and resources; and CMV enforcement funding mechanisms and sources. This information collection (IC) will help the Agency understand what necessary study data are already being collected by the States. This IC will collect data from Federal and State (and local) highway and motor carrier safety programs. Study findings will ultimately inform the identification and development of countermeasures to prevent crashes involving CMVs. As part of the CMV Crash Causal Factors Program, this information collection supports the DOT Strategic Goal of Safety. FMCSA is in the process of establishing an interagency agreement with the USDOT Volpe Center to collect the majority of the information associated with this ICR. Under FMCSA guidance, trained Volpe Center support staff will develop the survey questions, develop and administer the web-based survey for each IC, and analyze the collected information. Information collected under these four ICs will inform various elements of the study plan, including the sample design, data collection plans, participation agreements, resourcing plans, and development of the study database. This ICR does not need a Part B supporting statement because the ICR does not use statistical methodology. This ICR will collect information that will help inform the sampling plan. That study design/sampling plan will then be a whole new ICR of its own, which will need a Part B because it will then show what/how much data will be collected to get a nationally representative sample.
