What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

This information collection requirement incorporates many reporting requirements established by various statutes, as discussed below. Federal regulations implementing the CFSP, APSR, and CFS-101 are codified at 45 CFR 1357.15. States, territories, and tribes are required to submit the CFSP, APSR, and CFS-101’s in order to receive funding under title IV-B, subparts 1 and/or 2 (section 422 of title IV-B, subpart 1 [42 U.S.C. 622] and section 432 of title IV-B, subpart 2 [42 U.S.C. 629b] of the Social Security Act (the Act) respectively.) A title IV-B reporting requirement for states, established by The Child and Family Services Act of 2006 (P.L.109-288, codified at section 424(e) of the Act) requires states to collect and report caseworker visit data for children under the care and responsibility of the state. The legislation requires states to report (1) the percentage of children in foster care under the responsibility of the state who were visited on a monthly basis by a caseworker; and (2) the percentage of the visits that occurred in the residence of the child. States and tribes, as applicable, that receive funding through the Child Abuse Prevention and Treatment Act (CAPTA), Chafee Foster Care Program for Successful Transition to Adulthood (the Chafee Program), and/or the Chafee Education and Training Vouchers (ETV) have additional reporting requirements that are incorporated into the CFSP, APSR, and CFS-101’s to ease the collection burden on grantees. Tribes are not eligible to receive funding under CAPTA and, therefore, do not have to meet its reporting requirements. CAPTA requires states to submit a CAPTA State Grant Program Plan that remains in effect for the duration of the state's participation in the grant program. The CAPTA plan is to be coordinated “to the maximum extent practicable” with the title IV-B state plan (section 106(b)(2)(A) of the CAPTA, as amended). States are also required to prepare and submit an annual report describing how the funds provided under CAPTA were used to address the purpose and achieve the objectives of the grant program (section 108(e)). In addition, section 477 of title IV-E of the Social Security Act [42 U.S.C. 677], authorizing the Chafee and ETV programs, requires the submission of a state/tribal program plan every five years describing how the state/tribe intends to “design and deliver programs to achieve the purposes of the section” (section 477(b) of the Act). In order to help states and tribes plan comprehensively for the full array of child welfare services and minimize the collection burden, applicants (states and tribes, as applicable) are required to report on the progress in achieving stated goals and service delivery under title IV-B, CAPTA, Chafee, and ETV in the CFSP and APSR (45 CFR 1357.15(a)). The CFSP and the CAPTA plans were consolidated in FY 2000 and the Chafee Foster Care Independence Program (Chafee) was incorporated in the CFSP beginning in FY 2001. ETV was added in FY 2004. The caseworker visit data requirement was added in 2007. The Children's Bureau (CB) believes this integrated approach reduces the burden on the state by allowing the state to submit one plan and to submit all plans on the same schedule. This approach encourages comprehensive planning and service delivery to children being served by the state’s child welfare system. Since June 2021, the CFSP/APSR submission has also included information on the use of the Family First Transition Grants and Funding Certainty Grants authorized by the Family First Transition Act included in Public Law (Pub. L.) 116–94. The current request includes minor revisions to the CFS-101 forms to streamline data entry and to update fields. The forms have been made Section 508 compliant, so checkboxes have been removed and form names have been re-formatted.

Abstract

State and tribal title IV-E agencies are required to report Adoption and Foster Care Analysis and Reporting System (AFCARS) case-level information on all children in foster care and children who have been adopted or placed in a guardianship with title IV-E agency involvement. AFCARS is a data collection system for national adoption and foster care data authorized under section 479 of the Social Security Act (the Act). Section 479(c)(3)(A) of the Act requires the collection of comprehensive national information with respect to the demographic characteristics of children in foster care and those who are adopted with state involvement and their biological, foster, and adoptive parents. The regulation at 45 CFR 1355 sets forth the requirements of the Act for the collection of uniform, reliable information on children who are under the responsibility of the state or tribal title IV-B/IV-E agency for placement, care, guardianship, and adoption. States have been required to submit the AFCARS data since 1993. Tribes that operate a title IV-E program have been required to submit AFCARS data since 2012. The regulations were updated via the final rule published in May 2020 (85 FR 28410). The new regulations expanded the paradigm of data to be reported, revised some of the current data elements, and added some new elements. Those changes were incorporated previously; this request is for an extension with no changes.

Discharge Monitoring Report-Quality Assurance (DMR-QA) study program participation is mandatory for major and selected minor National Pollutant Discharge Elimination System (NPDES) permit holders in accordance with Clean Water Act Section 308. The DMR-QA study program is designed to evaluate the analytic ability of laboratories that perform chemical, microbiological and whole effluent toxicity (WET) analyses required in NPDES permits for reporting results in the Discharge Monitoring Reports (DMR). Under DMR-QA, the permit holder is responsible for having their in-house and/or contract laboratories analyze performance evaluation samples and submit results to proficiency testing (PT) providers for grading. Graded results are transmitted by either the permit holder or PT provider to the appropriate federal or state NPDES permitting authority. Permit holders are responsible for submitting corrective action reports to the appropriate permitting authority.

Abstract

While rail carriers are no longer required to file rate tariffs at the STB, a statutory requirement exists for water carriers that provide freight transportation in noncontiguous domestic trade (i.e., domestic, as opposed to international, shipments moving to or from Alaska, Hawaii, or the U.S. territories or possessions (Puerto Rico, Guam, the Virgin Islands, American Samoa, and the Northern Mariana Islands)). A tariff provides a list of prices and fees that the carrier charges to the shipping public. These tariffs may be filed electronically. The final rule will now allow water carriers to use (a) their usual business internet postings of their tariffs and (b) the filing of an annual certificate with the Board to meet their filing responsibilities.

Abstract

This submission is being made to the Office of Management (OMB) for the continuous approval of information collection requirements contained in the Commission’s Incentive Auction R&O, which adopted rules for holding an Incentive Auction, as required by the Middle Class Tax Relief and Job Creation Act of 2012 (Spectrum Act). The Spectrum Act directed the Commission to hold a “reverse auction” in which broadcasters can voluntarily return some or all of their broadcast spectrum usage rights in exchange for incentive payments. The Spectrum Act also required the Commission to reorganize the broadcast television band, which will be accomplished by repacking stations, or moving broadcast stations to different channels. The Spectrum Act directed the Commission to hold a forward auction of the ultra-high frequency (UHF) spectrum obtained as a result of the reverse auction and channel repacking, to be auctioned as flexible-use licenses suitable for providing mobile broadband service.
