What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Abstract

Since 1982, the Bureau of Justice Statistics (BJS) has conducted the Annual Survey of Jails (ASJ) under OMB Control No. 1121-0094 in the years between the Census of Jails collections (COJ, OMB Control No. 1121-0100) to gather data on jail inmate populations. Administered to a sample of approximately 940 local jails nationwide, the ASJ provides national estimates on the number of persons confined in jails, the number of persons jails supervised in programs outside jail, characteristics of the jail population, counts of admissions and releases, and number of staff employed. The ASJ is the only national data collection that tracks jail population size and characteristics from year to year. Policymakers, correctional administrators, and government officials use the ASJ data to develop new policies and procedures, plan budgets, and maintain critical oversight. The Bureau of Justice Statistics (BJS) requests clearance to conduct the 2023 and 2025 Annual Survey of Jails (ASJ) under OMB Control No. 1121-0094. The last ASJ was fielded in 2022 and collected midyear data. It was approved under the same OMB Control No. 1121-0094 with an expiration date of 06/30/2023. In 2024, BJS plans to conduct the COJ and will not field the ASJ in the same year.

Abstract

Under the authority of chapter 51 of the Internal Revenue Code of 1986, as amended (IRC, 26 U.S.C. chapter 51), the Alcohol and Tobacco Tax and Trade Bureau (TTB) regulations in 27 CFR Part 25, Beer, require brewers to place certain marks, signs, and measuring devices on their equipment and structures, and to place certain brands, labels, and marks on bulk and consumer containers of beer and other brewery products. The required information allows TTB to identify the use, capacity, and contents of brewery equipment and structures, as well as identify taxable brewery products and the responsible taxpayer. As such, the required information is necessary to protect the revenue and ensure effective administration of the IRC’s provisions regarding brewery operations and products. The required information also allows other industry members and the general public to identify the contents of bulk and consumer containers of beer and other brewery products. However, TTB believes the placement by brewers of the required information on their equipment and structures, and on their bulk and consumers containers of beer and other brewery products is a usual and customary practice undertaken during the normal course of business, regardless of any TTB regulatory requirements to do so, for the purposes of inventory control, cost accounting, equipment utilization, and product identification.

Key Information

Abstract

In recent years, certain amendments were made to the Internal Revenue Code (IRC) by the Taxpayer Certainty and Disaster Tax Relief Act of 2020 (Tax Relief Act; Division EE of Pub. L 116–260), which amended the Craft Beverage Modernization Act (CBMA) provisions of the Tax Cuts and Jobs Act of 2017 (sections 13801–13808 of Pub. L. 115–97). In summary, the Tax Relief Act transferred responsibility for administering CBMA provisions regarding reduced excise tax rates on imported distilled spirits and beer and expanded tax credits on imported wine (hereafter “CBMA tax benefits”) from U.S. Customs and Border Protection (CBP) to the Department of the Treasury, effective January 1, 2023. In addition, under the Tax Relief Act, U.S. alcohol beverage importers will no longer be eligible for CBMA tax benefits at the time of entry. Rather, importers will be required to pay the full excise tax rate to CBP, and they will subsequently submit refund claims to Treasury to receive their assigned CBMA tax benefits for entries made after January 1, 2023. Specifically, with respect to the CBMA tax benefits available to U.S. importers, the IRC amendments codified at 26 U.S.C. 5001(c), 5041(c), and 5051(a) state that an importer will only be allowed CBMA tax benefits refund if a foreign producer has elected to assign, and the importer has elected to receive, such benefits in accordance with regulations and procedures issued by the Secretary of the Treasury (the Secretary). In addition, 26 U.S.C. 6038E authorizes the Secretary to require foreign producers seeking to make CBMA tax benefit assignments to provide information, including information about the control group structure of the foreign producer, as required by regulation. Under those amended IRC authorities, and authorities delegated to the Alcohol and Tobacco Tax and Trade Bureau (TTB) under Treasury Orders 120–01, 101–05, and 111–02, TTB issued temporary regulations establishing procedures for alcohol industry members to take advantage of the CBMA tax benefits that may be applied to specified limits of imported alcohol beverage products entered for consumption in the United States beginning on January 1, 2023 (see T.D. TTB-186, September 23, 2022, 87 FR 58021). The new regulations are contained in 27 CFR, Part 27, Importation of Distilled Spirits, Wines, and Beer, Subpart P, Craft Beverage Modernization Act Import Refund Claims. In particular, the new regulations establish the procedures by which (1) Foreign producers may assign CBMA tax benefits to U.S. importers (see § 27.254 through § 27.262), and (2) U.S. importers may elect to receive those assignments and submit their CBMA tax benefit refund claims to TTB (see §§ 27.264 and 27.266). This information collection request is required to ensure that the IRC provisions regarding alcohol excise taxes, including CBMA tax benefits, are appropriately applied, which is necessary to protect the revenue.

Data Security Requirements for Accessing Restricted Data

Abstract

The Foundations for Evidence-Based Policymaking Act of 2018 (44 U.S.C. 3583) mandates that the Director of the Office of Management and Budget (OMB) establish a standard application process (SAP) for requesting access to certain confidential data assets. While the adoption of the SAP is required for statistical agencies and units designated under the Confidential Information Protection and Statistical Efficiency Act of 2018 (CIPSEA), it is recognized that other agencies and organizational units within the Executive Branch may benefit from the adoption of the SAP to accept applications for access to confidential data assets. The SAP is to be a process through which agencies, the Congressional Budget Office, State, local, and Tribal governments, researchers, and other individuals, as appropriate, may apply to access confidential data assets held by a federal statistical agency or unit for the purposes of developing evidence. With the Interagency Council on Statistical Policy (ICSP) as advisors, the entities upon whom this requirement is levied are working with the SAP Project Management Office (PMO) and with OMB to implement the SAP. The SAP Portal is to be a single web-based common application designed to collect information from individuals requesting access to confidential data assets from federal statistical agencies and units. BJS makes the microdata it is required to protect as confidential available to approved researchers through a restricted access setting via its official criminal justice data archive. As a Federal Statistical Agency, BJS adheres to the SAP requirements and BJS restricted (confidential) microdata are available for discovery and application via the SAP Portal. In late 2022, the National Center for Science and Engineering Statistics (NCSES), in its role as the SAP PMO, published a 60-day Federal Register Notice (87 FR 53793) and 30-day Federal Register Notice (87 FR 66754) announcing plans to collect information through the SAP Portal. This collection request was submitted to the OMB as a Common Form in late 2022; the OMB control number for SAP Portal information collection is 3145-0271 and the expiration date is 12/31/2025.

Abstract

The U.S. Office of Government Ethics (OGE) is the supervising ethics office for the executive branch under the Ethics in Government Act of 1978 (EIGA). OGE recently published a rule to establish a framework to govern an executive branch employee’s acceptance of both payments for legal expenses through a Legal Expense Fund (LEF) and pro bono legal services for matters arising in connection with the employee’s official position, the employee’s prior position on a campaign of a candidate for President or Vice President, or the employee’s prior position on a Presidential Transition Team (LEF regulation). The requirements for establishing and maintaining a LEF are found in 5 CFR part 2635, subpart J. In fulfilling the regulatory requirements, employee beneficiaries of a LEF must first submit a trust document for approval by their employing agency, and in some cases by OGE. The LEF funds must be administered by an independent trustee. Employee beneficiaries (through their trustees) must also submit quarterly and termination reports regarding the funds collected and disbursed by the legal expense fund. Information for these reports will in turn be collected from (1) donors who contribute to the legal expense fund for the payment of legal expenses and (2) payees who receive payments distributed from the legal expense fund. Together, this information collection (IC) is titled “OGE Legal Expense Fund Information Collection.”

Corps Water Infrastructure Financing Program (CWIFP) Applications

Abstract

The authority for the U.S. Army Corps of Engineers (USACE) CWIFP is Subtitle C of Title V of the Water Resources Reform and Development Act of 2014 (WRRDA), which is referred to as the Water Infrastructure Finance and Innovation Act of 2014 (WIFIA, see also at 33 U.S.C. 3901–3914). 33 U.S.C. 3904 specifies that entities such as corporations, partnerships, joint ventures, trusts, state infrastructure financing authorities, and tribal, state, or local government entities are eligible to receive federal credit assistance under WIFIA. As described in the Final rule (“Credit Assistance and Related Fees for Water Resources Infrastructure Projects”, RIN 0710-AB31) at 33 CFR Part 386, USACE CWIFP involves two sequential collections for eligible entities seeking federal credit assistance: ENG Form 6176, “CWIFP Preliminary Application,” and ENG Form 6177, “CWIFP Application." The Preliminary Application collection is required to validate the eligibility of the prospective borrower and the proposed project, perform a preliminary creditworthiness assessment, perform a preliminary engineering and environmental feasibility assessment, and evaluate the project against the selection criteria and identify which projects USACE will invite to submit a Final Application. The Preliminary Application addresses the CWIFP eligibility criteria, CWIFP selection criteria, and identifies other specific information that must be provided to USACE to be considered for credit assistance. Based on evaluation of the Preliminary Application, USACE will identify those eligible projects which are likely to proceed to closing and invite the prospective borrowers to submit a Final Application. Only those entities who are invited by USACE to submit a Final Application should proceed to complete ENG Form 6177. The Final Application collection is required to provide the information needed to assess the creditworthiness of both the applicant and project, identify the project’s engineering and financial risk, negotiate the terms and conditions of the credit assistance, and calculate the amount of budget authority that will be needed to fund the project(s).

Abstract

The EPA recently developed the Underground Storage Tank (UST) Finder application (hereafter UST Finder). UST Finder is a publicly available web map application containing a comprehensive, state- sourced national map of UST and leaking underground storage tank (LUST) data. UST Finder is available via EPAs GeoPlatform at https:// gispub.epa.gov/ustfinder. UST Finder provides users access to information on the attributes and locations of active and closed USTs, UST facilities, and LUSTs in states in a geographic information system (GIS) environment. This information collection relates to information that state and territorial agencies already collect from UST and LUST owners and operators as part of their customary business practice to manage their compliance and enforcement programs. To successfully implement, maintain, and improve the data quality and usability of UST Finder, the Agency seeks to gather, on a voluntary basis, information from state and territorial agencies that oversee UST/LUST programs. Specifically, EPA will request that these agencies provide location and other relevant data about USTs and LUSTs that is already being collected and managed by states and territories. This information collection is voluntary and does not require the agencies to collect additional data on USTs/LUSTs beyond the data elements that are already being collected through their previously implemented programs. States and territories will decide the extent of information to be provided. The EPA intends to implement four options for collecting the UST/LUST data from states and territories: (1) by developing an Exchange server or other automated service through which states can push their data to the EPA, (2) by developing a link to the agencies pre-existing electronic service used to maintain public websites such that the EPA can pull the data, (3) by allowing states and territories to submit existing databases or spreadsheets through an approved file sharing method, or (4) by EPA obtaining publicly available data from state and territory public agency websites (an option that will be exercised if states and territories do not voluntarily submit their data). For all data transfer options, the EPA will standardize, curate, and enter records into the UST Finder application.

Abstract

The COVID-19 pandemic led to substantial unfinished learning in math and an important debate about how best to address it. Traditionally, policymakers and educators have advocated a "broad foundation skill building" approach, but an alternative "just-in-time skill building" approached has received more attention recently, including in the U.S. Department of Education's COVID-19 Handbook. But there is limited evidence comparing these approaches. This evaluation will examine the effectiveness of adaptive technology products that deliver these two catch-up strategies in elementary schools, where teachers often struggle with how to teach math well and the benefits of using technology supports are understudied. The findings will provide valuable evidence, especially for low-performing schools identified under the Every Student Succeeds Act and their most underserved students. Enhancing HIV Care of Women, Infants, Children and Youth Building Capacity through Communities of Practice

Abstract

HRSA aims to increase delivery of evidence-based interventions that enhance client outcomes, increase the skill level of the HIV workforce providing care and treatment to Women, Infants, Children and Youth (WICY), and involve partnerships for dissemination of best practices to Ryan White HIV/AIDS Program (RWHAP) Part D participants. To that end, HRSA seeks to implement a Communities of Practice (CoP) platform for RWHAP Part D recipients. A CoP engages recipient teams in improvement learning sessions using subject matter experts along with application experts who help recipient teams select, test and implement changes on the front line of care. Through organizational self-assessments, didactic learning on specific care topics, goals setting and work plan development, each team can strategically benefit their organization. CoPs afford participants the opportunity to work in a group to solve a recognized challenge related to a CoP domain and support dialogue among participants and the consultant/subject matter experts. Recipient teams commit to working over a period of 12 months, alternating between Learning Sessions in which teams come together to learn about the chosen topic and to plan changes, and Action Periods in which the teams return to their respective organizations and test those changes in their clinic settings. The domains for the proposed CoPs are trauma informed care, pre-conception counseling and youth transitioning into adult HIV care services.

Abstract

Section 103(h) of the Federal Mine Safety and Health Act of 1977 (Mine Act), 30 U.S.C. § 813, authorizes MSHA to collect information necessary to carry out its duty in protecting the safety and health of miners. Title 30 C.F.R. § 77.1900 requires underground coal mine operators to submit for approval a plan that will provide for the safety of workmen in each slope or shaft that is commenced or extended from the surface to the underground coal mine. Each slope or shaft sinking operation is unique in that each operator uses different methods and equipment and encounters different geological strata which make it impossible for a single set of regulations to ensure the safety of the miners under all circumstances. This makes an individual slope or shaft sinking plan necessary. The plan must be consistent with prudent engineering design. Plans include the name and location of the mine; name and address of the mine operator; a description of the construction work and methods to be used in construction of the slope or shaft, and whether all or part of the work will be performed by a contractor; the elevation, depth and dimensions of the slope or shaft; the location and elevation of the coalbed; the general characteristics of the strata through which the slope or shaft will be developed; the type of equipment which the operator proposes to use; the system of ventilation to be used; and safeguards for the prevention of caving during excavation.

The information collection activities will occur primarily at the program level through the State Capitalization Grant Agreement / Intended Use Plan, Biennial Report, the Drinking Water National Information Management System (DWNIMS) and the Project & Benefits Reporting (PBR) System. The information on the Intended Use Plan (IUP) is needed annually to describe how the State intends to use available Drinking Water State Revolving Fund (DWSRF) funds for the year to meet the objectives of the Safe Drinking Water Act (SDWA) and to further the goal of protecting public health. The Biennial Report is needed to provide detailed information on how the State met its goals and objectives of the previous two fiscal years as stated in the IUP and grant agreement. The SDWA requires this information to ensure the national accountability, adequate public review and comment, fiscal integrity, and consistent management needed to achieve public health and SDWA compliance objectives. To ensure expeditious and timely use of the Fund, financial data must be collected annually through DWNIMS. Project level data will be collected on a quarterly basis using the PBR System to ensure SDWA eligibility and assess public health results from DWSRF projects.

Abstract

The foundation to our understanding of wildlife hazards to aviation lies in the quantity and quality of strike data within the National Wildlife Strike Database (NWSD). The database extends from 1990 - 2023 and is a collaborative effort begun in 1995 between the FAA and the USDA. Although the quantity of strikes reported each year over three decades has grown significantly, the quality assurance provided by the USDA is the keystone allowing the NWSD to be invaluable throughout the aviation industry. Pilots, airports, and others involved in wildlife strikes report strike data voluntarily on an as needed basis. The data collection is used by the FAA, USDA Wildlife Service, airports, engine and airframe manufacturers, ICAO and foreign countries to develop standards to address bird and other wildlife hazards to aircraft and injury to personnel and to develop wildlife habitat control methods on or adjacent to airports. Using wildlife strike reports, the FAA can determine the hazard level of species struck, track national trends, and provide a scientific foundation for regulatory guidance concerning mitigation of risks from wildlife strikes. Airports and wildlife biologists use the data to identify and mitigate hazardous species, to identify strike dynamics and attractants, and to evaluate the effectiveness of their wildlife management programs. Engine and airframe manufacturers use the data to evaluate the effectiveness of aircraft components. A wildlife strike report must include the incident date and time but can also include information about the airport, aircraft, aircraft operator, environmental conditions, damage, costs, effect on flight, wildlife involved, and incident reporter. Reporters can also attach photographs of damage and wildlife involved. The data elements collected help the FAA and partner organizations identify trends in wildlife strikes and their impact on U.S. aviation. Incident reporter contact information is collected for internal use only to contact reporters if more details about an incident are needed and to help identify potential duplicate reports. The information collected is authenticated and stored electronically in the FAA National Wildlife Strike Database (https://wildlife.faa.gov/home). This database is accessible to international, national, state, and local governments and both public and private organizations and individuals for use in addressing the wildlife aircraft strike issue. The FAA Wildlife Hazard Program, managed by the Office of Airports and the Airport Technology Research & Development Branch, will retain control over the information and safeguard it from improper access, modification, and destruction, consistent with FAA standards for confidentiality, privacy, and electronic information. The information collection is designed to yield data that meet all applicable information quality guidelines.
