What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

TSA Canine Training Center Adoption Application

Abstract

The TSA Canine Program is a Congressionally-mandated program that operates pursuant to section 110(e)(3) of the Aviation and Transportation Security Act (ATSA), Pub. L. 107-71 (115 Stat. 597, Nov. 19, 2001); and the Implementing Recommendations of the 9/11 Commission Act of 2007, Pub. L. 110-53 (121 Stat. 266, Aug. 3, 2007). The TSA Canine Program developed the TSA CTC to train and deploy explosive detection canine teams to Federal, State, and local agencies in support of daily activities that protect the transportation domain. TSA created the TSA CTC Adoption Program under the authority of 41 CFR 102-36.35(d) and 102–36.365 to find suitable individuals or families to adopt and provide good homes to canines who do not graduate from the training program. Individuals seeking to adopt a TSA canine must complete the TSA CTC Adoption Application. This collection of information allows the TSA CTC to collect personal information from the applicants to determine their suitability to adopt a TSA canine.

Postmarketing Adverse Drug Experience Reporting

Key Information

Abstract

FDA regulations require the reporting to FDA of important adverse drug experience information associated with the use of unapproved-marketed prescription drug product. This information is used by FDA to determine at the earliest possible time whether to request a manufacturer, packer, or distributor to recall a product from the market or to recommend a seizure or injunction action to halt the marketing of the product and to remove it from the market. Such action, initiated promptly, may avert further adverse effects that may be associated with the use of the product.

Experimental Aircraft: Letters of Deviation Authority (LODA)

Abstract

In 2004, the FAA established a Letter of Deviation Authority (LODA) process for operators who advertise or “hold out” their experimental aircraft for use in training, testing or checking in exchange for compensation. See 69 Fed. Reg. 44771 (July 27, 2004). To obtain a LODA, the operator must submit an application to the FAA that includes airworthiness and maintenance records, and an aircraft-specific training outline at least 60 days in advance of the first training operation. The FAA uses this collection of information to ensure that operators of an aircraft with an experimental airworthiness certificate who broadly offer their aircraft for training, testing or checking follow appropriate safety precautions. Application is made to the FAA electronically by email, fax, in-person delivery, or mail, to the responsible FAA Flight Standards District Office. This requirement applies to the registered aircraft owner seeking to conduct operations through deviation authority, or their agent. Importantly, the LODA requirement in this information collection does not apply to owners (and those affiliated with owners) of experimental aircraft who receive training, testing or checking in their own aircraft. On July 12, 2021, in response to a court ruling, the FAA issued a “Notification of Policy for Flight Training in Certain Aircraft” in the Federal Register (86 FR 36493) that established a shortened, email LODA requirement for owners of experimental aircraft who receive training, testing or checking in their own aircraft. However, the National Defense Authorization Act (NDAA) of 2023 eliminated this requirement. The FAA no longer requires owners of experimental aircraft to apply for a LODA to receive training, testing or checking in their own aircraft.

Abstract

Individuals of designated experimental populations for species listed as threatened or endangered under the Endangered Species Act (ESA) (16 U.S.C. 1531 et seq.) are categorically protected. Documentation of human-related mortalities, recovery of dead specimens, animal husbandry actions necessary to manage the population, and other types of take related to the status of experimental populations is important for monitoring the success of reintroduction efforts and recovery efforts in general. To minimize potential conflict with humans that could undermine recovery efforts, livestock depredations connected with experimental populations of listed species require prompt attention for purposes of determining the location, timing, and nature of the predatory behavior involved, accurate determination of the species responsible for a livestock kill, and the timely application of necessary control measures. The information collection requirements are in 50 CFR 17.84.

Abstract

This collection encompasses a mandatory recordkeeping requirement, requiring aircraft owners or operators to keep records of compliance with any applicable safety directives issued to an aircraft that has a special airworthiness certificate in the light-sport category (SLSA). Collection frequency is on an as-needed basis. On occasion, an SLSA manufacturer will issue Safety Directives to correct unsafe conditions on their aircraft. Owners or operators must comply with the instructions of the safety directive, record compliance, and retain that record or compliance. The information required to be recorded and retained within the SLSA aircraft records includes the following: • The method of compliance, • The safety directive number and revision date. • If the safety directive involves recurring action, the time and date when the next action is required. Respondents include SLSA owners, operators, mechanics, and SLSA repairmen. The information collected as described within this ICR, is used by FAA safety inspectors, aircraft owners, and aircraft maintenance personnel to determine if the aircraft is safe for flight, prior to operation of the SLSA. The information is also used by FAA aviation safety inspectors and FAA designees to determine if the aircraft can be issued an airworthiness certificate, and by the FAA and National Transportation Safety Board (NTSB) when investigating accidents to determine if there were any known unsafe conditions that contributed to the cause of the accident. The information collected is not disseminated directly to the public. The records of SLSA safety directive compliance are retained by the aircraft owner/operator. The owner/operator must keep the records for the life of the SLSA aircraft and transfer them to the new owner at the time the aircraft is sold. The owner or operator must make the records available for inspection by the Administrator or any authorized representative of the NTSB.

Abstract

The Ocean Shipping Reform Act of 2022 (OSRA 2022) includes the following language, ‘‘The Federal Maritime Commission shall publish on its website a calendar quarterly report that describes the total import and export tonnage and the total loaded and empty 20-foot equivalent units per vessel (making port in the United States, including any territory or possession of the United States) operated by each ocean common carrier covered under this chapter. Ocean common carriers under this chapter shall provide to the Commission all necessary information, as determined by the Commission, for completion of this report.’’ 46 U.S.C. 41110. The FMC will request information on containerized imports and exports from each identified common carrier on a monthly basis. The data elements will include both tonnage and empty and laden 20-foot, 40-foot, and 45-foot containers discharged and loaded. The scope will include each port of call on service strings that include U.S. calls by vessel-operating common carriers operating in the U.S. foreign oceanborne commerce. The information will be used to compile and publish a quarterly report on total U.S. export and import tonnage deployed and total loaded and empty 20-foot equivalent units per vessel operated by vessel-operating common carriers. The universe will be vessel operating common carriers that transport 1,500 or more 20-foot equivalent units per month (total across imports and exports, regardless of whether they are laden or empty) in or out of the U.S., in the U.S. oceanborne foreign commerce. Abstract

14 CFR Part 212 provides a mechanism for a foreign air carrier to obtain Department of Transportation (DOT) permission, in the form of a ‘statement of authorization,’ to operate certain types of charter operations that are not encompassed in the bilateral aviation agreement that may exist between the United States and that foreign air carrier’s homeland, or a number of other charter types. The information collected is used to determine if foreign air carriers applying for statements of authorization meet the public interest requirements necessary to approve such applications. Abstract

The National Technical Information Service (NTIS) Limited Access Death Master File Accredited Conformity Assessment Body Application for Firewalled Status (Firewalled Status Application Form) is used to collect information related to the implementation of Section 203 of the Bipartisan Budget Act of 2013 (Pub. L. 113-67) (Act). Section 203 of the Act prohibits disclosure of Limited Access Death Master File (Limited Access DMF) information during the three-calendar-year period following death unless the person requesting the information has been certified under a program established by the Secretary of Commerce. The Act directs the Secretary of Commerce to establish a certification program for such access to the Limited Access DMF. The Secretary of Commerce delegated the authority to carry out the DMF certification program to the Director, NTIS.
