Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Executive Order 12862 directs Federal agencies to provide service to the public that matches or exceeds the best service available in the private sector. In order to work continuously to ensure that our programs are effective and meet our customers' needs, Department of Homeland Security/U.S. Citizenship and Immigration Services seeks to obtain OMB approval of a generic clearance to collect qualitative feedback on our service delivery. USCIS has an operational need for an online request tool that people who have filed immigration benefit requests with USCIS can use to request certain actions that do not require submission of a full benefit request and fee. This collection contains six options: • Case outside of normal processing time: This tool allows individuals whose cases have been pending with USCIS longer than the normal processing time to inquire with USCIS as to its status. • Did not receive notice by mail: This tool allows individuals who did not receive a mailed notice to report that to USCIS and request a notice. • Did not receive card by mail: This tool allows individuals who have been granted a benefit, but did not receive the associated card by mail, to report this to USCIS and request a replacement card. • Did not receive document by mail: This tool allows individuals who have been granted a benefit, but did not receive the associated document, to report that to USCIS and request a replacement document. • Appointment Accommodations: Section 504 of the Rehabilitation Act of 1973 requires the Federal Government to make reasonable accommodations to its programs in order to provide meaningful access to individuals with disabilities. This tool allows individuals to request that USCIS provide them with an accommodation and explain what type of accommodation they are requesting. • Typographical error: This tool allows individuals who have received a notice, document or card from USCIS with a typographical error to inquire about the error and receive guidance on the corrective action.

Civics and Citizenship Toolkit/Teacher Training Registration

Abstract

Section 312 of the Immigration and Nationality Act requires immigrants aspiring for U.S. citizenship to have a "knowledge and understanding of the fundamentals of the history, and of the principles and form of government, of the United States." Section 451 of the Homeland Security Act of 2002 (Pubic Law 107–296) requires U.S. Citizenship and Immigration Services (USCIS), to promote instruction and training on citizenship rights and responsibilities, including the development of educational materials. To comply with these requirements, USCIS developed a citizenship toolkit and training workshops. The toolkit is provided free to organizations that serve, or that are interested in serving, immigrants. The toolkit includes immigration and civics publications, handbooks, multimedia tools and guidance on how to use these products to help legal permanent residents integrate into their local communities and American society. Adult educators and volunteers who work with immigrants may use the publications, videos and curriculum in the toolkit to teach American history, civics and citizenship in a classroom setting. Immigrants may also use the toolkit as a self-study resource to learn more about the United States and prepare for the naturalization process. In addition, USCIS provides free training workshops and conferences for: • Adult English as a Second Language (ESL), • Civics and citizenship teachers, volunteers, and immigrant- serving organizations to enhance their skills in teaching U.S. history, civics, and the naturalization process to immigrant students. These training opportunities will include sessions on the new naturalization test, the naturalization process, and an overview of the fundamental principles of American democracy. Individuals and organizations wishing to obtain a toolkit or training must complete and submit a registration form to USCIS.

Incorporation by Reference of Oral Findings of Fact and Rationale in Wholly Favorable Written Decisions

Abstract

If an administrative law judge (ALJ) makes a wholly favorable oral decision, including all the findings and rationale for the decision for a claimant of Title II or Title XVI payments, at an administrative appeals hearing, the ALJ sends a Notice of Decision (Form HA-82), as the records from the oral hearing preclude the need for a written decision. We call this the incorporation-by-reference process. In addition, the regulations for this process state that if the involved parties want a record of the oral decision, they may submit a written request for these records. SSA collects identifying information under the aegis of Sections 20 CFR 404.953 and 416.1453 of the Code of Federal Regulations to determine how to send interested individuals written records of a favorable incorporation-by-reference oral decision made at an administrative review hearing. Since there is no prescribed form to request a written record of the decision, the involved parties send SSA their contact information and reference the hearing for which they would like a record. The respondents are applicants for Disability Insurance Benefits and SSI payments, or their representatives, to whom SSA gave a wholly favorable oral decision under the regulations cited above.

Abstract

Prior to the personal conference, SSA provides the opportunity for the individual to review the information in their file that we used to make the overpayment and waiver determinations. SSA technicians send respondents a notice informing them of their overpayment and their ability to request review of their information via a personal conference. In addition, the notice explains that the respondent can provide additional documents to support their claim for waiver of their overpayment. SSA employees conduct the personal conferences mentioned above as one-time face-to-face, telephone, or video conference interviews. At the time of the conference, overpaid individuals may provide documents to support their contention they: • are without fault in causing the overpayment, • believe the overpayment is unfair, or • do not have the ability to repay the debt. Respondents may submit a personal statement, provide new or updated information, or present any previously submitted documentation or forms related to their case during their conference. For instance, they may present the SSA 795, Statement of Claimant or Other Person (OMB #0960-0045); or the SSA-632, Request for Waiver of Overpayment Recovery (OMB #0960-0037). If respondents decide not to attend the personal conference, SSA makes a final waiver decision based on available information. SSA does not track the percentage of individuals who attend their conference via a face-to-face meeting, telephone, or video conference. The respondents are beneficiaries or SSI recipients, for whom SSA denied their initial request for a waiver of recovery of an overpayment, thus requiring a personal conference with them when SSA cannot approve the waiver.

Generation-Skipping Transfer Tax Return for Distributions

Abstract

Form 706-GS(D) is used by distributees to compute and report the Federal Generation Skipping Transfer tax imposed by IRC section 2601. IRS uses the information to enforce this tax and to verify that the tax has been properly computed. The distributee will file a single Form 706 GS(D) annually and will report on it all taxable distributions from any trust received during the year. An individual will not file Form 706 GS(D) for any year in which he/she received no taxable distributions.
