Change Requests

What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Designation of Fishery Management Council Members and Application for Reinstatement of State Authority

Key Information

Abstract

This request is for extension of a currently approved information collection. The Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) authorizes the establishment of eight Regional Fishery Management Councils to manage fisheries within regional jurisdictions. This collection pertains to several sections of the Magnuson-Stevens Act related to the Councils. Section 302(b) provides for appointment of Council members nominated by State Governors, Territorial Governors, or Tribal Governments and for designation of a principal state fishery official for the purposes of the Act. Section 306(b)(2) provides for a request by a state for reinstatement of state authority over a managed fishery. Nominees for Council membership must provide their State Governor, Territorial Governor, or Tribal Government leadership with background documentation, which is then submitted to NOAA, on behalf of the Secretary of Commerce to review qualifications for Council membership. The information collected with these actions is used to ensure that the requirements of the Magnuson-Stevens Act are being met in regards to Council membership and state authority.

Key Information

Abstract

The Clean Water Act Section 305(b) reports contain information on whether waters assessed by a state meet the states water quality standards, and, when waters are impaired, the pollutants and potential sources affecting water quality. This information helps states and the public track progress in addressing water pollution. Section 303(d) of the Clean Water Act requires states to identify and rank waters that cannot meet water quality standards (WQS) following the implementation of technology-based controls. Under Section 303(d), states are also required to establish total maximum daily loads (TMDLs) for listed waters not meeting standards because of pollutant discharges. In developing the Section 303(d) lists, states are required to consider various sources of water quality related data and information, including the Section 305(b) state water quality reports. Section 106(e) requires that states annually update monitoring data and use it in their Section 305(b) report. Section 314(a) requires states to report on the condition of their publicly owned lakes within the Section 305(b) report.

Abstract

Under the Interstate Commerce Act, as amended by the ICC Termination Act of 1995, Pub. L. No. 104-88, 109 Stat. 803 (1995), and Section 8(d) of the National Trails System Act, 16 U.S.C. § 1247(d) (Trails Act), persons seeking to preserve rail service may file pleadings before the Board to acquire or subsidize a rail line for continued service, or to impose a trail use or public use condition. More specifically, when a line is proposed for abandonment, affected shippers, communities, or other interested persons may seek to preserve rail service by filing with the Board: an offer of financial assistance to subsidize or purchase a rail line for which a railroad is seeking abandonment (49 U.S.C. § 10904), including a request for the Board to set terms and conditions of the financial assistance; a request for a public use condition (§ 10905); or a trail-use request under the Trails Act. Similarly, when a line is placed on a system diagram map identifying it as an anticipated or potential candidate for abandonment, affected shippers, communities, or other interested persons may seek to preserve rail service by filing with the Board a feeder line application to purchase the identified rail line (§ 10907). (Railroad owning the rail line subject to abandonment must, in some circumstances, provide information to the applicant or offeror.) The collection also encompasses certain notifications to the agency under the Trails Act and related regulations.

Abstract

This request is for a renewal of a currently approved collection. Domestic law and international obligations require or authorize the National Marine Fisheries Service (NMFS) to collect information about the harvest of certain fishery products when these products enter U.S. commerce and/or are exported from the United States. To this end, NMFS has implemented four trade monitoring programs to collect information from the seafood industry regarding the origin of certain fishery products. The purpose of these programs is to determine the admissibility of the products in accordance with the specific criteria of the trade measure or documentation requirements in effect for the species of fish that are being imported or exported. NMFS collects the required information electronically through the International Trade Data System (ITDS) maintained by U.S. Customs and Border Protection. The ITDS information collection is merged with the Seafood Import Monitoring Program, both previously approved by OMB.

Abstract

The purpose of the collection of information is used to evaluate whether foreign air carriers requesting new authority or with existing authority to operate in the U.S. will be able to conduct their operations safely within the National Airspace System (NAS) and in compliance with international obligations. Operators meeting those standards are issued operations specifications (OpSpecs) authorizing them to operate in the U.S. Consistent with previous practices, FAA includes a regulatory standard for issuing maintenance OpSpecs to persons operating U.S.-registered aircraft outside the U.S. in common carriage. Operators are required to respond, as needed, to the collection to obtain or retain a benefit (OpSpecs). OpSpecs are issued to the operator applying. OpSpecs are not available for viewing to the general public. OpSpecs are available for viewing to FAA offices for the purpose of safety oversight of the operators. FAA occasionally shares OpSpecs information, as needed, with other agencies such as Transportation Security Administration (TSA), Department of Transportation (DOT) or to answer questions from U.S. congress. The FAA requires foreign operators applying for the issuance or amendment of OpSpecs to submit supporting documentation. The type of documentation that a foreign operator needs to provide to the FAA is identified in FAA Order 8900.1 volume 12, which is publicly available . The information is helpful to new applicants as well as existing operators.

The information collected in logbooks and the cost-earnings form help NMFS identify impacts of proposed regulatory measures on fishermen and the resource, consistent with applicable law such as the Magnuson-Stevens Fishery Conservation and Management Act and the Regulatory Flexibility Act. Reimbursement of Qualifying Adoption Expenses for Certain Veterans, VA Form 10-10152

Abstract

The VA’s authority to provide reimbursement of qualifying adoption expenses for certain covered Veterans is found in Section 236 of the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2018, Public Law 115-141 (March 23, 2018) (the “2018 Act”) and Section 235 of the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2019, Public Law 115-244 (September 21, 2018) (the “2019 Act”), which renewed and extended in nearly identical form Section 260 of the prior authorizing “2017 Act,” Public Law 114-223. VA has eliminated the section in the regulations that specifies an expiration date in order to accommodate Congressional renewal and extension of this authority under subsequent appropriations law. Veterans with a service-connected disability that results in their inability to procreate without the use of fertility treatments are authorized to receive reimbursement for certain adoption-related expenses for an adoption that is finalized after September 29, 2016 (the date the 2017 Act was enacted). To implement this benefit, VA uses VA Form 10-10152, paralleling DD 2675, which requires any Veteran requesting reimbursement of qualifying adoption expenses to submit the same types of evidence as required under similar DoD policy. VA Form 10-10152 was previously approved by OMB through the PRA clearance process, and VA now seeks a three-year extension of that approval of this information collection.

Abstract

Flight Operations Quality Assurance (FOQA) is a voluntary safety program designed to improved aviation safety through the proactive use of flight-recorded data. The purpose is to enable early corrective action for potential threats to safety. 14 CFR 13.401 codifies protection from punitive enforcement action based on FOQA information and requires operators with FAA approved FOQA programs to provide aggregate FOQA data to the FAA. Aggregate FOQA information provided to the FAA is protected from public release under 14 CFR Part 193. Operators will use this data to identify and correct deficiencies in all areas of flight operations. Properly used, FOQA data can reduce or eliminate safety risks, as well as minimize deviations from regulations. Through access to de-identified aggregate FOQA data, the Federal Aviation Administration (FAA can identify and analyze national trends and target resources to reduce operational risks in the National Airspace System (NAS), air traffic control (ATC), flight operations and airport operations. The FAA and the air transportation industry have sought additional means for addressing safety problems and identifying potential safety hazards. Based on the experiences of foreign air carriers, the results of several FAA-sponsored studies, and input received from government/industry safety forums, the FAA concluded that wide implementation of FOQA programs could have significant potential to reduce air carrier accident rates below current levels. The value of FOQA programs is the early identification of adverse safety trends, which, if uncorrected, could lead to accidents. A key element in FOQA is the application of corrective action and follow-up to ensure that unsafe conditions are effectively remediated.

Abstract

This justification supports an extension of OMB Control No. 9000-0029. This clearance covers the information that contractors must submit to comply with the following Federal Acquisition Regulation (FAR) requirements: FAR 50.103-3, Contract Adjustment. FAR 50.103-3 specifies the minimum information that a contractor must include when seeking a contract adjustment that would facilitate the national defense, as set forth in Pub. L. 85-804. The request, normally a letter, shall state as a minimum - (1) The precise adjustment requested; (2) The essential facts, summarized chronologically in narrative form; (3) The contractor's conclusions based on these facts, showing, in terms of the considerations set forth in FAR 50.103-1 and 50.103-2, when the contractor considers itself entitled to the adjustment; and (4) Whether or not - (i) All obligations under the contracts involved have been discharged; (ii) Final payment under the contracts involved has been made; (iii) Any proceeds from the request will be subject to assignment or other transfer, and to whom; and (iv) The contractor has sought the same, or a similar or related, adjustment from the Government Accountability Office or any other part of the Government, or anticipates doing so. If the request exceeds the simplified acquisition threshold, the contractor must certify that the request is made in good faith and the data are accurate and complete. FAR 50.103-4, Facts and Evidence. FAR 50.103-4 sets forth additional information that the contracting officer or other agency official may request from the contractor to support any request made under FAR 50.103-3. FAR 50.104-3 Special Procedures for Unusually Hazardous or Nuclear Risks. FAR 50.104-3 provides the information a contractor shall submit to the contracting officer when requesting the inclusion of the indemnification clause for unusually hazardous or nuclear risks at FAR 52.250-1. FAR 52.250-1, Indemnification Under Public Law 85-804. This clause allows contractors to be indemnified against unusually hazardous or nuclear risks. Paragraph (g) requires the contractor to promptly notify the contracting officer and furnish pertinent information for any claim or loss that may involve indemnification under the clause.

Abstract

This request for an ICR extension consists of mandatory reporting. State and Indian tribes are required to provide information to the FMCSA identifying all non-radioactive hazardous materials routing designations (highways) which exist within their jurisdictions. FMCSA requires that States and Indian tribes notify the FMCSA if they establish, modify, maintain, or enforce non-radioactive hazardous materials highway routing designations, so that FMCSA can then publish the information in the Federal Register and on the FMCSA website at: https://www.fmcsa.dot.gov. FMCSA estimates there will be an average of one response every two years per State/U.S. Territory/Indian tribe and FMCSA publishes this information annually so carriers of placarded non-radioactive hazardous materials will have knowledge of the restrictions. Several States the District of Columbia, an Indian tribe, and U.S. Territories have designated/restricted highway routes and/or imposed restrictions or limitations affecting the highway transportation of certain hazardous materials. While these localized routing designations are intended to improve safety, the proliferation of uncoordinated State and local routing designations could impede the free flow of commerce, have little or no demonstrable positive effect on public safety, and result in the exportation of risk from one jurisdiction to another. The FMCSA estimates that 100% of the States and Indian tribes that are providing the information do so electronically. States that are presently restricting/designating routes are using various technologies to collect and organize this information. The FMCSA utilizes a computer system to store and retrieve the routing information. This enables FMCSA to provide routing information as mandated by statute.

Abstract

This request is for a revision and extension of an existing information collection. There are minor changes in questions about direct marketing of catch and community infrastructure. Fishing livelihoods are both centrally dependent on ecosystems and part of the forces acting on these ecosystems, including resident marine species. Alongside social factors like economics and management, fisheries population fluctuations shape fishing livelihoods. However, the decisions fishermen make regarding which fisheries to access and when to access them are not fully understood, particularly within the food web frameworks offered up by ecosystem-based approaches to research and management. An understanding and predictive capacity for these movements of fishermen across fisheries in the context of ecological and social variability presents a significant gap in management-oriented knowledge. Managing fisheries in a way that enhances their socioeconomic value, mitigates risks to ecosystems and livelihoods, and facilitates sustainable adaptation, requires this fundamental knowledge. For this reason, the Northwest Fisheries Science Center seeks to conduct a follow-up U.S. mail survey, replicating the survey administered during 2017 and 2020, with slight changes in questions about direct marketing of catch and community infrastructure. The survey will be voluntary, and contacted individuals may decline to participate. Respondents will be asked to answer questions about their motivations for fishing and factors that affect participation in the suite of West Coast commercial fisheries. Fishing employment information will also be collected. This survey is essential because data on smaller scale fishing practices, values, participation decisions and fishing livelihoods are sparse; yet, they are critical to the development of fishery ecosystem models that account for non-pecuniary fishing benefits, as well as the ways in which fishing practices shape individual and community well-being.
