What is an ICR?

An Information Collection Request (ICR) is a federal agency's request for approval from the Office of Management and Budget (OMB) to collect information from the public. Under the Paperwork Reduction Act (PRA), agencies must justify why the information is needed and how it will be used.

When are they submitted?

Federal agencies are required to submit an ICR whenever they create, renew, modify an information collection. Each ICR includes a description of the collection, supporting materials and documentation (such as forms, surveys, or scripts), and proof that the agency has met the requirements of the PRA.

The ICR is submitted to the The Office of Information and Regulatory Affairs (OIRA) within OMB for review and approval. OIRA grants approval for a maximum of three years, after which the collection must be renewed through a new ICR submission.

Key Information

Abstract

The PACT Act was signed into law on August 10, 2022, and mandated that VA implement toxic exposure screening to identify Veterans with potential toxic exposures during military, naval, air, or space service. The PACT Act imposed a Congressionally mandated timeline to implementation of 90 days, with full implementation completed by November 8, 2022. Pursuant to a six-month emergency PRA clearance from OMB, and to ensure efficacy of the screening tool and ease of use by screeners, the project team performed a pilot test of the toxic screening tool with a sampling from seven targeted clinical areas and sites for 10 days, beginning September 6, 2022. The goal was to collect feedback and best practices to use in refining the screening tool and training to increase best chance for success. VHA now seeks to renew the PRA clearance for the screening tool for a full three years. Information collected during the toxic exposure screening will be included in the Veteran’s electronic health record and will be used to connect Veterans with resources, services, and benefits available, as well as provide guidance that Veterans be engaged in ongoing care or establish care in VA or the community to address their exposure concerns. VA will use several different methods of gathering information from Veterans through the toxic exposure screening, including VHA staff or community care staff administering the screening during a health care appointment, VHA staff administering at other Veteran touch point events (e.g., screening blitz event), and Veterans completing the screening independently before being contacted by VHA staff for a follow-up consultation. Veterans have the option of declining the toxic exposure screening.

Key Information

Abstract

The White House Office of Science and Technology Policy issued the United States Government Policy for Institutional Oversight of Life Sciences Dual Use Research of Concern (iDURC Policy) in September 2014. The purpose of the Policy is to identify Dual Use Research of Concern (DURC) and implement risk mitigation measures where applicable. DURC applies to life science research that provides knowledge, information, products, or technologies that could be directly misapplied to pose a significant threat with broad potential consequences to public health and safety, agricultural crops and other plants, animals, the environment, material, or national security. Institutions subject to the iDURC Policy are those within the United States that (1) receive funding from the U.S. Government to conduct or sponsor life sciences research and (2) conduct or sponsor reserach that involves one or more of the 15 agents or toxins identified in the iDURC Policy, even if the research is not supported by U.S. Government funding. Institutions outside of the United States that receive U.S. Government funding to conduct or sponsor research that involves one or more of the 15 agents or toxins identified in the iDURC Policy are also subject to the Policy. The iDURC Policy requires that institutions subject to the Policy provide education and training on DURC for individuals conducting life sciences research with one or more of the 15 agents or toxins identified in the iDURC Policy. It is also required that they maintain education and training records for the term of the research grant or contract. The policy states that records must be saved for three years after its completion, but no less than eight years, unless a shorter period is required by law or regulation. EPA is submitting an information collection request for the requirement of institutions in maintaining these training records. EPA's Office of Research and Development may choose to collect these records to ensure Policy compliance.

Abstract

This ICR covers the following: (1) the collection of information under 40 CFR part 35, subpart O, which establishes the administrative requirements for cooperative agreements funded under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) for state, federally-recognized Indian tribal governments, and political subdivision response actions; (2) the application of the Hazard Ranking System (HRS) by states as outlined by CERCLA section 105 that amends the National Oil and Hazardous Substances Pollution Contingency Plan (NCP) to include criteria prioritizing releases throughout the United States before undertaking remedial action at uncontrolled hazardous waste sites; and (3) the remedial portion of the Superfund program as specified in CERCLA and the NCP. For cooperative agreements and Superfund state contracts for Superfund response actions, the information is collected from applicants and/or recipients of EPA assistance and is used to make awards, pay recipients, and collect information on how federal funds are being utilized. EPA requires this information to meet its federal stewardship responsibilities. Recipient responses are required to obtain a benefit (federal funds) under 2 CFR part 200, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards to Non-Federal Entities and under 40 CFR part 35, State and Local Assistance. For the Superfund site evaluation and the Hazard Ranking System, the states will apply the HRS by identifying and classifying those releases or sites that warrant further investigation. The HRS score is crucial since it is the primary mechanism used to determine whether a site is eligible to be included on the National Priorities List (NPL). Only sites on the NPL are eligible for Superfund-financed remedial actions. For the NCP information collection, some community involvement activities covered by this ICR are not required at every site (e.g., Technical Assistance Grants) and depend very much on the community and the nature of the site and cleanup. All community activities seek to involve the public in the cleanup of the sites, gain the input of community members, and include the community's perspective on the potential future reuse of Superfund NPL sites. Community involvement activities can enhance the remedial process and increase community acceptance and the potential for productive and beneficial reuse of the sites.

Abstract

The National Emission Standards for Hazardous Air Pollutants (NESHAP) for the regulations published at 40 CFR Part 63, Subpart OOO were proposed on December 14, 1998, promulgated on January 20, 2000, and amended on April 20, 2006, October 8, 2014, and October 15, 2018. These regulations apply to existing facilities and new facilities that engage in the manufacture of amino/phenolic resins with HAP emissions points that include: (1) reactor batch process vents; (2) nonreactor batch process vents; (3) continuous process vents; (4) equipment leaks; (5) wastewater; (6) storage vessels; and (7) heat exchangers. New facilities include those that commenced construction or reconstruction after the date of proposal of the 2014 rule amendment. This information is being collected to assure compliance with 40 CFR Part 63, Subpart OOO. The October 15, 2018 amendments (83 FR 51842) responded to petitions for reconsideration regarding the NESHAP rule revisions that were promulgated on October 8, 2014 and revised the standards for continuous process vents (CPVs) at existing affected sources, revised the requirements for storage vessels at new and existing sources during periods when an emission control system used to control vents on fixed roof storage vessels is undergoing planned routine maintenance, and included minor technical corrections to improve rule clarity. This renewal incorporates revised costs and burden from activities from these final rule amendments. In general, all NESHAP standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. Abstract

The National Emission Standards for Hazardous Air Pollutants (NESHAP) for Miscellaneous Coating Manufacturing (40 CFR Part 63, Subpart HHHHH) apply to new and existing facilities that: 1) manufacture a miscellaneous coating (including inks, paints, or adhesives described by either Standard Industrial Classification (SIC) codes 285 or 289, or North American Industrial Classification System (NAICS) codes 3255 or 3259); 2) are either located at, or are part of, major sources of hazardous air pollutant (HAP) emissions; 3) process, use, or produce HAP; and 4) are not part of an affected source under another subpart of 40 CFR Part 63. New facilities include those that commenced either construction or reconstruction after April 4, 2002. This information is being collected to assure compliance with 40 CFR Part 63, Subpart HHHHH. In general, all NESHAP standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to NESHAP. In general, all NESHAP standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any startup, shutdown, or malfunction in the operation of an affected facility, or any period during which the monitoring system is inoperative. Abstract

The National Emission Standards for Hazardous Air Pollutants (NESHAP) for Iron and Steel Foundries (40 CFR Part 63, Subpart EEEEE) were proposed on December 12, 2002, promulgated on April 22, 2004 and amended on May 20, 2005 and February 7, 2008. Amendments to the NESHAP were proposed on October 9, 2019 as a result of the residual risk and technology review (RTR) required under the Clean Air Act (CAA) (as discussed further below). The NESHAP applies to both existing and new iron and steel foundry facilities that are major sources of hazardous air pollutant (HAP) emissions. The rule applies to emissions from metal melting furnaces; scrap pre-heaters; pouring areas; pouring stations; automated conveyor and pallet cooling lines; automated shakeout lines; mold and core making lines; and to fugitive emissions from foundry operations. New facilities include those that commenced construction, modification, or reconstruction after the date of the original proposal (December 12, 2002). This information is being collected to assure compliance with 40 CFR Part 63, Subpart EEEEE. In general, all NESHAP standards require initial notifications, performance tests, and periodic reports by the owners/operators of the affected facilities. They are also required to maintain records of the occurrence and duration of any failures to meet applicable standards, or any period during which the monitoring system is inoperative. Semiannual reporting of these deviations is also required. These notifications, reports, and records are essential in determining compliance, and are required of all affected facilities subject to NESHAP. Any owner/operator subject to the provisions of this part shall maintain a file containing these records and retain the file for at least five years following the generation date of such maintenance reports and records. All reports are sent to the delegated state or local authority. If there is no such delegated authority, the reports are sent directly to the U.S. Environmental Protection Agency (EPA) regional office. The final RTR amendments to the rule eliminate the startup, shutdown, and malfunction (SSM) exemption; remove the SSM plan requirement; add new work practice standards for cupola melting furnaces while off blast; add electronic submittal of notifications, semiannual reports, and performance test reports; and make technical and editorial changes. The remaining portions of the NESHAP remain unchanged.
